CHARGES CONSIDERED INCLUDE HOMICIDE

Hi all, Ratonthebeam referred us to these two pictures on the posts below and I just had to include them from 3 Arguidos. The one below is him going into the the police, he looks sly, very shifty, arrogant and slightly worried, but when he comes out he looks absolutely gutted, in fact almost in tears. I remember commenting about this one before, the one and only time I have seen Gerry look really worried and upset. Now this does not have anything to do with losing his daughter, it has to do with the one thing Gerry just cannot cope with, not being in control. He even tried to rush off but had to be held back by the solicitor to face the cameras, now funnily enough he does not normally have a problem with that, does he¬!

The child the McCanns just did not want and never thought of how much misery and harm they caused to little Amelie and Sean by taking their big sister away from them, for ever.

The saviours of Madeleine Beth McCann and her little brother and sister, from wicked parents, Goncala Amaral and Paulo Rebelo. When things go wrong for defenceless little children there are devoted police officers who will fight for victim's right. We honour them and all their hard work to bring this couple to justice, against all odds and in the face of appalling abuse, from those who sought to defend a couple of child abusing killers. May they hang their heads in shame for their racist abuse and total lack of concern for little children and their right to safety, to life.

Gerry in July 2007, when he believed his revolting plans were going to bring him fame, fortune, and the right to mix with some of the most important people in the world, his prison cell awaits.

Gerry, caught like a caged animal, in about October 2007 when reality was beginning to dawn and showing what he is really like...

Having run away from Portugal the McCanns start to show the strain of being hunted

The McCanns triumphant in the early days in PDL having killed Madeleine and started to cash in from a massive fund, where they made Madeleine "an icon". Wicked, despicable, evil. Kate cynically carries her press prop "Cuddlecat" which reeked of Madeleine's corpse.

The final picture of Madeleine Beth McCann on 3/5/07 with bruises to her wrist and legs

Sweet little Madeleine Beth McCann makes her final journey McCanns last desperate attempt to proclaim their innocence by stating they wish to be the saviour of children, how sickening, how perverse. Public defender, Clarence Mitchell

Hi All, in the brief newsflash in Correio de Manha it is announced that there is now an Order not covered by secrecy of justice that the McCanns are now to become DEFENDANTS for the crimes of murder, exposure (to risk of serious harm) abandonment and concealment of Madeleine's corpse. This has also been confirmed on Portuguese TV and also in the newspaper 24 Horas.

It seems to me the Portuguese Prosecutor is quite determined this couple will be convicted, hence all charges that may lead to a conviction being made against them. The second charge relates to the fact that they placed her at risk of being taken by a kidnapper. In this respect, in an attempt to save themselves, they provided further evidence against themselves. They initially said the window got jemmied and the shutters were damaged. When this was shown to be false, they said, well we left the door open. By stating they left the door open this clearly left them wide open to a charge of gross negligence. I always thought this aspect of the evidence was absolutely fundamental and crucial.

So, Clarence was not making a slip of the tongue when using the term "defendants" rather than arguidos for the McCanns, he was obviously announcing the inevitable, that they are about to be charged, it looks like, by July. I presume, the McCanns and their friends have refused to co-operate with the proposed reconstruction for fear of further incriminating themselves but they cannot say they were treated unfairly by being given the chance to come and explain. There is no way they can explain.

JUSTICE FOR DEAR LITTLE MADDIE, AND HER BROTHER AND SISTER WHO ARE SIMPLY NOT SAFE WITH THIS COUPLE, AT LAST!

God Bless her and may she rest in peace, safe from further harm with the Portuguese people, who have always sought to save and protect her x

Ana and Claudia have kindly stated they will update as soon as further news breaks but no doubt you will all be looking now we have finally got what we always wanted!

May 28, 2008 - 00:30 am Order: McCann defendants for death, abandonment and concealment of corpse Prosecutor takes murder It is the first court order not covered by the secrecy of justice that assumes that research to the disappearance of Madeleine McCann closing the suspected crimes of murder, exposure, abandonment and concealment of corpses. About all developments in the case of the disappearance of Maddie in the Wednesday edition of the newspaper Correio da Manha.

Please see also this video of Kate and Gerry McCann being interviewed on the anniversary of them murdering Madeleine where Gerry describes her as an "icon" and claims the Police cannot prove a "negative". Well they can, and whilst his indictment for murder may be a negative to him and his wife, it is very positive to us, for justice for a dear little child, done to death by her own parents and her body disposed of like rubbish, a truly wicked crime that they must pay the price for committing and seeking to cash in and make her an "icon" in death, inspired by just how much money the Diana Princess of Wales Fund made following her own tragic death. There are no real words to describe their despicable behaviour.

Please read the comments of my dearest Portuguese friend Claudia, below:

Cláudia said...
In that interview, Gerry aks how people can prove a negative, he states it is not possible to prove they aren't in any way involved in what happened because anyone can smear other people. You know what, Gerry, it's true, anyone can smear anyone. However, parents of a missing child should certainly be more worried about finding her and what happened to her than concerned about what people say and think. As for proving a negative, Gerry, you know, there is a very simple way to start doing that. What about doing EVERYTHING to help authorities, Gerry? What about answering ALL questions, Gerry? What about returning to the place where your daughter went missing, Gerry, when authorities ask you, after you stated for the whole world to see that you would return as soon as requested? What about starting there, Gerry? What about not sorrounding yourselves by PRs, spin doctors, and double teams of lawyers both in Portugal and in the UK, some of them specialists in extradition matters, Gerry? What about getting on a plane as soon as it is reported your daughter has been seen somewhere in this God's world, Gerry? What about not planning an anniversary event almost a year ahead, Gerry? What about staying with your children instead of leaving them to meet your friends, Gerry? What about that? You see, proving a negative isn't as hard as you think, Gerry. Unless you're lying, of course. That can make things a bit more complicated.

Morning Niki, Dolores and Mariana

It is unfortunate our press cannot report it just the way it is. I do not remember seeing any mention of abduction in the reports from Portugal, does anyone else?

This 10th Tapas member is a real mystery. I see it is mentioned it may be someone from the local community, is this why Murat was/is a suspect? Could it possibly be his privacy they seek to protect? When the judge has sought to apply a law that I read Claudia and others say has not been applied in other cases this does raise the prospect that someone or something is being covered up and that is very worrying as to why this would happen. It is almost like the police want the full truth to come out but this is being prevented at a political level.

As far as charges for neglect go, how can a mom who says her daughter said to her that very morning mom I was crying last night where were you, but who just ignores that and goes and leaves her again (and him too) possibly seek to deny they did not intentionally neglect Madeleine, particularly when they claim they left the door open. Are the police actually being prevented from laying more serious charges against them? This is very worrying, if so.

Unknown said...

Mandarinn
It is criminal behaviour all along for all of them, no exceptions.

Dolores
It is really good news that Amaral had asked for the wiretaps and he got them. I am sure they have learnt plenty.

Unknown said...

Viv

You are absolutely right. Abduction is only mentioned in the British press and that is how CM said his usual nonsense.

Unknown said...

Hiya Mariana

The report Dolores has posted is very encouraging that wire taps were authorised but I am a little confused as to what is being allowed in and what is being ruled out! If the police have information that the Judge will not allow them to use in any trial, I think this is why Goncalo is writing his book where he is going to publish this information anyway. He is a very, very brave man because goodness knows what forces he is taking on by doing so but like he says we will get to know the truth behind the lie whether it is used in court proceedings or not! No wonder Rosiepopos writes with such sickening venom against this wonderful man! To quote them: tee hee!

ratonthebeam said...

That was a question I was away to ask, actually, but I think I just got the answer. What does the report actually say in Portuguese, and does it translate into "abduction" in the English sense of the word? Or could it also mean "removed" - and therefore also apply to a corpse? :-?

Unknown said...

Hiya Rat

Unfortunately, it is the usual case of someone I would certainly prefer to call a rat, putting his own spin on what is written. He would argue no doubt that if the McCanns are to be charged with abandonment, putting her at risk of serious harm, then his brand of harm, abduction, must have happened, that is implicit in the charge, but that is not what it says, at all, that is Clarence re-writing what he wants it to say. We will stick to the Portuguese version that gives the facts, not the false representation of them by the supporter of a couple of child killers and I say that quite deliberately!

Unknown said...

Viv
As I understand this Protection Act, the judge cannot authorise the use of data before the event. After they event, the prosecutor can use the material.

ratonthebeam said...

Viv, I think you are right, actually. I'm just concerned about any possible mistranslations by our press, whether ignorant or deliberate; it's gotton to the stage that I simply do not trust any British papers or news channels, anymore, about anything.

Hiya Mariana

I do not think that can be right because he is not only, perversely, saying they would have needed to obtain authorisation for taps before they even killed Madeleine, he also seems to be saying the content of SMS messages after the event also cannot be obtained or relied upon. This I can certainly recognise from UK law. Quite often the police will have additional evidence but the judge has a power to exclude this evidence if it is more prejudicial than probative. This is as a safeguard to ensure a fair trial. The thinking is the evidence is so utterly damning on the face of it, the jury would be immediately swayed by it, without properly considering all the other evidence. This is what led me to say, last night, the judge will have weighed all the evidence and may have taken the view there is so much other evidence to prove homicide this does not need including as well. The judge has a very difficult balancing exercise to perform. It is his duty be impartial and ensure a fair trial takes place. He cannot be seen to be particularly favouring one side or the other. In fairness to him he will be concerned to ensure he cannot be criticised for being unduly harsh on the McCanns. I think the reality is when I really think it through there are all sorts of precise legal judgments being made based on the evidence and it is very difficult for us to speculate on this because we do not have that precise evidence, but it really does look to me as though there is some pretty devastating evidence against the McCanns. Also this is not just the decision of the Instructional Judge, the prosecutor has appealed to a higher judge and got the same answer which is what has been published. I think the McCanns are in really serious trouble here and the evidence is so bad the judge can afford to exclude some of it, purely on the basis of fairness to them, to ensure a fair trial.

With direct phone contact between Gerry and Gordon, there is no way on this earth that MI6 would ever allow the contents of those conversations to be released for general public knowledge. Not just for the personal protection of a Prime Minister, but for the protection of the Great British establishment. The British will want this kept secret under the full terms of the Official Secrets Act.

However, I believe the PJ already have this information and if I were PJ, I would use this like Kryptonite. Wave it in front of the Super Person and watch them go weak at the knees. Well done PJ, I can see exactly where you are coming from, and from where I am sitting, you are doing a fantastic job, sit tight and buckle up safely.

Dear PJ, My advice, keep that Kryptonite firmly in place and you will be very surprised what will be offered up in exchange for it ? ? ?

Unknown said...

Viv
You are most probably right about this. They have to think of the European Court of Human Rights too. They do not wish their case to be thnrown out on some minor technical matter. I am certain the McCann's will exercise this right.
I believe the prosecutor must have plenty to throw them in prison for many years.

Unknown said...

Hiya Mariana

The PJ /Portuguese Prosecutor have always known what they were up against. An intelligent and devious couple, who have access to the most expensive legal shenanigans money can buy. They have always known they are lacking in evidence in major respects, i.e. Madeleine's body. They have therefore had to do a very detailed and complex investigation to seek to get themselves over those obvious problems to be able to prove the case against the McCanns beyond reasonable doubt.

As you say, the McCanns will use any tool they have available, Gerry has used phrases like we will fight this all the way, clearly implying even if convicted, he would then go on to the European Court of Human Rights. The Portuguese Judge is obviously mindful of what this man is capable of, and not wishing to give him the slightest chance of saying Portugal, in any way, whatsoever, breached their human rights. One can hardly blame them for that!

Hiya darling

Well two things really, it said murder not manslaughter (please confirm)

Clarence Mitchell says things that are positively harmful to the McCanns and really should not be said. Why would they be investigated for all these serious offences if the police do not suspect them of anything (!!!!), either he is, as you say, utterly stupid, or well, I guess, he is utterly stupid, yes that has to be right!

Cláudia said...

Viv, homicide in Portuguese (homicídio) can both mean murder or manslaughter. It depends. But I can tell you that from what I know, the PJ always suspected accidental death. This is not my personal opinion that I'm mentioning here (although I may agree with it).
As for the rest, darling, the idiots said the PJ wanted them to confess and even proposed a deal. But they don't suspect them! lololol I'm just not sure if they're stupid or desperate. Or stupid and desperate.

Stella: you made me laugh! :-)

Cláudia said...

Viv, you got mail.

Unknown said...

Hiya darling I know the same word is used homicídio, but when they mean manslaughter they also use the word culposa for culpable I think which was absent in these reports. I am always going to believe that an intention to harm Madeleine could or should be proved.

xx

Cláudia said...

Hi, darling. The word 'culposa' sometimes has to do with the obligation that someone should have to predict something serious can happen. One example can be if you drive after drinking too much. If something happens and you kill someone, even if it is an accident, you had the obligation to antecipate it could happen. The term 'culposa/culposo' could be applied in that case.

Joe said...

This slimy 10th Tapas is being protected and the PJ by now will IMO know who it is. If this was the person who McCann was texting then what is the role of this person? It could hardly be a chat in view of the circumstances but more likely related to the events. A seedy bunch of individuals, I can smell the corruption here, and a malevolent undercurrent. As i said before there is several layers to this.

Unknown said...

Hiya darling yes I understand that ..your definition of culposa complies with our own definition of manslaughter, it was done with either recklessness or gross negligence and the person should have foreseen those possible consequences whereas in murder those consequences have to be intended i.e. blatantly obvious.

x

Joe said...

I note that McCann is denying the text messages, the same old routine. tell the truth for once or is he capable of that?

The recent court ruling where the PJ have been denied access to these messages was because they were before the disappearance or crime. What if the PJ can show that the crime or disappearance happened before the messages then the evidence would be allowed ?

nancy said...

Joe - Hi

I wish I knew the answer, but I would have thought it made sense to look at all the text messages from when they arrived in PdeL myself. After all, if something was being arranged and discussed before the night of the 2nd or
3rd, then that needs to be looked at and taken into account at any trial. It seems the PJ's are not only being obstructed by the UK authorities but by their own too.

I can see why private calls would come under the data protection act in a less serious case, but when a young child is involved I think the PJ's should be able to appeal the decision of the Judge.

At least things are moving in the right direction and the pink one and the ones he speaks for may hopefully have to put their money where their mouth is.

Cláudia said...

So, the Mccanns deny any text messages and possibly calls too. So, the PJ asked the court to access something that does not exist and the judge refused access to something that never was? In Portugal only really smart people become doctors. I thought the same happened in the UK...

nancy said...

Claudia Hi -

Gerry is going to be shown up for the liar he is if and when these phone details are made known, which I'm sure they will be in the fullness of time.

As BT said, it's quite likely that someone other than the Judge will have access to the call details and spill the beans for money! The same as here in the UK people in highly secretive jobs have grassed on things the government were supposed to have under wraps. Let's hope the same happens in this case.

It seems the PJ's also want the mobile phone details of the tapas 7

I bet they are all quaking in their shoes right now and so they should be - they have taken the public for morons and a whole lot of money in the process.

How stupid the government will look sending a couple of child neglectors or worse to Brussels to represent the UK! Someone in government must be biting their nails back to the quick!!

Cláudia said...

Nancy, I also hope so. I really do!

Afraid of being constituted arguidos 24horas

McCann friends refused to return to Portugal

Text Carlos Tomás

29/05/2008 (Thanks to 'Li' snd Joana Morais for translation)

The other two couples that left their children in the Ocean Club were afraid by the fact that the Portuguese law now provides a penalty up to 10 years in jail for those that abandon minors

Two couples refused to return to Portugal to cooperate with the PJ in the reenactment of the 3rd of May 2007. Amongst the motives for the refusal, 24horas discovered that it was the fact that Jane Tanner, Russel O'Brien, Rachel and Matthew Oldfield were afraid of being constituted as arguidos.

From the group of nine people that dined in the Tapas Bar in the night of the disappearance, apart from Maddie's parents these were the couples who also had children. And also left the children alone in the apartments of the Ocean Club - which according to the article 138º of the Penal Code, constitutes a crime of exposure or abandonment that can be punishable with ten years in jail.

"They made several demands, from a private Jet to a five star hotel. Their last request was not to be constituted arguidos, whilst the McCanns demanded exactly the opposite. According to our law that is impossible to guarantee", explained a judicial responsible connected to the process to 24horas.

According to the witness statements collected by the PJ at the Tapas Bar, only Russel O'Brien and Gerry McCann left the restaurant between 19h00 and 22h00, the period that the authorities believe the child went missing.

"The refusal of the friends to return to Portugal is unbelievable. Only three said they would come", David Payne, Dianne Webster and Fiona, said the same source.

Notice that the depositions of Fiona Payne and her husband are considered to be fundamental to elaborate the Public Ministry's accusation which is almost concluded.

Facts

Calm

Diane Webster, 63 years old, was the most calm person of the group. After Kate entered the Bar screaming "they've taken her", she was calm and serene.

Reservation

The reservation of the apartments of the Ocean Club - made through the Internet - was done by David Payne one of the witnesses that was available to return to Portugal.

Three consistent versions

The Judiciary Police investigators who are connected to the Maddie's process, a team coordinated by the superior coordinator Paulo Rebelo and Guilhermino Encarnação, responsible for the Department of Faro, have already analysed the main statements collected in Leicester, England.

The ones that have consistency, are the ones of David and Fiona Payne and Diane Webster, 24horas discovered. All the other depositions show several contradictions or do not advance anything important to the case.

In any case the statements of more than 50 persons who spent their holidays at the Ocean Club in that date and who live in England, are still being analysed.

According to the statements of these three friends of the McCanns, from 18h00 onwards none of them saw Maddie, although she was extremely active and enjoyed being with the group.

The only person that said that went to see the child a little after 21h00 is her own father, Gerry, who has confessed that he was talking for several minutes with a friend close to the apartment and after that only his wife Kate that gave the alarm of the disappearance after 22h30 . The authorities were only called near 23h45.

McCanns in fury after 14 txts slur, 29 May 2008
McCanns in fury after 14 txts slur Daily Mirror

By Martin Fricker

29/05/2008

Gerry McCann reacted angrily yesterday to claims he received a string of mystery texts the day before his daughter vanished.

Police applied to Portugal's supreme court to seize his phone records after learning of the alleged messages.

They claim Gerry was sent 10 texts from an unknown number 24 hours before Madeleine disappeared.

And detectives say four messages arrived from the same mystery number the day after she went missing, according to court documents.

But Gerry and wife Kate have dismissed the claims as "utter rubbish".

A source close to them said: "They have had their phone records available for inspection for months. But the police never asked for them. And now they have formally asked, they have been refused.

"Any suggestion of Gerry receiving 10 texts the day before Madeleine disappeared are utter rubbish.

"He hardly used his phone during the holiday and most of the friends with them didn't even have mobiles.

"The only time his phone rang was when work called and he explained he was on holiday. There are no mystery texts. Gerry has nothing to hide. It's yet more nonsense coming from Portugal."

Police also applied to see the phone records of the friends that Gerry and Kate were on holiday with.

But Portugal's supreme court yesterday issued a detailed ruling rejecting the application. It is believed detectives waited too long to request the records and that accessing them could breach privacy laws. A local judge had already turned down the application.

As part of the ruling, it emerged for the first time that the McCanns are being investigated for manslaughter.

It is the first time official paperwork has been made public in the year-long investigation into the five-year-old's disappearance from Praia da Luz.

The 5,000-word ruling also reveals that police are investigating the McCanns for "exposure, abandonment and concealment of a corpse".

Kate and Gerry recently claimed police do not officially suspect them - even though they are both still "arguidos".

McCanns' spokesman Clarence Mitchell said: "They are not officially suspected of any crime.

"Nor have they been accused of any crime."

Maddy has been missing for 392 days

*

Note: This report is inaccurate. It was 14 text messages on 02 May 2007 and 4 text messages on 04 May 2007.

Where and when on earth did the Tanner fantasist see the abductor then? It is not a month ago that McCann was telling the media "the abductor that Jane saw". If true then he knew she never left the table and it also destroys their abduction claim. Yet they continue

Hi, Rat!
That article in 24 Horas states that 4 of the Tapas, two couples, refused to come because they feared they would be made arguidos, like Kate and Gerry. It also states that they tried to negociate with the authorities saying they would come if they weren't named arguidos but under Portuguese law that isn't allowed, obviously. And because witnesses and arguidos do not negociate with the police (that's not in 24 Horas, that's just me saying!) :-)

Afternoon All,
Just popping by briefly. Hope you're enjoying the day.

Stella:
Google 'gordon brown's brother', and a Wilkipedia entry states:
'Brown and public relations: It's a family affair
[edit]
Nuclear lobbyist younger brother

Brown's support for new nuclear build sits uncomfortably with the fact that, since September 13, 2004, his younger brother Andrew has been head of media relations at nuclear company EDF Energy.[18] Previously, he worked for the lobbying company Weber Shandwick.[19] [20]

As of April 2007, Brown was still at the company: he sat in on an interview with EDF boss Vincent de Rivaz.[21] An Independent article in May 2007 claimed that "...Brown senior keeps his younger brother at arm's length", but did not provide details of how he achieves this.[22]

[edit]
Elder brother was a spin doctor too

According to the Evening Standard,

"When Gordon's older brother John was working as a public relations boss at Glasgow City Council some were surprised that the body was granted £900 million by the Chancellor to repay its debts for building council houses. English cities never received such favours at the time."

Oh, where for art thee now?

NB: Brown's wife is a close associate of Julia Hobsbawm, founder of 'Editorial Intelligence', a PR company, particularly focused on 'influencing' public opinion, including online sites.
Obviously, CM knows them all as well.

'Oh, what a wicked web we weave when first we practise to deceive'; that old warning still holds true today for children of any age, particularly the tall ones ;-)

I like your poem, Stella. These are interesting times, to be sure.

Gotta go. Have a fab day, all.

Good Afternoon All,

I think the most likely of the T7 not to want to return are David Payne, Russel O'Brien, Jane Tanner and Mathew Oldfield. Imo all of these have lied and the reconstruction would have caught them out in their lies.

ratonthebeam said...

If 24Horas says "two couples", my money is on Tanner&ROB and the Oldfields.

That leaves the Paynes and Diane Webster - a group of three - who could be the ones who did not refuse to go.

?????????????????????????????????

Tanner & ROB left a "vomiting" child.

The Oldfields left an 18 month old by itself.

They are all afraid that they get nicked for child abandonment as well!!!!!

Cláudia said...

Jane Tanner, Russel O'Brian and the Oldfields are the ones who according to newspapers reports refused to return. Moreover, David Payne, Fiona Payne and Diane Webster are said to have accepted coming and their testemonies are apparently believable, unlike the others.

Wizard said...

It's interesting to note the Paynes who had the baby listening device are the one who have agreed to return. They would not have been charged with child neglect because of this monitor and the alleged check. All the others are imo guilty of child neglect and may well have thought they would be charged.

Stella said...

Even thought the Paine's had a baby monitor, the distance between the apartment and Chaplins, exceeds the capacity of the signal from it. They would have known this instantly had they used it and switched it on that night. This was at least one night they were guilty as the rest.

They should be charged along with the rest of them, but perhaps given a slightly lesser sentance.

Oops, I meant sentence..

The Evening Standard are running the same story as the rest. The only one I have logged on to who isn't yet running it, is the Express! I wonder why!

Interesting connection there with Gordon Brown and his brothers, and CM! Gerry is of course an avid Labour supporter and it was at a Labour Convention in Exeter that he met Robert Murat.

It's no wonder that Gordon was on the blower to Gerry to give his support. It's obvious that Gerry was trying to climb his way to a higher status! Remember Gerry saying that he wasn't on holiday to enjoy himself, when a friend joked with him on the coach.

Just what was he there for I wonder?

The wheel turns Gerry and Kate and soon it will stop right at your door!!!

You should have gone back to Portugal and shown a bit of fighting spirit for your daughter Madeleine, and for the twins with or without your tapas pals!

Justice for Madeleine is what we are blogging for and soon may it come! Carry on the good work PJ's!

Stella said...

Gordon Browns youngest brother, Andrew before joining EDF energy, had a distinguished career in broadcast journalism with BBC and ITN. During his time at ITN, he was Editor of Channel 4’s political programme, ‘Powerhouse’, from 1996 to 2003. Before that, he worked in various senior roles on ‘Channel 4 News’ - as a programme editor, chief sub and as business & economics producer. At the BBC, in the late 1970s and 1980s, he worked on news and current affairs programmes including ‘Newsnight’. He also worked as a researcher in the House of Commons in the mid-1980s.

No wonder the Press are being manipulated.......

nancy said...

Stella -

I just left a blog on the Evening Standard regarding the distance from the flat to Chaplins - it seems that none of the papers have picked that up, but only mention the distance from the tapas bar which the McCanns say was only 50 feet, so they weren't really being negligent!!

The reason so many are against them is because they come out with lies like that instead of admitting they neglected their children and be done with it! They have never shown any remorse whatsoever as far as I have seen and neither have the tapas pals who left their children alone and whose children could have suffered the same fate (if the story of the abduction is true, which I don't believe for one moment).

McCann re-make is vital The Sun (No online link, appears in paper version only)

Kelvin MacKenzie (Editor of the Sun 1981-1994)

29/05/2008

I am puzzled at the refusal of the McCanns to fly to the Algarve today for a police reconstruction of the night Madeleine disappeared.

It is said they are suspicous of police motives and do not believe it will help find their daughter.

Are they really the best placed people to make that decision? after all, they remain the leading suspects in the case and despite Portuguese police handling the investigation badly, the law remains their best hope for justice.

Already the McCanns have tried worldwide publicity - including roping in the pope - and that didn't work.

They have taken the public's money and spent it on £50,000-a-month private detectives, and that certainly hasn't worked.

Those with decent memories may well recall these private eyes claiming they would have Madeleine home by christmas.

So why wouldn't the Mccanns and the Tapas seven try one more throw of the dice ? according to a "friend", it would have disrupted their family and business schedules.

Their "schedules" have already been disrupted and tragically will remain so for as long as Madeleine remains missing.

Could I urge them to have a change of heart and co-operate with the police.

Until they do so my personal jury will remain out

I would be interested to know how many nights the Paine's were spotted with a baby monitor on their table. I am stretching my neck out here, but I would say it will prove to be only be the night of the 3rd?

Wizard said...

Fiona Payne did not leave her children alone on the night of 2nd May she says she stayed in all evening – so at least she was responsible for one night. The evening of the 2nd May is quite interesting the Payne’s were in the apartment next door to the Mc’s - 5B. Fiona Payne says she was in all evening on the night of 2nd May and did not hear any crying coming from the apartment next door. This would be true as M was crying on the night of 1st May when here parent were asked to come back from Chaplins to look after their children. Bearing this in mind Kate says on the morning of 3rd May Madeleine says to her “why did you leave us crying last night”. According to Payne there was no crying (which I believe) but M allegedly says she was crying. Kate imo is lying Madeleine if still alive said nothing of the sort.

Even if the Paynes used a baby monitor, these gadgets are for when you are sitting elsewhere in the house or garden and it enables you to hear if one of the children are crying or in distress in their bedroom. Imagine if anything went wrong with one of their children while they were in the tapas bar or wherever and by the time they got back to their apartment it could have been too late. I would never dream of going further than my garden with one of those while my children were in bed quite frankly!

The Pink troll cites that charges of neglect will not necessarily be leveled at the McCanns as as abduction is also listed on the court papersof matters being investigated. Until charges are actually made none of us can be sure what will happen. All this talk of the Gordon Brown's brothers who know the Pink troll who knows the McCanns etc. it is very disquieting and does suggest sleazy Labour cover up.

With regards to the Paynes IMO, I do not accept their credibility. They never returned to PDL to help until the rogatory letters were applied, no more than the rest. Just because they may have agreed to return for the reconstruction it was probably a ruse as to show that there is no pact, in other words it looks better than all of them refusing when it was probably all arranged anyway.

nancy said...

So where did they all go, without Fiona Payne, on the 2nd May then? Was it the tapas bar, or Chaplins?I was under the impression that they all went to Chaplins restaurant on the 2nd May not the
1st! I know it was the tapas bar on the 3rd!!

Fiona Payne could be lying of course when she said she heard no crying on the 2nd! I thought that Mrs Fenn had heard crying that night!

And I agree with you that Madeleine said nothing about being left alone - this was made up by Kate along with other quotes. Even if she was crying the night before, after a night's sleep, little children like that forget very quickly.

Wizard said...

I still can’t get my head around the 14 messages on 2nd May sent from “officially non-identified” mobile phone. Four more were sent from the same phone after Madeleine went missing. I understand Gerry is saying he didn’t receive these calls but the pj are saying he did. The pj are interested in looking for a British citizen living in Portugal as the instigator of these calls.

Whilst on the subject of phones it’s alleged the pj were tapping the mc’s phones when they were in Portugal and the British authorities were asked to do the same when the Mc’s returned home.

Wizard said...

Nancy – its definitely the 1st May Mrs Fenn complained and Warner’s staff got the Mc’s back from Chaplins. As you say Fiona Payne could well be lying about being in on the evening of 2nd May.

The Brown family certainly seem to have left their mark everywhere - as you say no wonder there is a deathly silence in the media on this case!

It must be wonderful to have such power, and the fact that the tapas 9 seem to be holding the world to ransom with this case, just shows how the 'luvvies' get things their own way while the likes of ourselves would have been in the dock a long time ago over the neglect issue, let alone anything else that comes to the surface eventually!

I notice the McCann family, including Philomena, have gone very quiet recently - probably been told to keep quiet and not to rock the boat!!

nancy said...

Wizard -

Thanks for that info!

The truth is none of us can be exactly sure of who was where and when because they have all said things and then discrepancies have come into their statements. No wonder the PJ's wanted a reconstruction - they must be up to their ears in the tapas' timings of their comings and goings!! It could be the child neglectors want to confuse things because it suits them all!

I was just reading the Joana Morias blog and she was talking about the failure of 4 of T9 to return to Portugal. The last sentence, posted below, is interesting any ideas on exactly is meant?

"The refusal of the friends to return to Portugal is unbelievable. Only three said they would come", David Payne, Dianne Webster and Fiona, said the same source.
Notice that the depositions of Fiona Payne and her husband are considered to be fundamental to elaborate the Public Ministry's accusation which is almost concluded.”

Evening All,
Such a fine day; sunshine and showers. Hope we all enjoyed it.

Wizard:
Do you recall a brief article in the London Evening Standard some months ago which stated that one of the so-called Tapas9 was keen to co-operate, but fearful of the powerful people (for that, I read intimidating people) supporting the McCanns? The article was small; a few paragraphs on an inside page.

I believe that article is linked to your earlier comment:-

Joana Morias wrote:"...depositions of Fiona Payne and her husband are considered to be fundamental to elaborate the Public Ministry's accusation which is almost concluded.”

It is common practice for investigators to look for the weakest link; the person/people who are most likely to co-operate, for whatever reason.

Offer them protection; offer them reduced or no charges, and their fears can be overcome, usually through the intermediary of a lawyer in serious criminal inquiries.

The London Evening Standard story quoted a London lawyer.

ta ra said...

Wizard,
Also, perhaps we should remember that Diane Webster is a mature woman; a mother; the one person who remained calm, and silent at the time of the so-called 'disappearance'.

Mothers protect their own. That's nature...unless the mother is dysfunctional.

Just a thought.

Hi Honest Joe:
Re your comment:
"The Pink troll cites that charges of neglect will not necessarily be leveled at the McCanns as as abduction is also listed on the court papersof matters being investigated..."

Strictly speaking, he is correct. The first official publication of suspected crimes being investigated by the PJ is laden with suspicions about the parents; 'abduction' must be investigated in order to be proved or disproved; it is the other avenues of inquiry which dominate the PJs inquiry.

Perhaps, no charges will be brought against anyone in relation to Madeleine. Perhaps, many people will be charged, including her parents, and some of their associates.

Who can say for sure? The PJ, assisted by their British colleagues, Interpol, and child protection agencies.

All the PR mechanics refuse to meet any media interviewer, face to face in public, on air, on record.

What are they hiding from? Difficult questions perhaps, now that the media have official confirmation that the McCanns ARE being investigated for serious criminal offences, contrary to the claims of their expensive mouth pieces who only gained a public voice in the silence, the absence of the PJ because the Portuguese system protects the rights of suspects and witnesses more than we do.

Game over for the media manipulators. They are amateurs compared to those who control the media, direct the police, and influence the key issues in this case:
1. Child neglect.
2. Criminal inquiry into other matters.
3. Police investigation, unfettered by political intervention.
4. Free speech, and honest inquiry, subject to the constraints of libel law.
5....oops! Odd numbers distract me ;-) Add your own priority here xo

Re: Kelvin MacKenzie's comment in The Sun today.

What if...
The Sun, the UKs 'favourite' newspaper by circulation figures has been wrong footed by this story?

The current Editor Rebecca Wade has said she is 110% in support of the Mc Canns, and The Sun defends the McCanns; joins the PR party.

Time goes by; information becomes known to journalists (among others); more sceptics emerge. Wade defends her original judgement.

Times goes by; more information becomes available; the kind of information journalists must not ignore. Libel law is a constraint. Wade doubts her 110% support.

Time goes by. Journalists believe the information, and challenge their Editor. Enter...

Jon Gaunt, a columnist; a doubter, questioning the McCann version of events.

Times goes by. Nervous Wade realises the ongoing inquiry is investigating (possibly has serious evidence) serious criminal offences against the McCanns.

Times goes by. A pause. McCann story relegated. Sometimes, credibility is more important than circulation.

Enter Kelvin MacKenzie, former Editor of The Sun when it had a much higher circulation than it does today. MacKenzie, the influential UK media operator, today urges the McCanns to reconsider their position, and co-operate fully with the police. Until then, his 'personal jury' is still out, he writes.

Slowly, slowly...ALL monkeys will be caught; and some of the gorillas too, me thinks.

I very much doubt whether Wade will survive her misjudgment. Just an opinion.

Charmless, stupid cynics and fools, bore me terrifically so.

What's the point of them, except to remind us that honest inquiry, however foolish or wise, is an admirable quality.

Just my opinion ;-))))

Hi Leigh3,

You are so right. Cozy is the word, all one sided up to now. The McCanns just made statement and the only place it was questioned was on the blogs. The Pink troll making out for months that the McCanns were not really suspected of anything, and Arguido status was a minor irritation not akin to a suspect even.

Well its there for all to see now they are being seriously investigated on several levels.

Ecolab said...

If there are to come more arguidos, people will "sing".
I think we will have more arguidos. I still hope the Police will make a reconstruction BUT with actors.

The game will end. About a year from now, sounds realistic to me.

I hope I can join my bed soon. The Mayor is comming visiting tomorrow. A short but tuff day at work, and I will be seeing my dentist tomorrow afternoon. I`m not that fond of dentists, even if he is a goodlooking guy with a nice a**!

Slowley Slowley never truer words...

No farden centres for a while we have bought a house Rabbit and she loves the farden (when it stops raining)...

The truth is all that is needed and if Madeleine is still alive like they tell everyone she is they have shown how heartless they are by not going back to do the reconstruction. They may think that using the 4 friends that refused as an excuse but people are not as stupid as they think they are.

Leave no stone unturned unless it does not help the McCanns to turn it then leave it where it is.

Discusting the fund should be handed to a missing children charity immediatly and any blood money they have made should be handed over as well.

God Bless Madeleine she may be the worlds most well known missing child but it has not helped her at all and the Adults that should have let her down in the most discusting way.

ta ra said...

Honest Joe,
I agree with every word you write. Clever game being played, eh? Looks like the cleverest were the ones who said the least; the fools are the ones who said the most.

24/7, this game is tougher than PR pimps (often failed or tired/quitter journalists) could ever measure up to.

Rely on it. This is not over until it's over. It's not over yet, not by a country mile.

'They' lack the skill, and the stamina. It's only their vanity that vaulted them into PR, and fed their illusion that they were anything other than hired hands, cheap mouth pieces; tarts, available to the highest bidder.

Just my opinion ;-)

hope4truth said...

Yes a team effort and sadly I am on the right team. I say sadly as nothing would please me more for her to be alive well and happy but I am sure that is not the case.

I dont go on about this in my day to day life but many people pick up what is going on and from the bits they hear do not make positive comments about the McCanns.

The crying story went down like a ton of bricks and IMHO made them look even worse than they did already.

G'night Hope.

Yes, the media know the tide is turning. The waters are choppy now. The incoming tide cannot be stopped. It just takes time.

Re: the neglect issue raised on forums, and dismissed, disputed, downplayed, and ridiculed by the McCann Machine of media manipulators.

Take a closer look at the PJ 'fall back position'; it's all about neglect, abandonment.

That is why the McCann Machine of media manipulators pounced on anyone raising the neglect issue; it is their weakest link; the one issue that is most likely to lead to criminal charge, and conviction.

They thought they merely had to create doubt in the public mind about other issues. They knew the neglect issue was the most dangerous for them, I think.

So it should be the most serious issue. Neglect is an early warning sign of other, more serious motives, and actions if it is undetected or unpunished. History/precedent tells us this is true. It's fact, not opinion.

Sleep well.
xo
leigh

Joe said...

The irony of the neglect issue for the McCanns is that they positively promoted the fact that they left their children alone, the real motive IMO being (as has been said countless times by posters) so as to create a scenario in the public perception where an abductor had opportunity to abduct Madeline. In reality it is this very neglect that may come back to bite them.

ta ra said...

Honest Joe.
True. Sad for Madeleine, but true. No point being sentimental at this point.

Only tough minds aided by tender hearts can resolve this case; only that type of person will persevere, imo.

ta ra said...

P.S. Joe.

Yes, the PJ and others continue to investigate more serious crimes, but it is the neglect issue that underpins their case, and it's a good enough 'fall back' position, in my opinion.

More than good enough. Claims that it is 'within the bounds of responsible parenting' to leave infants alone undermines decades of hard work, honest work, sincere belief by child protection agencies who every day, every week, every year toil ceaselessly to rescue neglected, and abused children; the forgotten children; the children too poor, too tired, too unwell to be worth something of value to this spoilt, hedonistic, adult indulgent UK.
Just my opinion.
