1485 “Okay. Just finally, Fiona, I just want to ask you, you are aware that there is going to be a re-enactment over in Portugal, it is either going to be at the end of April or into May?”
Reply “Umm”.
1485 “How do you feel about attending that re-enactment?”
Reply “Well I’ve made my feelings clear in a letter, erm, already. Erm, my feelings are, I would do absolutely anything if I felt it was going to help bring, find Madeleine or find who took her. Erm, my reservations are, at this point, how doing the re-enactment is going to achieve that or advance the search in any way. And, obviously, there is a lot of apprehensions about doing it, just in terms of the media and they way we’ve been treated, the way the media would react to us doing the re-enactment, how they’d sort of physically actually manage to do a re-enactment without massive media intrusion, erm, and how the information would be used, I mean, we all know that we’re telling the truth of our actions on the night and if doing a re-enactment were going to be for the purpose of trying to find holes or, you know, in our movements and statements and try and rubbish our statements, then we know that’s not going to help find Madeleine, because we know, we were there, and we know we’re telling the truth, so I wouldn’t be happy to do it if that was the reason for doing it. I’d just like to be convinced how it’s going to move the investigation on really, erm, to find Madeleine”.
1485 “Yeah”.
Reply “And, at the moment really, we’ve got no reason to trust the motives of doing a re-enactment when Kate and Gerry are still aguido and, if they’re aguido, I think we’ve all got to be implicated, because I just don’t see how Kate and Gerry could have done anything that’s been suggested without us all being in on it, you know, it’s just impossible”.
1485 “Is that it?”
Reply “So, you know, that’s a big stumbling block really”.
1485 “So, at this present moment, you are saying you wouldn’t?”
Reply “No, I mean, we haven’t really had any, been given any information about how it’s going to be used and that’s the information that I think we would all need if we were going to do it and, obviously, there’s no point one of us doing it without everybody doing it. So, I think, you know, as far as I’m concerned, I’d only do it if everybody else was doing it, otherwise it’s pointless. And I still don’t see, erm, I think, emotionally, it would be hideous to go back and have to do an re-enactment, I really do, and I don’t see how, erm, emotions couldn’t affect the way it was done, because it would just be horrific, I mean, imagine, you know, Jane having to relive that, Kate having relive that, any of us having to relive that, you, you couldn’t do it without it being an emotional thing”.
1485 “Yeah”.
Reply “Erm, so I just, I just don’t see, I mean, in my eyes, doing it, it would be beneficial if actors and actresses did it because they don’t have that emotion and you can still direct them to exactly what you were doing and where you went and your movements. So, so I still don’t, we still haven’t had an answer to that really, that side of it”.
1485 “Okay. Alright. At this stage I have got nothing else to say to you”.
Reply “Umm”.
1485 “As you are aware, the interview is being monitored and it may well be that they have some further questions, but at this present moment, there are no more further questions”.
Reply “Okay”.
1485 “Alright. Actually there is. Sorry. Do you have your phone?”
Reply “Yeah”.
1485 “I just want to clarify your, did you take your mobile with you?”
Reply “I didn’t. My mobile had actually broken before we went on holiday, so we just had Dave’s mobile”.
1485 “Right. So did anybody use your mobile whilst you were away?”
Reply (shakes head)
1485 “No?”
Reply “They couldn’t have done, no”. 1485 “No. Could you just see if you have any of these numbers in your phone?” (So he thinks her mobile was being used, even though she thought it had been left at home)
Reply “Yeah”.
1485 “07XXX XXXXXX”.
Reply “07XX. I’ll look for 07XXX”.
1485 “The last digits are going to be XXX, that is going to be easiest”.
Reply “XXX”.
1485 “Sorry, you must have loads. Also look for one that ends in XXX as well”.
Reply “Ah XXX. Is it 07XXX XXXXXX?”
1485 “Yeah”.
Reply “That’s my, Simon XXXXXXXX, my brother-in-law”.
1485 “It is who, sorry?”
Reply “Simon XXXXXXX, he’s my brother-in-law”.
1485 “Is there any reason why he would have been called?”
Reply “We did speak, well it couldn’t have been off my phone, is this from my phone?” (this implies someone was using her phone whilst she thought she had left it at home broken, now who could that have been, I wonder)
1485 “Well it is possible that it, no, it wouldn’t have been off your phone”. (almost spilt the beans and then thought no leave her in the dark)
Reply “No”.
1485 “It would have been off”.
Reply “It would have been off Dave’s”.
1485 “Dave’s, yeah”.
Reply “We did speak to him, yeah”.
1485 “Did you actually make any calls yourself?” (maybe have triangulation want to be sure who was making the calls)
Reply “Erm, I used, I Dave’s phone. I’m trying to think who phoned Simon. I think Dave phoned Simon the following morning, erm, just because he’s another pragmatic, sensible thinking person”. 1485 “Yeah”.
Reply “Erm, I mean, you know, we would have phoned all our family that following day anyway”.
1485 “Umm”.
Reply “But we had a lot of calls from him. Plus he’s, he was, erm, just wanting to be of help really, so he did phone a fair bit as well, just in terms of, he organised for, erm, mobile phones, erm, you know, Portuguese mobile phones to be sent out to use, he, you know, he runs a business in XXXXX, erm, and financially as well, he was offering help if we needed, you know, money”.
1485 “Is there anybody other than family that you rang then?”
Reply “Erm, I rang the Children’s Nursery, tut”.
1485 “Have you got that number in there?”
Reply “Erm, yeah. I think I might have texted them. Erm, XX, sorry, it’s 01XXX XXXXXX”.
1485 “Okay”.
Reply “What was the other ending that you wanted, XXX?”
1485 “XXX, yeah”.
Reply “Sorry, I didn’t get to the last ones. 07XXX XXXXXX?”

1485 “The next one is a Portuguese number, well it is a short number, it is 91XXXXXXX?” Reply “I don’t, I wouldn’t have that in this phone, erm, it’s a Portuguese number. Is it a Portuguese mobile number?” (If her phone was broken and left at home, as she thought, how was it ringing a Portuguese number the following day, odd that)
1485 “I don’t know. It is just too short for, because ours are normally eleven, aren’t they?”
Reply “Yeah, we, because, as I say, (getting rather flustered here) Simon did organise, erm, a Portuguese mobile phone for us to use out there, erm, which we’ve still got at home, I couldn’t tell you what the number was for that mobile, but I used that once I was out there, you know, to contact, you know, Dave or, or any of them, I’ve texted on it”.
1485 “Somebody would have rang it or texted it?”
Reply “Yeah, tut, I’m just trying to remember how much I used it, you know, every day. Again, I mean, if I had Dave’s mobile phone bills, which I think we did give to somebody actually, it might have been Kate and Gerry’s Lawyers actually, but we did use those. I can’t remember how much I used them and how much I used the Portuguese phone, but we certainly had a Portuguese mobile”.
1485 “Yeah. It sent a text to XXX, which is Dave’s phone”.
Reply “Uh hu”.
1485 “On the fourth of the fifth, so it is the following night”. Reply “Yeah”. 1485 “At twenty-two zero two”. Reply “So we would have been at the Police Station”. 1485 “And then twenty-two zero eight”. Reply “Sorry, from which phone, because we wouldn’t have had the Portuguese phone by then?” 1485 “It would have sent, the Portu, well I’ve got the Port”. Reply “I don’t know how quickly the phone arrived”.

(so what the police officer is saying is that this Portuguese phone that Simon Payne apparently arranged to send over was already with them by the following night and someone was using it to text Dave's phone from the police station. That kind of implies that was Fiona and she was letting Dave know how much trouble they were in, perhaps? But as she later goes on to admit they all swapped their phones around so not sure who was texting who really)
1485 “Yeah”. Reply “I can’t imagine it was that quick”. 1485 “The Portuguese phone, or that number, sent a text to Dave’s number at twenty-two zero two on the fourth, the following night?” Reply “So it was when I was being interviewed that evening. I don’t think our phones came out that, I can’t imagine they would have been out by then, on the Friday night, so I don’t know. I’ll just check it isn’t, are you sure it’s a Portuguese number? Just read the number out again, I’ll just check it”.
1485 “It is 91XXXXXXX”.
Reply “Yeah, it is a funny number, isn’t it?”
1485 “It has only got nine digits as opposed to our eleven”.
Reply “Yeah. No, I haven’t got that number on and I can’t think, I can’t think who could have sent a Portuguese number at that point. Dave might recall when our mobile phones came out, but I’m sure it wasn’t, it couldn’t have been that quickly, erm”. (Well you know Fiona maybe Gerry and Payne already took Portuguese mobiles with them and your "broken" phone too?)
1485 “Okay. Here is another number that ends in, it looks like it ends in XXXX”.
Reply “XXXX”.
1485 “It might not necessarily be a mobile number”.
Reply “Erm, Dave’s mum, Diane PAYNE. Is it 0044 XXXX XXXXXX?”
1485 “Say that again?”
Reply “I’ve got 0044 XXXX XXXXXX?”
1485 “That is it, yeah. Who is that, sorry?”
Reply “That’s Diane PAYNE, it’s Dave’s mother”.
1485 “Yeah, there was calls made on the fourth from Dave’s mobile number?”
Reply “Umm, to Diane, yeah”.
1485 “So to his mum?”
Reply “Yeah”.
1485 “The next one ends in XXXX”.
Reply “XXXX”.
1485 “It may well be 01XXX, if that rings a bell”.
Reply “(inaudible). I’ll just go through methodically. XXXX. Erm, XXXX is, erm, yeah, 01XXX XXXXXX, that is Karen XXXXX’s home number”.
1485 “And who did you say that was?”
Reply “That’s Dave’s sister”.
1485 “Yeah. Do you know what the nature of those calls were?”
Reply “Well it was purely letting people know what had happened really and obviously there was a lot of concern back home as soon as the, the news hit, erm”.
1485 “And would you have made those calls from David’s phone or would Dave have made them?” Reply “No, Dave made, Dave spoke to his family, (officer again establishing who exactly was using the phone) I didn’t speak to this family”.
1485 “Okay. The next one, I think it is 02XX, so it could be a London number. XXXX it ends it”. Reply “XXXX. No, that’s not in my mobile, but I’m just recalling, I did make some phone calls on behalf of Kate, erm, the following morning and those, it’s a shame, because we’ve all swapped mobiles, you see, and not all of them were transferred, (now why on earth would they do that!!) but I’m pretty sure, erm, I rang at least two on Dave’s phone, just to let them know, again, you know, what had happened”.
1485 “Is that in the morning?”
Reply “Erm, that would have been, yeah, the following morning. (by the following morning they had all started swopping their mobiles around, how strange) I mean, I would be just saying to Kate, you know, ‘What can we do. What can we do’, and that was just one of the things, she said, ‘Look, just everyone will be panicking at home, just’, you know, ‘if you can contact a few people’. So, yeah, those might be numbers that I wouldn’t have now in my mobile that”. (but on her account above how could they be on her mobile when she says it was left at home broken, is she admitting she knows it was taken by Dave and being used?)
1485 “Dave could well have them?”
Reply “Well he’s changed his mobile as well because his died a death, (oh dear Dave all these broken phones and only certain numbers get carried across on the SIm card, umm) so I don’t think all his numbers are, you know, they weren’t all saved on the SIM card. But it’s easy enough for me to find out if they are, erm, friends or”. (or WHAT Fiona??)
1485 “Okay. There is two more left anyway. The first one is, it is a mobile number and it ends in XXXX”.
Reply “XXXX. Is that 07XXX XXXXXX? That’s a friend of mine, Lisa XXXXXXX”.
1485 “Lisa?”
Reply “XXXXXXX. X, X, X, X, X, X, X”.
1485 “And where does she live?”
Reply “She lives near to us in Leicester, erm”.
1485 “And who was it that rang her or text her?”
Reply “I would have rang her”.
1485 “It is actually a text”.
Reply “I would have called her and, I think, at that point, it was just to check on the house, erm, she had a key to my house and she’s a good friend as well”.
1485 “And the final one ends in three, one, two, three”.

WHY I PUT US ON TRIAL BY KATE MCCANN - WE WANT £1M/JUSTICE/OH AND TO SEARCH FOR MADDIE - TIME AND DATE WAS STUCK ON THEIR CAMERA?


Court Case( Injunction) in Lisbon 14th January 2010

We are currently in Lisbon for the trial to determine whether the injunction against Mr Amaral's book and DVD should remain in place. This trial is about whether the book is a true reflection of the official judicial process in to Madeleine's disappearance and whether its contents damage the ongoing search for Madeleine, her siblings and our reputations.

Mr Amaral's book and DVD contains some information from the PJ files but there is a lot in the files which is not in Mr Amaral's book. Hence it is highly selective and therefore biased. Mr Amaral's book contains his opinions rather than fact. His opinions differ from the findings in the PJ file. The conclusions of the latter are: 1.there is no evidence that Madeleine is dead and 2. there is no evidence that Gerry or I are involved in Madeleine's disappearance. This is very different to the theories and conclusions of Mr Amaral. It is logical and common sense that spreading these theories as Mr Amaral did (and continues todo) damages the search to find our little girl. If the general public (and the Portuguese people in particular) are bombarded day in and day out with such theories, this will eventually 'colour' their understanding and judgement -lies and inaccuracies become fact. If people subsequently believe that Madeleineis dead and that we are involved in her disappearance then they will not look for Madeleine, will not consider any suspicions about others which they may have and will not come forward with information. We consider this highly detrimental to the search for Madeleine.

There are few points which have been raised in the last few days which I would like to address specifically:

Abduction theory:For us, there is only the abduction theory possible because we were not involved in Madeleine's disappearance and we know Madeleine did not wander off by herself. It is obvious and right that the police should consider other theories initially.

There may be only one theory for you and Gerry, Kate, I suppose those with a criminal intent have to stick to a theory otherwise people might laugh at them. But given you left your children alone how do you KNOW Madeleine did not wander off by herself? She could easily have got through the patio door that you say you left open, right by that large swimming pool. You know a normal mom could not have sat there and left her children alone in those circumstances. I suspect British Police actually do believe in the kidnapper theory but they tag a bit more on to that, child trafficking, you know what you are being investigated for. It was very helpful of the Portuguese senior police officers and prosecutor to confirm at the hearing the investigation of you considers three incredibly serious offences against Maddie, MURDER KIDNAPPING CHILD TRAFFICKING. They are not theories, they are what they think you and your husband are capable of! Why do you say the police should only consider these theories initially? Because you and your husband think you can tell the police what to do? Did you fall out with all of them because they would not? Have you considered suing Leicester Police for failing to find Madeleine also? After all, they were there too and to this day they say they are still looking for her. What happened to your plan to sue the PJ for One Million for failing to find Madeleine and why did it become a personal issue just picking on the one police officer? Is it helpful in terms of securing ONE MILLION that you can also pursue his publishers and the TV Company. Why did you refuse to allow the same TV company to put your own documentary on for a fee of £35,000 so that your own side of the story could be told in Portugal as well as Goncalo Amaral's ? Is that because you thought it would spoil your planned claim for damages in the sum of ONE MILLION. In Uk we have a name for that sort of behaviour, it is called "abusing the process of the court". There is another applicable maxim, he who comes to equity must come with clean hands". Getting damages for libel is an equitable remedy that IMO you are most certainly not entitled to. You briefed the press far more than anyone during secrecy of justice and even put your star witness, Tanner on Panorama!

The window: I described to the police officers exactly what I found that night, as it was and is highly relevant and I knew that every little detail could be helpful in finding my daughter which is our only aim. The window which is a ground floor window was completely open and is large enough for a person to easily climb through it. Whether it had been opened for this purpose remains unknown. It could of course have been opened by the perpetrator when inside the apartment as a potential escape route or left open as a 'red herring'


"My" daughter Kate? Is there a parting of the ways here, or are you telling us Maddie is not Gerry's daughter also? Have you now become a qualified lawyer or a qualified police investigator now Kate? Who are you to say what is and is not "highly relevant"? I think what is highly relevant in relation to the supposed open windows is the fact that the only forensic evidence found on them was your fingerprint, on the inside! You said on Panorama that someone "broke into the apartment and stole Madeleine". But there were no broken shutters, no forced window. That was just a lie wasn't it Kate? Now you tell us they may have opened it from the inside, yes the fingerprints confirm that, don't they Kate. Oh and well done for only taking best part of three years to think of that one, oh those hard hours at the computer poring over the files. In three minutes your fantasy abductor came through the patio door that you apparently handily left open for him, drugged all three of your children, opened the window from the inside and the shutters and then ran out with the silent Madeleine. Miraculous, lol! Oh, I forgot, he waved to Gerry, Jane and Je\ Wilkins as he passed by. As Gerry said on Panorama these evil predators had been stalking and staking out for days but on the night forgot their car, lol. And these fantasy bafoons even have time to think of "red herrings", funny you mention that one Kate!

The dogs: We realise that the behaviour of the dogs was the turning point in the investigation for the PJ. The use of dogs has proved to be problematic and unreliable in previous cases

(please refer to the Jersey ‘Haut de La Garenne' case and other research published about their use and reliability). It is vital to note that alerts by such dogs are classified as intelligence rather than evidence, as police officers familiar with their use will verify. These alerts must be supported by forensics in order to be used as evidence. The results of the forensic examinations did not identify any blood or Madeleine's DNA. To suggestor use the dogs´ reactions as evidence is simply wrong and abusive.


If the findings of the dogs are so trivial and cannot possibly incriminate you Kate, why have you made such a fuss about the claims of Goncalo Amaral, could it be money you can make out of it?

The proposed reconstruction: The suggestion of a reconstruction of our movements and other key witnesses at the crime scene and/or surrounding area in the early days following Madeleine's abduction was declined by the PJ as 'not usual' for Portugal. When the PJ finally requested a reconstruction to take place in 2008, Gerry and I were still arguidos and as such would have attended for a reconstruction. Some key witnesses (including some of our friends)declined to attend the planned reconstruction as they were not convinced of the aims and usefulness of it. In particular, as the reconstruction was not to be shown to the media (and hence the general public), they did not feel it would help to find Madeleine. Had the intention been to show it to the general public, it may have 'jogged' memories and encouraged people to come forward with information. It should be added that other key witnesses were not invited to attend.


The Police deal with investigations into missing children in confidence. The police wanted to bring back to Portugal those witnesses who THEY had assessed were key to the disappearance of Madeleine McCann, the two prime suspects, Kate and Gerry McCann and their friends who, having consulted lawyers decided they would not go for fear of incriminating themselves. Of course innocent people have nothing to fear and would be only too happy to fully co-operate with the police in seeking to find a missing child. The Police have said that a media circus which Gerry McCann laughingly accepted on Paxman he organised is most unhelpful to a police investigation. That and making lots of money are the key reasons the McCanns persist with their media circus and vile campaign against Portugal and their police which they commenced in the early hours of 4 May 2007 demonstrating their cold and calculating intent to discredit those they KNEW would be investigating them.

Our team is confident that the injunction will remain in place because none of thewitnesses thus far have been able to prove in court that Mr. Amaral's right to express his opinion is superior to the rights of our family to peace, respect and protection of reputation, and above all, the right to continue the search for our daughter Madeleine effectively and without hindrance. As has been made clear this week, Mr Amaral's ‘thesis' is not supported by any evidence. The search for Madeleine must go on until we find her and bring her abductor(s) to justice.


I would say it is the job of the Police to find Madeleine and, as Leicester Police recently put it "those behind the disappearance of Madeleine McCann" who they make clear they intend to bring to justice, of course if it was Portuguese people or any other nationality, Leicester Police would not have jurisdiction. But as we have seen, Kate and Gerry McCann do not wish to work with the Police in either Portugal or even their local force. That is because Police in both UK and Portugal know exactly who is "behind the disappearance of Madeleine McCann", her own parents, with the assistance of their "friends" who refused to attend a police reconstruction.

You know what Kate, I think I am just too nice to you. How come you are laughing and happy just days after Maddie went in PDL but when you are after a million quid nearly three years later always look so agonised, oh well guess I just answered my own question. Do you think that when you instruct your lawyer to make vicious and pointless criminal complaints against Goncalo Amaral people will feel sorry for you and think you are such a sweety? What a warped lady you are! You and your delightful hubby have been ripping into the Portuguese police and getting it put into the British press from the first night you reported Maddie erm "abducted". What a cynical couple of money grabbing liars you are! Keep screwing your face up but the thick war paint never runs, does it?

On day 3, Gerry having run home to UK, it does not seem to me that Fiona Payne is doing much to support Kate in what must clearly be a very distressing and intimidating situation with the throng of press. How can she feel it is worth the personal sacrifice to do this? She looked very ill last December and I feel has been ill for a very long time..now she is instructing Duarte to take criminal proceedings against Goncalo Amaral? Why Kate? If your husband wants to pursue this vindictive war, let him come and take the strain, you ought to get back to your children!

Then we have Gerry McCann and Kate McCann arriving for yesterday's hearing. Pictures really do tell stories, I think, and Gerry thinks it is OK to just swan off and leave her to it? Did he not notice how distressed she was, first time around? Of course what we see from Gerry second time around is not distress, it is the dawn of reality and just pure unadulterated fury. How different they are.

















13.1.10 Gerry and Kate arrive for the second day in court knowing things are most definitely not going their way. As Gerry furiously and repeatedly lunges at Sandra Filgueiras, Portuguese Reporter, shouts her down and raises his hand to her, Kate closes her eyes in horror. I am sure she has been there many times before, it really is time to call it a day you know Kate. Just watch this evil man in action on BBC video here with his mask well and truly removed as he arrived for court this morning already in a rage after a terrible day for them on Sky News reporting all the factual findings against them from senior police and the senior prosecutor in the case. They lied from day one. Of all the horrible displays of rage from Gerry in front of the press even, this just has to be the worst I think. He really looks like he is having to fight with himself to stop himself from attacking her. Stop the video a few times and look at the horrific facial expressions and violent body language. He only manages to calm himself when a mail reporter saves the situation by chiming in with a calming comment. It is unexpectedly announced on the second afternoon of the trial that Gerry has to rush home for urgent work committments. As we can see above, the arrogant smile before the proceedings started got replaced with complete fury. Now if I was his lawyer, I would have sent him home too! GERRY McCann angrily dismissed Portuguese detectives’ claims that his daughter Madeleine is dead as he arrived at court today.

Senior officers involved in the case told a hearing in Lisbon yesterday of their belief that Maddy died in her family’s holiday flat and that her parents faked her abduction.

Returning for a second day of evidence, Gerry McCann and his wife Kate insisted that none of the claims were new.

Mr McCann was asked by a Portuguese reporter whether it was worth the emotional cost for the couple to attend the court case.

He replied: “Do you have children? Anyone who has children would go through the same process.”

Lisbon’s main civil court is hearing an attempt by former police chief Goncalo Amaral to overturn a ban on his book questioning the McCanns’ account of what happened to Madeleine.

Speaking as he arrived at the court building hand-in-hand with his wife, Mr McCann seized on public prosecutor Jose Cunha de Magalhaes e Meneses’s testimony yesterday that it was “50-50” whether the child is dead.

Mr McCann said: “The most important thing yesterday was what the prosecutor said, there is absolutely no evidence that Madeleine is dead and there is absolutely no evidence that we were involved in her disappearance.

Chief Inspector Tavares de Almeida told the court yesterday he believed that Madeleine died in her family’s apartment in the Algarve resort of Praia da Luz on the day she went missing.

He said the main evidence for this was the findings of British police sniffer dogs sent to Portugal to examine the flat.

Mr McCann said the evidence of the police witnesses called by Mr Amaral’s lawyers did not surprise him.

Mr Amaral’s lawyers argue that the material in his book - Maddie: The Truth Of The Lie - is contained in the official Portuguese police files for the case, many of which were made public in August 2008.

Arriving for today’s hearing, Mr Amaral said he was “very happy” that his police colleagues had repeated in court what was in the files and in his book.

The McCanns, both 41, from Rothley, Leicestershire, say their main motive for challenging the former policeman is the fear that people will stop looking for their daughter if they think she is dead.

Explaining why the couple launched legal action against Mr Amaral, Mr McCann said today: “This is a legal process that we’re going through to protect our daughter and our family.

“We’re looking for new information to help the search.

“The question of course is who is looking for Madeleine and who has been looking for Madeleine over the last two years, and that is us and our investigators.”

Mr McCann will return to Britain this afternoon because of work commitments, a spokeswoman for the couple said.

Fiona Payne, one of the friends who was on holiday with the McCanns when Madeleine disappeared on May 3 2007, is flying out to support Mrs McCann.

McCanns 'Want Justice' At £1m Libel Trial

The couple are in the Portuguese capital for a three-day hearing at which they will seek £1m in compensation and a final ruling preventing Goncalo Amaral from repeating claims he made about them.

The lawsuit had originally been due to be heard in December, but had to be postponed after Mr Amaral's lawyer was taken ill.

Mr Amaral was in charge of the investigation launched when Madeleine McCann disappeared shortly before her fourth birthday during a family holiday in Praia da Luz in May 2007.

He was taken off the case the following October after criticising British police in a newspaper interview.

Mr and Mrs McCann were named by police as "arguidos", or suspects, but that status was lifted when the investigation was shelved in July 2008.

The same month, Mr Amaral published a book called Maddie: The Truth Of The Lie, in which he claimed the youngster was dead and called into question the McCanns' account that she had been abducted.

No-one can be allowed to say that our daughter can't be found without very good evidence.

A Portuguese judge granted an injunction in September last year banning its further sale or publication.

The former policeman was also prohibited from repeating his claims about Madeleine or her parents.

Arriving at Lisbon Airport, Mr McCann said: "We're just here to continue the search for Madeleine, and to protect our own family, and their human rights.

"No-one can be allowed to say that our daughter can't be found without very good evidence. That's what this court case is about."

Mrs McCann said: "We're looking for justice."

The couple, both 41, from Rothley, Leicestershire, are not expected to give evidence during the hearings, although they are thought to be planning to attend them all.

They have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter.




This would seem to indicate that the camera belonging to the McCanns and the video, I assume belonging to David Payne as we can see he was recording them on the holiday bus, were immediately seised by police and by 8 May in UK being analysed. The date and time had never been set, stuck in 2002. So, come on Gerry, I would like to know how you produced that last image of Madeleine with the time and date on it. Presumably unaware of the mounting evidence police were gathering against you, even at that stage.

It would also be interesting to know what the contents of the 73 deleted pictures are that the police managed to recover.

The police extensively researched how Gerry could have immediately had available two 6 x 4 prints of Madeleine on Kodak xtralife paper. It would seem they concluded that the only way he could have had them available was to bring them from home. This is a specially laminated picture that prevents it from staining even if drinks spill on it and prevents fading etc, not available in PDL, which is hardly surprising given these pics were handed over in the small hours when no photo shops would be open in PDL (about 3 hours after they " reported her missing" erm perverting the course of justice there). But there are a number of outlets around his home in Leicster that will produce this nice long lasting and durable pics for you. Again, demonstrating that Gerry McCann is not really so smart as he thinks he is and no wonder LP announce they will keep on investigating this case until they bring to justice "those behind the disappearance of Madeleine McCann). No surprises who they are alluding to there!

See also article from the Guardian dated 25 May 2007 where they emphasis in the opening lines it was THREE WEEKS TO THE DAY before the McCanns released this apparent last photo of Madeleine. Given it was supposedly taken by Kate, is this a bit of blame allocation/self protection by the scheming Gerry McCann, who, oddly enough had just popped back home to the UK, then he triumphuntantly returns with his handiwork. I would say, a picture of Madeleine from the previous year.

1. I am employed by Hampshire Constabulary as a Detective Constable and am currently stationed in the Hi-Tech Crime Unit. I hold a Batchelor of Mechanical Engineering and Management degree from Liverpool university. My duties include the retrieval and examination of evidence from computers and other digital media and the investigation of computer crime. I have successfully completed two courses held by Guidance Software Inc in relation to their forensic software tools.

I have also successfully completed one course held by Access data Corp in relation to their forensic data tools.

2. On 8th May at 21.00 hours, the following was delivered to my home address by PC 178 Barham, requesting they be examined to establish if they contained pictures and video footage of a hotel complex in Praia da Luz.

On 9th May 2007 at 08.30 I delivered this video camera in the sealed bag number CD 48113 to the imaging unit at Hampshire Police Support headquarters, Netley for examination. I conducted no examination of this bag and contents.

On 9th May 2007 I commenced my examination of a sealed plastic bag seal number CD48115 with two exhibit labels attached marked 64 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 2) and 32 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 3).

5. This bag contained a power lead and cable, a black camera case which contained an Olympus C50 camera and a memory cad holder which contained one card.

6. I identified NALF/2 as the memory card which was installed in the camera and NALF/3 as the card in the memory card holder.

7. NALF/2 is an Olympus XD 64 MB memory card number MXD64P3L922905RN9 0223 MAD.

8. NALF/3 is an Olympus XD 32 MB memory card number MXD32P3RO34505RN20235 MAD.

9. I imaged NALF/2 using Guidance Software Inc computer forensic software called Encase version 5.

11. I examined the data from the two cards and located 43 pictures in the live area of the two cards.

12. I produced these pictures as identification references SWM/3019/01 to SWM/3019/43.

13. On checking the camera I found that the time and date was not set on the camera and it was recording the time and date as 0000 hours on 01/01/02. This did not change during the examination. None of the pictures SWM/3019/01 to SWM/3019/43 have any created dates recorded. The last written time and date for each of them is recorded as 0000 01/01/02.


14. Last Accessed represents the date the file as last examined. Whether the Last Accessed Date is triggered depends on the nature of the examination. Opening a file will trigger the Last Accessed Date, as will looking at the file properties and browsing the file structure with Windows Explorer. Examining a file on “write protected media” such as a floppy disk will not trigger this date, neither will examining a file on a compact disk or DVD.

15. Last Written represents the time and date that the contents of the file was last changed. The Last Written date and time is unchanged by the process of copying a file from one drive to another.

16. The creation date and time of the file is usually when it is written to the surface of the disk, subject to the accuracy of the computer clock that was used to perform this task. When this date and time is seen to be after the last written date and time it shows that the files has been transferred from another media.

17. Starting Extent represents the physical location of the starting cluster of the file.

18. Using my forensic software I was able to locate 73 pictures files in the unallocated clusters which had been deleted and were no longer accessible to the camera user.


19. I produce a report containing each of these picture identification reference SWM/3019/01 to SWM/3019/43. (THESE DO NOT APPEAR TO HAVE BEEN DISCLOSED!!)


20. I produce a compact disk SWM/3019/44 containing pictures SWM/3019/01 to SWM/3019/43 and report SWM3019/45. I have also copied the pictures and the folders as they appear on the cards, to this disk.

21. Unallocated clusters

22. Unallocated clusters are clusters on a drive that are not currently assigned to a file. Also called free space. A file may either occupy one or more clusters. The clusters that a file occupies are not necessarily contiguous. Some of these clusters may still contain data from files that have been deleted but not yet overwritten by other files.

23. When the data is extracted from the unallocated clusters there are not imes and dates or file names attributed to the data. My forensic software therefore saved the data in file format and named the files according to the location of the data within the unallocated clusters.

Madeleine, then aged three, appears giggling as she dangles her feet into a swimming pool beside her younger sister Amelie and her father, Gerry.

The photograph was taken by her mother, Kate, as the family of five enjoyed their holiday at the Ocean Club complex in the tranquil Algarve resort.

Later that evening, the McCanns left the three children sleeping in their apartment while they ate at a tapas bar a few metres away.

On one of their half-hourly checks they discovered that Madeleine had disappeared, while two-year-old twins Amelie and Sean remained in their beds.

Despite reports of sightings from as far afield as Marrakesh in Morocco, and Crete, police admit that they have no idea where she may be. Believing that she may have been driven across the border into Spain and, from there, to anywhere in Europe, the McCanns are preparing to travel across the continent to spread the hunt for her, starting in Spain.

A British billionaire has offered the McCanns the use of a private jet, although the family are said to be wary of doing anything that makes them look like celebrities.

"We need to start finalising our plans for interviews in areas of Europe where the coverage of Madeleine's disappearance has been limited," Gerry McCann wrote yesterday on the website dedicated to finding his daughter.

As the family's ordeal enters its fourth week today, there have been suggestions from people close to the McCanns that they are concerned about the flow of information from the police to them.

"While they remain content with the overall thrust of the investigation they do at times hope that their questions and concerns are addressed more quickly," a source close to the McCanns told the Press Association news agency.

"They fully comprehend the restrictions that the Portuguese legal system places on everyone involved in this, but naturally as parents who want their little girl back some of the delays that are occurring are frustrating," he added.

Madeleine's uncle, John McCann, said the family remained determined to explore "all ways" of getting Madeleine back. "That will focus on the criminal investigation but we have to - as a family - be open to other ways."

Wildlife in the snow ..





It was minus 7 here last night and a few nights back I had the most horrendous time to get home, having to skid past people who had given up, over an icy hump back bridge etc which was terrifying. I actually cried when I got in the house, I think it was just sheer relief. I had been on a mercy dash to take my mom out shopping as their car is off the road and she was completely fed up!

But my friend who lives in Compton Dando near Bristol just sent me these fabulous wildlife shots she took of her garden including as you will see the most fantastic shot of her resident great spotted woodpecker so I thought I would share them with you as we all continue to suffer the worst winter in memory. But hey ho, I just booked for me and Luke to clear off to Dominican Republic in February where I think it will be about 28 and surrounded by coconut trees, now that is better!

Dozens of papers are now leading with this story from the Press Association, that must be very embarrasing for Kate and Gerry. But I am relieved to hear they intend to bring those "behind her disappearance" to Justice!

Thousands of British police files detailing the hunt for Madeleine McCann will not be released unless those behind her disappearance are brought to justice. Skip related content

Senior Leicestershire Police officers have remained tight-lipped about their role co-ordinating the search for the toddler since she vanished from a Portuguese holiday resort in May 2007.

But analysts at the force have drawn up a list detailing the mass of information they have gathered and considered whether they would ever release any of it to the general public.

The paperwork includes everything from correspondence with Government ministers, minutes of police meetings, details of leads and sightings to copies of letters from the McCann family.

Leicestershire Police said they will not release any information while the inquiry is ongoing and will never reveal the tactics of their investigation. But internal documents suggest some papers may eventually be published.

They stated: "Anything in relation to the investigation into the disappearance of Madeleine McCann will not be released whilst it remains ongoing.

"Consideration may be given to releasing certain material, ie, that which would not reveal police tactics, when the circumstances surrounding Madeleine's disappearance are fully known and the person/people involved have been brought to justice and a suitable period for any appeal has elapsed."

Madeleine, from Rothley, Leicestershire, disappeared on May 3 2007 from Praia da Luz, nine days before her fourth birthday.

An investigation into her disappearance was carried out by the Portuguese police, supported by Leicestershire Police.

The force is responsible for co-ordinating British inquiries under the codename Operation Task.

Kate McCann has revealed that she struggled to control Madeleine McCann after the birth of her and Gerry's twins, it was revealed today.

Missing Madeleine would run around 'screaming...shouting for my attention', the mother-of-three said.

In an interview given to a Portuguese magazine before she was named as a suspect in the case of the four-year-old's disappearance, Kate also said the first six months of Madeleine's life were "very difficult" and that the girl had suffered from colic.

The revelations come as police said they were trawling through Kate's medical records amid suspicions in Portugal that she may have had a history of depression.

The detailed analysis of her medical notes could provide them with significant evidence against the GP, who is a suspect in the case of Madeleine's disappearance.

Speaking about Madeleine's upbringing, Kate, a 39-year-old GP, told Portugal's Flash! magazine: "She cried practically for 18 hours a day. I had to permanently carry her around."

This period explained "the strong bond between mother and daughter", she said.

Although the arrival of the twins Sean and Amelie shook up Madeleine's life, she accepted them very well, said Kate.

"She managed to deal perfectly with this new reality, although she herself at the time was still a baby.

"The worst thing is that she started to demand lots of attention, especially when I was breast-feeding them.

"She would run up and down screaming in the background, shouting for my attention."

Mrs McCann also insisted that she and her husband were "truly responsible parents" and had committed no crime.

Speaking of the night Madeleine disappeared, she said: "I was sure immediately that she didn't walk out of that room. I never doubted that she had been taken by someone.

"I went through a phase of guilt for not knowing what happened to her. I blamed myself for thinking that the place was safe.

"But the certainty that we are truly responsible parents has helped me carry on.

"I know that what happened is not due to the fact of us leaving the children asleep. I know it happened under other circumstances."

Asked about whether she and her husband were responsible for their daughter's disappearance, she said: "It cannot be considered a crime. Someone committed one, but not us."

Portuguese newspapers continued to report today that Mrs McCann will be re-interviewed in the UK this week by British police on behalf of the Algarve authorities.

But a spokeswoman for the McCanns said the couple had to date received no request for new interrogation.

The judge in the case, Pedro Daniel dos Anjos Frias, rejected prosecutors' request to have the McCanns brought back to Portugal for further questioning, the Correio da Manha said.

He insisted that the fresh interviews should be carried out by British police in the UK, according to the paper.

The re-interviewing will only take place when further DNA testing in Birmingham is completed, either tomorrow or Wednesday.

A letter of appeal will be sent to Britain, setting out all the questions Portuguese detectives want to ask the couple, along with the evidence supporting their hypothesis, the Correio da Manha reported.

A source told the paper there was only a "very low" probability that Portuguese officers would be allowed to sit in on the interviews.

A McCann family spokeswoman said today: "We have been in touch with the lawyers to try and get a steer on what is in the Portuguese papers.

"They assure us we have had no request to date for any further questioning, either from the Portuguese police or in the UK."

She could not say whether the McCanns' legal team was expecting the couple to be re-interviewed.

Since Kate and Gerry McCann were named as official suspects last week, there have been suggestions in Portugal that Madeleine was given drugs on the night of her disappearance.

The accusations have been strenuously denied by the couple but have not been ruled out by police. Although the order to seize medical files came from the Portuguese authorities, the background searches are being carried out by Leicestershire police.

A copy of Mrs McCann's diary has also been seized by police, who are now waiting for permission from the judge to seize and dismantle the McCanns' hire car so they can search for "traces of skin".

It has been reported that DNA evidence with a match to Madeleine was found in the Renault Scenic 25 days after their daughter vanished.

Yesterday it emerged the McCanns are trying to knock down potential evidence retrieved after two British sniffer dogs, capable of detecting blood and human remains, were used in the investigation in August.

One of the dogs picked up a "scent of deathî on items ranging from Mrs McCann's clothes to Madeleine's favourite soft toy Cuddle Cat.

Leaked reports from the investigation have suggested that Madeleine's parents could have accidentally killed her and then disposed of her body using the car. Although they do not know the full details of the Portuguese prosecutors' case against them, the McCanns are concerned that it may rest on the dog's reaction.

The couple's legal team has now consulted the lawyers of an American man accused of murdering his estranged wife in a case where "cadaver dog" evidence was central. They want to highlight the judge's dismissal of such evidence in the high-profile Eugene Zapata murder trial in Madison, Wisconsin.

Mr Zapata's estranged wife, flight instructor Jeanette Zapata, was 37 when she vanished in October 1976 after seeing her three children off to school.

Her body has never been found. Detectives suspected Mr Zapata of involvement in her disappearance but did not charge him because of a lack of evidence.

Police decided to conduct new searches using cadaver dogs and Mr Zapata, 68, was charged with firstdegree murder last year after the dogs indicated that they had scented human remains in an underfloor crawl space at the former family home and other properties linked to him.

But the judge ruled that the dogs' ability to detect remains was too unreliable, noting that no remains had actually been found.

THAT ONE PERSON DO THE RIGHT THING FOR MADELEINE, FOR CHRISTMAS

Gerry McScam I have to say that ever since Martin Smith's very accurate description of you and your short brown hair entered the public domain you have been going overheard ooh I mean overboard with the hair dye, in fact I nearly died of laughter when I saw you turn up for the Select Committee with them jet black locks, lol, which reminds me, can you fill us in on when their esteemed report is due, or is it sub judice or something, lol, merry christmas anyways xxxxxxxxxxxx Hum, I suppose you still measure 1.75 to 1.8 metres tall, you know 5 10 not 5 7 hun? Oh PS some nasty bruising on Kate's arm there, good of you to cover some of it up with your hand holding her t shirt over the offending area. I mean you would not really want people to see how hard she struggled with Madeleine's Abductor, now would you, lol!
I could be wrong, but does motor mouth look just a little less arrogant here and somewhat worried, so he should be, I think he realised that expecting Goncalo Amaral to hand over about £400,000 to each of his kids including one who he got rid of and is a Ward of Court (so no longer his responsibility anyway) was probably a bit of a media disaster, even by his standards.
Despair, so do the right thing for Madeleine Kate, go and tell the Police the truth because you know your husband never will.

The McCanns jet into Lisbon, 11/12/10 to face Goncalo Amaral in court but at his lawyer's request the case gets adjourned for one month.

Isabel Duarte, the McCanns lawyer states, I just wanted them there for some support, I know 90 per cent of Portuguese people are against us. I am sure Gerry will be very happy with such frankness from his own lawyer, but as the one person who can do something for Madeleine, maybe he should develop some foresight instead of just pursing his lips and claiming, well we believe. 90 per cent cannot be wrong Gerry, Goncalo believes you were involved in the disappearance of your daughter and so do we. So spare her a moment for Christmas and think about the little girl Goncalo has too, almost the same age as Madeleine. Do you think children will be better with countless thousands of pounds, your children, and do you think the innocent little girl that belongs to Goncalo and Sophie will be better with her family bankrupted. You ask to understand this just has to be done, we do not understand. Children need just enough money to have their basic needs catered for, but most important they need love and a stable homelife. But I doubt you would ever understand that or how to remove that agonised look from your wife's face.

The UK's national law enforcement centre for protecting children - the Child Exploitation and Online Protection (CEOP) Centre - has today issued an online viral message aimed at anyone close to the person who was involved in the disappearance of Madeleine McCann.

That person could be a relative, friend, work colleague or neighbour. Whoever they are they have a secret that could reveal what happened to Madeleine and protect other children.

In order to increase the possibility of reaching that person, the Child Exploitation and Online Protection (CEOP) Centre supported by global law enforcement agencies and specialist charities, is asking the public to help spread the message via the internet.

It has released a short 60-second film that can be viewed at the CEOP website. This contains the message they are looking to spread and the public are being asked to link to it and build it into their own online environments. The film also includes new age progressed images that show Madeleine as she may look today.

Interpol, Europol and national police agencies from Australia, the US, Canada, the UAE and Europe are supporting the initiative. Specialist charities and NGO's such as the US National Center for Missing and Exploited Children (NCMEC), Missing Children Europe and the UK Charity Parents and Abducted Children Together (PACT) have all thrown their weight and expertise behind the initiative.

Jim Gamble is head of the UK's CEOP Centre and explains the rationale:

"The person we are looking to reach is likely to be a partner, family member, friend or colleague of the person or people who were involved in Madeleine's disappearance. It is also highly probable that they, or someone close to them, is using the internet to search for any updates that may suggest the police are getting closer to discovering the truth."

"Today we want to deliver a message to that person and we're asking everyone who goes online to help us. We want the message to become so widespread that it becomes just one click from any Madeleine search as a constant reminder to that person that it is never too late to do the right thing - that it is never too late for that person to redeem themselves."

"So if you are a parent or carer, a student or member of the public who is a social networker, blogger or emailer, or if you run any type of online environment, big or small please look at the film today, link to it, share it with your friends and post it in the online communities you occupy. Do everything you can to spread it around the online world. We want to make it omnipresent so that the person we are trying to reach sees it and is prompted to do the right thing."

The message is available on the CEOP website and is in seven different languages - English, Arabic, French, German, Italian, Portuguese and Spanish.

The message reads:

"Madeleine disappeared on 3 May 2007 while on holiday with her family in Portugal. Madeleine is now six years old. We know that there is someone out there who knows who is involved in her disappearance.

They may be keeping this secret out of fear, misplaced loyalty or even love. Keeping this information secret only increases the anguish of Madeleine's family and friends and increases the risk to other children.

If you know who is involved and are keeping this secret remember that it is never too late to do the right thing.

We urge anyone who knows anything about the whereabouts of Madeleine or has any information regarding her disappearance to do the right thing and to give that information to their local police."
