'Hurtful' Madeleine book banned

Portuguese police are no longer actively investigating the case
A controversial book claiming Madeleine McCann is dead has been banned by a Portuguese judge, a spokesman for the missing girl's parents has said.
The Truth Of The Lie by ex-Portuguese policeman Goncalo Amaral had hampered the search and added to Kate and Gerry McCann's distress, the judge said.
Mr McCann told a press conference that the claims were "unforgivable".
Madeleine, of Rothley, Leicestershire, was three when she vanished from an Algarve holiday flat on 3 May 2007.
The judge at Lisbon's main civil court outlawed any further sales or publications of the book.

At a news conference in Leicestershire, Mr McCann said: "There's a lot of people in Portugal, who might have evidence, that believe Madeleine is dead.
"If people believe that they won't search for her and they won't come forward with information.
"I know for a fact people have been told Madeleine is dead. There is no evidence to support that and that is unforgivable."
Clarence Mitchell, the spokesman for Mr and Mrs McCann, said the couple were "absolutely delighted that the judge in Portugal has done the right thing by granting this injunction".
Mr Amaral has said he does not believe the McCanns' account that Madeleine was taken while they ate with friends in a nearby restaurant.
The injunction means Mr Amaral has to ensure all unsold copies of his book are removed from shops and warehouses or face a 1,000 euro-a-day (£877) fine.
It bans him from repeating any of his claims about the McCann family and applies to a TV programme he produced earlier this year.
Copyright for the book and film must also be passed to the McCanns' lawyer.
In May the McCanns said they were suing Mr Amaral for defamation over the "hurtful" book's "unfounded and grossly defamatory claims".
But Mr Amaral, who led the inquiry into Madeleine's disappearance but was removed from the case in October 2007, told Portuguese TV he would counter sue.
Mr Amaral had led the regional Policia Judiciaria (PJ) in Portimao until he was taken off the case after criticising British police.
Last month detectives hired by Madeleine's parents said they wanted to trace a "Victoria Beckham lookalike" with an Australian accent.
She is being sought because of comments she reportedly made to a British man who met her in Barcelona 72 hours after Madeleine went missing from Praia da Luz.

I have to say that when you look at the official PJ file, particularly the report of Martin Grime the handler of Eddie and Keela, together with the forensic reports there is absolutely no evidence that Madeleine died in the apartment and he was wrong to persist with this.

The Order the Portuguese Judge has made against him including having to remove all books across Europe or face a £1000 per day fine is draconian and cannot leave anyone in doubt as to the unlawful conduct of anyone writing such a book. As an ex police officer he really should have known better.

This does not change my view that the McCanns were involved in the disappearance of Madeleine, but it has to be said, precisely what they did with her remains a mystery and it is a relief to know that British Police are still investigating this case.

If the Portuguese Police had found any evidence at all to support the McCanns theory that Madeleine was the subject of an abduction by a stranger then they simply could not have shelved the investigation. In addition it was open to Gerry and Kate to appeal the decision to shelve it. But they chose not to do that, instead they employ a couple of hopeless private investigators who clearly do not have the logistics or the legal powers to properly investigate. It is a farce to generate satisfactory evidence to defend Kate and Gerry McCann by perpetuating a myth, Maddie was abducted by a stranger.

When shelving the case the Portuguese Attorney General had the specific option to officially clear Kate and Gerry McCann of any involvement in the disappearance of Madeleine, he chose NOT to do that. Neither have there been any denials by British Police of their involvement in her disappearance. I believe people should draw the obvious conclusions from that. I continue to believe it is more likely they were involved in her disappearance. A witness, Martin Smith will say that he is about 70 per certain the man he saw carrying a child who looked just like Madeleine was Gerry McCann who was heading in the direction of the beach. He alone must be pretty clear what he then did with her, I would say handed her over to someone on a boat.

In this instance, just as they did with the Daily Express the McCanns have demonstrated that they could not care less about supposedly being libelled by being accused of killing her. They waited until the deadline of 12 months to sue in the UK, to cash in with the maximum damages, a record half a million between them plus their costs.

Similarly they have casually sat back and waited for Goncalo Amaral to become a millionaire from his sales of books and film, then they pounce like the couple of serious money grabbers they are, saying they want a million.

Well it is not the first time we heard that is it, a long time ago we heard about their aspirations to even sue the Portuguese Police for that figure. I would estimate they have already grabbed about one and a half million pounds in libel damages and still they are not satisfied. Goncalo Amaral was not right, but he was nowhere near as wrong as these two and it is a disgrace to suggest he has personally caused Madeleine any harm at all. That honour belongs to her parents. The parents who caused her serious emotional harm two nights before she disappeared, again according to a reliable witness, the elderly Pamela Fenn, who says she heard Maddie become increasingly distraught as she cried Daddy, Daddy for one hour and fifteen minutes. So much for these so called checks every 30 minutes. There is nothing decent about this couple and they have absolutely nothing to be righteous about as they carry on with their sickening defence of themseles and money grabbing crusade. A crusade I have to say, Gerry McCann was intent upon from before Madeleine even disappeared.

The court decision stems from an injunction brought by Gerry and Kate McCann from Gonçalo Amaral. The couple's lawyer points out that this is just "the first phase of the action [proceedings].

The legal case against Blake, the spy when he had the audacity to write a book, the UK Attorney General went after the money he had made from it, (an account of profits which the McCanns now seek from Goncalo). Blake breached the Official Secrets Act, again that is relevant to Goncalo's conduct as a former police officer and he would have been charged in UK. :

Attorney General may have intervened in the case against Goncalo Amaral by the McCanns due to him stating he was going to publish the book here. I have no doubt UK would simply not allow that.

Gerry and Kate are pleased the book has been removed from sale it does not stop the fact the two of them have played an evil game with the life of a child they say is findable.

It is about time these discusting parents were held acountable for the damage they have caused to their little girl.

We hear all about how special she is and how the twins miss her and how Jaycee gives them hope.

If they are telling the truth this pair of scum have not helped the investigation once I am still waiting to hear from any of my very well travled friends of poster sightings (the fund said it had spend a fortune on posters where did they go?) I am still waiting for a detective agency to actually detect and Kate has still not answered 48 very simple questions for her child.

What is it about two selfish adults who go on a family holiday and do everything but act like a family? Children dumped all day in a creche (and the twins hurried back there a day or so after their sister was abducted while Mum and Dad go and see a Pope who cant help)and spend their evenings in a bar while leaving the children in an unlocked room (I think one of the excuses was in case of fire)...

These people should not be celebrated and protected they are the worse kind of parents.

I am watching GMTV and they are up in arms about children not being toilet trained and able to hold a knife and fork (unreal) but the parents cant be bothered with them and although the McCann's children may well have been able to do all these things they were neglected and their middle class parents could not be bothered.

Enough is enough if Madeleine was abducted then the McCann's are the most evil people in the world playing games with any chance of finding her the laughter on her 4th Birthday was discusting and the spin and waste of her fund is not acceptable.

If they killed her or she had an accident at least they are not adding to her suffering now...

Amaral is not at fault ok maybe the book should not have been writen but if they think that it will stop Madeleine being found I guess they have a point but they have never helped look for her and until Kate answers those questions and the pair of them take a lie detector test I will continue to belive they cant be so evil they dont want to save their child if she is really missing.

I will continue to belive something happend to end her life and in a sick way in my book this makes them less evil as they cant help her no matter what they do.

Gonçalo Amaral: 'I Will Not be Silenced"


Sandra Felgueiras (voice over) – The judge’s decision on a request for an injunction of secret character that had been filed by the McCanns arrived this morning. Starting at the moment when Gonçalo Amaral’s editor is notified, the sale of any books and videos that are still in stores will be forbidden. The editor has not been informed about this decision yet, but from what can be read, it is impeded from performing any new editions, and Gonçalo Amaral is strictly forbidden from making any comments that correspond with the parts of the book that defend the thesis that Madeleine died.

Gonçalo Amaral – What makes this worse is that they are trying to shut us up, but they won’t shut us up, that is for sure, and the book will be published in English, even more so because the conclusions that are in the book are in the process.

SF (voice over) – What is certain is that if Gonçalo Amaral and the editor do not obey the order, the court can condemn them to pay a fine of 1000 euro per day.

GA – It’s a very dangerous decision. It’s a decision that places the freedom of expression at stake. Let’s see what the political parties will say. They will certainly have to say something.

SF (voice over) – In Rothley, Kate and Gerry McCann rejoiced over the decision, even more so because it paves the way for a satisfactory outcome in the other civil action that they have filed in June against the former inspector, who was removed from the case and later abandoned the Polícia Judiciária. Over alleged moral damages, they demand compensation in the amount of one million and two thousand euro.

GA – What they want is to make money in order to pay for their house in Rothley, which is what they have been doing.

SF (voice over) – Gerry and Kate have not heard Gonçalo Amaral yet, but from England they assert that the most serious part is that the former inspector’s book damaged the search for Madeleine.

Influenced by this piece of news or not, the truth is that ‘The Truth about the Lie’ sold out in many Lisbon bookshops, this afternoon. This is almost a unique copy of a non-fiction book that became the most sold book during the entire year of 2008. 175 000 copies have been sold, and that is not counting with the editions that were translated for Spain, France, Italy, Denmark, the Netherlands and Germany. The adaptation of this book into a television documentary was watched by 2 209 000 people and became the single most watched television programme in Portugal, apart from football matches.

But is it the truth or a lie? This thesis from Gonçalo Amaral about the Madeleine McCann case has never been proved, and now, until an order to the contrary, it will have to be silenced.

I think this will make the public more curious about what exactly is in the book. They only have to do a quick search on the internet to find it, or is that the McCanns next step get all reference to the book removed from the internet, or they will sue.

The only thing they should ever rejoyce about is Madeleine being alive and unharmed they really dont see why more and more people think they killed their child.

I hope they give lots of interviews as they just cant help themselves and come accros as cold uncaring and tie themselves up in knots with their lies...

3 People asked me if I had read the book yesterday and I pointed them to the net. I dont spend my life outside of forums talking about this but people know I dont belive she was abducted (then neither do most of the people I work with or know socialy) and anyone who is unsure thinks the McCann's campaign is odd to say the least.

I wonder what would have brought Madeleine comfort and make her rejoyce? Perhaps a parent to be there when she woke up crying!

Are we to believe the book is only banned, although BBC are using the word halted, in Portugal, or is it the whole of Europe?

The legal team may well have astutely advised the McCanns' how best to silence Amaral and certainly when best. They waited until sales of the book had bought in enough personal collateral for Amaral to be worth being sued.

This speaks volumes, money being the most important factor. A secondary factor was silencing someone who dared to put forward another version of events in contradiction to theirs.

Madeleine is purported by the McCanns’ as the reason for the legal action. However, it is clear for anyone to see the timing of this action is a strong indicator Madeleine is far from their thoughts - monetary gain appears topmost.

Their legal advice might have been spot on but their marketing advice which has always been suspect gets it wrong again.

Has anyone in their marketing team considered the Streisand Effect and how this action will boost sales of the book creating a demand that was not there previously?

Perhaps I am selling them short and they did consider this arguing that higher sales would increase the payout on any civil action against the book they take.

Banning the book in Portugal after most perspective readers in that country have already purchased and read it means nothing.

The World is a big place and they have created a demand for this book in their actions - intentionally or not.

Deformation law in Britain is strange. As we know if someone says something about you that could affect your professional standing or income etc and you say it is untrue you can sue.

The person suing does not have to prove what is being said is untrue it is for the defendant to prove what they say is correct.

This law is a useful tool in black and white cases but seems unreasonable in grey areas. The McCann case is a grey area – there is no evidence to assume that an abduction took place.

The only reason an abduction theory comes to the fore, over other possibilities, is because the parents of MBM say they are not involved in any way.

As a high percentage of cases like this involve those closest to the child, therefore, is it right to stop people who suggest otherwise? As we know a good argument can be put forward for the parent’s involvement in this case.

Deformation laws in Britain will no doubt be reformed over the coming years – not before time imo.

So the McCanns' are in the process of suing Amaral for defomation.

Can’t Amaral counter sue?

The onus of responsibility to prove what is true is on the shoulders of the defendant.

Thus if he counter sues they would have to prove that what Amaral said is wrong and they can’t.

Therefore that’s defamation because his reputation and livelihood has been damaged by their remarks.

It's just not a one way argument.

hiya guys and thanks for some really good comments and Nanna Di, the report from the superb Ms Filgeiras (I give up trying to spell it correctly but admire her skills as a journalist enormously).

The terms of the Order, as reported there are interesting, Goncalo is not allowed to talk about the parts of the book that defend the thesis that Madeleine died. Well that seems to give him plenty of scope to talk about everything bar that. This does take the sting out of it to an extent because it seems to me that Gerry and Kate have not been able to object to the book in toto because much of it is factually correct, just the conclusion that it draws.

If I was Goncalo I think I would just focus on the other evidence, whilst of course taking great care not to upset the court. As the report confirms it just has to be said his thesis has never been proved to be correct. But given there are to be further hearings I am sure he will need to weigh very carefully whether it is in his best interests to comment further at all.

The book has been a sellout that is for sure and he has informed the world of his views. The McCanns simply cannot take that away from him.

It just has to be said they did act cynically waiting to cash in for the maximum amount of money. I think the suggestion they seek damages for Madeleine is positively obscene.

Wiz, I fear the McCanns have already won in that they have obtained a judgment from the court, where the Judge will have looked at the thesis of Goncalo and the evidence, or should I say lack of it. I think it is very clear cut, the Pt AG correctly summarised the situation in relation to the state of the evidence and he is the one that was qualified to give that opinion, not Goncalo.

Even as a senior police officer, he was going beyond his remit. His job was to investigate the case and obtain as much evidence as he could as to what happened and then present that to the legally qualified prosecutors for them to see whether that evidence could form the basis of any criminal charges. They decided that it clearly could not.

There is the evidence of Jane Tanner and the Smith family that they saw a man carrying Madeleine off, that is, by any definition, evidence of an abduction.

I think it would be more accurate to state there is no evidence of any intruder being in that apartment in the manner suggested by the McCanns, either the night before or that night, or any evidence of the window and shutter being forced open and someone climbing through.

In short, whilst there is evidence of Madeleine being abducted, there is no evidence of any stranger being involved. That was why the evidence of the TAPAS group as a whole was so key to the prosecution case. If Madeleine was abducted and no stranger was involved, then the TAPAS group were!

I do not think that Gerry McCann has ever been concerned about Madeleine because IMO he planned for her to disappear, and of the major motivating factors for that was to make a huge amount of money out of it.

That is precisely what he is doing, putting his plans into action to cash in following getting rid of Madeleine and informing the world of that to generate massive interest and of course CASH.

I do not believe the McCanns give two hoots about anyone saying they killed their daughter, because they know there is no evidence to prove that. Quite possibly, they are so confident because they know that is not what they did.

If the McCanns has any concern for the impact on their supposed search for the daughter they deliberately lost, they would not have waited until the time limit to sue the Daily Express had almost expired. They would have done what the PCC offered to do, got those articles stopped immediately.

The former director of the PCC confirmed on TV that when he suggested intervening Gerry McCann actually told him he did NOT WANT HIM TO. This just proves he wanted those killing theories to run because of the money he could make out of them. Waiting for Goncalo to make a huge amount of money before he did anything about it it another textbook example of just how much Gerry McCann cares about the search for his daughter or his reputation.

I believe Gerry deliberately fed those killing theories with the ridiculous tales about dirty nappies and how they were going to get an American expert to rubbish the dogs. In time I think people, more and more, will see what an evil, cynical, money grasping man he really is.

I also believe that Goncalo Amaral probably was losing his temper with UK cops because they were streets ahead of him and I am sure Rebelo is too. He had tunnel vision and was trying to build a case against Kate and Gerry for what they did not do.

Hiya Di, I think it is likely Maddie was got rid of alive because she was an abused and unwanted child that Gerry wanted to make a lot of money out of and he may still know where she is, alive. I would not be surprised if that is how he keeps Kate quiet, shut up or I will never bring her back. But I still do not rule out the possibility of her murder or manslaughter in the apartment. My clear impression is that this is not what the police believe happended to Madeleine.

Di - Congratlations on your new grandson I hope mother and baby are well.


My ealier comments about there being no evidence of an abductor.

The witness statements for an abduction are the suspect sighting by Jane Tanner and the Smith’s sighting.

Tanner cannot say she witnessed the abduction – what she says is she saw a man carrying a child in his arms. The child was wearing pink legging/trouser bottoms which could well have been pyjamas but even this is speculation.

If Tanner’s sighting is true then she may merely have seen a man carrying his sleeping child home.

The fact that this man has never come forward imo means Tanner either didn’t see anyone, did not see him at the time she says, the man did not wish to become involved or it could have been an abductor.

The Smith’s sighting we can confidently say did happen. They, like Tanner, witness a man carrying what appears to be a sleeping child. Later on Mr Smith says it thinks the man could well have been Gerry.

Again this is not evidence of an abduction it is a man carrying a sleeping child that could well be his own. The reason the man does not come forward and identify himself is he has nothing to do with the abduction but does not want to become involved, it was in fact Gerry or it was the abductor.

Both of these sightings are not likely to be abductions although Mr Smith attempts an identification of the man and there are fewer options on what was seen.

Someone somehow removed Madeleine from apartment 5A dead or alive – this we know for certain. I do not believe it was a stranger abduction as there was no forced entry and only an insider would know that the patio doors were left unlocked.

A burglar might attempt an entry this way on a chance that the doors might open but would they steel a child – imo no.

If it had of been one of the T9 why would the McCanns be so confident they were not involved this strongly suggests to me the Mcs know what happened. Of course one of the T9 could have been aiding and abetting who knows.

Madeleine’s pyjamas were pink but this is an extremely common colour for little girls to wear. So this factor imo is not that significant.

Neither of the two sightings are confirmation of an abduction and there is no further evidence to suggest a stranger abduction took place. Tanner’s sighting is the one the Mcs choose to believe simply because it puts them in the clear.

Sorry Wiz, but I think your suggestion this is not a number of witnesses witnessing the abduction sounds a bit like you are clutching at straws.

I can think of no good reason why the police would not have traced any other person carrying a child looking like Madeleine that night, neither can I think of any reason why an innocent person would not come forward to eliminate themselves. The Police interviewed everyone in the resort! That aside, it would be a bizarre coincidence if that was not Madeleine, given it looked just like her and her "father".

I entirely agree Tanner is not a credible witness and I think it is likely whatever she witnessed was later in the evening when she went to find out what the heck Russell was up to! I do not believe she made any checks at all, I believe the waiter who states only the men disappeared for anything up to 15 minutes at a time. Kate was either set up to make this discovery or she was fully compliant in what was going on, but given her reaction she is either a great actress or she was genuinely distraught even though knowing Gerry just got rid of Maddie. She just did not want to go on this holiday. Two years previously when Maddie was only two, Payne and Gerry were exchanging paedophile fantasies about Madeleine. The following year she did not go away with this group again, and of course she did not want to go on this occasion either. To me that makes it pretty clear what she was fearful of, the safety of Madeleine.

We of course agree and so do the police, there was no stranger abduction. That is why the case got shelved in Portugal, because if there had of been they could never have shelved this case, they would have been duty bound, and the McCanns would have been entitled to insist they keep on investigating. The fact the McCanns did not insist, again completely and utterly speaks for itself. How can they tell the Pt to keep looking for a strange abductor when the Pt Police know damn fine it was them!

A really good lie is always based on the truth. The McCanns and the rest of the TAPAS group can keep on insisting she was abducted, because she was!

It is very hard to believe the rest of the TAPAS group would be willing to become part of a conspiracy just because either Kate or Gerry or negligently both of them were responsible for the death of Madeleine. Why would they do that?

Kate and Gerry McCann are suing the police chief who bungled the investigation into their daughter's disappearance - and blamed them for her death - for £1million.

In a 36-page writ handed to the Sunday Mirror, they lay bare in painful detail how Gonçalo Amaral's accusations left them "totally destroyed" and caused them "irreparable" damage.

It also gives a harrowing insight into the day-to-day life in the McCann household as they struggle to cope without Madeleine.

The writ - which the Sunday Mirror has had translated from Portuguese - outlines how the couple both suffer from "permanent anxiety, insomnia, lack of appetite, irritability and an indefinable It also says Kate McCann is "in a deep and serious depression".

'Disgraced former police Amaral has pocketed £ 1million writing a lurid book and making documentary full of cruel about Madeliene and her And now they are suing him every penny of it.

He accuses them of accidentally killing their three-year-old daughter and then covering up her death.

Amaral, who was thrown off case after five months, repeatedly claimed Madeleine in the holiday apartment on Algarve. In his book The About The Lie he spouts his theory that the couple hid daughter's body.

The lawsuit also highlights fears for four-year-old twins and Amelie when they start later this year and begin to hear rumours that Madeleine is dead.

And it accuses Amaral of being a self-obsessed, manipulative money-grabber with no morals.

The couple, both 41, have hired Portuguese lawyer Isabel Duarte to sue Amaral for defamation and for breaching their human rights. Mrs Duarte, 54, said: "Somebody has to stop him and shut him up. He is a rich man now, earning millions from the distress of this family. We believe he has made up to 1.2million euros (£1million) from the book and the video. We want the court to punish him by taking at least that much from him."

The McCanns have a good case for defamation as they have already been cleared by Portugal's Attorney General. The case will go to trial in Lisbon next summer and Amaral, 49, could force the McCanns to take the stand. Madeleine is named with Kate and Gerry and the twins as a complainant in the lawsuit, lodged on June 24.

The McCanns, both doctors from Rothley, Leics, claim Amaral's repeated insistence that their daughter is dead has stopped people looking for her. The lawsuit states: "Madeleine has been deprived of the possibility of a fair and adequate investigation into her disappearance, putting her moral and physical integrity at serious risk."

It says Gerry and Kate have been "totally destroyed from a moral, social, ethical, emotional and family point of view, beyond the pain that the absence of their eldest daughter causes them".

The couple want a minimum of £430,000 in damages for Madeleine, which will be used to keep the search for her going. They also want a minimum of £215,000 each for them, and another £86,000 each for the twins. It is thought any money they get will go to the Maddie fund.

The McCanns say his "sole objectives" in writing the book were "to earn a lot of money", using "lies". It says the book and his 50-minute documentary, which has been shown twice on Portuguese TV, are "manipulative, perverse, false, destructive, defamatory, deeply damaging and therefore illegal".

Amaral was in charge of the 30 detectives looking for Madeleine after she vanished in May 2007 on a family holiday in Praia da Luz.

He was largely responsible for making the McCanns "arguidos" - suspects - four months after Madeleine vanished. But he was kicked off the case in October 2007 days after the Sunday Mirror revealed he was working as little as four hours a day and was enjoying long, boozy lunches.

He was removed from the case on his 48th birthday. Amaral took early retirement shortly afterwards, ending 27 years on the force.

He began writing his book, promoting it by travelling around Europe giving newspaper interviews.

It went on sale in a blaze of publicity in July last year - three days after the McCanns' "arguido" status was removed. Earlier this month Amaral was charged with torturing a witness during a separate missing child case. He faces jail if convicted.


£430,000 damages for Madeleine which will be used to continue the search for her.

£215,000 for each parent for the emotional distress the book has caused them. They say they suffer 'permanent anxiety, insomnia, lack of appetite, irritability and an indefinable fear'. The writ also says Kate McCann is 'steeped in a deep and serious depression'.

£86,000 for each of their twins Sean and Amelie, who could hear his allegations when they start school in September.


£500,000 from the book which has sold 180,000 copies in Portugal alone.

£430,000 from the extra 150,000 books which have been sold in Brazil, France, Germany, Italy, Spain and Holland.

£100,000 for a TV documentary watched by one in five people in Portugal - 75,000 copies have sold on DVD.

Not endorsing the Mirror of course but it would seem that at the very least they got this 1.2M figure correct,being what the McCanns and their lawyers estimated Goncalo had made, which they wish to relieve him of.

Oh goodness they make my flesh creep.

What normal parent would be concerned to just keep on and on suing people for as much cash as they can rake in! Just how dare they suggest this has anything at all to do with looking for Madeleine who they trademarked within days of her going missing and advertised her apparent eye defect in spite clear police advice this would sign her death warrant. "A good marketing ploy even though yes we thought the abductors might do something to her eye". I still have this morbid fear of ever bumping into that bars//

If this is the case, it affirms as this story does generally, there was only one reason for this action by Kate and Gerry McCann, money grabbers, cashing in like they always have done using their little girl who they cruelly abused and abandoned, again, if after she complained, on their own account, mummy where were you when we were crying. May they hang their heads in shame.

After 175 thousand copies sold, the rights of True Lies has been sold to Spain, France, Italy, Germany, Denmark and the Netherlands, the documentary based on the book and broadcast by TVI has reached the 2.2 million spectators and a digital copy of the work to be circulating freely on the Internet, a Portuguese court has banned the sale of the book of Gonçalo Amaral, ex - Inspector of Judicial Police who investigated the case of the disappearance of Madeleine McCann.

The prohibition of a judge 13. Civil Court of Lisbon extended - even if the actual Goncalo Amaral who is prevented - or else pay a fine of 1000 euros if they obey - to make "the reproduction, comment, opinion or interview, where they could defend the thesis as described in the book: that the child died and the parents, Gerry and Kate McCann, may be responsible.

I agree with you about the credibility of the sightings.

Tanner’s as you suggest probably happened at a different time to the one she says and can be discounted. For me she could not have walked past GM and Wilkins on a deserted street and not be seen by them.

The Smith’s sighting is more credible and of course no one came forward to eliminate themselves from the enquiry possibly because it was Gerry or a stranger abductor who looked like Gerry.

My views on witnesses who allegedly see Madeleine has been somewhat tarnished after all the futile sightings of her reported.

When a sighting is checked out it proves not to be Madeleine and doesn’t even look like her.

This makes me rather sceptical about the Smith’s sighting but of course I agree this one could be the significant sighting and cannot be discounted as easily as Tanners.

I understand that in police investigations similar to this one difference are looked at that fall outside the normal routine for the day in question.

There are lots of differences during the evening of May 3rd.

The McCanns did not go down to the beach café with the rest of the Tapis group.

The children did not go to the tennis courts after the crèche had finished as usual.

Only men checked the children at night – reported by the Tapis staff. On 3 May both Tanner and KM checked. In fact Kate, as far as I can see, only checked once during the whole week - on the one occasion she checked M was missing.

The T9 only checked their own children at night. On 3rd May this changed and Oldfield checked the McCann children not once but twice.

In Kate’s conversation with others at the tapis bar she mentions her concerns over the children’s safety being left alone in the apartment. She did not do this at any other time during the week.

She also mentions that Madeleine cried the night before 2nd May. She does not mentioned on the 1st May when surely she would have noticed on returning home that night Madeleine had been crying for an hour and a half (Mrs Fenn’s statement). Even if Madeleine did stop when they arrived back.

Significant changes to the usual routine they had set up that week.

Just reading back the Mirror says when talking about Amaral:

LOL – I have to hand it to them regarding the angle they dig up with this sentence.

What I find strange is the reasons for the McCanns civil action against Amaral. These reasons could just as easily be transferred onto the McCann’s behaviour.

I have to say as this case proceeds the mc’s manipulation of events becomes so apparent I start to think Machiavelli could have taken a few pointers from them.

I think this discloses a very interesting point. Are the Smith family genuine witnesses for the prosecution or are they manufactured witnesses for the defence? We know that Metodo 3 were going around bribing witnesses for the McCanns.

The Smith family hail from Drogheda in the North Eastern tip of Southern Ireland. This is not so far away from where Gerry has so many roots and like to holiday, Donegal.

It is odd that the Smiths did not apparently realise the significance of their sighting until two weeks later. Even more odd when you consider that the Pt Police were refusing to disclose any details of a supposed abductor until they heard from the Smith family because they were just not satisfied with Tanner.

So it could be said Gerry arranged for this family to back his stranger abduction theory which was so incredibly important to him implanting the idea in the mind of the world and of course rich businesses and celebrities that he was targeting, to really kick start his Fund.

Initially Mr Smith was saying he hoped his sighting would help the McCanns. But in September, he changed his view to say he thought that the abductor was Gerry McCann having seen him dismount the plane with Sean at East Midlands Airport on TV.

Again, it could be said this was a clever move. The Police were beginning to consider the Smiths were not credible witnesses, they were in league with Gerry McCann. So he points the finger at Gerry McCann but states he is only about 70 per cent certain it was him. No court would take that as an identification of Gerry and so although giving the impression he is not Pro McCann he has not actually done Gerry any harm.

That would then leave no witnesses at all who witnessed any abduction.

But when looking at the PJ files it would seem that the Smith family have been determined as credible and reliable witnesses who have not wished to speak to the press. The same conclusion was clearly not reached in the case of Gran Cooper who had to be warned by British Police to stop chatting to the Mirror.

So, on balance, whilst I am aware of the possibility the Smiths are witnesses for the defence, I do not think it is terribly likely. In any proceedings against the McCanns their evidence will clearly be considered crucial, not least because if it can be proved they were bribed by Team McCann that is enough to finish Gerry. But if they are proved to be telling the truth it sets the scene as to what really happened to little Maddie, which would also finish Gerry.

He is not as clever as he likes to think.

Hiya again Wiz,

I too have to laugh at the simplistic suggestion from the Mirror as to why Goncalo was removed from the case, but I suppose it is satisfactory for their readers!

In the early stages on this blog, I focussed very much on all of the money making schemes we were hearing about from Team McCann. Maddie the Movie, which apparently would have to be about the suffering of Kate and Gerry. It was claimed that this and a book someone was ghost writing for them could net them £10M and I do not believe that was an exaggeration.

Then we heard of an ambitious plan to sue the PJ for £1M for failing to find Maddie.

My feeling was this clearly indicated the motivation of Team McCann for the crime of making Maddie just disappear, to make a huge amount of cash, cash in as I repeatedly stated.

That garnered a lot of adverse publicity and Clarence repeatedly came out fighting on TV and with many radio interviews and interviews with the press to try and scotch that impression. But in early 2008 he had already given that impression by claiming the fund would run out in months, that was the most terrible lie given we subsequently found out there was a ONE MILLION POUND surplus slushing around in that Fund as he was making that claim.

So having toned down their money grabbing enterprises for some time, now we see them start back up again.

I believe I was right to state way back the whole motivation for this crime was to cash in and we can see them finding it irresistable to do what they always planned to do. Otherwise Gerry would reason, we have got rid of Madeleine and gone all through this for nothing and that just would not do!

Another good point flagging up the police will always look for significant changes to routine on the day of the crime as suggestive of something being planned to happen or happening.

I think the other thing is Kate admitting that she slept in the bed in the childrens' room the night before. That suggests she had a fall out with Gerry and I believe I know what that was about, his sickening plans that she was having grave concerns about. Maybe she copped a few bruises in the process.

She could hardly deny sleeping in that bed because when you look at a PJ picture of the room that bed actually looks far more slept in than Madeleine's and would clearly have her DNA all over it.

It is pretty awful they did not join in the group trip to the beach that afternoon. I found it very curious that DC Marshall was seriously wanting to question what David Payne was doing that afternoon and what he was wearing.

I wonder if the children were all so tired that night because they all got drugged! I am convinced that they were drugged, not least because even sly Gerry suggests the flipping abductor drugged the twins, all in this FOUR MINUTE window of opportunity as they call it, to abduct Maddie.

b) The prohibition for the requested parties to perform new editions of the book or the video, or of other books and/or videos, that defend the same thesis, and that are destined to be sold or published by any means whatsoever in Portugal;

c) The prohibition for the requested person [Gonçalo Amaral] and the requested parties to cede the editing rights or the authorship rights over the contents of the book or the video, or of other books and other videos about the same theme, for publication anywhere in the world;

d) The prohibition for the requested person and the requested parties to cite, analyse or comment, verbally or in writing, on parts of the book or the video that defend the thesis of death of the third requesting person or of concealment of her body by the first two requesting persons;

e) The prohibition for the requested person and the requested parties to perform the reproduction or comment, opinion or interview, where said thesis is defended or from where it can be inferred;

f) The prohibition for the requested person and the requested parties to publish statements, photographs, or any other documentation that is allegedly connected to said book and video or said thesis.

Moreover, the Court condemns each one of the requested societies to pay a compulsory pecuniary sanction in the amount of 1000 euros for each day that the prohibitions or the order to apprehend the books and the videos are not respected.

The depository of the books and videos, whose collection is ordered, is the lawyer who represents the requesting persons."

The editor that publishes the book ‘Maddie: The Truth about the Lie’, Guerra & Paz, has informed that it is going to contest the judicial prohibition that involves Gonçalo Amaral’s book, after having received the notification this Friday.

The action that was filed against the book includes the prohibition of selling the book’s edition rights for foreign publications, as well as the impossibility to cite, analyse, give an opinion or interviews about the thesis that is defended by Gonçalo Amaral.

Guerra & Paz defends that these restrictions are “an attempt against the freedom of expression and the freedom of contract, hurting the most elementary rights that are consecrated by the Portuguese Constitution”.

In the same press release, the editor names the decision as “unjustified and disputable”, taking into account the international application of the decision.

“It is only out of respect to the institutions and due to our will to contribute to their prestige, that we obey this arbitrary position that we will contest in the Portuguese courts and, if necessary, at super-national instances”.

Just a thought if Guerra & Paz, are successful in their legal battle sales of the book world wide will go through the roof.

Just think of the promotion this book will get through the court action.

Even if the publishers are not successful there has to be a way round to enable them to print and publish this book abroad.

I still fail to see how a Portuguese court can ban the book being printed and published abroad. It’s outside their jurisdiction to sit in judgement over what other countries can and cannot do.

I'm pleased someone has the b*lls to stand up against the McCanns legal team for this and I applaud Guerra & Paz for taking the stance they have.

Thanks for your kind comments Wizard Mum and baby are fine Although Mum is very tired, which is understandable. I had a lovely cuddle this afternoon, he is sooo gorgeous.


Reading back you made me think. I know I have mentioned this before but I will say it again.

There was a witness that said she saw Gerry, I am not sure if he was at the cashpoint or the witness was. Whoever it was said they overheard Gerry talking on his mobile, saying please do not hurt her.

This would tie in with your theory Viv, that Gerry handed Madeleine over to someone, or someone did take Madeleine and Gerry knows who that someone is. Meanwhile Gerry makes as much money as possible off the back of his daughter.

Could this be why they are bouyed by the Jaycee case, does Gerry know eventually Madeleine will be returned.

Sorry, even typing this scenario makes me shudder, that if true, he could be so cold and calculating. I do hope I am wrong.

Joana is definitely finding the news from Europe tonight. The latest story just posted is from France. It involves the case of an 8 year old girl who went missing a month ago.

The parents alleged she had been abducted.

The body of the little girl has just been found and under further interegation her father admitted causing her death.

She had been kept in the fridge of a former house the couple lived in.

Hmm… there’s that fridge again.

Di I am pleased mum and baby are doing well and that she is feeling a bit more comfortable. I envy cuddling a gorgeous new baby boy, how utterly wonderful!

It is heartening to hear the publishers intend to contest this decision. That clearly demonstrates they are right behind Goncalo and not leaving him to pick up the pieces and the legal costs bill of fighting it.

But this is what Article 10 of the European Convention of Human Rights actually says, it is a qualified right:

1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by a public authority and regardless of frontiers. This Article shall not prevent states from requiring the licensing of broadcasting, television or cinema.

2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for the maintaining of the authority and impartiality of the judiciary.

It seems to me these two bits are particularly relevant here:

for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence,

Without conclusive evidence or any charges, Kate and Gerry clearly do have the right to the presumption of innocence and it is damaging their reputation for Goncalo to insist Maddie died. Additionally, as a former police officer, he received all that information when the case was subject to secrecy of justice and I do not believe he has a right to write about this. Certainly not by analogy with British Police, they would, without doubt, be prosecuted for such conduct.

Member States can give greater rights under the Convention but they cannot give less. It is not just a question of the rights of Goncalo Amaral here, it is the rights of Kate and Gerry. I also think the decision is more subtle than that, the Judge will be aware the case continues in UK and that the parents remain suspects. He would know that in UK will simply do not want the prospects of any trial seriously damaged by Goncalo going further than what the evidence states, he is defending his thesis of what he claims that tells him. But on any rational analysis, you simply cannot go that far with it.

I cannot remember the name but remember the statement very well, really good point!

She sounded like a very credible witness and really when witnesses are not actually saying anything that helpful to the McCanns and did not wait months or even years for their startling recollection, I think you have to take them at face value and accept they are cogent and honest.

I am a British national, and I live in a house in the village in Portugal having lived there for 9 years.

I used to live in Worcester and my family still live there.

I came back to UK on 23rd April 07 to Coventry. I believe with Fly Thomson and was travelling alone.

I flew back with the same airline on 30th April from Coventry to Faro.

I had booked my travel arrangements through a company in Lagos. Part of the package included collecting me from faro and taking me home.

I didn't see any news as my T.V. was not working.

On the afternoon of Monday 7.5.07 I was in Lagos as I needed to do some banking. My car is xxxx coloured and has an English Registration.

Near to the main road in Lagos is a pedestrian area. There are parking spaces at the side and I parked in one of those spaces. There are ATMS near there and I went to the one on the left hand. I don't know what the bank is called but it is about 3 doors away from the Banco Espirito Santos.

On walking towards the ATM I was aware of a man in the pedestrian area. He was holding something to his ear which I thought might be a Dictaphone but later assumed it was a mobile phone.

I noticed him as he was talking very loudly. I remember him saying 'PLEASE DO NOT HURT MADELEINE' There was a lot of other speech, but I can only remember that phrase.

I think he had a notebook in his left hand and I think he was holding the phone in his right hand. The notebook seemed to be the type that journalists use. He seemed very upset and the way he was acting and with the notebook I assumed he was an actor or journalist.

It was very quiet and no-one else was around.

He was pacing up and down, being 10 metres away from me at the furthest, and the closest he was just a few feet away as he walked past me at the back while I was using the ATM.

I would describe him as a white male about 5.6' with pale mousey coloured hair. It think he was wearing an overcoat or raincoat of dark coloured with grey being the main colour I remember. I thought he was talking with a slight Irish accent.

I withdrew 150 Euros at the bank and I also withdraw some cash from my fathers account. I was at the machine for a couple of minutes and when I left the man was still there walking and pacing up and down. I thought to myself 'who's Madeleine'. When I got back into my car the man was still there as I drove away.

I had a lot of chances to see the man's face during that time, and I had never seen him before.

The account the card services is xxxxxxxxxxxxxx in my name at the xxxxx branch. The sort code xxxxxxxx and the account no. xxxxxxxxxxxxxxxx. The card has now been replaced with another sand I don't have the old card number.

I was then going to xxxxxx (a two minute drive away. I was going to do some insurance paperwork.

I have been a member of this bank for many years and am known by staff there. There were 3 staff working and I know that lunch is between 1pm and 2pm, so I think my visit was before that. One of the staff was xxxxx, one was xxx. I was talking to the one of the staff xxxxx. She has a daughter called xxxxx and she always chats when I visit.

She asked me if I heard about the missing English girl. I said I hadn't seen any news. She told me the missing child was called Madeleine and had gone missing from a resort along the coast. I told her that the man I had just heard must have been the father of the child. I only assumed this by logic and from the conversation AFTER the fact.

In relation to the identity of the man I saw I thought initially that he must be the father based on what he said and what the staff had said about the missing girl.

I went to the third local bank to do some more banking.

I don't usually watch or follow news. But months after this saw a news report on the local TV station at home. The footage showed the father of the missing girl. At that point I realised it was the man I had seen on the occasion above. I had not seen this picture before, but I am as sure as can be that he is the person.

I have been asked whether I have made this assumption but I do not believe I have. I am 99.99% sure if shown his photograph with lots of others I would have picked him out as the man.

I am more interested in the case and have been following it since this event.

In September 2007, I was at a health club of xxxx. There was a kid's party.

Some of the children were walking off and I was worried because of what happened to Madeleine. I kept a watch on them returning them to the group when they walked off. There was also a large t.v. Which showed news about the case. I started talking about it to a man known as xxxxxx I told him what I had seen previously in Lagos. When I told him he said I should go to the police.

I asked him to come with me and he did. We went to the local station, they referred me to the GNR. We went there and they gave an email address for the PJ at Portimao. He then sent them an email and an officer made contact with me.

In relation to the times and dates I can add the following.

I keep a diary which I record a lot of detail in, in particular appointments and finance matters. It is kept up to date and I am not aware of any errors. It shows that 150 euros was withdrawn on 7th may, to cover my phone bill.

I authorise the British or Portuguese police to make any enquiries in relation to these financial transactions.

When I first spoke to the British police about this, I was under the impression that the events happened on the 2nd May. This was before the girl went missing and therefore not correct. I examined my bank statements and found the withdrawal from the ATM, my visit to sort out my insurance and the deposit to the third bank took place in the afternoon of 7th May. My bank have advised me that the cash withdrawal took place at 2.26pm.

Very well spotted Di, this witness is convinced that was Gerry on the phone on 7 May pleading with someone not to hurt Madeleine. That would clearly suggest that he is involved in her kidnap. How interesting that at first she also indicated he sounded Irish, he does a bit and clearly has that background as well as Scots, this just gives more credence I think.

The footage showed the father of the missing girl. At that point I realised it was the man I had seen on the occasion above. I had not seen this picture before, but I am as sure as can be that he is the person.

I have been asked whether I have made this assumption but I do not believe I have. I am 99.99% sure if shown his photograph with lots of others I would have picked him out as the man.

When you put this together with the Smith sighting, Mr Smith also being pretty certain that was Gerry carrying Madeleine off, it does explain why Gerry is in no rush to stop people sayng they killed Madeleine, I think it throws off the scent very nicely for him, as well as being a real nice little earner!

There are people on the internet who have been downright abusive to me for suggesting that Gerry abducted her rather than killed her, now why would they do that?

Oh and if I remember correctly Payne was forced to admit at his rogatory interview that in addition to their own mobiles they went and bought some more!!!

I can imagine Gerry would have wanted an untraceable pay as you go to make such a call!!

Maybe those 14 text messages he received onto his mobile the day before, but deleted and the four the day after were quite damning enough.

I still believe I am correct Di, and the Police play cat and mouse with Gerry as they try to locate little Madeleine.

Thanks Wiz, I had not actually realised he was saying that because another post I looked at he drew the conclusion they killed Madeleine.

I have always thought this crime was premeditated and to me it has all the hallmarks of an abduction to make a lot of money. Gerry may have been heartened by cases like Jon Bennett where although the parents were always suspects and the body was right there in the house, they managed to keep getting away with it.

Sadly, I do believe it is possible Gerry handed her over to paedophiles. If that is the case no one can imagine how much she must have suffered. Let us hope that is not the case.

I really do believe the police feel this is what happened and Mrs Justice Hogg was making a direct appeal to that "one person" who knows where Madeleine is, I am fairly certain she was referring to Gerry McCann.

Like you Di, I think Kate knows what happened but I do not believe she planned or approved of this. I believe she is controlled by Gerry McCann and in genuine terror for the safety of her daughter.

Di, I did post on Photon's thread and pointed out that in that letter it also said the McCanns had a £323,000 mortgage with Northern Rock, a lender who used to lend in difficult cases,

I believe that with Kate only working part time and often not working at all due to child birth, the size of that mortgage, cocaine, golf, private fertility treatment and Gerry only being a junior consultant who probably would not have a good private practice, probably on about £75K they would have been struggling financially.

It is clearly possible that by May 2008 when that letter was written Kate could have been pregnant again. Perhaps she thought this would help her. But if that is the case she must have lost the baby which just makes things even more sad for her.

It can only exemplify how truly wicked it was to target even the McCanns road with those sickening leaflets, by a bunch of vigilantes who have no empathy and no understanding of just how dire the situation may be or Kate's state of mind.

People get caught up in serious crime and sometimes it is not always their fault, this bunch of thugs really ought to think carefully and understand they do not know better than the police and there is no conspiracy by the British Government or the Police that provides any excuse for their sickening behaviour.

Dana Fowley has waived her right to anonymity

A mother has told a jury that she sat and watched television while her 10-year-old daughter was gang-raped in the next room.

Caroline Dunsmore, 46, is currently serving a 12-year prison sentence for her part in abuse of her daughter Dana Fowley, now 29, in 1990.

She is giving evidence at the High Court in Dunfermline in the trial of two men accused of raping Ms Fowley.

The rape is alleged to have taken place at a caravan park in Perthshire.

Neil Kendall and Ian Davidson are accused of raping Ms Fowley, who has waived her right to anonymity, while she stayed at a chalet in Abernethy Caravan Park with her mother and step-father William King.

Dunsmore described to the court how her husband, who has since died, had picked 10-year-old Dana from her bed, blindfolded her and removed her underwear.

She said she did nothing about the abuse because of her fear of her husband.

She added: "Dana was in some state. She was crying and shaking, but I didn't go through because William King would have battered me."

Special defence

The mother told the court that the second accused, Ian Davidson, later had sex with her daughter while she had sex with her husband in the same room.

She said: "It happened at least two or three times. Me and William King were having sex at the same time as Ian Davidson was having sex with Dana."

Joanna Cherry QC, prosecuting, said: "How did it come about that the four of you were in the same bedroom having sex?"

The woman replied that it was her husband's idea.

Later, when asked if she could identify Mr Kendall and Mr Davidson now, Dunsmore pointed to the men in the dock.

Mr Kendall, 44, of Citadel Place in Edinburgh, denies raping Dana Fowley while acting with others at the caravan park between 30 April 1990 and 27 June 1990.

He has lodged a special defence of alibi, claiming he was not within the caravan at the time of the rape, and a separate special defence of incrimination, claiming the attack was carried out by three other men.

Mr Davidson, 54, of Murrayburn Place, Edinburgh, denies two charges of rape and two of using lewd, indecent and libidinous practices towards the girl by having sex with Dunsmore in front of her, and forcing her to perform an oral sex act on him.

The alleged offences involving Mr Davidson happened between February 1987 and June 1994 at various addresses in Edinburgh.

He has lodged a special defence of alibi, claiming he was living at various addresses in Manchester at the time.

The trial, before Lady Stacey, continues.

Well spotted. I am absolutely shocked to discover that Kate McCann was on maternity leave at the time of her holiday in Portugal.

How can this be - I remember seeing a statement by the Portuguese prosecutor’s office saying words to the effect that when they considered the evidence of the dogs finding (i.e. cadaver scent) they did not take into account KM’s occupation.

If she did not work for the last 18 months or longer how can they comment thus? This evidence by the Leicestershire police - I can’t help but think is wrong because how can the Portuguese compromise the dogs findings by suggesting cross contamination could have occurred because of her occupation. Surely this would have been extremely unlikely if not impossible.

This opens a whole new can of worms why was KM still on maternity leave.

She might of course just have been fed up with her work and was spinning it out. Conversely she could have had a medical condition that prevented her return – post natal depression for example springs to mind.

If I understand correctly the pj failed to receive medical records for the Mcs they were blocked.

I know we have been over the fact Kate may be scared of Gerry or not getting her child back but I cant get past the pictures of both of them on Madeleines 4th Birthday there is joy on both of thier faces.

If Gerry set it all up and Kate has to dance to his tune or risk not getting her child back I dont think she could have managed to put her foundation on that morning let alone laugh and smile along with the man who caused all this?

I agree there are many weak woman out there who dont fight for thier children but if Kate belived Madeleine had been sold for god knows what reason she has other children who could disapear in an instant (or be abused when the need took over) and if she wont fight for Madeleine the twins are just not safe.

I cant see Madeleine ever comming back her eye is supposed to be a a strong identifying feature so are we to assume she has been kept out of sight for 2.5 years as the risk of taking her out anywhere would be too great. This rules out a happy adoption and places her at risk of abuse out of sight of the world.

I have always wondered if her eye was as bad as he pictures made out or was exagerated therefor she could be out there adopted and happy but if this is the case she cant come back as how could they explain her eye suddenly back to normal?

So either way Kate cant expect to see her child again if Gerry got rid of her once she was set free she would be interviewed and the people who held her could be found and that is not a risk they would take.

The very fact there is a 2 million reward for information (that has hardly been mentioned) tells me she is dead peadophiles are scum but they stick together in little on line groups bragging about the sick stuff they do and someone not involved directly could broker a deal for the cash and no conviction. The fact no one has come forward to do this if she is still alive is un likely.

Wiz, I would be careful about the letter from LP, saying Kate is on maternity leave because it is dated May 2008. It may be therefore that she was on maternity leave at that time because she was pregnant, again.

It is not possible IMO for her to have extended maternity leave lasting that long from the twins, they were two years and two months old at the date of the holiday!

However, I do think it is possible that Kate had been otherwise ill and not working for a long time. That would explain, perhaps the money worries over that £323,000 mortgage etc and Gerry feeling he had to earn a lot in some other way...

I do believe it is possible Kate had a long term problem with depression, being married to him and the quick succession of pregnancies, Madeleine, she says a difficult baby, followed up very quickly by a difficult pregnancy with the twins..and the money worries of her not working. Not difficult to imagine at all!

I agree it is more likely now that Madeleine is dead, but many children are kept alive for photographic work which is such a massive earner, that is sadly perfectly true.

As you say, Madeleine being kept in a relatively normal home having been adopted just seems quite impossible to imagine. No normal person would hang onto the most famous missing child in the world. There would be the constant fear of her being recognised.

The only reason I can think of logically why Kate and Gerry never mentioned that reward was because they did not want Madeleine found. To me that is also the reason they put out a number of pictures of Madeleine when she is very plainly much younger than when she disappeared, with short blond or red hair, rather than long brown hair. They wanted to confuse and did not want the public to have a clear image of what she looked like. Any sensible person, wanting to find her, would have just focussed exclusively on the tennis balls pic, but the McCanns have done their level best to just ignore it.

But if they knew Madeleine was already dead, would that be a reason to not advertise the reward? In that situation they would have known no one could find her and it would have added a great deal of credence to their supposed situation of being distraught parents.

I think you are right HOpe, there have been times when Kate looks just as cold and calculating as Gerry, sounds it too. I think it is right to say we know she is involved, we just do not know the extent. And the rather graphic example above demonstrates, failing to protect your child can get you 12 years in prison.

Or could it be that Gerry is wrong to place so much trust in them, they do have an opportunity to redeem themselves by telling the police of their interactions, more so with Kate McCann and what their conclusions are.

Let us hope the Daily Mail has moved them a little further in the direction of remembering what they used to do for a living!

Well I find that rather amusing Wiz. A couple of years ago he wanted to run from the Portuguese. The Portuguese would still have hold of this case if it was a stranger abduction, so Gerry feels that is the right thing to suggest, even though the Pt have absolutely no intention of re-opening this case.

Now why is it he does not mention he wants to work with the British as well, could it be he does not like UK Police, I think so!!

The LP letter tells us on the 16th May 2008 KM was on maternity leave. I have tried to find the whole of this document on the McCann files but have failed to locate it.

There is a mention of 1 year maternity leave but no reference of dates. 1 year maternity leave is a statutory right. I would have thought after 1 year if you did not return it is unlikely your job would be held open indefinitely.

So if she was still employed by the local health authority its difficult to see how she was still had a job with them if the maternity leave was still running in May 2008 - the twins being by that time 3.

We know from May 2007 to September 2007 she was in Portugal and not working and we also know when she returned home she did not return to work.

Is it likely that she went through IVF treatment again during the period September 07 to May 08 and then miscarried?

If this is true no wonder they kept quiet about it. To go through all the trials and tribulations of IVF whilst still apparently so distressed and searching for a missing daughter beggars belief. It sounds very callus – like saying OK I lost one child I replace her with another.

I know the original information came via Proton a respected blogger but I can’t help thinking this piece of information is flawed in someway.

The Leicestershire police must have been asked to follow up on how many corpses KM had visited prior to her holiday and this piece of information does not appear in the published police files.

I would like to sugest to the DX who have today printed Mrs Amaral's letter to Madam Kate to keep digging up things from the past and next week lets see the beaming pictures of them on Madleines 4th Birthday with a headline "9 day's after their child was snatched by a wicked peadophile ring Kate and Gerry take comfort and Joy from the supporters in PDL today is Madeleines 4th Birthday and you can see how distressed they are"

I am sure the DX only printed the letter to show GA was a hard working cop who just wanted to find the truth for Madeleine as he did Joana...

I’m not sure what to make of the Express’s position in this article.

The “poisonous” description of the letter, from Amaral’s wife, is a quote from one of the Mccanns' friends not a view of the Express.

On rereading the letter I would not call it poisonous it is just one woman talking to another and stressing her husband’s continuous hard work and resolve in trying to find out what has happened to Madeleine.

The comment referring to Kate as Madam Kate - it’s difficult to say whether this is a sarcastic remark or not as the writer was not English and might just have been being polite.

The Express tells us regarding the letter: “The McCanns’ spokesman Clarence Mitchell explained: “Kate is aware of the letter and its contents. It was complete nonsense.”

Totally biased Mitchell is of course entitled to his opinion but not one that most people following the case would wholly agree with.

I did like the Express pointing out the McCanns were attempting to bankrupt Amaral as this does not show them in such a saintly light as usual. Imo showing their true characters.

This is from The Sun but does include an actual quote. So Kate had already made up her mind by Oct 07 she was not going back to being a GP. I am wondering about the utility of this claim she was on maternity leave in May 08.

Oh and speaking of the most incredible gaffs, when a friend made this comment in Oct 07 did they realise that in May 2008 Kate would go on telly to explain how Maddie said mummy where were you when we cried last night and she just did it again. If Kate had actually said prior to this, she wanted to work in CHILD WELFARE I really do fear for her mental health!

I do not agree, this claim was mere propaganda in the media, not what had come directly from the lips of Kate and Gerry McCann.

I believe Gerry was the man behind that propaganda in his bid to advance the death theory, so that he could make a huge amount of money out of it.

Hope, you are right IMO the Fund will get them and the action against Goncalo is to do with topping that same Fund back up again.

The Fund is at the heart of this case and Portugal never had jurisdiction to deal with that, Goncalo himself says so in his book!

I do not know how Gerry rationalises his conduct against Goncalo Amaral but the figures being bandied around clearly imply he intends to clean him out and take all his money off him and his family.

The Daily Express now seem to be on the side of the McCanns IMO, with the Daily Mail on the opposite side and the BBC wanting to stress they are on neither side.

The Daily Express IMO is an article intended to try and mitigate the damage to Team McCann by this asset stripping action against Goncalo and his family. It is not just the damages he wants from Goncalo, it is the legal costs he will incur in trying to fight it.

I do not condone the conduct of Goncalo in writing that book, but I think the conduct of Gerry now in cynically seeking to grab all his cash and put his family into penury, a full 12 months after the books was published is an awful lot worse. As they both battle it out for public opinion I think we should focus on just how money grabbing Gerry McCann is, that this was the motivation for the crime in the first place and how he just cannot resist continuing to make money out of the little girl he deliberately chose to get rid of.

A consultation with the DC Soand from the department in question confirms that this is just a file reference, but as a complement to Operation Task system for the purpose of reference, if any investigation should be necessary by the department. No work has been done on the basis of this file.

An examination of all other police files using a search system does not reveal any information about her.

And despite fresh leads taking his probe to Australia and Barcelona, the east Belfast man insists the golden-haired youngster is being held just 10 miles from where she was snatched in Praia da Luz two years ago.

But he warned that the sprawling wilderness where he believes Maddie is languishing is almost impossible to search completely.

Belfast-born Dave revealed the grim theories when he opened his case files to us.

We spent the day at the Cheshire office he uses to conduct the world’s biggest missing person case.

Sunday Life can now lift the lid on how his Alpha Investigations Group private eye agency really operates and what it is like to search for the world’s most famous missing youngster, who disappeared two years, four months and 10 days ago.

When we visited Dave’s headquarters, US kidnap victim Jaycee Lee Dugard had still not been rescued and the world had long forgotten her name.

But even then Dave said he was convinced Maddie was entombed by an abductor in a cellar or dungeon, like Austrian cellar victims Natascha Kampusch and Elisabeth Fritzl.

“Maddie is most likely being held captive, possibly in an underground cellar, just like Natascha or Elisabeth, and could emerge at any time,” he told us.

Days later, news broke that tormented Jaycee had been freed from the foul compound where she was abused for 18 years by monster Phillip Garrido. Dave simply said: “This just supports my theory that Maddie is alive and imprisoned.”

There was further backing for his theory when American boy Ricky Chekevdia was found hiding with his mother in a tiny “secret room” two years after he was kidnapped while caught in a custody battle.

Former detective inspector Dave, who grew up on Belfast’s Woodstock Road, was drafted in by Kate and Gerry McCann last November after Spanish investigators failed to find new leads.

Renowned for leaving no stone unturned in his UK murder investigations, Dave now spends his days with a four-strong team probing every lead that comes in to his office.

His partner Arthur Cowley has more than 30 years’ policing experience in north-west England – and the pair are backed up by a translator and an ex-police administrator.

They have sifted through thousands of emails, answerphone messages and letters to get that one breakthrough lead.

Last month, the information took Dave’s probe to Australia and Barcelona to track a ‘Victoria Beckham lookalike’ suspect, who spoke with an Australian or New Zealand accent.

She was seen asking two British tourists at a marina in Barcelona if they were there to deliver her “new daughter” – three days after Maddie disappeared.

But he told us he is now back to focusing on his original theory.

He still feels Maddie was snatched by a man spotted by the McCanns’ friend Jane Tanner, one of the so-called ‘Tapas Seven’ who dined with them the night Maddie went missing.

Dave said: “Jane is a very reliable witness and there were other sightings of this man, who Jane saw carrying a little girl in a blanket, in the days leading up to the disappearance.”

He feels this is the lone prowler who has Maddie stashed in a cellar or dungeon in the lawless villages around Praia da Luz.

But Dave warned: “This rural, sprawling terrain makes it extremely difficult to search. You could quite easily keep a child there for years and no-one else would know.

“The person who has Maddie is most likely a paedophile or a person so desperate for a family they were willing to kidnap for it.

“I wouldn’t like to speculate on what is happening to her.”

Dave says the region where he feels Maddie is being held has attracted many strange characters, including convicted sex offenders.

“I don’t want to generalise or make gross exaggerations, but there are people there living on the edges of society,” Dave said.

He added there were as many

as nine child sex attacks in the area round Praia da Luz from 2005 to 2007 and the victims included British kids.

Some happened as close as 20 miles from Praia da Luz, and six of them were on girls between the ages of three and 10.

He is now investigating leads on six child sex offenders, 78 other rapists and sex attackers and 22 vagrants.

In a glimmer of hope, Dave said: “The key thing is no body has been found.

“When paedophiles kill, they often dump the body nearby, and this isn’t the case here.

“Even if Maddie had been dumped in the sea nearby the resort, the ocean often gives up his victims.

“Until I find evidence that she is dead, I will keep going.”

And his plans for the future?

“I don’t know. We could still be sitting here in 10 years.

“If Maddie is being held, she may be being brought up to speak a different language and not even remember her own name or where she was from.

“All we can do is try and keep public awareness high – and try and reach as much of that mountainous region outside the resort as we can.”

The body of a 8 years old girl, who died a month ago but whose parents had invented a scenario of abduction, was found on Friday by the French gendarmerie at Le Mans after 24 hours of research, according to a judicial source.

The father confessed in police custody having invented the story of abduction, said the prosecutor Joelle Rieutort.

"He confessed after the police pointed contradictions" and "fairly quickly said the abduction was a fake" she said to reporters.

Both parents were placed in custody.

The body of the little girl was found after her father's confession in a container in a warehouse belonging to the company where he works.

In custody, he ensured that the girl died in the first days of August of "natural death", he said his body had been kept in a freezer at the couple's previous home, says Ms. Rieutort.

"The autopsy will be conducted as soon as possible. There are no apparent signs of violence," she said.

The father alerted police Wednesday on the alleged disappearance of the girl. He claimed that he briefly left the child alone, asleep in his car on a fast food restaurant parking, just the time to pick up food with his 10 years old son.

Nearly 150 policemen were mobilized on Thursday and have been looking for the little girl.

The McCanns have launched a 48-hour media blitz in a fresh bid for information about their missing daughter.
Waiting to interview the McCanns these days is to bear witness to a well-drilled media circus: a luxury suite in a London hotel; trays of croissants, pastries and jugs of coffee; a revolving cast of journalists asking variations of the same questions.

“The doctors will see you now,” the same assistant quips as three more reporters shuffle through. It is a setting and a schedule tailored to the whims of film stars or musicians, in town to promote a summer blockbuster or a brand new album.

Of course Kate and Gerry McCann – both medical doctors — have nothing to sell. They are here to raise awareness about the ongoing campaign to find their missing daughter, Madeleine, who vanished without trace from a Portuguese beach resort during a family holiday a year ago this Saturday.

The McCanns have been criticized in some quarters for using the media to raise awareness about Madeleine’s disappearance, notably since they were named by Portuguese police as formal suspects, or “arguidos” in the case.

That criticism has clearly hurt. They are defensive about their use of the media, arguing that for 99 percent of the time they try to lead a normal family life, focusing their energies on their young twins, Madeleine’s younger brother and sister.

This 48-hour blitz has been carefully planned, they say, to capitalize on the inevitable coverage that the anniversary of Madeleine’s disappearance would have generated. Kate admits that her daughter has become iconic of the plight of missing children over the past 12 months.

Twelve months since they first stepped in front of the full glare of the world’s media, the McCanns appear relaxed and comfortable in front of a camera. I have to beg to differ on that one though! They sell the Kate and Gerry Show and the Iconic little Maddie they deliberately got rid of and then produced a logo to represent her and promtply trade marked. Trading has always been important to them, including tacky merchandise.

In this further story from CNN 3 May 2008 notice how Gerry insists they were not involved in their daughter's abduction. Was he afraid this is what would come out from the investigation? Maybe he should have realised that British Police were just not going to tell him anything, his action to the High Court that was ongoing was just a waste of time and of course a waste of legal costs, paid for of course from the Find Maddie Fiddle, better known as their Defence Fighting Fund/Contingency mortgage payer.

Thank you for your post of the LP letter – I note it clears up the point of why it was said the Mc’s have no credit cards.

Do you have any insight why someone should have a file reference on CATS. What Leicestershire police say on this point doesn’t make sense to me. It implies there was not any investigation into the Mccanns' (I think) but not why the reference was there in the first place.

“Searches made of the local section of child abuse investigation shows a registration number 19309 in CATS (system of action location). A consultation with the DC Soand from the department in question confirms that this is just a file reference, but as a complement to Operation Task system for the purpose of reference, if any investigation should be necessary by the department. No work has been done on the basis of this file.”

My impression of the file reference is that one was generated due to concerns about child (sexual) abuse and indeed I would not be the least surprised if Operation Task is a massive operation related to that.

I agree with you the action against Goncalo Amaral is very vindictive but also feel the major point is Gerry did all this to make money and that is precisely what he is about. Quite how he will continue to try and justify that to the general public, I just cannot imagine. To any normal person the suggestion of such a massive claim on top of all the rest sounds like lottery money!

Exactly Wiz, the letter seems to be rather carefully worded but does suggest that perhaps operation Task generated such a need for a file to be opened in relation to the McCanns. I do not accept that one would be opened for no reason!

Likewise I do not accept that their credit cards etc would not be shown up even on an ordinary credit search, let alone what the police may be able to access.

I continue to believe there are issues where it had been determined this was a matter for the UK.

Gonçalo Amaral's "The Truth about the Lie" to stay on the shelves
On September 10th, Duarte Levy reported that Gonçalo Amaral's book about Madeleine McCann's disappearance was still on sale.

The ruling by judge Amelia Puna Loupo that bans the sale of "Maddie: The Truth Of The Lie," will not have a direct impact on sales for the moment, in Portugal and anywhere else. This is because the order has not been completely formalised, as has been admitted by the lawyer representing the McCann family in this case.

Isabel Duarte noted that "the process has been secret until now to retain the utility of the decision obtained." In this case, the other parties have still to be heard - Gonçalo Amaral (author), Guerra y Paz (publisher) and Valentim de Carvalho (responsible for the screening of the TVI video)

As if that wasn't enough, there is also a 10 day delay to allow the three parties to oppose or 30 days to present before the Lisbon Court Of Appeal an appeal against the decision by the judge for the Third Civil Section of the 13th Lisbon Court. "As long as we have not received notification, we will continue to sell the book. When we have received notification, we'll see," a public relations officer for the publishing house Guerra y Paz, was quoted as saying by the press agency, Lusa.

The preventative order involves the publishers being banned from selling the books and videos, "that remain on their shelves or in shops and warehouses, and the requirement to collect (the copies) and hand them over to the authorised agent."

"The decision takes effect, despite the fact that it's not final, since the opposing parties, in keeping with, "the conflict principle," have the opportunity to express themselves," lawyer António Pinto Pereira explained to 24 Horas.

If Amaral and the publishers present arguments capable of convincing the judge that the decision carries serious and irreparable prejudice, "that would mean the results of the decision by the preventative order would be suspended"

Pereira Pinto would actually, "make a hybrid decision": not to produce any further editions of the book, but not to void the stocks or withdraw the books already on sale until there was a decision from the higher court.

If the higher court decides in their favour, Amaral and the publishers can go ahead with demands for compensation against the McCanns (for actual damage caused) and as individuals, against the judge Amelia Puna Loupo (for an illegal decision causing serious prejudice).

Elsewhere, it's business as usual.

"We have neither been notified nor informed of the decision of the Portuguese court, and we shall continue to sell the book," stated Isabelle Mazzaschi, representing the publisher Bourin distributor of, ""Maddie : L'enquête interdite," (the French title of Gonçalo Amaral's book) in France, Belgium, Switzerland and Luxembourg.

In Paris, Brussels and Geneva, the French version of the book by the former PJ coordinator was available yesterday afternoon in all the main outlets in spite of the fact that the order by the Portuguese court had been all over the media.

"The sale of the book will continue until we have been notified by the French courts," Isabelle Mazzaschi confirmed for 24 Horas, adding that, "the Portuguese decision has no weight in France." And she is right.

According to Pinto Pereira, "outside our country, the order is totally ineffective, because the principles of territoriality and sovereignty of other states cannot be violated."

The publisher, TM Publishers, which distributes the book in the Netherlands and in the Flemish region of Belgium, has also told 24 Horas that Amaral's book will stay on the market.

Delighted with the publicity surrounding the court's decision, this publisher (TM) has decided to place the cover of the book - "Maddie, De waarheid achter de leugen" the Dutch title, on the home page of its web site: www.tmpublishers.nl

"The book has made it into the top 10 best sellers and has been well received by the public," the publisher's spokesperson acknowledged, stressing that, "that is not a logical or normal decision in a European country."

"The book has been on sale for some time in our country and without a legal order we are not going to change anything," he insists.

All foreign publishers of "Maddie : L’enquête interdite", contacted by 24 Horas, have refused to withdraw the book from the shelves without a local court order, at the same time as they admit that they will be contacting their lawyers and the Portuguese publisher to decide the book's future.

Among the best sellers.

According to the publisher Guerra & Paz, the book "A Verdade da Mentira," has sold in Portugal alone ( because there are editions in Belgium, the Netherlands, France, Spain, Luxembourg, Italy, Switzerland, Germany and Denmark) close to 175 thousand copies (including copies sold through the daily newspaper, "Correio da Manhã"), a much higher number than other Portuguese authors, according to the sales figures for 2008. "A vida num Sopro" by José Rodrigues dos Santos, was the next best seller by a Portuguese author last year, with 115 thousand copies, followed by "A Viagem do Elefante" by José Saramago, with 100 thousand.

Amongst the top sellers is "Equador", by Miguel Sousa Tavares, which has sold close to 370 thousand copies. With a cover price of 13.30 Euros, Gonçalo Amaral's book has already taken 2.3 million Euros - the profits are divided between the publisher and the author, with the author receiving a lower percentage.

Thanks very much for that heartening report for Goncalo, which as you say, does make sense.

It is also possible to see where the McCanns have got this £1.2M figure from roughly dividing the gross value of book sales.

It seems to me that Judge feels that she has the power to tell Portuguese citizens what to do, but clearly does not have the power to dictate to other countries. Some interesting legal developments ahead that is for sure.

I do hope that Team McCann are once again going to rue the day!

One day we have a News Confrence telling the world Posh Spice Skippy has stolen Madeleine the next minute there are lawless towns around PDL and they belive that is where Madeleine is being held...

The second they get a whiff something might be banned they run off and tell the world all about how clever they have been???

They are really getting rubbish advice from the highly paid people they pay out of Madeleines fund...

If this book is sudenly un banned then everyone knows about it now and more people will ask questions...

Or maybe this is their way of making sure if they ever do get dragged to court they can scream Not Fair and get away with it???

Then there are worse places than jail being stuck with each other for ever must be hell...

Maybe you are in the line of business where I could do with some advice!

As you say, a standard credit report will give details of all loan agreements of whatever type and whether they are up to date, whether there is a default on the loan, exactly how often and for what duration they have been in arrears etc. Gerry has Master Cards and these would most definitely show up, even if always in credit because these searches can be as much to say something good about your credit history as bad. I continue to believe the level of mortgage relative to income was very high at £323,000 and when you think of what the likely purchase price of Rothley Manor would have been at the time of purchase demonstrates these two doctors had virtually no equity to put into their purchase. It paints a picture of a couple who should be on a good financial footing, but clearly were not!

With mortgage repayments of £2000 per month and Kate not working I believe this couple would have been struggling financially and I think it sets in context their offending. But I think that living in a large ostentatious house that at that stage they plainly could not afford would be part of what Gerry McCann is, a narcissist, he needs the trappings of success and power. They could have bought a more modest property but still lived in a very pleasant house.

Di, I do not think the Gaspar statements alone would have been the reason to investigate child abuse issues, I think it would have been the whole scenario of the McCanns insisting their serious neglect led to Maddie being abducted by a stranger. I also think there is likely to be very much more the British Police Agencies know about they did not share with the Pt because that would have been made public under Pt rules and child abuse investigations are always highly confidential. Living children cannot be identified etc. Letting anything further out does not just relate to Madeleine but also the twins and quite possibly other doctor's children as well. UK simply would not disclose such details.

I have to stress this is just my opinion but from everything I can see Goncalo is wrong, the McCanns did not kill Maddie in the apt and dispose of her body.

So looking at it from the McCanns point of view they have no problem in him saying this for a very long time so that they can make a huge amount of cash out of it. In terms of strategy and whether that was a good thing to do, it pays to remember lawyers are in business to make money, they can offer advice but at the end of the day, it is the client who gives the instructions and the lawyer does what they are told to do.

Whenever you get people who are seriously on the wrong side of a legal dispute you will often find they manage to convince themselves that if they throw enough money and enough heavy weight lawyers at the problem, they will win. But the reality is that people like Gerry McCann and probably Kate too become so obsessed they fail to keep a firm grip on reality.

In one sense yes, they can keep hold of the possible fact, they did not kill Madeleine and therefore on a strict legal analysis, he is libelling them, but at the end of the day they are still wrong because IMO they did something even worse than that, they arranged for her to be abducted and all they are doing is poking at a hornets' nest.

Maybe they are so desperate with the situation in UK they feel they can legitimately use the law to go after Goncalo in this way and he will effectively pay for their legal defence of a criminal action by UK against them. If that is what they believe, they are utter fools.

Although I am trained in the law, I would be the first one to say that using the law can be a very big mistake when you are, at heart, completely in the wrong.

Gerry McCann will just wreak more terrible heartache and distress for Kate with his tunnel vision, I am pretty certain of that.

Dr Martin Roberts commenting exclusively to the McCann files takes a closer look at what GM said at the recent press conference over Amaral’s book.

GM: "I guarantee that if we are awarded damages they'll certainly be used, erm... to continue the search for Madeleine and we'll certainly look at other worthy causes, errr... within that."

So what are the worthy causes within that search for Madeleine? That clearly precludes any other children benefiting. Not that I have ever been in the least doubt Gerry has never been of benefit to any child whatsoever!

I would say his real meaning is that the search for Madeleine is part of his defence and that all costs a huge amount of money, as does the new golf clubs and the huge mortgage etc with a wife who is too damaged to go back to work.

I understand the way his mind works and he would smile smugly to himself, thinking about how he is going to get Goncalo to pay to defend him. Psycho!

Just rereading 13th September’s Belfast telegraph article on JM.

Two comments both of which are true:

Dave the hapless PI:
But "there’s a glimmer of hope, a body hasn’t been found and when paedophiles kill they often dump the body nearby and this isn’t the case here.”

Joana Morais:
“Very true, but so do other killers who often return later to move the body to another location. But being an ex policeman he’ll know that.”

I think as a body has never been found the Mc’s have a window of doubt to hang their stranger abduction on and they milk this for all it’s worth.

Gerry in particular is very confident a body will not be found and the Mc’s and their associates were also very confident, from early on in this case, the mystery would not be solved.

The questions to be ask is why are they so confident, what do they know that we don’t?

As pointed out previously most people would not give up reasonably paid secure jobs to assist team McCann. The mystery might well have been solved very quickly and like Madeleine their jobs would disappear overnight.

What I would like to know is how did they have the foresight to know no evidence to pin point Madeleine’s whereabouts would be found, dead or alive, 2 ½ years down the line.

I wonder if I could find a similar crystal ball to the one they use.

There are so many strange things that they do and think are normal when a child is missing I cant belive they are not in a jail cell...

Leaving the children home alone
Kate going back to the Tapas to break the news (err what about the twins?
The shutter was smashed no the door was unlocked
Uncle John giving up a high paid job to get another high paid job that could have ended any second
And them being happy a family member wanted to make money from a fund that was supposed to be used to find Madeleine...

I could go on but we all know how odd they have been xxx

Hiya both, I think Gerry believes he has committed the perfect crime and his confidence of not being found out are baffling, but he clearly was taking steps to put out some very confusing images of Madeleine and he clearly took two old images to PDL with him.

I was just pondering this blog entry by him, one of the many he then thought he had better whoosh clunk, just like he did with his daughter:

I continue to believe the very last thing Gerry wanted was for some thug to recognise Madeleine and think wow I can claim the reward.

I think Gerry did show us his weakspot.

Hiya ICTOAN and how lovely to hear from one of our great old friends again, I hope you are OK and all current projects going well for you.

Thanks for the sad report which is an all too common picture of the male being violent and the woman failing in her duties to the child. I see the inference you are making here and it is a very clear possibility, particularly when we consider the bruises on Kate and her confirming she slept in childrens' room the night before. Although forensics would have demonstrated that anyway.

I do think that in view of just how common this scenario is of a woman getting herself a violent partner and then failing to protect the child, there should be a public services ad campaign reminding women very clearly of their legal duty of care and what steps they could and should take to protect themselves and their children in such a situation. Failing that, they go to prison!

Now I will go and check Felicity's email box :-)))

A woman jumped to her death from cliffs after her son's crimes drove her to depression.

Kim Rolf killed herself by jumping from the cliffs at Rottingdean after telling friends, family and mental health officials that she could not cope with her son Jack’s actions.

The 48-year-old, of Martha Gunn Road, Brighton, went to the cliffs to take her own life on October 18 last year.

Jack Rolf, now 18, had moved out of the family home but regularly returned to the house.

Mental health professionals who treated Miss Rolf noted her anxiety about her son.

After his mother’s death Jack Rolf began drinking heavily.

Earlier this year he was convicted of attacking a man in a car park and robbing a pizza delivery driver and a tourist at knifepoint.

He was jailed for six years.

Deputy Brighton and Hove coroner John Hooper recorded a verdict of suicide.

Hi ICTOAN, at 18 Jack would have been in the transitional stage between being dealt with by either the Youth Offending Team or adult probation. Probably still by the Youth Offending Team.

Youth offending team officers actually have far more time to spend with young offenders than probation officers do with adult offenders. There is a different approach of working more holistically with the whole of the family. Therefore I would have thought his YOT officer should have picked up on the problems he was causing to his mom and liaised with other workers who were clearly aware of her mental health difficulties being exacerbated by her son's behaviour. She should have been flagged as at risk of serious harm and steps put in place to protect her /get better treatment perhaps as an in patient because to do what she did she was obviously very unwell and could not have hidden that.

I think it is just one more example of how those who are responsible for the care of others in the community do not manage to actually deliver that care. Resources, hospital beds, it is very tragic for this lady.

As to the impact on Jack, his response in turning to drink and getting into even more serious crime is understandable. Sometimes it is recognised that the very best thing that can happen to such a troubled young person is a lengthy custodial sentence that gives adequate time to actually do meaningful work with him and that is what he has got. He obviously has a lot of problems that cause him to feel sheer rage and that can be addressed in custody. If he had received a short sentence, this is not protecting the public by seeking to rehabilitat him but the judge did give an appropriate sentence where he will have to spend 3 years in custody and then another 3 years on licence under the superivison of a probatio officer. If he misbehaves during that period he can be sent back to prison.

Have you seen this, Tony and Debbie are being Carter Rucked, cannot say I am surprised, he always said on 3As he wanted them to sue him, well now they made his dreams come true, he really should not have published and delivered those books!! :

yes read about TB and DB not sure what to make of it I never agreed with the leaflets especialy so close to the McCann's home (I hope everyone is watching out for the twins)...

But cant help think it is a battle TB will actually welcome???

Maybe if things go to court he should turn up in a T Shirt with the pictueres of them on Madeleines 4th Birthday on it not sure it was one of the 60 reasons but it is hard to belive it is the image of two parents who belive their daughter is in hell on the first of many painful anniversarys...

Well as you know I have never agreed with the conduct of Tony and Debbie and I think the leaflet drop in Rothley was an absolutely dreadful thing to do.

He is still talking tough but IMO this is definitely not a battle he can win. Carter Ruck's legal fees will be running at about £1000 per day probably and when they win and Tony cannot pay those costs and damages they will apply to take his house off him. If the man has any sense at all, now is the time to back down!

I do like the new look of your blog – although you say you don’t know how you achieved it - the look it is good.

On JM’s blog I was reading a post relating to TB &DB being Carter F*ck*d. A poster likened the situation to the tyranical reign of Sadam Hussein in Iraq where everyone who disagreed with him disappeared.

Of course in this case people are Carter F*ck*ed and silenced.

Reading the legal action being threatened I can’t help thinking this is exactly what happened to 3A’s, another thorn in their side of the McCanns, which was silenced.

TB sent the questions he posed to the McCanns 5 times for amendments or comments and they refused to answer.

It’s a wonder they didn’t act then but perhaps it took time for them to establish how much TB et al were worth and whether they had they spondoolies to make it worth their while.

Well I am not taking much notice of very abusive people who supposedly support Kate and Gerry McCann. I continue to believe they do them far more harm than good.

I see they are once again turning up here where they know they are not welcome with the same silly remarks. It does not seem to occur that is harassment but maybe it should. I think this is what we have seen from very extremist people on both sides of the debate and there is now way I could ever condone the conduct of Bennett and Co, he has got sites closed down by his behaviour and he has given the McCanns a perfectly lawful reason to sue him.

From everything I can see this action is more likely being funded by Brian Kennedy given the letters Bennett is very foolishly continuing to publish and I very much doubt he is the least bit concerned about the costs bill or who finishes up paying it.

If liability is established against Bennett et al and they cannot pay the judgment inclusive of costs, that will entitle Carter Ruck to go for their assets to satisfy the judgment and generally that means that person's house. Bennett brought this on himself by his behaviour and I can only say again, if he has any sense he will stop writing and publishing his letters etc and back down right now before they serve the writ which is now due and then he will be liable for the costs.
