WATCH THIS VIDEO OF KATE AND GERRY INSIDE THE STRASBOURG PARLIAMENT. He denies they neglected or abandoned the children and quite astonishingly states YOU ARE GOING OVER OLD GROUND, IT IS REALLY QUITE BORING! Thanks very much to Di, LGC and others for drawing this to my attention! If he is going to put himself before educated people in a parliament then he is going to have to accept they are going to ask educated questions, demanding to know why he is there, and just how sincere he actually is about childrens' rights.

Hi All

We now have an article in The Times that confirms the McCanns will get access to all evidence against them in July and after that it will be opened up to the public and the press, so we can all see what the case against them involves. It does sound as though the investigation will continue. This is to be welcomed. Moving forward at last and all the speculation will no longer be necessary. If Murat is innocent we will of course find this out to or judge for ourselves from what we see. The disclosure of the details will certainly make an interesting read! I think it is only the McCanns who had something to hide!

Kate and Gerry McCann to be told why police made them suspects in disappearance of Maddy

Madeleine McCann’s parents will be told next month what evidence the police have to make them official suspects in her disappearance, it was announced today.

Portuguese Attorney-General, Fernando Jose Pinto Monteiro said Kate and Gerry McCann will be given full access to the case files relating to their daughter’s disappearance last May.

The police inquiry into Madeleine’s disappearance shortly before her fourth birthday covers homicide, abandonment, concealment of a corpse and abduction. All evidence in the investigation has until now been covered by strict laws of judicial secrecy.

However, Mr Monteiro told the 24 Horas newspaper today: “In July, the process stops being covered by the judicial secrecy."

This will mean that the thousands of pages of witness statements and other evidence will be made available to the McCanns and their lawyers before being opened to the press and public

Mr Monteiro said that the disclosure of the evidence would not affect the ongoing investigations or possibility of changes.

“We won't rest until the child is found,” he said. “The fact that the judicial secrecy is lifted has nothing to do with the development of the investigations.”

The opening of the files will be welcomed by Mr and Mrs McCann, from Rothley, Leicestershire. They have insisted there is absolutely no evidence against them and the police should concentrate their investigation on stranger abduction.

Mr and Mrs McCann were dining with a group of British friends at a tapas restaurant on the Ocean Club resort in Praia da Luz when Madeleine was reported missing from her bedroom.

The couple, from Rothley, Leicestershire, hope the release of the files will lead to the lifting of their status as arguidos (official suspects) imposed last September. Robert Murat, 34, the other official suspect, will also have access to the evidence which he hopes will clear his name.

However, the release of the information could be delayed for several weeks as Portuguese judiciary starts a month-long holiday in the middle of July.

The announcement came as Mr and Mrs McCann embarked on a series of meetings with MEPs in Strasbourg in a renewed effort to secure backing for a Europe-wide child abduction alert system.

The couple have until July 24 - the close of the plenary session - to collect the signatures needed to ensure that their proposal, in the form of a written declaration, is sent to the EU President and published.

They have chalked up 225 signatures so far, leaving them another 168 to collect.

Mr McCann said: “This is an important issue and Europe needs to work together. We want to get as many signatures as possible but there’s limited time left.”

The couple launched the drive for a United States-style Amber Alert in April, but now fear time is running out in their bid to achieve formal recognition of the scheme.

Such a declaration carries no legal weight in the European Union but the McCanns believe it would help them win the moral argument over whether such a cross-border system is needed.

The couple believe a European version of Amber Alert - which notifies the public via media across the US when police confirm a child has been abducted - would have helped the search for their daughter in the crucial hours after her disappearance.

Well how fantastic the McCann's must be thrilled this is what they want isnt it??? Get all the evidence in the public domain CM can spin it (well he can try)...

If only half of all we have heard is true then any public sympathy will vanish. I told someone I know about the Crying the night before she went missing and she said no they wouldent have left her again if that were true and then Kate tells the world that is exactly what they did (lady was never a huge fan of theirs but has no time at all for them now)..

Madeleine may finaly get the justice she deserves and maybe people who have shouted bullied and been vile may finaly realise that a 3 year old child deserves to be cherished loved and cared for not left alone in tears night after night and then vanish with no questions asked (well only the questions the McCann's want to answer may be asked if you try and ask them anything at a police station forget it)...

God Bless this child and may people pull their heads out of the sand and start to put children first Neglect is not something to be proud of it is apaling that anyone should neglect children but for parents who are Doctors to do this and try and play the naive card is even worse.

I am afraid she thinks that if she puts the word abduction first it will clear them of any wrongdoing.

Problem is if the PJ have DNA evidnce from the apartment from a dead body it means that she was not abducted but killed in the apartment.

Abducted trough the window with the tampered shutters that were not tampered with from a locked room that er actually wasnt locked.

Crying for her parents on the 2nd May is a silly thing for a child to do poor Kate had to think about taking them out with her but in the end thought NO leave them alone this is our time...

Well it must have come as a great shock to the McCanns that any evidence has been collected against them. How could there be evidence against THEM as the abductor took Madeline? I am surprised that they have not had the Pink clown asking "evidence", "ludicrous, what evidence could there possibly be?"
Are they prepared for the world to know all the little inconsistencies
that have been peddled? It will be a different ball game now after the disclosure of the files for them to keep a lid on the media and it all spinning out of control, even if no charges are proffered. All IMO only.

Well it might be old ground Gerry but you have to face up to the fact that there are many, many people who think you and Kate should face charges of child neglect; whether you like it or not, that is fact!

And the Amber Alert system would have made no difference at all if Madeleine had gone walk about in PdeL that night (remember she walked in her sleep sometimes) and fallen into the pool or suffered another fatal accident. Likewise either of the twins could have been taken ill. the McCanns are simply trying to close the stable door after the horse has bolted.

Of course, all sensible people would want the Amber Alert system to become law to protect vulnerable children, but the McCanns and anyone else who neglect children shouldn't be representing the UK in my opinion.

It might be boring old ground to McCann, but in reality the questions remain unanswered. Stay away from the spin, not good at it would be my advice as he comes across as aggressive and unconvincing. He would be better off sorting out his daughter's whereabouts than getting involved in a scheme that he KNOWS NOTHING about and is using as a PR ploy to cast him and Dr. Kate in a good light. Care for your own first before to start to dish out advice.

So let me get this right Mum 21 does not like the order of the offences the McCanns are being investigated for as quoted in The Times, well she better have a row with them about it then, but no matter which order, they are the same offences and I think the most accurate version is as per the Order of the Portuguese Judge..kidnapping, homicide, abandonment, concealment of a corpse, if I remember right. Some people like to think they are making a point when there isn't one, but perhaps the point is kidnapping was the first offence to be investigated (Murat). Some reports have also suggested the offences of kidnapping and homicide are linked, that is very sinister and would most certainly suggest murder as I have previously stated. However, I think it is unlikely, again, as I have previously stated, Claudia pointed out there is no substance in the claims made by the Portuguese taxi driver.

It seems very clear to me the police know full well that Madeleine died in that apartment, not just because of forensic evidence but because they bugged McCanns calls and emails. The only trouble is although they therefore know for a fact the McCanns killed Madeleine they cannot use this in evidence in court because the judge will not allow retrospective consent. So they have to find other evidence, but given what they know they are most certainly not going to ever release the McCanns arguido status and I believe from the comment above, charges are likely in the foreseeable future.

As Claudia says, I can now see the sequence, there will be nothing to preclude Goncalo from writing his book because all the evidence will be in the public domain anyway, but his book will give us his take on the whole situation, as he sees the evidence, which will be very interesting indeed because if there is one person who is going to know it is him! By the time Rebelo took over the McCanns had done a runner. This is why Rebelo has had to consult with Goncalo such a lot for the personal input he can give having been in charge of the investigation whilst the McCanns were actually there.

Its just that all along our Portuguese posters said that the PJ need to have all the facts first. I am a little confused here. Also why is it mentioned in one of the papers that the McCanns lawyers need to prepare a defence. Why if they are innocent?

I do not profess to understand Portuguese law and it is true to say that in UK there is no way on earth a whole criminal case file would get released in this way.

However, I am certainly not criticising the way the Portuguese do things. It actually makes complete sense to me. Whilst the investigation is under way, there is complete secrecy so the police can get on with their work without hindrance and this was particularly important with someone as interfering and manipulative as Gerry McCann. Having had this period of secrecy the whole process is then open to scrutiny and is therefore open and transparent enabling people to judge for themselves. That way neither the police nor defendants can hide anything at all and there is a lot to be said for that. Once a case actually gets to court in UK, nothing is confidential anymore anyway, the whole point of a criminal trial is that it is public. This is intended to be a safeguard to the accused that he is not being tried behind closed doors without the public knowing what is going on, so the State cannot behave in an oppressive way. There are quasi criminal trials that do go on behind closed doors in the UK and our government are actively seeking to increase this, e.g. just holding suspected terrorists without charge etc. Holding immigrants in centres which are very close to being prison establishments again without any charges, just a suspicion or maybe not even that!

In a criminal case in UK there is protection afforded for judges and witnesses in certain cases where it is felt they may be in danger. Obviously judges home addresses etc. are kept confidential, jurors are protected and witnesses names and addresses may be kept from the public to prevent them from being intimidated or worse. The McCanns clearly have attempted to interfere with witnesses by setting up their most recent hotline asking for anyone connected to the case to get in touch.

Having gone on at some length I feel the only thing the PJ may not release is personal information about prosecution witnesses that may put them in fear of intimidation, for their own protection.

The above report and others states that the release of the police file will not impede the ongoing investigation. This clearly implies that the file they have to date is being released in accordance with the normal rules for disclosure to the defendants and their lawyers so that they can start preparing their defence. The report also states it will not interfere with possible charges to be brought.

Therefore it can be taken from this the McCanns are to see what has already been amassed against them so that they can start to prepare their defence but there is further investigative work which will continue against them. When you consider the extent of the criminality, the false sightings, the fraud, which is truly international, this is hardly surprising, it would represent a positively vast amount of police work. Both teams in the UK and Portugal are relatively small to cope with all of this and it is going to take time, I am sure.

I would struggle to think how the McCanns can properly be brought to court really until all of this has been investigated because it will go to that vital homicide charge, was it premeditated and planned (murder) or was it a loss of control at the time or negligence. If it was a loss of control at the time, very careful consideration has to be given as to whether that was murder or manslaughter, if it was negligence, then it is manslaughter. In short they have to look at the state of mind of the McCanns. What I see in Gerry McCann is somewhat who is very cold and calculating. What the police seem to see in Kate McCann is a woman who was not coping with her children and losing her temper etc. Again, careful considerations would have to be made, depending on all the evidence at to the appropriate charge. Very often in UK when parents just lose it and hit a child but genuinely did not mean to cause them serious harm, the charge will be manslaughter nor murder. It could be a very different matter where drugs have been deliberately administered, unless they were prescribed.

Just reading back - Nancy's point..we would all want Amber Alert to be brought in to protect children. The thing is the EU have been considering this Scheme for years and there are many reasons why it does not protect children. It involves the police in rushing to put cross border procedures into place, but so often children have not crossed any borders and whilst the police are rushing to do this they are wasting precious time looking for the child. We should not forget the tragedy that happened in Greece, the police rushed around putting out an Amber Alert, whilst those two little boys starved to death, trapped in a lift, right on the doorstep. The vast majority of children who do go missing are missing because of their parents, either because they abused them or because one parent snatched the child from the other, I do not see Amber Alert as being a satisfactory solution to this problem. The McCanns themselves highlight what a waste of time it would have been in their own case. Time and again what we heard from Kate and Gerry McCann was a clear attempt to seriously waste police time, insisting they went and looked for Madeleine in Morocco etc. This was their agenda, get the police on a wild goose chase looking for Madeleine, and please, please stop looking at us!

The police have been looking for Madeleine's body and we all know for a fact that is all they are ever going to find and even that prospect is very remote.

There has been a real battle of wills going on between the police and Kate and Gerry McCann.

The police agenda is we are investigating you and we want to do a private reconstruction with all the available witnesses to aid the investigation. The McCann agenda is we are determined to continue to say that Madeleine was abducted and the only thing we are going to co-operate in is a media event, a Crimewatch style reconstruction that gets televised so that we can generate leads to prove that Madeleine was abducted. Generate leads like Gran Cooper the health worker who lives not too far from Gerry McCann and who saw nothing at all. A man walking on the beach in the rain who came and knocked her door asking for money for a charity, proving what exactly!! This is not generating reasonable doubt it is making the McCanns look like the desperate liars that they are who still believe that a media circus can somehow make them appear to be innocent, it has done exactly the opposite!

Picking up on last night's thread again, that people with high self esteem react aggressively when challenged, whoops Gerry just went and done it again, and of course Kate chirped in too! How very frustrating for them when they just want to move on and forget what they did to their own daughter..Kate cannot understand why people are talking about that again, well guess what Kate we are never going to shut up about it until you (and hubby) get put where you belong, so stop getting shirty about it! Mind you I do agree about a criminal on the run..(!) or two or three or four..

The parents of Madeleine McCann went to Strasbourg today, trying to get the support of more 182 MEPs, for a “written declaration” that appeals for a system similar to the American Amber alert to be set up in EU, but they only managed to get 15 more signatures and are far from the 393 needed.

During a Press Conference, Kate and Gerry McCann reacted with exasperation, when journalists questioned them about the fact that they left three children alone in an apartment, the night when Madeleine disappeared. “We didn't abandoned or neglected Madeleine. Somebody came in the apartment and took a child. Repeating that question is really annoying”, was the answer of Gerry McCann.

“The fundamental question is the fact that a child was kidnapped and there is a criminal on the run”, said Kate McCann. “We must concentrate in the fundamental question. It's not helpful to insist in raising the same subject. Nothing changed, in the last 14 months and I don't understand why we are talking about that, again.”

Just how are the McCanns going to fit in their holiday in between trying to canvass voters on the Amber Alert system?

Or has their holiday been shelved?

Talking about the Amber Alert campaign, why is it that not one person in the media, with the exception of perhaps Jon Gaunt, ever questioned the hyprocisy of the McCanns being chosen to represent the UK in Strasbourg and Brussels? After all they are suspects in the disappearance of Madeleine and if this had been any other couple, the media would have been on it like a ton of bricks!

Just why aren't the media questioning both the legality and logic of the MEP's decision on this?

It is most perplexing that if the PJ have significant evidence against the McCanns then why do the McCanns insist on pursuing an agenda that tries to distance themselves from all this, only to find themselves in the public eye at a press conference, like yesterday where they are always going to be asked about the case and then get ratty about it. Lay low is my advice and give us all a break from smokescreens.

They are trying to send out a defiant - 'we are responsible parents' message to the public but unfortunately they are only fooling themselves. They seem to be in complete denial that the disappearance of Madeleine could have had anything whatsoever to do with themselves. And getting involved in all these activities must be one way of avoiding facing up to their responsibilities.

Kate's assertion - "We know we are good parents" says it all really.

I wonder how they really feel when they are facing each other across the breakfast table after a restless night, which must be inevitable however much they try to deny it.

How could they sleep peacefully, even though Kate said she only slept badly for the first five nights or so. They would have to be hard as nails to do that in my opinion.

Yes they have nailed their colours to the mast, a sort of sickly yellow colour I do believe. Why the hell would they really care about Amber alert when they could and did nothing to assist the PJ. Everybody and his brother/sister searched for Madeline from day one, so any Amber alert would not now even come near to the effort the world put into looking for Madeline. So its all a red herring this amber alert done to save their reputations. Stay home and look after your children, how about that. Nobody but the sponger MEP's care and most of them do not know who the McCanns are probably. There may be a lot of red eggy faces one day but probably not as politicians always get out of it.

Do they really think that they can just sit there IMMUNE and their daughter missing, they prime suspects and all the unanswered questions that remain over their missing daughter, and then expect the media to just ask them about their amber alert? It makes you wonder why they got themselves locked into this Amber Alert campaign in the first place. Could it have been to try and get the focus of attention away from what they did; in other words make themselves look like a couple of saints in the eyes of the public!!
If so, I think it has backfired, by the questions obviously asked by the EEC members in the hall at Strasbourg.

The majority of parents losing a child as they have described would have just wanted to search for their own daughter until there were no stones left unturned, co-operated with the PJ's and never left Portugal until they had searched the complete area of PdeL.

So, Gerry, you believe you really don't have a case to answer, then?

And, ergo, that everyone is well within the boundaries of attentive parenting if they go out for hours and get drunk while their tiny offspring are left totally on their own?

So could you define the terms 'conscience', and 'duty of care' for me, please? And whilst you're at it, how about 'responsible parenting', 'compassion' and self-denial'.

Oh go on then, what about 'smug', 'selfish' and 'git'.

He finds it boring, she thinks people are avoiding the issue.

Well I find it quite boring in fact I find both your attitudes towards the neglect you subjected to your daughter and her siblings on their family holiday repugnant. I also find your avoidance of the issue repugnant. It is time that the UK press started asking you two proper questions. The idea of both of you as figure heads for a safety alert for missing children in Europe is morally repugnant to me. I wonder if your little daughter is bored. Seeing you two child neglectors, hearing your sick spin fills me with repugnance.

Some very interesting posts.

The quote I got is that Gerry said it was annoying to be asked these questions, not boring, unless there are two.

Annoying to me is more his style and fits with his wish to completely deny they did anything wrong. The way he refers to the children in such a dispassionate way is very telling also I think.

Their behaviour is completely self-serving. They insist they want to find Madeleine and yet they keep leaving the twins to pursue some political agenda they feel could score them points and clearly would do nothing at all to find her. What has happened to Hogan International and Metodo 3, what of their new hotline, why don't they announce how the search is progressing. I am afraid we all know the answer to that.

They behave exactly the way desperate criminals always behave, in complete denial. Gerry has always wanted to set the agenda with the media and always reacts with anger when they have the temerity to ask him relevant questions. He just cannot cope with being challenged and I do agree it is a great pity our press have not been able to do this. Watching some of the interviews where they just play along with the McCann's agenda, blissfully ignoring their prime suspect status is quite sickening.

If they wanted to demonstrate they are good parents who don't they just get their heads down and be with the twins instead of keep leaving them, just like they did immediately disappeared, dumping them in the creche ever day and then jetting off on a publicity stunt to make them look religious and good. Given the twins lost Madeleine what must have been going through their little heads to not even have Kate and Gerry either. Did they look like they cared about any children they have, of course not! What has happened about this so called holiday for the twins, which I just do not know how they had the cheek to announce!

Again, I think it is about failure to accept responsibility and acting in complete denial. Criminals will always seek to distance themselves from what they did and minimise it.

To say one of the other twins is a way to avoid actually saying Sean was crying, his little boy, aged two, left on his own with his 3 year old sister as a babysitter who, not surprisingly reacted by also crying. Poor little angels who have parents who cannot face what they did to them.

Just 2 points:
1. The announcement about lifting secrecy of justice is in my view a clever maneuver coinciding with Macs trip. It is done without obligation to fulfill, it gives no indication about what really achieved in investigation. It could be read as some hope for McCanns (no charge mentioned, strength of case undermined..., arguido status may be lifted...). BUT it is not!
It is deployed before tactic - confuse them, so they will not make drastic steps, but will make steps - and watch.
No wonder Clary was so annoyed at it: nothing was given out - and he tried so hard with his holidays announcements.

Secrecy would be lifted only after charges are brought AND only after certain measures taken to protect witnesses AND more likely after arrest as the case is serious crime (not pocket lifting). No one could expect arrest to be announced... 6 in the morning: bang, bang, bang in the door.
Then they will have access to the files.

IF charged with neglect they will not have access to the evidence of murder, only neglect.

Well but Amaral will have his chance to publish the truth!

Europe consists of separate countries with controlled borders.

Hiya BT and good to see you back too. I wholeheartedly support what you say. Loving parents who maybe do not have a lot of money take their children on holiday in tents even, my ex husband and I did that and we never lost one of them! We used to go on holiday with other relatives or friends and liked to have a drink and a laugh at night. That we did, right outside the tent! This is what it is all about I think, a couple who just did not want to include their children in the holiday and look after them, all they cared about was themselves and as Gerry has even said on his blog, having time on their own. You can get that at night when the children are asleep but it does not mean you just clear off and leave them!

I also wholeheartedly support what you say about the outrage we feel at the accusation Portuguese Police did not look for Madeleine. What we saw on the media was the most massive search, on foot, on horseback, by helicopter etc. People gave up their holiday to look, locals frantically gave up their time to look, meanwhile Kate and Gerry sat in their apartment plotting their next move. Kate freely admitted they did not bother to look in their first interview with Jane Hill, which was so shocking and revealing there is a thread devoted to it on this blog. They gave themselves away immediatley by not even pretending to look, no Gerry was too busy timing how long it took them to jog to the top of a cliff. Words really fail to describe this. There is no way on earth they could have known she was abducted given what they claim and they should have been looking for her, just like any normal parent would, but they knew there was no point.

Nancy, I would like to give that reporter a medal ;-) Seriously, though, as you point out, saying "the child" is very odd. It sounds to me like "the child" has become a bit of a pain in the a**e to them. Well, "the child" has caused them all this trouble, hasn't she? I mean, they are now facing charges and all the poor souls did was nip out for a few wee drams and left their kids alone. Totally normal parenting! Not neglectful at all eh? How dare "the child" bring all this to their doorsteps!

It's kind of like the way I would talk about my computer when it starts playing up. Not one of my dearly beloved family members. Gerry digs him self an ever deeper hole with every sentence he utters, IMHO.

I won't get involved in the discussion on amber alert and the McCanns involvement in the process, as it makes me so bloody angry that these two are holding themselves up as a paragon of virtue in the parenting stakes, that I fear I may swear quite a lot! aaaarggh! ***@&&%$$@@*!!!*

Thanks for the very helpful post flagging up the clear difference between an amber alert system in the US, inter-state and the very different situation across sprawling Europe, the clear blue water etc. a different scenario altogether and one no one else has pointed out so far, so this is very helpful.

I would expect a lawyer to use a carefully selected word such as the child which would not cause offence, I still see Madeleine very much as a child who had rights and to me those do not end, in death. This is certainly the way the law looks at it, hence people got prosecuted for murder etc. Victims rights have to be supported by the law, the fact that they died, does not change that.

It's what I thought but wasn't sure. I can understand that the terminology used needs to be delicate, so to speak, so as not to offend. I also wondered if they were legally bound to use "child" since the case is not yet over and nothing yet has ben proven in court. Alas, my legal knowledge is very lacking!

What is interesting is that Gerry is not quite so delicate in HIS terminology "find the body..." ! Good job the Portuguese judicial system know their manners and, IMO, have just put Gerry's right where they belong - in the gutter.

Gerry McCann certainly does seem to see himself as a budding politician. It is like it says in the academic thread I posted really, isn't it? He has an over-inflated ego and just cannot accept constructive criticism and feedback. He reacts with hostility and aggression. His own over-inflated ego and inability to control his temper when he is challenged is his undoing. He just keeps trying and it just develops ever deeper into the realms of pure farce. I suspect Kate is just too fearful to try and tell him, but the looks she gives him say it all!

We've certainly had loads of support and that's given us strength and its been able to make us focus really so we have actually, in our own way, it might not be physically searching but we've been working really hard and doing absolutely everything we can really to get Madeleine back."

In short er ummm ah, we did not bother! but an Amber Alert would have raised awareness that people needed to be looking for Madeleine, it does not get much more perverse than that, does it!. As Jane Hill said people were giving up all of their time to look for someone else's child, the parents of whom, just could not be bothered. Waste of time, "they have taken her". Yes, sure, Kate, we believe you, the police are just awful..spiteful, wicked people, you are a lovely, lovely mum!

Very good point about the Amber Alert system being used in the States as short cut for inter states police forces - a whole different scenario to the use of the system in Europe. Something I must admit I hadn't thought about.
So quite likely all those MEP's who have decided not to back the system obviously see things along the same lines as you do I should think.

He and his lapdogs say that we who do not accept their parenting style (imo, neglect) and do not believe their abductor story are nutters.

They go to Strasbourg with the same up their own a***es attitude:

What about their complete lack of understanding that you do not leave 3 little children aged 3 and under alone in a flat an go out for wine and dinner with friends just because they as parents felt it was safe. When one disappears in those circumstances expect to be criticized and most importantly held accountable. Oh thats right it is boring and avoiding the issue, eh.

Zodiac, their comments about an intruder disturbing the children the night before is plain rubbish and probably their most "squirmy" excuse yet. I can understand how you are so sick of it.
As scientists they should be familiar with Occam's razor, in which the simplest explanation with the fewest assumptions is usually the correct one.

In this instance, the reason why Maddie awoke crying was because her parents abandoned her and the twins and she was alone and afraid.
Seems to me they do have the intelligence to realise this but what makes me angry is that they assume that their lies fool the rest of world because WE don't know this. How conceited is that?!

And I am serious: they were just drunk. If Last photo is fake (I think it is), it shows "the day after" Gerry in full - typical hangover face. Poor Amily is after crying a lot: swollen nose, bitten lips and puffy eyes (looks as if she was ordered to stop crying and take a photo). Poor thing.


Re: Payne. He says it after McCanns were declared arguidos in Madeleine's death.
I think he new that McCann lied, but did not know and could not think of their involvement. He was expecting something else (like drugging children or neglect accusations, but not involvement in death and concealment). By we I think he meant his family.

When we last came to European Parliament Brussels in April, we launched a written declaration seeking to gain support of majority of MEP’s introduction of a Europe wide missing child alert system.

A structure we feel is absolutely vital if no other families are to go through the pain we have suffered and continue to suffer since Madeleine’s abduction nearly 14 months ago.

Our visit today at the plenary session here in Strasbourg has been extremely useful and very encouraging. Both in terms of being updated on the good progress of the declaration, and having the chance to lobby directly many of those MEP’s who have yet to sign it

Whilst we remain confident that the declaration will have been signed by the deadline at the end of next month we have also learned that we still have much to do to increase awareness among MEP’s before then

We wish to thank the 226 MEPS who have already put their names to the proposal. Each and everyone of them is directly helping to protect children throughout Europe

We also wish to thank the leaders of those key political groups within the Parliament of whom we were fortunate enough to be able to meet today.

Many MEP’s have told us directly that will be signing the declaration by the end of the next session And that crucially they will also be urging many of their political and national colleagues to do the same

This gives us great confidence that the target of 393 signatures is achievable.

We were however also surprised to learn that some MEP’s remain unaware of the declaration and its aim of improving child welfare, despite the international publicity that surrounded it.

Here in France there is a missing child alert system but in the handful of cases it has been used over the last 2 years it has been completely successful

We also understand that the French government may encourage the adoption of this system across Europe during their forthcoming Presidency.

Portuguese television reporter: During this stay in the European Parliament, who has received you, who have you visited, have you been to political groups for example?

Clarence Mitchell: I think Edward McMillan Scott will answer that.

Edward McMillan Scott: The purpose of today’s visit was primarily to thank those Members of the European Parliament who have already signed the declaration and to ask them to encourage others to sign so that we reach the figure of beyond 393 by the end of the period on 24 July.

Today Kate and Gerry met a number of individual MEPs about 40 or 50 altogether, including the leaders of some of the larger groups of the European Parliament and some of the larger delegations. So we hope that personal contact will encourage them and their groups to support the declaration. I think part of the problem, as Kate said, is the a lack of awareness of first of all, the importance of the missing child alert system in America, and here in France, and its value in saving lives, and the fact that it costs nothing.

But there is also a declaration fatigue there are now 41 declarations in the European Parliament open for signature Last year out of 116 only 41 succeeded in being adopted as a resolution of the European Parliament So it is a challenge and I’m incredibly grateful to Kate and Gerry for taking the time to come here today so that out of the their personal tragedy some good may come. And to pass on that message to the number of colleagues we have seen.

German Press Agency: Mrs McCann if such a missing child alert system had been in place when your daughter disappeared, in what way do you feel it could have helped?

Kate: I mean, it’s very difficult to answer that question to say whether it would have helped to recover Madeleine definitely or not. I believe it would have given us a greater chance. I think the awareness early on in the critical hours would have been greater and hence I think there would have been more help from the public at that crucial time and potentially Madeleine may have been retrieved. We will never know. But it is a possibility. Yes.

Another Portuguese reporter: Mrs McCann, you said that if the system had existed it would have been easier to have found Madeleine within the first few hours.

It was difficult in the first few hours because Madeleine was alone in the house. Don’t you think that this was perhaps abandonment?

Kate: I think perhaps you are avoiding the issue to be honest. Madeleine was not alone for a few hours. And I didn’t say it would have been easier I just think our chances would have been greater of Madeleine being recovered.

I think the issue here is that a child has been abducted and there is a criminal out there, who is still out there.

I think we need to concentrate on the real issue here. It doesn’t help by going over issues that you have just raised.

Portuguese Reporter again: You didn’t answer the first question, which was, it could be that the Portuguese police will take you up for abandonment or negligence which is something that comes that under the Portuguese criminal code.

Gerry: You know, we didn’t abandon, neglect Madeleine. As Kate has already said, somebody went into an apartment and stole a child. That’s where the focus is.

You are going over old ground. It’s really quite boring and we want people to focus on issues which we think will make a difference. The amber alert would make a difference. It can be a deterrent. It can help to find a missing child.

We need cross-border cooperation.

Kate: Also, nothing has changed in the last 14 months. I am not really, you know, sure why we are talking about this now because nothing has changed on that issue in the last 14 months.

Clarence: Kate and Gerry are not accused of any crime whatsoever.
Neither is there any suggestion that any charges are being considered.

I am sure it was a very difficult questtion for Kate to answer as to whether an Amber Alert could have helped find Madeleine!!

This comment is particularly irksome to me, given she sat in her room, phoning friends and her mother asking for a priest, meanwhile the public and the police were looking for Madeleine!

Or, as the Portuguese reporter mentioned did she mean the first few hours whilst they were getting pissed? She is right though when she says nothing has changed in the last fourteen months, recovering Madeleine is just as hopeless now as it was then!

Somehow she always manages to rub people up the wrong away, the public are lacking in awareness, they were not helpful enough and so are the MEP's, that is what Kate told them, I am sure that will help to make up their minds. I wonder how the people in PDL who frantically searched for little Madeleine feel about her crass remarks, knowing as they do, she did not get off her backside and look at all? Did Clarence forget to warn Gerry not to say anything at all, I wonder, " you are boring me keep going on about it....(!!)" He might as well have followed it with "now why don't you just shut up and listen to me".

Kate and I had a flying visit to Strasbourg yesterday to the European Parliament. The visit was organised by one of the written declaration sponsors, Edward McMillan-Scott who is a Vice-President of the parliament.

It was hectic schedule but well worth effort. We met with the other sponsors, many MEP’s who have signed the declaration and many who did not realise that there was a declaration on the introduction of an EU wide Amber alert. As we stated when we launched the declaration in Brussels last month- the alert is not our idea. It already has the support of the European commission and they and other groups such as Missing Children Europe, PACT and Missing People have done a huge amount of work previously. Our hope is that getting the declaration formally adopted by the parliament will speed up the implementation of alerts throughout the EU member staets and facilitate cross-border cooperation. Many of the MEP’s who have not signed said they will and a lot of those who have already signed said they will lobby their National and fellow group MEP’s to sign.

Today we heard that 283 have now signed the declaration compared to 211 on Monday. We are hopeful that the additional 110 signatures required will be achieved by the next sitting of parliament on the 7-10th July. It would be a great shame if the declaration failed because of a combination of ignorance and apathy.

Just popping in briefly - I’ve just read your excellent article but I am now confused. Mr Monteiro says disclosure of evidence to the Mc’s and their lawyers in July, however the investigation is continuing and there is still a possibility of charges.

To disclose evidence to the two prime suspects and their lawyers before charges are brought must mean the McCann’s arguidos status will be dropped. Evidence isn’t given to suspects until they are charged or their arguido status is removed. Surely this also means at this point there isn’t enough evidence to charge the McCanns and achieve a successfully prosecution?

This is all bad news isn’t it? Surely this means the two guilty parties will get away with murder? There will be no justice for Madeleine? Monteiro’s statement reads to me like saving face for the pj. The McCanns lawyers will cherry pick the weak evidence for circulation and ignore the stronger evidence, likewise, the British press, which as we know is pro-McCann, will do the same. It will be a complete whitewash! Sorry to be so negative but that is how I’m reading this at the moment. I haven’t had an opportunity to read all of the posts on this article so I apologies if this has already been raised.

Watched the video from the link at top of the page and it is clear to me the McCann's do not want anyone to bring up the neglect issue which in Gerry's words is Boring.

What a slime ball he left his children along and says someone came in and removed Madeleine well Gerry they would not have done so if you had been where you should be and not out with your mates.

Once all the evidence is out in the open maybe they will shut up as anyone who thinks that they did no wrog that holiday will have the evidence to view.

If the McCann's set themselves up as the saviours of children god help the world these two did not give a damn about their childrens saftey and have gone out of the way to pass the buck from hour one of her so say being missing.

Boring is not a word I would use in the same sentance as Madeleine it has gone on for over a year but she was far from boring what 3 year old is? Gerry and Kate are negligent parents and that is the nicest way to describe their selfish actions.

I'll say what I've been saying all along. The truth will out even if it isn't the way most of us expect. However, if what they wish is that people stop questioning them, they are so wrong they don't even imagine. They will never have peace again. There will always be someone asking difficult questions, there will always be someone investigating on their own (I can't wait for the secrecy justice to be finished. Investigative journalists will have a field day and they have the advantage to be able to investigate using alternative channels, unlike the Police, and they can also escape all the burocracy and political interference), they will always have to live whith people's looks and stares, they will always be confronted with people's doubts and judgements on their parenting methods and other suspicions, they will always have to look over their shoulder because that's what people who have things to hide do. And they will have to live with themselves. When everything's dark and silent, they will have to be alone, with no other then themselves. And that will destroy them, bit by bit by bit.

The truth does not always come out as litigation and legal threats often stem the truth. Spin then can distort the truth.The McCanns have a team of lawyers and a spinning clown. So IMO anything that is published will be met with libel threats or injunctions, and failing that anything that is published will be used as evidence against trial ( impossible to get a fair trial argument) if one ever occurs.

I personally do not believe that they would be/are parading about Europe or that MEP's would entertain them with amber alert if they were facing serious charges. I do hope, as I have said countless times before that the truth does emerge one way or another. I am not optimistic though. Some people can compartmentalize tragedy or actions and never reflect or allow those actions to interfere in their lives. Whats done is done move on attitude. It will be jolly interesting to see what is what though, and the pink clown will even now be preparing for the date of the evidence going public and getting his pet press,TV stations and contacts to head off any possible contradictions that may be revealed. He will latch on to the weakest or ambiguous bits of evidence and spin spin ignoring anything that might be incriminating, and the press will print all his spin if the past year is anything to go by.

Mandarinn, I'm not sure if this is what we can call a conscience. But I do believe that people cannot escape themselves and what they do. I believe when they're alone, sorrounded by darkness and silence they cannot escape the fact that they lost Madeleine. That they left her for a meal and fun. That she is no longer between us. And that she was most likely alone when she left. I just hope she wasn't scared and that she didn't suffer. But I still believe they cannot and will not escape all this. And that is what will defeat them in the end. Their actions will destroy them.

As you know, Mandarinn, I do not believe Madeleine was killed. Not on purpose, I mean. I believe that everything that happened after May 3rd was damage control. Fuga para a frente, as we say in Portuguese. That is why I believe that things will eventually catch up with them. The universe is wise, very wise. And I predict a strong earthquake soon. Maybe not a judicial one. But one which will rock many people and many things. Let's see how the characters react to the effects of the earthquake. Some may even tremble themselves. And break.

I do agree with you whoeheartedly that once in the public domain journalists other than most those pathetic ones in the UK may start to dig into the background of this whole affair and not be restricted politically or procedurally as the PJ are. I hope it happens that way because there IS a massive story there buried beneath the spin and subterfuge IMO.

I read the announcement of opening up the files to mean the McCanns will continue to be investigated and there was a clear statement this would not preclude the bringing of charges against them. To me this clearly implies they need to investigate further. I do think if the evidence of the bugged conversations could have been used they would be in court much quicker and it is a great pity consent was not obtained from a judge at the time. My view is the fact this cannot be used is a great blow to the prosecution but they know from those conversations that Madeleine died in that apartment and so they will continue to investigate them. I also feel they already have overwhelming evidence the McCanns seriously and intentionally neglected their children and a decision could be taken to proceed with this charge alone, which would still bring them to justice. They have had this evidence certainly since last July when the Paynes confirmed they simply did not check their children but they were not prosecuted for this at the time because the police have always been investigating the more serious charges of homicide and concealment of the body and once a decision to charge is made the prosecution must bring their whole case to court. It was not an option to prosecute them for neglect and then prosecute them again. For this reason it may be they will still not charge them at present because they want to make more serious charges than child neglect.

I think the post from 3As is supposition dressed up as fact, we can have an opinion, as I do about what the police intend to do, but there is no way we can actually know, beyond the statement made.

24 Horas speaks of people being concerned about media meddling by the McCanns adopting a project already being considered, i.e. jumping in at the end of the process so they can claim the glory. This is planned and deliberate. They know that damning evidence is going to come out about them and they know they are going to continue to be investigated. So they wish to produce a political cous that paints them in a good light as defending the rights of children.

I am very concerned at the implication here that one of the greatest proponents is the wife of the Portuguese EU president Barrosa. I do not think I want to comment further on that!

I agree it's a setback that the mobile phone messages are being disallowed as evidence. However, the fact that they are being disallowed I think tells us that they must have contained something important to the case.

Di - thanks for the stress management blog - I have a son who is always stressed so I'll copy that and send it to him!

I must admit I have had the same thoughts, but bearing in mind many of the European MEP's didn't even bother to attend, judging by the amount of empty seats in Strasbourg, it seems to me that the McCanns are getting more backing from the British MEP's than from the other European countries involved, so perhaps their support is not so strong as they would have us believe.

Zodiac - thanks so much for the transcript of the Strasbourg Conference - really interesting and it was nice to see that some searching questions were asked by the Portugues media - didn't hear any British reporters ask a question, but maybe I missed that!

Kate and Gerry's answers when asked pertinent questions about Madeleine's supposed abduction (notice I didn't call her 'the child') must have made McMillan and CM cringe - no wonder she and Gerry have to use a spokesperson! Those listening at the Conference must have thought the same thing.

Irina - I think you are right about the photo, and about the McCanns having drunk too much that night to go and look for Madeleine - perhaps that's why they didn't call the police for 45 minutes - to give them time to sober up! A fat lot of good the Amber Alert system would have done with their delaying tactics!

And as for Kate saying that they didn't leave the children for a few hours - that's bunkum because they were out on five consecutive nights without their children so just how many hours is that? And on the night Madeleine disappeared they were out for more than a few hours - perhaps adding up is not her strong point!

If you add up how many parents and how many children and multiply that by five you get a damn sight more than a few hours - at least when I went to school!

Never mind I just wanted to say how lovely to have ICTOAN back with us, welcome.

Also, the Police know the McCanns killed Madeleine and they will never have their arguido status removed. Gerry is pursuing just what he said he would "an aggressive and high risk strategy". This case has always been difficult for the police but they will get there in the end and the McCanns will have to live with it in the meantime.

I am very much looking forward to release of the evidence but for most people we already know they are guilty.

Have a great evening. I had a lovely steak with my parents and then a look at mom's fab garden, on the way home saw a kestrel with her two babies nearby, being a great mom and then saw two tiny little muntjac deer. Came back to water my garden but it is freezing, so soon back in again.

Mum and dad are going on vacation. I always choose August because most people in Portugal take time off in August so it is easier to set things up when you go in groups.

Actually I have done two things today that I never thought I would do.

1) Realised how wrong I was for ever posting at viles .

2) Supported Germany at football. They have just beaten Portugal 3-2. Actually Portugal didn't look on form tonight, I hope they didn't have a 3 hour lunch break today.

I hadn't read that. There is currently a bit of a mess here and I also did not get it by e-mail.
It takes a bit more than a football match to put me in a bad mood. If two child neglecters who managed to lose their daughter while they were eating, drinking and laughing and who then did everything they could not to help the authorities don't put me in a bad mood, a football match certainly doesn't. And that poster forgets that I was born in Germany. I was obviously supporting my national team, but I know that right now many friends in Germany are happy. From now on I support both Holland and Germany. Both for emotional reasons! :-)
P.S: try not to be so demanding. Telling the time is not that easy for some people who have been subjected to a lobotomy gone terribly wrong! ;-)

Doc, I forgot to add that apart from Holland and Germany, now that Portugal is out I would also love to support England. Maybe next time they'll humour me and try a bit harder to be among the 16 better European National Teams. :-)

Well, Germany is only because I was born there and because there are people who I met there who I really miss. For the football alone, Holland is certainly the team to support. Great football and a great, great people. Incredible footballs fans who play really fair.

Doc, do you have any psychological background?
There's a thing that has always made me wonder. How can people say they are hurt and bullied by posts written by people they don't even know? Aren't all these people supposed to be adults? Does that happen to people who are especially vulnerable and alone? Don't people have a real life, with real friends, real relationships, real joys and real disappointments? Do they lack a backbone? This is a thing that has always confused me since DE times. I can understand that people expect or don't expect certain things from certain posters. I can even undertans being surprised or disappointed. But being hurt, crying and feeling intimidated as some people have claimed is beyond me.

Commiserations - but they've had a great run for their money! Great team! Great Ronaldo!!

As I'm English to the core though (with a dash of Spanish thrown in), I must say a few words of support for our team!! Get off your fat overpaid backsides, stop living the high life with the millions you all earn and get the World Cup back for us - or else!!!

I have just viewed the video link and in my mind it is absolute proof coming from their mouth that they are involved in Madeleine's disappearance.

Any normal parent who wasn't playing a legal game would instantly say soemthing like.. 'We are so sorry for leaving Madeleine and the children that night. etc etc ' and if one got ratty over the question you would say something like 'How many times can we say sorry'

BUT DEAR OLD GERRY deflects , says it was not negligent (he is thinking only here of the legal side) and says it is boring. Blimey I thought his 3yr old girl went missing.

AND FINALLY he talks again by dressing up opinions as facts. In the school literacy curriculum it teaches 8 and 9 yr olds to do this when writing a piece of persuasive writing. ie When you need to swindle or embellish your point of view.

I AM 100 per cent confident of my opinion on them and legally I am extremely confident the process will grab them and gently turn the screw until they are exposed.

I see Dianeh has taken up the truly horrific case of the children who were left to starve to death in Brisbane. That she does so is admirable, but I do find the following statement a little odd, coming as it does from a McCannfan:

"As to how much I care, I am crying as I write this. Children are a blessing and should be cherished. There is no shame in giving your children up if you cant (or wont ) look after them.. the shame comes in leaving them to die."

Absolutely right! When Madeleine first went missing I like the majority of others felt terribly sorry for the McCanns, but that feeling slowly evaporated after Kate refused to answer 40 of the PJ's questions, and they did a runner from Portugal as soon as they were made arguidos. Their 'we will leave no stone unturned to find our daughter' vow flew straight out of the window when they thought their safety was in question didn't it.

When the grandparents were in PdeL they should have sent the twins back with them and stayed until they had combed every single inch of PdeL personally. That any normal parent would have done! It could be they knew they wouldn't find poor Madeleine.

Did they knock on any doors - well yes, they knocked on the media doors and their powerful friends' doors straight away of course to get the scent off themselves.

And these people who are sycophants of the McCanns and their tapas pals should realise they are only encouraging other selfish parents to do exactly the same as they did and put other childrens' lives in danger. We've seen it happen a few times since Madeleine lost her childhood!

Pleased to hear that DianeH has been crying tears for the little children in Brisbane, but then why doesn't she cry some for Madeleine too! They rarely say how sad it is about Madeleine, but just rant and rave about everyone on here at every opportunity, which is every single post!! I'm surprised that anyone with an ounce of intelligence posts on there.

Why don't they put a few theories out about what actually happened to Madeleine instead of slagging off everyone on here.

There is none so blind as those who don't want to see and they are all blinkered when it comes to the innocence or guilt of the McCanns and won't even admit they were negligent in leaving their tiny children - so that says it all for me!!

And on a personal note, I see they made a false accusation against me, saying I was always suggesting the twins should be taken away from the McCanns. That's an utter porky because I've never ever suggested that!

What should be taken away is their freedom after their gross neglect of their children in PdeL, and their tapas pals with them!

You can say that again - I was weaned on football. We lived around the corner from West Ham Football grounds (when it was always near the top of the league) and both my father and brothers had trials and passed to play for them. The War stopped my father, and my brother chose to carry on with his career as a draughtsman, but football is certainly in my blood.

Love tennis and golf too and still manage the odd game, although I do more swimming,walking and dancing these days (now I'm getting past my sell by date)!!

I have often wondered why the McCanns set up a long term strategy as soon as Madeleine disappeared, and I see that Hawkeyes1 on the 3A's agrees with me!
On their thread No. 13157 the topic is LAWYERS FOR THE MCCANNS AND PROSECUTION - with reference to an army of top flight lawyers working on the McCann case.

His post included the words:

"Once the Madeleine Fund was set up as a Limited Company it was no longer just for a modest middle aged couple. In essence it became a Corporation, complete with it's own board of Directors. You only have to look at the commercial aspects of all the registered classes in the early Madeleine Fund Trademark application:

International law, Mutual Legal Assistance, trademarks, moneymaking schemes, private investigations, libel lawsuits, the Defence Lawyers only now start to make sense.

But additionally, the question that has been puzzled me: how did the McCanns know that Madeliene would NOT be found during the trademark filing period with the UK Intellectual Property Office in early to mid-May 2007? In it they had already revealed their future career plans.

If it was truly an abduction case then surely the million pound rewards being offered by their tycoon supporters would have ensured Madeleine's safe return before the end of May!!"
