There again, if you are talking about Mum21 she does not understand anything really, she claims I said the McCanns should not have sued but in fact I distinctly remember explaining the legal basis for why they sued, not that she would understand of course. But in addition to standing on strict legal rights, there are also morals, but again I could not expect either Mum21 or Kate and Gerry McCann to be able to understand that. It is bizarre they are saying there is no difference as between the two. Forgive me did they forget this is Kate and Gerry's child who they dumped in bed and left alone to cry every night, what did Murat do? Perhaps the better question would be to ask what did Kate, Gerry and their friends do to him! <BR/><BR/>I recall that in fact the McCanns were going to sue a Portuguese newspaper Tal and Quai (got that wrong I know but something like that). This was in August when the allegations against them first started t hit the press. Nothing ever came of this action. I think the issue with the DE was they just went over the top, the claims about swinging etc were just scurrilous and not connected with Madeleine's disappearance at all and very clearly amounted to libel. I do not think any other paper ran that story, did they? Not sure though, it was mainly the very seedy Daily Star if I recall. <BR/><BR/>I cannot remember the exact figure but I think in UK it is something like 90 per cent of civil legal cases are settled. This is because we have some of the greediest lawyers in the world who charge such astronomical fees clients just cannot afford to take the case all the way. But Kate and Gerry always wanted to extract a settlement out of Express and clearly had enough ammunition to do so, given the swinging claims. <BR/><BR/>I think the fact Murat took on a total of 11 papers and is also possibly as you say, going against Portuguese papers as well shows that he has a proper case. Clearly the McCanns cannot sue any papers that have made fair comments about their admitted and criminal misconduct in so seriously neglecting their children, neither can they sue them for accurately reporting what the police suspect them of. They may not like that, but it is not libel! <BR/><BR/>I wish Murat every success and hope the money will at least help him and Michaela to rebuild their lives which have been ruined by the tawdry allegations against them. No one can imagine just how terribly distressing all of this must have been. The McCanns have done plenty to attract criticism, Murat just got used as the perfect Patsy as they cast the net around looking for someone to blame, even the police!<BR/><BR/>Anyway Hun, can you tell me why the McCanns did not sue the PJ for failing to find Madeleine, I just cannot understand why, did some silly lawyer say, well you can dream but I cannot see the "cause of action". It is interesting that 11 media outlets have agreed to pay him damages. Knowing how fond the McCanns are of screwing money out of people and propanganda to proclaim their innocence, how come they could only get one to admit they libelled them...very often the Daily Express were simply re-hashing the story that the Daily Mail had written the day before, of course though, Clarence did not want to fall out with the Daily Mail as well. As for other news outlets, I am sure they told the McCanns and their lawyers where to get off. No talk lately of Clarence making it his life's work to track down every internet site that dares to criticise his clients and make sure they are sued, no, he is talking instead of finding some more clients! It seems to me that precisely what consular assistance you get when involved in problems with the death of a child in a foreign country is a very subjective matter dependent upon a lot of circumstances. Firstly of course, it depends on how good the consular staff are in the location. Secondly of course that is two instances we have heard of where police initially seek to deny that the victim has suffered a violent death. Exactly the same happened in Goa. Clearly consular staff can only report to the parents what they are told by the police. Kate and Gerry had the advantage of actually being there and if there is a couple who know how to push buttons to make sure they get their rights then certainly Kate and Gerry fit the bill. He was obviously lobbying government ministers including Gordon Brown and the Foreign Secretary personally, not everyone is quite so pushy!<BR/><BR/>Secondly it is interesting this report confirms that of course we cannot dictate to a foreign police force how they investigate a crime that happened in their country. Again it is interesting to compare this statement with Kate and Gerry's supporters insisting the British Police should have immediately took over. This report confirms of course the foreign country can ask for assistance of British Police and it is abundantly clear this is what happened in Kate and Gerry's case with Gerry pointing out on his blog at the end of May 07 "Senior British officers here from the outset working on the case". The fact is the McCanns have always been in the frame and they knew it!! No police officer would be blind to the fact that in any case where a child mysteriously dies or disappears the parents are the prime suspects because the statistics confirm that about 95 per cent of the time, they are the culprits!
