Dead children's father held on sex charges

Kate and Gerry McCann on a recent visit to Portugal where they once again seek to suggest the key to this case lies in finding this mystery abductor of Madeleine. Comments posted in Portuguese newspaper Correia da Manha indicate that both the Portuguese and British expats, find their presence unwelcome. They are sick of the McCanns media circus and the farce they persist in and sick of the impact upon the area of the continuing stigma the McCanns and the disappearance of Madeleine have upon the area. These people are clearly in no doubt, it was the McCanns themselves who brought that stigma to such a lovely area and they just want to move on. The McCanns find themselves in the position where the money they can make out of a daughter they obviously caused to disappear has now ran out along with any sympathy they may have had in the early stages before people became completely clear this was no one in a million chance of some phantom boldly stepping in and stealing Madeleine without leaving a slightest sound for neighbours to hear or any forensic trace. It was, what it typically is when children just disappear and the parents get a detailed investigation of them, the parents themselves that made that child disappear.

Quite why Kate continues to grope the thigh of Gerry on the press pictures we see is beyond my comprehension. But there has always been something that is so highly inappropriate about this couple.

The reporting on the McCann case by papers such as The Daily Express etc was not a good day for Justice. It cannot be right that British newspapers feel they are not interfering in the course of justice because the case is being investigated in Portugal and therefore allow themselves carte blanche to just publish and be damned regardless of the impact upon a serious investigation into the degree of criminality involved by Madeleine's parents and more importantly still, whether she was/is still alive. We were told quite categorically there was Madeleine's blood and body fluids/hair in the apartment and hire car, that did not translate into fact, other than one miscroscopic speck of blood behind the sofa was thought to be a good match to Madeleine's. By no means can it be taken from that she died there. This could be accounted for by a scab knocked from her knee, a tiny cut, whatever. It shocks me that in spite of the clear forensic reports setting this out people still choose to refer to her apparent blood splattered up the walls. It could not even be identified as blood but the DNA extracted was found to be from a European male, clearly not Madeleine. It does not seem to occur to these people this human brown substance splattered up the wall could have been something far more unpleasant than blood like vomit or.. The facts in the McCann case are quite bad enough, it is a great pity people want to be salacious rather than look for the truth or be concerned about justice for Madeleine and other children. Quite why people cannot understand that courts will protect the rights of the McCanns to a peaceful life without harassment whilst they continue to be no more than police suspects, I do not know. I think it is more a case of they do not want to understand. Criminal law is a completely separate issue to libel law played out in the civil courts for cash. Criminal law is not used by individuals it is the State prosecuting you and unless you have acquired substantial assets as a result of criminality they are not after your cash, they are after your liberty! That is why there are so many safeguard in place to ensure people are treated fairly when suspected of crime and children who are still alive and have been sexually abused are not named or otherwise identified. I would just ask these people if it was your grandchild or your relative would you not expect the same for them?

In the latest Smith case the mother stands accused of killing both of the children after the father was extradited back to UK for child rape offences. So again we have this complex cross jurisdictional issue. What is libellous can simply mean what cannot be proven. I do not agree with the report below inasmuch as it appears to suggest an admission of libel against the McCanns by certain newspapers has anything at all to do with whether or not they are guilty in the disappearance of Madeleine. Libel law is for those who say their reputation has been damaged and so they are entitled to stop the publication of those damaging statements and to obtain monetary compensation for the damage caused. But this is clearly open to serious exploitation and there are so many cases in UK that illustrate how the devious, the dishonest and the downright greedy have sought to use this law which so often is for those who seem to be completely lacking in normal human morals.

Bloggers have a lot of freedom to say far more than the press are allowed to say, let us hope the actions of a minority who just go completely over the top in their conduct and claims do not spoil this right to freedom of speech for all of us. Some may wonder, just like me, why nonsensical letters based on what the News of the World say are written to senior members of the police and government, some may wonder why leaflets insisting Madeleine was not abducted she was killed by the McCanns got delivered to their neighbours. I wonder how these people can be so certain when they cannot even tell the difference between the blood of Madeleine and the DNA extracted from some bodily substance of a European male. If you are reading I would have a long hard look at your conscience and ask yourself why you are commenting on this case, that may take some soul searching.

Police name the two British children found dead in a Spanish hotel room as their father appears in court in the UK on child sex abuse charges after being extradicted from Spain.
Rebecca Smith, five, and her brother Daniel, 11 months, were found dead at the Hotel Miramar in the Costa Brava resort of Lloret de Mar yesterday.
Lianne Smith, 43, the children's mother is now being questioned by police over their deaths.
Her former partner, Martin Smith was brought back to the UK from Barcelona yesterday and appeared at Carlisle Magistrates' Court this morning.
Smith, 45, faced six counts of gross indecency with or towards a girl aged under 16 between April 30, 1995 and February 1, 2001; six counts of rape of a girl aged under 16 between February 1, 2001 and April 29, 2005, and one count of attempted rape of a girl aged under 16 between April 30, 1997 and February 1, 2001.
No pleas were taken and Smith was remanded in custody until 7 June when he is due to appear at Carlisle Crown Court.

In a statement, Cumbria Police said: "During the court hearing it was disclosed that Spanish police have informed Cumbria Constabulary that Martin Smith's wife, 43-year-old Lianne Smith, has been arrested on suspicion of the murder of his two children Rebecca, five, and Daniel, 11 months, in Spain.
Local press reports in Carlisle, where Smith was believed to be living, said that he called himself a professional medium, and had appeared on the television show Most Haunted as an expert on parapsychology.

Put bluntly, have any lessons been learned from the coverage of the disappearance of Madeleine McCann in Portugal three years ago?

The Spanish authorities investigate crimes in a different way to us with much earlier, and much, much more hands on, judicial involvement.

A judge from a court in the nearby town of Blanes (close to Lloret de Mar) will oversee the investigation and has already been to the Hotel Miramar and spoken to staff.

But the right to a fair trial is as important to Spaniards as here in Britain and article six of the European Convention of Human Rights, which guarantees the right to a fair trial, applies there too.
Lianne and Rebecca Smith had been reported as being missing from Staffordshire since December 2007.
Staffordshire Police said they had moved to Lichfield from Cumbria, before moving on again.
In a statement, Staffordshire Police said it was "very saddened" at the developments.
"It is believed that they were with Martin Smith, who was under investigation at that time by Cumbria Police for serious sexual offences," the force said.
"Our officers have worked closely with Staffordshire Social Services, Cumbria Police and, once it was established that the family were believed to be abroad, Interpol and other law enforcement agencies to trace the family.
"We are continuing to offer our full support to the investigation in Spain and Cumbria Police."
The bodies of Rebecca and Daniel were discovered yesterday.
Spanish television reported yesterday that Lianne Smith had called the hotel reception asking them to call an ambulance, but when the emergency services arrived there was nothing they could do for the children, who were thought to have died of asphyxiation.
The family of three had been staying in the beachfront hotel on holiday. El Mundo newspaper reported on its website that they arrived on Monday night.

Have media learned lessons from Madeleine's case?

As media interest focuses on the deaths of two British children in a hotel room in Spain, media lawyer Duncan Lamont writes for Channel 4 News about how the legal systems differ in the way they investigate such crimes - and how the media reports them.

The reporting of alleged crimes committed abroad by the British media can give a misleading impression of both how local cases are reported "over there" and how our criminal investigations are reported.
This is because the law of contempt of court, to protect the rights of defendants but also the prosecution, works in the individual jurisdictions.
The English and Welsh Courts protect the administration of justice in their jurisdiction. The Scottish courts ensure fair trials in Scotland and there are laws in Spain to ensure defendants are not prejudiced there.
In fact Spanish laws are, by and large, tougher – the investigators give less information to the media, defendants can remain anonymous until after conviction and the media by and large let the local investigators get on with their jobs (even if the process can be relatively slow).
Conversely Spanish newspapers can report on cases here in more detail that our courts allow by our media. The British media is not usually interested in Spanish cases, but when it is it is aware that it can report more than the local media because it cannot (it would argue) prejudice the course of justice in Spain.
Reporting the courts and ongoing police investigations is usually covered by qualified privilege which means that as long as you are contemporaneous and accurate, you cannot face a libel claim from a defendant who is subsequently found innocent and therefore (they might argue) should never have been tainted with suspicion of murder or whatever.
Things can go catastrophically wrong when there is such public interest in an alleged crime that the media overstep the boundaries and conduct their own investigations (interviewing potential witnesses can be prejudicial, as can offering to pay them money!) and even speculating wildly about guilt and innocence.
The parents of Madeleine McCann, who disappeared, presumed abducted three years ago, were the subject of a torrent of media speculation and allegation and subsequently won substantial damages (as have others associated with the case) from the British media for the publication of defamatory untruths about them.
In Spain the process may be about to start again as there have already been reports of a confession, suffocation – all matters that turn out to be wrong or misleading.
We know there are two innocent victims. But whether it could be murder, manslaughter or madness, is not as simple as may first appear.
This case may (or may not) capture the world's attention in a way that Madeleine McCann's disappearance did but the media in Britain, and indeed in Spain where there has been more detailed and speculative reports than usual, need to remember the obligation of fairness and accuracy – all the local police have officially revealed is that that the mother of two deceased minors has been detained so they can find out what happened.
Something tragic has occurred but there is no reason to that the Girona police will not scrupulously comply with everyone's rights under the Europe wide human rights principles and in particular the right to a fair trial for all involved, victims included.
Hopefully their work will not be sidetracked into investigations into media reports of the case.

Jo Morais has put together a very good post about Trafigura dumping toxic waste and then seeking to bribe witnesses. There is a picture of a child seriously burned by this which is very distressing.

Trafigura use the same lawyers as Kate and Gerry McCann to silence those who would seek to criticise them, Carter Ruck.

So the message seems to be if you are guilty but want to shut people up, these are the lawyers for you, they have the same complete love of money and lack of conscience as the "clients" they act for.

Kate and Gerry McCann conned money out of the public claiming some stranger "broke in" (McCann,Kate, Panorama,November 2007 in spite of Mark Warner/The Police making clear months previously there was no "breakin") and abducted Madeleine and then used that money to pay "private detectives" to find witnesses who will say they saw an abductor or they saw Madeleine.

Clarence Mitchell admits some of those witnesses have been paid, or, to put it another way, bribed.

We can see just how concerned Kate, Gerry and Dutch firm Trafigura actually are about child welfare and we still would like to know why they gave Mr Halligen up to half a million pounds/what has become of it and why they do not pursue a tracing action to recover that money as normal law abiding people would do? So far as the law is concerned it would be held that Halligen has been "unjustly enriched", maybe the McCanns have something to hide about their own brand of that.

Why were Ofsted just ignoring a schools track record on safeguarding children from sex offenders, writing reports saying the school procedures were exemplary and robust etc when in some cases yet another sex offender teacher had just been sent to prison? Do parents not have a right to know that some particular schools have employed one teacher after another, sometimes four at a time who are sex offenders? It appears that sometimes Ofsted inspectors did not even know, the school tell the Local Authority but they do not pass it on to Ofsted. Ofted say they have a policy where notwithstanding the track record they are satisfied that after there has been a further conviction procedures have been improved and so there is no need to mention it, sounds like a whitewash to me. What could be more important than safeguarding children from sex offenders?




Ofsted fails to tell parents of sex abuse cases

Exclusive: Channel 4 News has uncovered eight specific instances where Ofsted reports failed to highlight cases of sexual abuse involving school teachers. Ofsted say it does not report on cases of "inappropriate behaviour".


The investigation found cases where the education regulator did not highlight in its inspection reports of schools where teaching staff in England had either been convicted or were awaiting trial for sexual offences against pupils.


In many cases Ofsted gave the schools positive ratings for their "safeguarding" procedures.


One of the most striking cases involves Headlands comprehensive school in Bridlington where five members of staff have been convicted for sex offences against pupils in the past five years.


Astonishingly, the seven Ofsted reports covering the period when these offences and convictions occurred say nothing about them and instead some offer assurances about the quality of safeguarding at the school.


The police first began looking at the school in 2003 when allegations were made concerning science teacher Stephen Edwards. This investigation faltered.


In the following year Ofsted inspectors reported that child protection arrangements were "secure". It would later emerge, however, that during this period Edwards and another teacher, Ian Blott, had been having sexual relationships with pupils aged between 13 and 17.


A new headmaster exposed what was going on and a subsequent major police enquiry investigated several staff members. Ian Blott was jailed in 2006 for four years, Edwards in 2007, also for four years. Another teacher, Terry Mann, was imprisoned for similar offences.

In April 2008 a local authority report said there had been repeated safeguarding failures at Headlands. But when Ofsted published the findings of its latest inspection in May 2008, it made no mention of any previous problems with safeguarding and simply said that "procedures for the safeguarding of students meet national requirements".


Two months later, in August, a female classroom assistant, Lindsay Collett, received a conditional discharge for having an illicit relationship with a pupil. In the same month, the person hired to replace her, Christopher Reen, began a sexual relationship with a 15-year-old pupil.


The mother of this 15-year-old pupil spoke to Channel 4 News: "My daughter was too young to cope with it. It's caused a lot of stress within the family, the impact of what's happened. It saw the end of my marriage... It's been all consuming, really.


"I think if they had been regularly reporting on safeguarding issues and had been honest about what had happened in the past. Then things, yeah, would have been better for my daughter and maybe it wouldn't have happened."


Only last March, Christopher Reen was jailed for three years.


The school says the situation has improved. The head teacher, Chris Abbott, recently said: "A whistle-blowing culture has emerged and problems are dealt with immediately."


In another harrowing case involving a special needs school in Buckinghamshire in 2005, one of the teachers, Anthony Bulley, pleaded guilty to six counts of rape and sexual assault against four boys. He was jailed for 10 years.


Ofsted published its next report in 2007. It extols the virtues of the school, saying that child protection procedures are exemplary. But once again there is not a single mention of the major child protection failures which had occurred here since the previous Ofsted inspection.


A spokeswoman for Buckinghamshire County Council, which runs Stony Dean School, said that it had put in place "significantly more stringent and cohesive practices... Stony Dean School today is a very different environment."

In other examples found by Channel 4 News.


At a Birmingham school last year, a teacher was jailed for four years for having sex with a pupil. Two months later the Ofsted report did not highlight this, saying "safeguarding arrangements meet government requirements"


In 2008 in Barnsley, another teacher was jailed for the same offence. No mention of it in an Ofsted report six months later, merely an assertion that "safeguarding, child protection... meets requirements".


In Keighley, in Yorkshire, in 2005 a teacher who subjected a boy to years of sexual abuse was jailed for three years. Again, in the subsequent Ofsted report in 2008 there is no reference to it, but inspectors do report "effective child protection policies... are in place".


Of all the other cases that were looked at, there is only one instance of Ofsted making any reference to a previous child protection failure.


The politician who has chaired for the last decade of the select committee in charge of monitoring Ofsted, Barry Sheerman, had no idea this was going on. He said he was "shocked" and "astonished", insisting that the inspectorate has a duty to parents to report on these cases.


He also said: "We've been going through some pretty hard times with Ofsted at the moment, it's growing fast, it's growing to be a very big inspectorate and it's time, I think, it needs to be assessed very carefully by government, by the department, to assess if it's fit for purpose."


Ofsted state why - on occasion - they don't include these details. Parents can be reassured that when they don't include these details it's because the situation has been resolved. Patrick Leeson, Education and Care director at Ofsted told Channel 4 News:

"It is not the case that issues like this are never mentioned in an Ofsted report. What parents.... need to be clear about is that where Ofsted inspects a school and finds evidence that the child protection has not been adequately carried out, there will be reference to failings in an Ofsted inspection report.


"The focus of the current Ofsted inspection, school inspection arrangements, are to make very clear judgements about schools being safe places and actually carrying out their safeguarding responsibilities apropriately."


In an additional statement, an Ofsted spokesman said that although they ensure the right checks are carried out on staff members, they can't vouch for all their behaviour and that cases of inappropriate behaviour are a matter for the police and local children's services:


"Ofsted has an important role in checking that schools are doing what they should to keep pupils safe.


"Our inspectors make sure that the right checks have been carried out on staff and that pupils know how to ask for help. Our inspections cannot vouch for the behaviour of every member of staff, but ensure that the school is taking the right action.


"We do not investigate or report on individual cases of inappropriate behaviour. These are rightly a matter for the police and the relevant local children's services.


"When we inspect, we consider fully any information relating to safeguarding including information shared with us by the Independent Safeguarding Authority, and any such issues are considered as part of our inspection."

200 teachers per year get the push, if anyone thinks paedophilia is not a massive and major problem that needs bringing out in the open and confronting they should think about those adults and what they do to those children and the long term effects on that child, throughout the rest of their lives, often turning them into serious substance abusers and criminals.

Do not turn your back on safeguarding children and the lives that paedophiles ruin. Be aware!

Victim calls for fugitive attacker Martin Smith to face courts

A WOMAN who suffered years of abuse has called for her attacker to be brought to justice from his hide-out on Spain’s Costa del Crime.

Investigators want the public to help them trace 10 “most wanted” fugitives thought to be on the run in the Costa del Sol region, including Martin Smith, 44, of North Shields, who is wanted in connection with the rape of a child aged under 16 and gross indecency with a girl under the age of 16.

The 44-year-old is accused of raping and indecently assaulting a girl, under the age of 16, over a period of 10 years.

He was arrested by police in North Cumbria after his victim found the courage to speak out about the years of abuse she endured throughout her childhood. But he skipped bail in January last year and has been on the run ever since.

Last night, as pictures of Smith and nine other dangerous criminals were being circulated among the British community in Malaga, his victim spoke out about the years of abuse that left her feeling dirty and worthless.

The woman, who cannot be named for legal reasons, said she wanted to see her attacker caught so that he would never put another person through the same ordeal.

“It was regular abuse. It made me feel awful, small and dirty, and like I had done something wrong and I was the liar and you don’t think anybody is going to believe you. You think it’s all your fault,” she said. “I felt like I needed to have justice done because otherwise it could happen to other people and I don’t want anybody else to go through what I went through. It wasn’t a life, it was torture.”

Smith, who was born in North Shields, but has travelled around the UK, is wanted in connection with the rape of a child under 16, gross indecency with a girl under the age of 16, indecent assault of a girl under 16 and attempted rape of a girl under 16.

The alleged attacks, on one victim, occurred between 1995 and 2005.

Police hope the public in Spain and the UK can help find the suspects, which include some of Britain’s most dangerous child sex offenders.

Smith’s victim only spoke out about her terrifying childhood after she was free from the abuse. She has now started a new life at university and has got engaged.

“I had been free of the abuse for two years so I was feeling in a stronger place. Good things had started to happen and I had people around me who I knew would support me and who would believe me,” she continued.

“As soon as you feel strong enough you have to do it. It is terrifying and it’s a huge thing to do but you know you have done the right thing.

“He needs to have justice done. He can’t do this to somebody’s life and get away with it.”

Det Supt Andy Slattery, of Cumbria Constabulary Public Protection Unit, said: “We are investigating a report of historical sex abuse against a girl under 16. Martin Smith was arrested in connection with this case but fled the country whilst on bail.

“It is extremely important that we speak to him to bring a conclusion to this case and get justice for the victim.

“We are working closely with our partners in Spain and a European Arrest Warrant has been issued to help us track him down. We are urging the public to help by appealing to anyone who knows him or has information as to his whereabouts to get in touch with us.”

Information given to the charity by the public could be used to help police in Spain find the crooks and arrest them.

Lancashire man jailed for sex attacks

A 35 YEAR old man from Leyland, Lancashire has been sentenced to 14 years in prison for a series of sex attacks and possessing indecent images of children following the discovery of his role in an online paedophile network.

In January of this year, Delwyn Savigar, of Queensway, pleaded guilty to an attempted rape which he committed in 1999 and an indecent assault in 2002. He had previously pleaded guilty to raping a schoolgirl in 2002 as well as distributing and possessing indecent images of children.

Savigar was identified during a joint investigation between the UK’s Child Exploitation and Online Protection (CEOP) Centre and the US Department of Justice (USDOJ), US Immigration and Customs Enforcement Agency (ICE), and US Postal Inspection Service (USPIS).

He was arrested by Lancashire Constabulary in September 2008 following intelligence provided by CEOP which demonstrated that Savigar was a key administrator in an online group which allowed hundreds of members worldwide to share indecent images of children.

Savigar’s arrest on 10 September 2008 was coordinated with the arrests of other suspects in the US. Forty-three UK suspects have been identified as members of the internet bulletin board operated by Savigar and separate police investigations are currently underway. The investigation in the US is also ongoing.

Upon examination of his computers, Savigar was found to have in excess of 100,000 indecent images of children. He was subsequently charged with distributing and possessing indecent images of children.

While in custody, the defendant’s DNA was taken to be loaded on to the National DNA Database. A month later, detectives based at South Ribble CID were informed of a DNA match with Savigar relating to the rape of a 13 year old schoolgirl on 30 April 2002.

The victim had been walking along a quiet path in Penwortham when she was approached and forced down some steps before being raped. She reported the matter to police and a full DNA profile was obtained although at that time there was no match on the database.

Savigar was re-arrested on 16 October 2008 by South Ribble CID officers and charged with rape.

Due to the serious nature of this stranger rape on a schoolgirl, detailed crime analysis was conducted on other offences within the area that could be attributable to Savigar. Detectives were concerned that he had not been brought to the attention of police previously and about the serious nature of this offence when he would only have been 27 years old.

Lancashire Constabulary’s Cold Case Investigation Team began to investigate other cases, as a result, he was charged with attempted rape and indecent assault on two further victims.

In the first incident, a 16-year-old girl was walking to work through playing fields in Walton le Dale on 18 April 1999. Savigar pushed her to the floor and placed his hand over her mouth and throat before indecently assaulting her. The young victim screamed and managed to struggle free before running off.

In the second incident, a 13-year-old girl was walking alone along a country lane in Much Hoole on 13 April 2002 when she was approached from behind by Savigar who placed his arm round her neck and mouth before attempting to rape her.

Detective Inspector Nina Foley, who led the investigation, said: “I am pleased with the sentence handed down by the judge today; it quite clearly reflects the very serious nature of the wicked crimes Savigar committed.

On Portuguese TV, however, he declined to say precisely what that meant. And while his claim might ultimately prove true, it is based on the flimsiest of evidence.

Critics have questioned whether police were in fact trying to divert attention from their own failures in the investigation.

More sex offenders being picked off in an ongoing investigation concerning historic sexual abuse of children, this time from an area near Lisburn. I am sure there must be many people who are feeling very afraid as the police say we are not releasing any more details, more to come!

Justice for all abused children, including those who are now adults, but of course historic could mean 3/5 years.

Thanks for those past few kind words, it is indeed gratifying to know that some of us are on the same wave length. As you rightly say many share the view that the Mccanns were undoubtedly responsible for the disappearance of Madeleine but it is impossible to surmise further without positive evidence as to her fate. On this point I should be interested to learn where you think she may be if still alive. I am certainly not disputing the possibility of kidnapping/trafficking but I remain convinced that if they disposed of her alive there is little hope that she may still be so. Short of the labyrinth of dungeons almost pin-pointed by Edgar how could anybody conceal such a famous person from eventual discovery? Homicide is an element that must never be dismissed until there is proof to the contrary ~ guilty until proven innocent?

Your lead into this thread says it all!

In spite of my pessimistic attitude it is gratifying to know that the appropriate authorities are taking child abuse very seriously (contrary to popular belief) and at least some of the earths scum are being prosecuted for their sick, perverted self indulgence. Even one conviction out of one hundred is better than no conviction at all. At the same time it arouses public awareness as to the extent of the problem and hopefully encourages development of public responsibility to look for the warning signs!

If your persistence pays-off in the future, I am thinking of nominating you to be considered for inclusion in the Queens honours ~ how does Dame Viv grab you!!!!

This is the sort of comment I mean when suggesting that Gerry could not care less who knows he is guilty. It is like the action against Goncalo Amaral, his reasoning is simple. You cannot prove I killed Madeleine and so saying that entitles me to a load of cash.

This is typical of his mindset, he enjoys it, it is like a game where he has control of that vital information as to what happened to Madeleine. Who can take that control from him? The Police. The first time I saw Gerry looking quite forlorn was as he exited the police station in Portmao (sp ?).

Being in control is terribly important to him and in that gruelling situation he was entirely under the control of the police and having to perform to his highest level which must have been quite draining for him.

The remark you posted is a clear admission isn't it. What normal parent would make such a remark as though confusion as to what happened to their daughter was either helpful or amusing? Confusion can only be helpful to one who committed the deed but does not want people to have the same knowledge as the perpetrator.

It is his media circus and he needs to pull all the strings, this gives him great pleasure, including figuring out how much money he can make from each new venture.

One thing I would love, a confidential, no holds barred chat with my hero Jeremy Paxman. I found the interview he did and the look on his face just fascinating as he so carefully studied Gerry, almost like he was putting him under the microscope. I will never forget that sickening smirk that Gerry just could not help but break into as Jeremy said well it is your media circus you just use the media as and when it suits you, don't you? (not verbatim of course).

Of course Jeremy was not allowed to accuse Gerry and neither is he allowed to publically state what he thinks, but I think his face and the nature of the questions put just said it all.

It is curious and gratifying to me that someone really seems to be on just the same wavelength as me as to how they see this case and the point you make, it is impossible to surmise further without further evidence is the exact point that so frustrates me when reading so many comments from other bloggers. What happened to Madeleine is she just disappeared from that apartment without leaving any trace, quite how people can just keep categorically stating well she has been dead since 3 May, even going into graphic detail about how she supposedly died is simply beyond me. It was OK surmising from the press reports we were getting in 2007, but now we know that much of that was just based on the view of a couple of police officers, rather than hard evidence, it is not OK, IMO.

But what certainly is a fact for both of us clearly, is that the McCanns were somehow involved in that disappearance and it certainly looks from reading police comments/ the questions put to the "key witnesses" on the file as though it is believed she went missing around 7 pm that night, well before the McCanns arrived at the TAPAS restaurant.

I have never discounted homicide, it remains a very clear possibility. I think they formed the view Madeleine had to be got rid of and that is certainly one way to get rid of her. But disposing of a body rather than a living child would undoubtedly have been more difficult and people would be less likely to assist them. But say Murat was promised, you will become a millionaire because this is a foolproof plot, we will hype up the media to libel us and then make a killing with libel actions. Some people would help dispose of a child's body for that sort of money, but likewise he would also consider it worth his while to assist in removing her alive. I am not saying that Murat was their accomplice but someone helped them that night, there just had to be a vehicle to take Madeleine away in. There are other possibilities, Geraghty, did OB have a hire car and of course someone like Kennedy could arrange literally anything he liked with the sort of money at his disposal.

So where could she be if she is still alive, again it is just pure guesswork. But I find it a bit odd the way CEOP approved that madeup picture of Madeleine with an Arabian look. If she was still alive it would be very difficult to keep her in the Westernised world because she has been plastered all over the media. But perhaps the Middle East, "treated like a Princess"?

Of course if she was passed straight into the hands of a gang of paedophiles for perhaps photographic work they would not risk the police actually finding them with Madeleine.

I really respect the view of Mr Menezes the Prosecutor who gave evidence at Goncalo's hearing where he sought to overturn the injunction. Aside from stating he believed charges for kidnapping/trafficking could have been brought, he also said there was a 50:50 chance of Madeleine still being alive. The McCanns have always given the impression they are in no great rush to find Madeleine but know that she is out there. If, British Police knew for a fact they were guilty of her homicide, even allowing for the audacity of Gerry McCann, it is difficult to accept he would have gone ahead with the action against Goncalo, but of course Gerry is no ordinary person. He is a person who, in his own words pursues "high risk strategies". I think he would know from legal advice that both Portugal and UK would want Goncalo silenced and so in that respect he just had to win. But what is to become of their supposed action against Goncalo for damages, in all the circumstances?

Lol SB I am not sure I deserve to be Dame Viv, but at nearly 56 I am certainly starting to look like a bit of dame!

There are a lot of prosecutions and ongoing investigative work taking place against large organised gangs of paedophiles. That gives me continuing optimism that Madeleine may be recovered, dead or alive and we will see a breakthrough in this case.

There is also a greater emphasis on raising public awareness of the extent of the problem. If parents are more aware that the overly friendly male who likes to take their daughter out and cuddle her or the over attentive school teacher, they are better prepared to protect their children from terrible harm that could be about to or actually taking place that they are simply unaware of. If people do not know of the extent of the problem and the red flags they should be aware of they cannot protect their children and so this just has to be a good thing.

“It is not usually wise to venture into questions of individual guilt or innocence. These are properly matters for the courts, not for politicians.

I do so briefly today because I have never seen so much speculation and so many press stories, created by the spin doctors of the parents and by mysterious sources for the Portuguese authorities, when there is so little fact behind it all. It is part of the modern disease, of fighting battles through the media instead of people getting on and doing their jobs diligently.

The Portuguese side, after four months, seem to have decided that the little girl is dead and the parents were involved in the death. To prove this it would be helpful to have a body, and an autopsy which shows how she died. At the very least, if they cannot find the body, it would help if they had an independent witness who had seen the death occur, or had seen the parents moving the body after the time of the disappearance. It demonstrates little police competence that this most closely watched couple was able according to sources to keep the body from police attention immediately after the disappearance, and then to move the body many days later. How come the police did not search extensively enough to find the body at the beginning? How did they miss any evidence of harm to the child they now might claim to have? How did no-one see anything strange when the body was moved?

The McCanns theory that the girl was abducted also needs evidence to support it. Can they clear away any doubt over whether entry was forced into the holiday home? Were there no screams or disturbances as the little girl was taken? Did no-one see her at any point as she was carried away? Why has no-one seen her since, despite the massive awareness campaign? How did the abductor time the removal, given the fact that parents and friends were returning to keep an eye or ear open for the children?

Have the police questioned all who left that resort around the time of the loss of Madeleine?

This is a heart rending story. The two sides seemed determined to damage each other. The truth remains a casualty. Maybe the McCanns should employ a private detective rather than a spin doctor, to find evidence of the abduction they are sure happened and the trail to her present whereabouts. In the meantime with so few facts it is difficult to say what happened, apart from understanding the grief that the loss of Madeleine is causing.”

I often wonder if suffering from stress (or more)at home is it really advisable to hope for a miraculous change of circumstances by taking a holiday. Holidays when everyone is thrown together 24/7 can often be more stressful than being at home.

Gerry’s attitude is incontestable, who can possibly deny his blatant arrogance, audacity and desperate need to control. I always think of his behaviour alike to Tom and Gerry only with a reversal of roles ~ playing cat and mouse, catch me if you can! I too have always thought him to be laughing at our expense which in itself is infuriating so I can imagine how the authorities must react to his complaisance.

Reverting back to public awareness, I am by no means a prude but in my opinion television has a very negative effect on modern life. There is a distinct propensity to 'normalise' social activities and thus make them appear acceptable, which of course they are not! For example ~ teenage pregnancy, rape, drug/alcohol abuse, child abuse, antisocial behaviour, bullying, violence, obscenity, the list is endless. Perhaps the situation is not as bad as I think it to be, as I said before I only have access to BBC Entertainment channel which could be the dumping ground for U.K. rejects. Whatever, I have tried on many occasions to generate a change in this area but always get caught up in the BBCs office of circumlocution!

Realising you are only suggesting a tangible scenario for a live Maddie in my opinion the idea is very unlikely. Again we must remember that the Mccanns are in reality a non-entity and although they could realistically be mixed up in some nefarious activities the opportunity to be in any way connected to the astronomically wealthy Arab world I consider to be a million to one chance! Maybe cute but Madeleine could hardly be considered beautiful and I believe with their bottomless pit of opulence they can afford the very best attainable. What would an Arab want with a little girl anyway? To add to the harem and in time be treated in the same way as any other possession, not an enviable position for a little western child. The age progression portrayal of a North African/Arabian transformation is another very shady area. Generally European kids living in a hot climate do not change colour unless they spend a lot of time in the sun and even then they develop a very golden complexion whether dark or light haired not a swarthy native colour.

I totally agree that Madeleine’s disappearance was arranged earlier than assumed by the PJ. That can be the only possible explanation for enabling them, with the help of accomplices, to remove her from the apartment and far away from the crime scene long before Kate finally raised the alarm and of course ample opportunity for Gerry to implement his long term 'high risk strategy'!

Hi both and thanks for some interesting posts again.

John Redwood seems to me to be very subtly discounting both assertions made and clearly implying, so far as he no doubt thought prudent, given his position, that he believes the McCanns to be guilty. There is much that he says that I wholeheartedly agree with and again it is something that has annoyed and upset me.

You do have two warring sides using the media, rather than either side demonstrating any real concern for one missing little girl called Madeleine.

You do have parents who simply have not behaved as any normal parent ever would in all the circumstances and that is more than enough, in itself, particularly taken with their inconsistent accounts to totally discount their version of events.

But on the other side you do have a police officer who has behaved in a completely unexpected and totally unethical way. There was just one witness in court who supported his opinion, Almeida and I am afraid that causes me to lose faith when you see there is just no evidence to support their assertions. I am afraid I found the documentary Goncalo produced, lame and incredible about how Madeleine supposedly suffered this accidental death whilst they were at The Tapas, he made no attempt to explain how they could so quickly and so completely have gotten rid of her body and cleaned up. It is just quite impossible to believe by any sensible person IMO. It just did not really make any sense. And yet, he sought to assert as an established fact, the little girl is dead. I find that unacceptable for a man in his position. I have noted from the PJ files that just prior to him being removed from post he was desperately requiring Portuguese labs to check the results of British labs, all to no avail, he wanted to be proved right. It is not part of a proper investigation to go into it with a fixed view as to what happened and then seek to make the evidence fit that view.

In court Ricardo Paiva confirmed that Goncalo did prevent other theories from being investigated. I remain of the view that Madeleine likely was alive when they arranged for her removal from that apartment, otherwise the confusing array of pre arranged and time distanced photographs released at various intervals, some apparently doctored and the complete failure to ever mention the reward monies just makes no sense to me. It just seems clear to me they were actually very worried about Madeleine's whereabouts being genuinely reported by someone seeking to claim the reward monies. The most horrifying prospect of that is the McCanns knew she was with some very unsavourary criminals.

Gerry demonstrates a mindset where he does not actually accept that being with paedophiles would do Madeleine any serious harm at all. That I am afraid, to me, says just how utterly sick and twisted this man is, and what he is capable of.

Firstly, yes what a fabulously hot and sultry day, why bother to go abroad when we get this in May, stunning, my tan is being topped up nicely, lol!

Wiz, I think there is a lot of evidence of severe stress emanating from that holiday. Kate sleeping away from Gerry on at least two night, in with the children. Kate being covered in bruises immediately afterwards as seen in many photos and finally admitted by her mate Fiona although a pretty bizarre excuse given for them. A couple of doctors who actually claim they go out night after night on the lash leaving their three tiny children alone and they leave the door open. The writings of Kate in her diary which gave the clear impression the Pt Police of an aging mum, in terms of caring for such young tots, not coping well and not receiving any support at all from her husband who was more concerned on improving his tennis stroke. They chose to go on a group holiday and yet they breakfasted and lunched alone every single day, in their apartment. I get the impression this was always the holiday from hell.

SB I did not take the Dame Viv suggestion as in any way an insult, just too grand a title that is all, it was quite an honour really, so do not worry about that.

I do not mind being nearly 56, yes I used to be younger, better looking, fitter, slimmer, but that is just part of being more mature and I am still having a great life and so would not wish to turn the clocks back. In many respects I have so much freedom to to do what I want now and that just take some beating!

Wiz maybe I should just add one thing to that, being aware that Maddie cried alone, but going out and leaving her again. Even if parents were taking the risk and popping back to check on them, when they had the knowledge that was simply a disaster because the children were awake and crying there is no way on earth they would have done that again. Further, they would have been deeply distressed by what Madeleine had to say.

And then Gerry's abusive comment on the holiday bus, f..ing and I am not here to enjoy myself, and that was before they even got there.

All in all, a highly dysfunctional family. To state the obvious, functional families do not go abroad as a family of five and then come back as a family of four, a catchphrase the McCanns thought appropriate to repeatedly use. They bring all their kids back quite safe and well, unlike the McCanns who just brought the twins back and then encourage them to play the "game", hunt the monster who took Maddie. As you know I do not believe they should still have the twins. A poor family from a council estate may have got better service because they kids would have been removed!

Something that always sticks in my mind is the words of criminal profiler Pat Brown when she said of the Mcs. If they think it OK to leave 3 children under the age of four alone night after night what else might they do. Hmm…. Chilling words imo.

About a week ago I was reading in the Mail an article titled ‘Why are doctors addicted to drinks and drugs'. Apparent one in six of them are! It’s food for thought when you think of the number of medics holidaying in PdL with the Mcs.

The way Pat Brown looks at the conduct of the McCanns is exactly the same way that social workers and probation officers are trained to consider the risk factors that present, you are looking for red flags that indicate a serious risk of harm and aware that what you can see may just be indicators. As Pat says, what are they capable of given that behaviour we can see and what is really going on.

I think it is also a question of their attitudes to childcare displayed and the typical conduct of criminals with a lot to hide, minimisation and denial. I honestly do not know why two seemingly intelligent people have gone on TV and given the performances that they have. To any normal person their laissez faire attitude to childcare and bizarre excuses offered just enflame and enrage ordinary people. Their acting on so many occasions has been poor and no reasonable parent in the circumstances would need to keep on seeking to defend themselves. I have never seen anything quite so sickening and bizarre as Kate explaining how Madeleine "just moved on" and the bizarre, uncaring smirk that she put on.

These two may be very well qualified and intellectually able, but in emotional intelligence, they are severely lacking, that is why their children are at such serious risk of harm.

It is interesting you mention the statistics concerning substance abuse by doctors because the figures are very similar with solicitors. These are high pressured jobs where there is a need to seriously perform to earn the high salaries they are paid.

I have always felt that substance abuse be it from drink or drugs is part of the McCann lifestyle and when children came along those two things just do not mix. Looking after children requires stability and responsibility, not something these two were prepared to give. But I think there are even more serious issues with Gerry and David Payne and again child abuse is not something that does not affect qualified doctors any more than substance abuse. It is just that professional people can afford those substances, do not need to steal to get them and so less often come to the attention of the police. The same with childcare issues, abuse by more professional families is far better concealed. Until something as serious as Madeleine, brings it to the fore.

I didn't think for a moment that you took offence!

I managed to locate the interview you mentioned between Jeremy Paxman and Gerry Mccann and take your point entirely, also I have never before seen the John Redwood blog entry posted by Wizard which makes for interesting reading. In both instances and many other Mccann interviews over the past months it is apparent that the interviewers are having to suppress their true feelings as to the accountability of the McCann’s in the disappearance of their daughter. It is however, still fascinating and interesting to watch/listen to how the likes of Paxman coax the interviewee into revealing things they would rather not divulge.

This identifies yet another flaw in Gerry's character. Well educated he might be, a consultant cardiologist he might be but he cannot understand that there is a multitude of people that can match, if not exceed his level of intelligence. It is blatant from the way he reacts to certain unexpected questions that a) he is very uncomfortable with the question and b) he lacks sufficient perspicacity to respond quickly and coherently to the question. Clearly he is not quite as cunning as he likes to think himself! Net result ~ anger and/or waffle!

In addition, time and time again they come out with the same old statements ~ No evidence to prove Madeleine is dead. No evidence to suggest our involvement in her disappearance. Witnesses and sightings being ignored by the police. Scoping exercises. Complete review of all the evidence. Blah! blah! blah! Given his level of intelligence you would expect him to have planned a more detailed defence strategy than that!

It is useful to completely clear the mind of the past months spin and revert back to the beginning to put things back into perspective. The more I think about it, the more your thoughts relating to Madeleine’s disposal seem perfectly logical.

So, apart from being initially deceived by the theories made public by the PJ, what facts are we left with? I am in no doubt that the McCann’s and their loyal friends deliberately trashed the apartment prior to the arrival of the police, nor do I doubt their spontaneous desire to load up the washing machine with their entire wardrobe in advance of forensics. I will pass over the contradictory statements, timelines and all the general methods of creating confusion as that aspect has already been done to a turn.

Then we have Gerry's extraordinary bedtime reading ~ a very strange choice for holidays (perhaps teach yourself tennis would have been more appropriate). Why on earth would he be in possession of such reading matter unless it was intended to be diversion tactics and the same applies to Kate’s shrine. Surely early days for exhibiting that genre of grief. Much of the misleading information fed to the public could be construed as merely image protection, but why go to those extremes unless there be an ulterior motive?

Again the gallery of dissimilar photographs spread across the globe. Apart from not wanting Madeleine discovered, why do this unless you intend to lay a false trail in order to conceal the truth. If indeed this was Gerry McCann’s intention, it certainly fooled Goncalo Amaral. Even the holiday itself was designed to create a false impression so how anybody can think this anything but a premeditated crime is to me incomprehensible.

As you have pointed out, it is easier to dispose of a living child than a dead one ~ however that does not mean that I think she is still alive! I remain convinced that she was an abused child and needed to be disposed of permanently ~ I don't believe that Gerry Mccann is stupid enough to risk her discovery, which I think would eventually happen if she still be alive.

Apologies if I am not making sense but I stopped smoking recently and it's playing havoc with my psyche!

This is of course only one interpretation of the word 'troll' but used in the context of internet surfers there is a distinct similarity. The case of Madeleine Mccann has created much animosity within the many blogs that originated in support of justice for little Madeleine ~ unnecessary animosity, arising from bigoted, hypocritical, vicious individuals whose sole object appears to be destruction of a worthwhile cause.

What I fail to understand is the reluctance by these 'trolls' to reveal their true identity and more to the point to provide a valid argument in support of their attacks against such blogs as this. This shows a singular lack of courage which is tantamount to cowardice. Granted, the majority of posters use a pseudonym in preference to their given names but they do not hide behind anonymity nor do they persistently change their names in order to conceal their identity.

Normally if a person resorts to abuse and aggressive behaviour it is because they do not have a valid argument so they must devour their enemy with personal enmity ~ not a very commendable act I am sure you will agree! So, do yourselves a favour if you want to be taken seriously ~ reveal your identity, provide a valid reason for your attacks, put forward a dignified argument that is worthy of discussion. Otherwise your contribution means nothing!

Remember ~ The only reason that these blogs have been created and people like me contribute our opinions is because a little girl has disappeared from the face of the earth, a little girl that was seriously let down by her parents!

Di, great to see you back and good luck with the wedding plans which must be really exciting.

Would a couple of normal doctors with no criminal agenda and concerns for their children leave their kids alone with the door open every single night?

Would a bunch of doctors who were immediately quite certain some predator "broke in" through the small window and metal shutter (ignoring the open patio door) and stole Madeleine from her bed, repeatedly mess with those shutters /window, even closing them again, and allow all and sundry to traipse all over the flat, prior to even bothering to ring the police?

Would someone from a council estate with no degree level education be quite sure the crime scene had to be completely untouched and the police immediately telephoned?

Would parents from a council estate with no degree level education have left their children every night with the door open and done so again when the children had been crying and complained about that and even gone on TV to brag about it?

There are some simple yes and no answers to these questions.

That is why there is an ongoing investigation into the disappearance of Madeleine in the UK and that is why Leicester Police announced their determination to "bring to justice those behind the disappearance of Madeleine McCann".

This anniversary special following Kate and Gerry's recent trip to Portugal is almost too pathetic for words, even Clarence Mitchell has to say "so long after the event".

If this man did not think it was relevant then, who has greased his palm to suggest it is relevant now and how on earth would he even remember the date of this incident, three years down the line!

I read another report and the PJs were said to be either pink or yellow, perhaps they were actually yellow and that is just the wrong colour. Of course these people with this sleeping child in the back of a van that they made no attempt to hide, looked just like gypsies, well of course, they would do!

A Portuguese man has come forward to report a possible sighting of Madeleine McCann the day after she disappeared, it was revealed today.

Carlos Moreira, 65, saw a young blonde girl wearing pyjamas like those of the missing British child in the back of a van on May 4 2007.

But he only contacted the private investigation team employed by Madeleine's parents, Kate and Gerry McCann, last week.

It is understood that he did not think the information was relevant until learning in a recent TV programme that Portuguese police did not mount roadblocks following the little girl's disappearance.

Madeleine was nearly four when she went missing from her family's holiday flat in Praia da Luz in the Algarve on the night of May 3 2007 as her parents dined with friends nearby.

At about 8am the next morning Mr Moreira saw a young girl lying at an angle in the back of a white van at a roadside snack bar near the Portuguese capital Lisbon, some 170 miles to the north.

He said she was with a man and a woman who looked like gypsies.

It is understood Mr Moreira was not certain that he saw Madeleine, but recalled that the girl was wearing pink and yellow pyjamas similar to the ones the missing child had on when she vanished.

He said: "When the van door was opened, she did not wake up, as if she was drugged. This girl was blonde and looked around four."

McCann family spokesman Clarence Mitchell said: "I can confirm that Mr Moreira has been spoken to by the private investigators currently searching for Madeleine.

"I cannot go into any further detail for operational reasons.

"He has done absolutely the right thing in coming forward with his information despite it being so long after the event."

and if we look at the video of Maddie getting on the plane and the tennis balls pic, she does not have blond hair, it is brown, as you would expect it to be following the loss of babyblond hair and with two brown haired parents. Kate McCann has dark eyes and dark eyebrows together with oft showing roots, there is nothing natural blond about her.

It is very difficult to know quite why this mother committed such a terrible act but in her mind it is clearly linked to the removal or the conduct of her husband who abused a child over a ten year period but she flitted with him. Most odd! I suppose she felt that if she did not she would lose the children anyway, well she has made sure no one else can have them.

Court officials in Spain say a British woman has admitted killing her two children in a hotel room on the Costa Brava.

Rebecca Smith, 5 and her 11-month-old brother Daniel were found dead in the Hotel Miramar at Lloret de Mar on Tuesday.

Lianne Smith, 43, was arrested by police shortly after their bodies had been found.

Following a court hearing in the nearby town of Blanes today, judge Rafael Fernandez ruled there was evidence that she was responsible for the deaths. Smith will now be held in custody in Girona.

Court officials said in a statement: "Smith spontaneously declared that she had killed her two children.

"Forensic psychologists carried out an examination for the arrested woman, Ms Smith, concluding that she was conscious and aware of the situation and that the results of the psychological tests were normal.

"A statement was taken from Ms Smith in the presence of a lawyer, a translator and the public prosecutor. She was read her rights."

The children died on the same day Smith's partner Martin Smith was extradited to the UK on child sex abuse charges.

He was remanded in custody at Carlisle magistrates yesterday accused of 13 charges child sex offences said to have been committed in the Cumbria area between 1995 and 2005. He has also been charged with jumping bail. Ms Smith and their daughter had been reported missing from the Staffordshire area since December 2007. It is understood Martin Smith has been told about the deaths.

Post mortems were carried out yesterday on the two children.

The results have not been made public, but reports in Spain suggest they had been suffocated.

In this extract her ex partner says she barred him from seeing the children in 1992. Her new partner commenced a ten year period of sexually abusing a child in 1995 if the child was under sixteen ten years later that child must have been no more than 6 when the abuse which included rape commenced.

Revealing that the double-murder suspect had a family on Tyneside, John Hope, who used to live in Killingworth, is reported to have said he thought his ex must have been brainwashed into killing her two children by her suspected paedophile partner.

Mr Hope, 54, who was married to Lianne until 1992, has reportedly said the woman he knew would never have hurt her children.

The bus driver, who had two children with Lianne, Sarah and Christopher, said: “The woman I knew would never have harmed her own kids in a million years. She was a great mum.”

The couple split in 1992. He said he continued to see the children for a year, but then Lianne barred access.

A one-minute silence was held yesterday outside the town hall in Lloret de Mar in memory of the two infants with more than 100 locals and holidaymakers taking part.

Deputy mayor Ignasi Riera i Garriga said: “The local citizens wanted to express their condolences for the tragic deaths.”

“We are talking about children aged 11 months and five years so it’s always going to be something that is very sad for people.

“The citizens here want to express remorse.”

Smith was the youngest of four children, born in Newcastle, and brought up in a strict Roman Catholic family.

He left school at the age of 16 and got a job as an apprentice in a recording studio before becoming a sound engineer.

He also claimed to be a psychic and has appeared on Living TV’s Most Haunted programme. DVD episodes of a TV ghost hunting show have now been pulled.

A source close to Maddie's parents Kate and Gerry said last night the sighting was "highly significant" and added: "It could be a key breakthrough."

Maddie, of Rothley, Leics, was three when she disappeared on a family holiday in Praia da Luz, on the Algarve, on May 3 2007.Portuguese Mr Moreira said he only recently connected his sighting with the Maddie hunt because it was 160 miles from where she vanished.He was driving from Carregado, near Lisbon, to Alentejo on May 4 when he stopped at a snack bar in the Benavente region at 8am.

He told The Sun: "I saw a white van with the back door open. I saw a girl, lying on a pile of clothes in the back. She was wearing a two-piece pyjama set, pink and white, or yellow. I saw her back, I could see her hands and feet.

"She moved one of her fingers but she was deeply asleep. When the van door was opened, she did not wake up, as if she was drugged.""This girl was blonde and looked around four. A woman came out of the back of the van. I noted that a strong and tall man, wearing a suit, was in front of the snack bar.
"He looked like a gipsy. He was with the woman from the van, he was younger than her. He told her off for leaving the van."

Mr Moreira said the experience stuck in his mind - but he only realised it could be useful when he saw a cop being asked on TV why roads to the north or to Spain were not blocked after Maddie vanished.He explained: "The road I saw the van on was such a route."

He said the man he saw was clean-shaven, aged 40 to 42, fat but good-looking. The woman was 60 to 65, fat with grey hair.The McCanns' spokesman Clarence Mitchell said: "His account is being looked into. He has done the right thing in coming forward."

I was just reading a report from the Portuguese Attorney’s Office about the Sun and Mirror’s recent articles of the alleged sighting of Madeleine in a white van. I pleased to see they, like us, are not swayed by creative reporting - or should that read fiction!

“The PGR [ Portuguese Attorney General Office] does not consider Carlos Moreira alleged Maddie sighting in Benavente reliable. In Portugal, this and other similar accounts do not have the undisputed credibility necessary to reopen the Public Ministry archived process relative to the investigation of Madeleine Beth McCann' mysterious disappearance.

A source from the Portuguese Attorney General Office explained yesterday that «none of the information’s which have reached the official investigators of the case [Portuguese Judiciary Police], amongst them various alleged sightings, had the required degree of probability and/or plausibility to reopen the process».

The same [Maddie's Case Process] will only be reopened if and when we are presented with accounts that have an acceptable amount of reliability, added the source.

A Judiciary Police source also said that no new leads have arrived to them recently and, that all the information’s received up until now were not considered as being of unquestionable credibility by the Portuguese Public Ministry, in order to prompt the reopening of the Maddie case.

An official source from that same institution guaranteed that despite the process is archived, the Judiciary Police keeps a commitment to explore all the leads.”

The McCanns do seem rather quiet so let us hope this hive of activity has something to do with that and the police are busy letting Gerry McCann know he is nowhere near as smart as he thought he was.

So much for his £1.2 M cashgrab from Goncalo in May, he better hurry up!

The Pt AG's office clearly got something right about anything that pleases Kate and Gerry, like three year old alleged sightings of a little girl sounds asleep in the back of a van. They find their cause for such excitement implausible and improbable and they are not going to bother to further investigate such flights of fantasy

I am sure Ricardo Paiva has some real police work to be getting on with and his good grasp of English must come in very useful!

Priest guilty of indecent assaulting sisters

Father Eugene Lewis Father Lewis was found guilty of 11 counts of indecent assault

A court in Omagh has found a Catholic priest guilty of sexually abusing three young sisters.

Father Eugene Lewis, 76, denied 11 charges of assault between 1963 and 1973. The sisters said the abuse began when they were as young as seven.

The abuse took place at their County Fermanagh home.

A jury of six men and six women unanimously convicted the former provincial superior of the Society of Missionaries of Africa.

The priest was also accused of raping one of the sisters, but since the alleged incident happened in Dublin he could not be tried for the offence in Northern Ireland.

During the six-week trial the jury heard that Lewis had befriended the girls' parents nearly 50 years ago.

Prosecuting QC Ken McMahon said the priest had "wormed his way" into the family through a fellow, but innocent cleric.

Mr McMahon told the jury that although welcomed into their home at anytime, he often chose to call at bedtime or on Saturday bath night.

Lewis, who currently resides in Dublin, was ordained in 1958 and after his time in a seminary between 1960 and 1970, he went to Dublin and then served on missions overseas.

More recently he has worked in west Belfast.

He will be sentenced in June.

The wedding preps are going badly, we thought we had plenty of time but it would seem not. The wedding venue is booked but that is it. It would seem you need at least 12 months for everything else. I would have thought in this day and age people would be more flexible but apparently not. The worry is several good people have gone out of business and most people want 50% deposit. We have lost a very good bridal shop only last month in this area, how many deposits have been lost along with disappointed brides, so so sad.

Sometimes I feel deep despair about the society we live in today. My life here is hampered by beaurocracy and daily petty annoyances that put together amount to total destruction of the quality of life, rather like your wedding arrangements!

The extensive problem of paedophilia to level headed folk such as us is really quite unbelievable. What makes so many people vile, sick, perverted misfits that are not fit to inhabit the earth? It is a subject that I will never, ever understand!

So what is happening in their "libel" action against Goncalo Amaral that was supposed to be scheduled in May? Are they after a little settlement for that as well, now let me do the maths, Express they settled for one eigth of their original claim. So that means they must now be demanding £150,000 from Goncalo if he wants them to shut up and go away. Humm, well I suspect Goncalo will tell them to go and erm shove it or something.

The McCann threatened the group of British media Express Newspapers with a trial. In a letter sent by lawyers Carter Ruck's office - which represents the parents of Madeleine - is required an application for excuse on the cover of newspapers in the group and a compensation for moral damages.


It was advanced that the amount requested is four million pounds (about 5.2 million euros), but Clarence Mitchell, spokesman for the couple, denies.

At issue is the coverage carried by newspapers in the group - 'Daily Express',' Sunday Express', 'Daily Star' and 'Daily Star Sunday' - to the case Madeleine. Coverage McCann believe that the "defamatory and rough." Kate and Gerry are appalled, especially with the news published in the 'Daily Express'. Actually, I am quite amazed Gerry has not had a high level meeting with our new leaders Cameron and Clegg. had that fully reported in the press and made quite sure Leicester Police and that cunning Portuguese Police man who nearly tricked Kate all get the sack. Come come Gerry you have such high level connections, surely Cameron and Clegg will be making an announcement any time soon pointing out what an innocent lovely dad you are and furthermore entirely disbanding Leicester Police and CEOP (they accused the McCanns and are therefore simply not fit for purpose) and severely censuring the PJ, insisting Ricardo Paiva gets the sack for being too interested in accounts of Gerry and Payne being paedophiles. What rubbish!

If Portugal fails to comply with these demands and fails to start looking for some swarthy Maddie abductor Cameron will sever diplomatic relations and food parcels forthwith.

Quite how Kate got up the nerve to go on Panorama, months later and tell us someone "broke in" to the apartment that she says they left open is just completely beyond me. Maddie just calmly said to her abductor oh go on then squeeze me out through the window I promise to just pretend to be asleep and not scream FFS!

When are the two social workers and the coppers going to come and certify these two over their lurid and silly lies about the disappearance of their daughter?

I mean they just have to be barking mad to keep this lot up and still demanding millions of pounds off people who "libel" them, words absolutely fail me. What Goncalo suggests they did is flipping tame to what I think they really did. They ought to be paying him!

The obscene abuse you have been subjected to Viv, although distasteful shows the calibre of person that you are dealing with. Normally who would bother about such perverted ignorance but when it is directed at you personally it becomes a completely different issue!

A view shared by the office of the PGR, which emphasizes that "in cases like this it is common the appearance of hundreds of 'information' imaginary media from time to time, disclose."
"All the evidence and any information '(of which there are hundreds) that are relevant and credible, were treated with appropriate investigation," said the PGR recognizing "that jusqu'aucune statements that were made to trial would have proved appropriate and credible to trigger the reopening of the investigation. "
"If we have evidence, with a reasonable degree of credibility, the trial may be reopened," concludes the PMP

It is curious why this blog, small as it is, continues to attract such attention from those who clearly just want to shut us up.

I continue to believe it is the different approach to many other blogs that explains that, i.e. I do not believe Maddie died an accidental death whilst left alone in the apartment.

I do agree that trolls who persist on this blog, display the same mentality as Gerry McCann.

I continue to believe that Portugal are only prepared to retain jurisdiction in this case on the very limited basis this was a stranger abduction. As such they require the group to co-operate with them to eliminate themselves and to produce some cogent evidence. Given that is not forthcoming, they will not re-open the investigation. But Gerry, including via his lawyer Isabel Duarte has continued to insist there is sufficient evidence of stranger abduction to re-open the case. Duarte spoke of those disturbing pictures possibly of Madeleine.

It is terribly important IMO to Gerry's strategy to get the case re-opened in Portugal on that basis because it would do what the McCanns have always sought to do. Obtain a declaration, once and for all, they are innocent and there is an active investigation by the police into their claims, rather than into them. That would in turn free them up to do what they have always planned to do, films, books, documentaries detailing the "shocking stranger abduction and how we have suffered" and of course netting them millions of pounds in the process.

It is somewhat typical of a character like Gerry with a distinct narcisstic streak and the accompanying highly inflated ego, that he just cannot accept the reality of the situation.

There is no persuading either British & Portuguese Police /respective governments the McCanns are innocent and some strange abductor should be sought. They know for a fact the McCanns were responsible for Madeleine.

British Police have the clearest jurisdiction to pursue the investigation into the McCanns following the shelving of the case in Portugal because it could be taken no further in that jurisdiction. If and when charges are forthcoming it will be by Leicester Police and it is utterly futile for Gerry to put spin into the press claiming they are to be dismissed from the case. That is just another of his wild flights of fantasy. He dislikes LP with an absolute passion!

Gerry has said he wants all files amalgamating. He went to the High Court to try and get British files and he lost. But that has not stopped him from trying.

If you had committed a terrible deed, like he clearly has, in getting rid of Madeleine, you would want to know exactly what was on those files so you could try and manipulate your way out of the evidence against you.

I think Gerry would also see it as a balancing exercise. Again you need to consider just how desperate he would feel. He would reason there have been so many supposed sightings of Madeleine and details of supposed abductors. He would reason to himself just by virtue of that, that sheer weight of so called evidence pointing away from the McCanns would actually cancel out the evidence against them. But that is quite absurd and desperate. From the very first moments the McCanns were telling some very fundamental lies about what happened, that leaves the police in absolutely no doubt who is responsible.

Further, Gerry has defrauded the public to pay for "private investigators" to produce this wealth of fantasy "evidence". He is not fooling anyone with any common sense, only himself in thinking he can outcon the system. Again that is typical of a desperate criminal whose devious plans have been seriously thwarted, along with seriously denting his ego. But Gerry is not the type to give up, he will just keep on, even after he is arrested. That goes with his personality style.

The juror later asked one of his colleagues to pass him a note with her mobile phone number during a break in the case - but he refused, and reported the matter to the judge.

The Nottingham Crown Court trial, costing hundreds of thousands of pounds which was nine days old at the time, was instantly halted while an investigation was carried out.

Frances Oldham QC, defending John Cort, a solicitor accused of murdering his business partner, argued that the entire jury should be discharged.

But after four days of legal argument, which included DC Messiah and the juror, known as Miss X, giving evidence, it was eventually decided the case could continue.

But the woman, and a fellow juror left "upset and confused" by what had happened were discharged, and the case continued with just ten jurors.

The extraordinary incident took place on April 29, but reporting restrictions meant the details couldn't be revealed until the end of the trial today.

Cort, and his co-accused Brian Farrell, were convicted of murder solicitor Vina Patel, a partner in Cort's law firm, to get a £1.5m insurance payout and both jailed for life.

In her ruling, Mrs Justice Dobbs said the juror had noticed DC Messiah, smiling at her from the public gallery on the "third or fourth day" of the trial.

The judge added: "After that there was eye contact. She was not looking for it to happen, and was not sure what to make of it.

" She got the impression he wanted her number. He had made a hand movement, like a phone, to his ear.

"This happened on the Wednesday. She wrote her number on a piece of paper on the Thursday morning 15 minutes before the morning break, in case she bumped into him.

Mrs Justice Dobbs said the woman spotted DC Messiah during the break but he appeared to be busy.

"All were asked if they felt able to continue. All, save one, said 'yes'.

"A male juror said he felt upset and confused by what had happened. Both he and Miss X were discharged."

DC Messiah, who interviewed members of the 'Tapas Seven' as part of the investigation into Madeleine McCann's disappearance, has not been in court since the resumption of the trial.

However, in her ruling, Mrs Justice Dobbs said he claimed he had "no contact with the juror" and "could not be the person" who had gestured to her.

Deputy Chief Constable Gordon Fraser said: "This matter was brought to the Judge's attention during the trial and as a result two jury members were dismissed. "The trial continued and resulted in a successful conviction.

"The Force demands the highest standard of professionalism from all staff and will thoroughly investigate any allegations of inappropriate behaviour.

"The Force's Professional Standards Department will now investigate the alleged incident and therefore it would be inappropriate to comment further at this time."

It would be an interesting exercise to go back and have a look at the degree of involvement of DC Messiah in the Maddie case, but I know, prior to doing that it was pretty substantial.

It does not really say a lot for his integrity that he would behave in such a way towards a jury member in a serious murder trial that the police obviously wish to win, if the information is accurate/

The case itself is very interesting, debt ridden solicitor killed his business partner. Proof if ever we needed it, that professional people can do the most terrible things for the most bizarre reasons. The McCanns had a £323,000 mortgage debt, and a wife who although a qualified doctor appeared to have just given up on work. It has always looked to me like Gerry spent a lot of money on that holiday, with his Mastercard, making his plans perfect. A clear case of speculating to accumulate, the demise of Maddie looks to be no more than some mad business venture to him. A "high risk strategy" as he would call it, I do not think the risks get too much higher than this Gerry!

Even the vague idea that Madeleine died in Portugal as a result of an accident is preposterous. There is absolutely no evidence to suggest this as even a remote possibility let alone an established fact! Apart from anything else it would have been simple for the McCann’s and their cronies to cover up an accident ~ and what sort of parent wouldn't rush their child to hospital in the event of serious injury irrespective of their own position?

Initially I refuted the credibility of Amirals belief in this theory, as a seasoned detective he couldn't possibly misconstrue such flimsy circumstantial evidence as to make accidental death a viable option ~ he must have been deviously manipulating the McCann’s! Now too much water has gone under the bridge to think of anything but his naivety and his desire to successfully conclude the investigation.

Going along the lines of your thinking Viv, rather like Gerry’s counter-attack every time something potentially damning comes to light, how many instances can we recall where false indications have been planted that in themselves are inconceivable. Gerry walking about at night with a lifeless body to be conveniently seen by the Smith family. The hired car boot being left open day and night to get rid of noxious pongs. The keys to the local church being given to them exclusively. The mysterious trip to Huelva. To name but a few!

This blog is beyond doubt the only one I have seen that concentrates on known facts, plausible options and does not go off on a tangent with bizarre theories that have absolutely no foundation whatsoever!

There was always this determination to ramp up and publicise death claims by the McCanns themselves, clearly Gerry must have instructed Philomena to do that, setting his money making venture in train, as it were. Then there were the reports they were to go to American lawyers who had managed to refute dog findings in the case of Eugene Zapata, but Mr Zapata then accepted a plea bargain for just three years jail, admitting he did kill his wife. Clearly the authorities lacked hard evidence, otherwise they would never have accepted such a deal, it was the only way they could get him to admit exactly what he did to his wife. I think even at this stage Gerry had done all of his homework and knew all about plea bargains and how to put something into the media that could never be proved:

Police are investigating what sparked gunman Derrick Bird's killing spree amid reports he was involved in a bitter family feud.

Reports suggest Bird's first victim was his twin brother David who he had rowed with over a will.

The 52-year-old taxi driver then embarked on a three-hour massacre through Cumbria, killing 12 people including former colleagues and random passers-by. Finally, he killed himself.

It was claimed another of the dead was the family's solicitor, Kevin J Commons. David Whyte, a business associate of Mr Commons, told the Press Association he expected the firm to be making a statement in the morning.

Britain's worst mass shooting since the 1996 Dunblane tragedy began when the divorced father-of-two shot fellow taxi drivers in the town of Whitehaven this morning, killing at least one.

It ended just over three hours later with the discovery of his body 20 miles away in woods near the hamlet of Boot after a frantic manhunt. Officers recovered two weapons.

Three of those injured in the shootings were in a "critical" condition in hospital and another five were said to be "serious".

Deputy Chief Constable Stuart Hyde, of Cumbria Police, said there were 30 separate crime scenes and described it as the "most exceptional, challenging incident" the county had faced in a long time.

The force has launched a "full and thorough" investigation into the tragedy, looking at Bird's history, access to guns and motives for the shootings, he said.

Those who knew Bird said he was a quiet, "normal bloke" with two grown-up sons - one of whom had just become a father - who lived alone in Rowrah, near Frizington, Cumbria, and liked tinkering with his car.

A woman and her 23-year-month old son were murdered in their cottage in a sleepy rural village, it has been disclosed.

Their attacker, a 44-year-old man believed to be the woman's partner or ex-partner, then killed himself at the house in Holbrook, Derbyshire.

Police said they received a call from a concerned neighbour at about 11am on Wednesday. When officers arrived at the cottage on Well Yard they discovered the 38-year-old woman and the man dead.

The baby was critically injured and taken by air ambulance to Royal Derby Hospital where he later died, Derbyshire Constabulary added.

There had been reports a gun was used in the fatal attacks but police said this wasn't true.

Neighbours were standing out in the street discussing the grim discovery at the cottage, tucked back from the main road that runs through the picturesque village.

Lined with trees and well-kept gardens, Holbrook is in a conservation area in the heart of Amber Valley, Derbyshire.

Detectives said they were not looking for anybody else in connection with the deaths, described by one woman in the village as a "terrible tragedy".

Andrew West-Hunt, 52, landlord of the Spotted Cow, said the woman was a regular visitor to the pub having moved in to the area after living abroad as an ex-pat in France or Spain.

He said: "She was intelligent and obviously educated. She said she had looked at a couple of places and then settled on one here."

Rape is an extremely difficult offence to be prove, the issue usually focussing on one whether or not the woman actually consented to intercourse.

Because it is an offence that has a very low conviction rate due to the difficulty in proving it, does that mean that suspects should get pre-conviction anonimity? I do not think so. True, there are occasions when a woman makes a false allegation but this could also be set out in the press if that turns out to be the case.

If a woman was to be charged with paedophilia or assaulting her partner, would she be granted anonimity prior to actual conviction? NO. This tory proposal seems quite sexist to me and not in the interests of justice. If people do not know about allegations by reading the press they are deprived of information that could prove vital to them and their personal safety.


Huntley was prosecuted a number of times and acquitted, that did not make him innocent or lessen the serious risk of harm that he posed!!

I was pleased to read that Italian Police have filed slander charges against Amanda Knox who received 26 years custody for murder and sexual assault on Meredith Kercher last December. Her own culpability being considered more serious than her former boyfriend who got 25 years

She claimed that during a night long interrogation she was hit twice in the head causing her to sign the confession to being present when Meredith was sexually assaulted and left bleeding to death.

It is somewhat typical that guilty parties always attack the police. Kate and Gerry McCann are so good at that, claiming they were being framed and even claiming they are going to get £1.2 M from Goncalo Amaral who is convinced that Madeleine died from an accident and they hid her body. Whilst I do not agree with his viewpoint, I certainly agree they were involved in disposing of Madeleine but with prior malice, not accidentally. It was not reasonable for him to write a book as an ex police officer but it is simply outrageous IMO, for them to say they want damages from Goncalo. If anyone should be claiming the money he made out of the book it should the the Portuguese State to defray the considerable expenses involved in the Maddie case.

I gather that under Italian law, if convicted, she could face another 6 years, serves her right! Those with a serious personality disorder, she being a prime example, just do not know when to call it a day and show some remorse for the terrible crime they committed. We are still waiting Gerry, but what a dreadful piece of complete and utter lack of parental concern and self preservation he showed when he cynically told us, it was no different to dining in your own back garden. We do not all live in palatial mansions with grounds, Gerry, but if we did, would definitely make sure the children were safe with a proper nanny whilst wandering the grounds!

Just had a read of the posts on Jo Morais blog.

This is a good post, I had never thought before about the prospect of them avoiding attending the Paraiso Restaurant on the beach that afternoon because it would demonstrate that Madeleine was not around. The police are talking about the afternoon and early evening in email correspondence on the file. They clearly think the McCanns suggestions she was "taken" later in the evening whilst they were "neglecting" her is utter codswallop. TTW4 answers those who are suggesting we forget everything about this case and just do something "positive" for Madeleine, get a new law on neglect. There is nothing wrong with the existing laws on neglect in Portugal and Uk, the offence the McCanns committed was far more serious than that and of course they would like people to focus on their apparent neglect, rather than offences likes murder, kidnapping, trafficking and sexual abuse. Those who have pushed for mere "neglect" charges for the McCanns letting them off the hook for the real crime, rather than the smokescreen are definitely pushing a McCann/Tony I do /say anything for Money Bennett agenda. If they neglected her, that opens up the way for the much vaunted "stranger abductions" gobbledygook.

Anway this is a good post and so were TTW4's. I can understand people feeling there are posters on there deliberately posting for the McCanns, shut up about everything else and let's just talk about neglect. No way! We are not shuttng up about what your former friend the Doctors Gaspar felt compelled to tell the police about a typical couple of paedophiles fantasing about child sexual abuse, Madeleine's father and Madeleine's "Uncle Dave", as the statistics so clearly tell us those who really pose a serious risk to children.

Anyway I continue to digress, this is the good post, I thought (although one should not assume that being missing means "dead" ) The point about breakfast is also really good, it could well explain why the McCanns made it their practice to breakfast i the room, sot aht when Maddie "disappeared" no one would notice:

I too believe Maddie was not alive on the 3rd, there are no photographs of her and nobody saw her on that day, not even at Breakfast!! sadly she was already gone. The Mcs used 3rd to create their alibi and put forward their abduction theory. That is also why Mcs did not go to Paraiso restaurant because they knew the CCTV would prove that Maddie was not there. IMO maddie was a victim of sexual abuse from within that group that is why they have all lied.

May 31st, Important Update: Child Rescue Alert

Last Tuesday, May 25th, was International Missing Children’s Day. Disappointingly, the day didn’t seem to get as much attention as it deserves, or rather, as all missing children deserve – and need!

The day was also important as the UK’s new ‘Child Rescue Alert’ was launched. Gerry and I, along with many others, campaigned hard back in 2008 for the development of such a system within all countries across Europe, to help when a child is abducted. Many of you also helped to make this campaign successful by lobbying your M.E.P.’s at this time. In view of this, I feel it’s important that as many people as possible within the UK are aware of, and familiar with this new ‘Child Rescue Alert’. This is a system which could save the life of a child. Each member of our country could play a role in achieving this, if they are aware of the CRA and its usage.

The Child Rescue Alert will be used by the police when it is probable that a child has been abducted and in imminent danger of serious harm or death. When the CRA is launched, the public will be notified via various media channels, including TV and radio, with broadcasts being interrupted on a regular basis, to ensure that as many people as possible are aware of the abduction and therefore able to help. The telephone number to call with information following an alert will be: 0300 2000 333. (NB: If you think your child has been abducted or if you think you have seen an abduction taking place before a CRA is launched, call 999 immediately).

Forgive me if the subject of Charlotte Pennington has already been discussed here but as a comparative newcomer to the forum I am not au fait with past topics.

In the absence of much contribution this week I decided to take another look into this young woman’s inclusion in the web of intrigue. What do I find? ~ Another confusing contradictory account of the disappearance of Madeleine Mccann!
First things I find interesting is her Irish origins and that she arrived in Portugal the same day as the Mccanns to commence work with Warners, working with small children. Even on the same transit bus according to one of the tapas mob. She also apparently worked for Warners a couple of times in the past so new something of the way they operate.

Next ~ is her involvement merely an extension of her past acting career, taking centre stage by way of habit or is there something more sinister going on? If the former it is certainly very coincidental.

Thinking on the lines of Madeleines disappearance being at a much earlier time than the Mccanns seemingly fictitious timeline, Ms Penningtons conflicting statements do appear to be designed to substantiate Madeleines existence during daytime, Thursday 3rd May 2007. There is no point in my reproducing all the inconsistencies in her various statements and press interviews as they can be researched easily elsewhere, however there are one or two blatant issues that I will identify.

l. She states that she only had personal contact with Madeleine on two occasions - 29th April and 3rd May!
2. Did she enter the Mccanns apartment or didn’t she?
3. She did'nt previously know the Mccanns yet she evaluated their personalities very quickly and was convinced of their innocence?!?
4. We are trained to comfort people in this sort of situation?!? (is this a normal occurrence in Warner establishments).
5. Following being told that a child was missing she said that the "room was empty - the twins having been already collected by one of their friends"!?!
6 Much of this was quoted from a Daily Mail interview about 3 days after papers ran a story that on 3rd May nobody could confirm having seen Madeleine for about 7 hours - Metedeo 3 having already been appointed by the Mccanns!?!

O.K., I accept that her testimonies are riddled with inconsistencies and she could just be living a fantasy but why would anybody do such a thing if not actively involved in the subterfuge?

Kate Mccanns verbage extracted from findmadeleine website -

'All missing children are vulnerable to exploitation including sexual exploitation, with this being the motive in many of those cases of stranger abductions where a motive can be determined. Child sexual exploitation and child pornography in particular, is sadly and shockingly extensive worldwide. It is a multi-billion industry aided by the use of the internet with the thirst for younger victims growing'.

If that is their vision of 'not coming to any harm' then I dread to think of their ideas of a child being harmed.

No remorse, no acceptance of culpability, no admittance of negligence just the same unconvincing statements for self preservation and image protection. Kate even has the audacity to suggest that Madeleines disappearance has raised awareness of the plight of other missing children! - Sick!

I agree a good post from Joana's site. We have discussed many times on here why the McCanns did not go to the Paraiso Restaurant that afternoon, but I don't think we thought about the fact it would be obvious Madeleine was not there due to the CCTV.

Regarding The Child Rescue Alert. Kate states that they campaigned hard in 2008 to develope the system along with others.

What a great shame Kate & Gerry could not have put their efforts into campaigning hard for their own daughter Madeleine, and to get their so called friends back to PDL for a reconstruction, and Kate answering all the PJ's questions and not just the last one.

The reward should also have been mentioned at every given opportunity but no it was not, perhaps because they both knew it was pointless as Madeleine had not been abducted.

Madeleine is missing yes, but imo Kate & Gerry both know exactly where she is.

As for donations Viv, I now personally do not know one person who actually believes that Madeleine was abducted anymore. One gentleman who remained convinced of an abduction shocked me recently by saying they are a pair of liars. When I asked him why he had changed his mind after all this time, he said it was because they were after the Portuguese Policeman, GA, although I have to say he did not know his name. He said he watched the interviews on tv outside the court and knew they were both lying. Why it takes some people so long to wake up to the fact there are so many discrepancies in this case is beyond me.

As for people still donating to the fund, sending Madeleine presents(very weird), I can only assume they are family, friends and newspaper readers who have been totally taken in by the drivel that is written.

How does it transpire that she always seemed to be in the wrong place at the right time? Like some night predator.

Hello Di and nice to see another post arrive, it has gone very quiet on here with the lack of news and lovely weather we have been enjoying.

I am posting the email between DC Marshall and Ricardo Paiva again because I feel it is so vital in letting us know what the police thought, after Goncalo had been removed from the case.

Why were the Paynes asked to complete further questionnaires referred to, and as you say, why would they have their own solicitors and be so reluctant (along with others like Russell OB) to return for the reconstruction.

DC Marshall is specifically talking about the afternoon and Payne cannot remember what he is wearing and the early evening. I am sure there is a link with the McCanns not being at the Paraiso. I also think from this email the Paynes are clearly considered suspects by LP.

For them to be so concerned about the afternoon and what Payne was wearing they must have further information which of course has not been released by LP. In spite of being openly referred to as a paedophile on the internet, Payne has not responded once, and neither has Gerry McCann.

It would not seem as though the McCanns are going ahead with their action for damages against Goncalo either. Maybe their learnt their lesson about what comes out, as their lawyer, Isabel Duarte said, "we knew we were opening Pandora's box"! But surely not if this couple were "innocent". What could harm them in those circumstances. I still believe it was Mr Menezes who dealt the most killing blow to them, they could have been charged with kidnapping/trafficking, that provides the most cogent explanation of all as to why the McCanns have been so coy about the reward monies that were so generously offered by wealthy people.

As requested, appended are the statements of Arul and Katherina Gaspar.

I read carefully the written statements given by David Payne but was not able to extract any other information besides what is already known.

He declares that he saw Madeleine, for the last time, at 17H00 on 3/5/07 in the McCann's apartment. Also present there were Kate and Gerry. He did not indicate the motive for being there or what he was doing. Similarly he does not indicate for how long he stayed.

When asked with whom he was on the afternoon of May 3rd, he declares that this information was already offered to the police and he cannot remember if anyone else was there.

He does not remember what he was wearing that afternoon.

He took part in the searches, having carried out most of them alone. He was at times accompanied by Matthew Oldfield.

He did not partake in the searches realised on the 4th of May, because, on this day, he spent to majority of time in the police headquarters.

For many of the questions, he does not give a complete answer, affirming simply that he has already given this information/declaration to the Portuguese police.

I examined again the declarations of Fiona Payne. In her depositions, she states that she went to the McCann apartment, around 19H00, on the 3rd of May, together with Kate. She states that 10 minutes later, the husband arrived; it is not clear which husband she refers to, if to Gerry or her own husband.

Her responses to the written questionnaire are vague, given that, she continues to answer to the questions with "they conform to my earlier deposition" or some similar statement.

Of course criminal suspects are very concerned about answering police questions again when they have previously answered them twelve months previously, because if you are telling lies those stories need to match. If you are telling the truth you simply do not have that concern, it is highly relevant that he makes a point of saying both David and Fiona are vague and wish to refer to their earlier statements, rather than risk contradicting what they had already said.

Normal people wishing to help in every way, would not be the least bit concerned about giving their version of events again or whether it exactly tallied with what had been said previously. This is the conduct that police particularly look for to point to guilt.

I also found it very odd, that when things were going so terribly wrong in court for the McCanns as they sought to attack Goncalo Amaral, Gerry rushed home, clearly in a rage. Then Fiona turns up to "support" Kate. Where were Kate's close family members and why were they not supporting her?

Again this speaks for itself for me, if Kate and Gerry were innocent, family members would be there. But if they are guilty they would want no part of their criminal enterprise, only Fiona who I believe most certainly was involved in that very serious crime, due to what she is married to.

Smug Fiona is a nasty piece of work IMHO how she could look so smug and full of herself in PDL when Maddie was first taken is beyond me.... She along with 8 other adults (if Maddie was abducted) were all a part of saying it would be fine to bugger off to the bar and have some fun while the kids were left in danger.... (If they really were left alone I am begining to doubt they were but had to be to come up with an excuse).....

As for Kate being disapointed with the attention the Amber Alert system recieved has she ever stopped to think no one is intrested in the projects backed by a Mother who still cant be bothered to answer a single question for her missing child..?

Not being funny but Amber Alert can only work if you are telling the truth.... They lied from the first moment it was reported to anyone outside the group it was proved the shutters were not smashed and she could not have got out that way.....

Maddie was carried away by a man who looked like anyone who could be in the frame and no car in sight so what exactly would they have achieved with Amber Alert....

The damming fact they never even bothered to search for her as it was "Too Dark" or even went out the days afterwards show how concerend they were they knew there was no point....

As Di says I dont know anyone who belives them in the past there were a few who were not sure but the court case brought out things they need to keep buried as you say Viv if you have nothing to hide there can be nothing in a Pandoras Box to come out......

Kate saying she was there she knows what happend is a strange statement as well although I am sure she was there and does know exactly what happend...

Lets hope the investigation is re opened and they swoop on the T9 arrest them all for perverting the course of justice and interview them all at 9 seperate police stations....

If there is a chance Maddie is still alive she deserves that much surely???

Why she has been left to rot for three long years is beyond me I know social services are letting lots of children down alot lately but 3 years is a long time to forget about a small child....

I agree there is something very smug about Fiona, even right then at the time and it is very hard to imagine how she could have been so smiling, calm and collected. She is clearly equally smug and arrogant with the Police. I would be keen to see these questionnnaire LP wanted them to fill out, but know we are not going to be allowed to see them. But it does demonstrate just how important the police feel the Paynes are to solving this case. I just do not know how she can be so smug and arrogant in all the circumstances, involved with the disappearance of a little girl.

I also agree that leaving them alone was just a farce and something the Paynes were clearly unhappy with doing hence the mother in law and the baby monitor being taken. It is utterly bizarre for any normal parents who are even taking nan, to actually plan to go on holiday and leave the kids with nothing more than a monitor and never even check on them, apparently. The mind numbing negligence that demonstrates, if it were true as they just sat there getting drunk is hard to imagine, particularly from doctors! Just because kids are quiet it does not mean they are safe!

I do hope it will reach the stage where they are all arrested and held at separate stations as you suggest so they cannot compare notes any further. As you say, three years is a terrible long time for nothing to have happened.

I just do not know how the McCanns have the nerve to claim any credit for Amber Alert which would not have been appropriate in this case anyway. It is used when they have details of an abductor/his car etc. Not where a child just disappears into thin air and there is no lead for the public to report on.

Never a word In Daves defence either I guess they need Clarrie all to themselves (or they could not think of what to say about it) also not many people know about it (yet)....

Well the case against Goncalo was supposed to be listed in May, and that has come and gone.

If I were Goncalo I would certainly make sure there was a witness who was going to drop that out, like Ricardo or Mr Menezes.

If there is some hitch in their action against Goncalo going forward, who is causing the hitch, British/ Portuguese Police or the McCanns themselves for fear of what else may be dropped out. Goncalo would not be libelling them at all by mentioning the Gaspar statement, that is evidence from a proper police investigation and privileged against any form of libel action.

I think they just got too greedy and somehow felt they could stop that from being mentioned, if I was Goncalo it would be no holds barred against those two. But there again, I would never have given them a cause of action in the first place by insisting Maddie died in the apt without any definitive evidence to back that up.

I went on Claudia's blog and asked her and she does not seem to know either, commenting that she had only seen reference to it being held in May online, but she would try and find out.

It is difficult to comment about the listing given this is in Portugal but certainly in UK terms this is now seeming rather odd to me, given they originally applied for the injunction in about April 2009. Particularly when taken in conjunction with the silence of the McCanns on the matter.

It is looking like they just might have done the sensible thing and realised the potential costs may far outweigh the potential gains! This is not an action that would be covered by a no win no fee agreement, so the McCanns have to ask themselves the question, do they have sufficient cash left in the Find Maddie Fund to pay for this and what will the public say about the remainder of the Fund just being spent on lawyers, not that there is much change there.

Clearly what has been spent including on so called private investigators has always been about drumming up non existent "leads" to take the heat off themselves and of course Gerry always knew "a really good team of lawyers" was going to be terribly important to them as he initially commented. Odd really for an "innocent" couple.

I wonder if the McCanns do understand now, just why, in spite of the millions of pounds they have frittered, people still do not believe in their innocence and they will never be in a position to make Maddie the Movie and become multi millionaires.

I am sure our hearts just bleed for them.

Just reposting this really good post from SB and others thoughts on this would be appreciated, there are certainly a lot of coincidences, and just when did Maddie actually disappear?

Gerry seemed to feel the need to "prove" she was around that day by going home on 20 May 2007 and then returning with what I believe is most obviously a doctored *do excuse the pun^, "LAST" (how very ominous and in tune with Gerry's perverse thought processes) picture of Maddie. It does not actually take a trip home and a wait of over a fortnight to release this precious last pic does it? For someone who was bleating and wailing about the apparent inactivity of the police that was pretty extraordinary.

I still want to know just when Leicester Police are going to turn up at the hospital and remove Gerry McCann to the cells, where he most certainly belongs.

Forgive me if the subject of Charlotte Pennington has already been discussed here but as a comparative newcomer to the forum I am not au fait with past topics.

In the absence of much contribution this week I decided to take another look into this young woman’s inclusion in the web of intrigue. What do I find? ~ Another confusing contradictory account of the disappearance of Madeleine Mccann!
First things I find interesting is her Irish origins and that she arrived in Portugal the same day as the Mccanns to commence work with Warners, working with small children. Even on the same transit bus according to one of the tapas mob. She also apparently worked for Warners a couple of times in the past so new something of the way they operate and she had previously worked in New Zealand.

Next ~ is her involvement merely an extension of her past acting career, taking centre stage by way of habit or is she another cast member in this ever increasing list of players? If the former it is certainly very coincidental.

Thinking on the lines of Madeleines disappearance being at a much earlier time than the Mccanns seemingly fictitious timeline, Ms Penningtons conflicting statements do appear to be designed to substantiate Madeleines existence during daytime, Thursday 3rd May 2007. There is no point in my reproducing all the inconsistencies in her various statements and press interviews as they can be researched easily elsewhere, however there are one or two blatant issues that I will identify.

l. She states that she only had personal contact with Madeleine on two occasions - 29th April and 3rd May!
2. Did she enter the Mccanns apartment or didn’t she?
3. She didn’t previously know the Mccanns yet she evaluated their personalities very quickly and was convinced of their innocence?!?
4. We are trained to comfort people in this sort of situation?!? (is this a normal occurrence in Warner establishments).
5. Following being told that a child was missing she said that the "room was empty - the twins having been already collected by one of their friends"!?!
6 Much of this was quoted from a Daily Mail interview about 3 days after papers ran a story that on 3rd May nobody could confirm having seen Madeleine for about 7 hours - Metedeo 3 having already been appointed by the Mccanns!?!
How does it transpire that she always seemed to be in the wrong place at the right time? Like some night predator.

O.K., I accept that her testimonies are riddled with inconsistencies and she could just be living a fantasy but why would anybody do such a thing if not actively involved in the plot and/or receiving a nice little sum of money from their ever depleting slush fund?

Viv, I think when Gerald is finally carried-off screaming by LP, demanding government intervention and image consultants (and possibly a psychiatrist to prove diminished responsibility) he will at least be entitled to maximum exposure after the past three years award winning performance! So what better place to set the scene but his place of work!

They chose the Gran Canaries because of its large gay community and they fitted in. PdL didn’t look like the gay capital of Portugal to me. So why or why are the McCann detectives interested in O’Neill. Desperation comes to mind.

LOL also about your comments concerning Gerry being dragged off, I do genuinely think he would be very threatening and intimidating to police officers and would most certainly feel he is so important the government should intervene. But I am sure Mr Cameron knows the reality about this man.

Wiz, thanks for your post, I do recall Rosiepops going on about the kidnapping of Jeremy Vargus, I think even going back to Express days. That thing was making links that the McCanns are clearly still wishing to make and making those connections that no other person had thought to make. Of course they have given up on the case of Mari Luz given her real killer was quickly apprehended.

As you say, the MO of these two is to take boys, I can see aged 6, 14 and 15 to sexually abuse, given they are gay they are just not interested in 3 year old little girls!

Transferring to new post on this because I think it is worthwhile to note the desperate rubbish from the McCanns/The Sun has not actually stopped!

Clarence Mitchell points out the McCann Dicks have not been able to investigate this, well of course they have not, these two have been in the custody of the real police who would not be allowing access to those who wish to just pervert the course of justice/the thinking of the public as to who was actually responsible for the disappearance of Maddie.
