seems to have been cut to just a few lines

The Home Office has secretly begun a review that could lead to a fresh police inquiry into the disappearance of Madeleine McCann.  (now that is very short for theTelegraph)

but hey ho, here it is in full, it does seem to be rather inconsistent with other McCann spin in the Daily Star, four little Yorkshire papers, and then because we had all been ripping into it on Joana Morais, The Sun, OK Gerry, we believe you, The PJs are rubbish, Leicester Police are rubbish and they do not like you much either, now that is one of the few facts :-)))  It is not very secret now is it, lol!

Home Office launches secret review into Madeleine McCann's disappearance

The Home Office has secretly begun a review that could lead to a fresh police inquiry into the disappearance of Madeleine McCann.

The move follows the release of 2,000 pages of evidence last week which Portuguese detectives are accused of having failed to fully investigate.

According to sources close to the McCanns, Alan Johnson, the Home Secretary, has ordered officials to examine the 'feasibility' of British or Portuguese detectives looking afresh at all the evidence.

Kate and Gerry McCann met with Mr Johnson last year to plead for help in their search for Madeleine, who vanished without trace in May 2007 from a holiday apartment in Praia da Luz, Portugal.

The couple have also met with John Yates, the Metropolitan Police Assistant Commissioner, who has headed up a number of high profile inquiries in recent years.

He is said to be "sympathetic" and to have made "general offers of assistance".

The source said: "The latest we have heard from the Home Office is officials are undertaking a 'scoping exercise' to look into the possibility of a review of the case.

"They are looking at all the options. It is basically a feasibility study.

"Kate and Gerry met with Alan Johnson to request a review is done. Hopefully any political intervention can unlock obstructions that might be in the way."

Pressure is now being put on Portuguese authorities to agree in the first instance to a three-day review of the case that could be held at Interpol's headquarters in Lyon in France.

The McCanns will hope the Home Office can persuade their Portuguese counterparts to co-operate in a case review.

The review – were it to go ahead – would involve British police working with Portuguese counterparts as well as experts in child abduction across other European forces.

The Portuguese police have been heavily criticised for their handling of the case which led to detectives naming the McCanns, both doctors from Leicestershire, as arguidos – or suspects – in the case and accusing them of involvement in her disappearance.

Their arguido status was subsequently lifted and the police investigation shelved.

But with the senior officer in charge Goncalo Amaral now widely discredited and facing financial ruin after being sued for libel by the McCanns over a book he wrote, it may become harder for the Portuguese to refuse the request for a thorough review.

The revelation that possible leads – many passed to Portuguese police by the McCanns' own private detectives – had apparently been ignored will add to the clamour.

Last week, details emerged of a series of possible sightings of Madeleine, who was just three when she vanished.

A further obstacle was removed with the death from stomach cancer two weeks ago of Guilhermino Encarnacao, who was in charge of the Policia Judiciaria in the Algarve.

Mr Encarnacao was convinced Madeleine had died in her parents' apartment and was a major source of a series of off the record briefings to journalists against the McCanns.

A Home Office spokesman said: "We can confirm that the Home Secretary had a private meeting with Kate and Gerry McCann.

"Leicestershire Police stand ready to co-ordinate and complete enquiries if further information comes to light in the UK; or if requested to do so by the Portuguese authorities, who continue to lead on the overall investigation."

The spokesman refused to discuss what talks took place at the meeting or whether there was the chance of a review of the evidence at Interpol.

The spokesman added: "We are not going to comment on the outcome of any private meeting with the McCanns."

Mr Yates was unavailable for comment. He led the cash for honours investigation and was also involved in a new inquiry into the murder of Julie Ward, who was murdered in Kenya in 1988.

FURY AT LABOUR SNUB TO FAMILY OF MADELEINE

 This Daily Express article from early July 2007, debunks the myth that senior members of the Labour Party including David Milliband were being helpful to Kate and Gerry McCann.  Milliband entered office and point blank ignored them.  Given what we now know, that as early as June UK top profiler Lee Rainbow was advising that Gerry McCann in particular should be scrutinised as homicide suspect that is hardly surprising.

FURY AT LABOUR SNUB TO FAMILY OF MADELEINE

Friday July 6,2007

By Padraic Flanagan in Praia da Luz

DAVID Miliband was under fire yesterday for turning his back on the parents of missing Madeleine McCann.
The new Foreign Secretary has failed to make any contact with the family.

His predecessor, Margaret Beckett, made regular calls offering support to the McCanns. Mr Miliband could face a carpeting for the snub from Prime Minister Gordon Brown who, as Chancellor, contacted the McCanns to promise to help “in any way he could?

It is 64 days since four-year-old Madeleine was snatched from her bed as she slept in a holiday flat  rented by the family in Praia da Luz on Portugal’s Algarve.

But the MP for South Shields ?at 41 the youngest Foreign Secretary since David Owen was appointed in 1977 at the age of 38 ?has so far failed to signal any interest in the case.

A source close to Madeleine’s parents, Kate and Gerry, said last night: “It’s true, there haven’t been any phone calls at all from David Miliband, which has been a surprise to be honest.

“Margaret Beckett went out of her way to get in touch, even breaking off from important talks in Washington, to telephone Kate and Gerry and let them know she could count on her help.

“Even Gordon Brown has Gerry’s mobile number and has called in the past,?said the source. “It gave the family a great boost to know that Government at the highest level cared about Madeleine.

“In the early days after Madeleine was snatched, the Foreign Office provided a lot of vital help to the family, and even now the consulate on the Algarve keeps in touch.?/P>

But, so far, the new Foreign Secretary has been unable to find time to make contact. The source said: “If I were Kate and Gerry, I would have expected something but there hasn’t been anything.?BR>
The source said GP Kate, 38, and cardiac consultant Gerry, 39, would never complain about a lack of support, preferring to concentrate on their campaign to find their daughter.

“They haven’t got any complaint with the highest level of Government, in fact they are hugely grateful for what they have already received from senior politicians,?said the source.

“They would never complain or say anything about it, they are  just not those kind of people. Their only focus is on doing everything they possibly can to get Madeleine back.The parents, who have moved to a secret address on the Algarve to give two-year-old twins Sean and Amelie more privacy, have welcomed the release earlier this week of BBC journalist Alan Johnston after 114 days in captivity.

The family, from Rothley in Leicestershire, said his release  had lifted their spirits while they endure an agonising wait for news of their daughter.

Mr McCann said yesterday: “It was heartening for Kate and I to learn of the release of Alan Johnston after almost four months in captivity.

“Although the circumstances of his kidnapping are very different to Madeleine’s, it still lifted us to see him being freed knowing he will be reunited with his family shortly.

“We also agree with the commentators who have stated his family have acted with tremendous dignity throughout,  and Alan himself appeared incredibly resilient and composed following his release. Our best wishes go to Alan and his family.?/P>

Cashing in on Little Maddie McCann

There are people all over the internet now with blogs and forums about Madeleine.  But so many of them are making money out of a missing little girl perpetuating death theories because it sells. You can be as sick and gory as you like.  Paypal buttons, advcrtising, books. They cannot move on with these apparent opinions now we have the Portuguese Police files or even accept the words of the Portuguese Prosecutor so recently in court, Mr Menezes, there is a 50:50 chance that Maddie is dead or alive and the parents could have been charged with kidnapping and trafficking her.   We have the parents perpetuating a fantasy stranger abduction theory and they have cashed in to the tune of millions.

I could almost count on one hand now the number of people who are actually concerned about little Maddie herself and open to the possibility of her being dead or alive.  That is a terrible indictment on human nature.

I just opened this blog again so that I could say so and in the hope people can see how repugnant their behaviour is.  People who repeatedly attack the police and CEOP the only people who can actually bring Justice for Madeleine, so what is their agenda?

THE INJUNCTION (UNDER APPEAL) AGAINST GONCALO AMARAL FULL DETAILS

  It is interesting to note that at first instance, the McCanns application for an Injunction was not granted and they went to the Appeal Court where they were then successful.  The Judge recognised that Goncalo's right to freedom of expression was equal to the  rights of Madeleine,  Sean, Amelie, Kate and Gerry but in the end determined that given the criminal process against the McCanns had been archived their rights prevailed.   They do have the right to be treated with respect and their family life and personal safety respected whilst there are no criminal charges against them, no one can take the law into their own hands.  Fundamentally, I would say it is a decision for Madeleine.  It has not been proven that she is dead and she has the right to be treated as a missing person and a search for her continued until it can be fully established what happened to her.  The Judge also recognised that dissemination of such information by Goncalo could damage the ongoing investigation into what happened to her.  British Police have confirmed, many times that continues.  This is not a decision declaring they are innocent it is simply upholding their civil rights.  It is not up to a civil court to determine criminality and they have not attempted to do so.

The Temporary Injunction: Granted on September 9, 2009

4 February 2010 | Posted by astro Leave a Comment

This is a translation of the text of the Civil Court ruling that granted the temporary injunction on Gonçalo Amaral’s book, ‘Maddie – The Truth of the Lie’, and the corresponding DVD. It was issued on the 9th of September, 2009. The numbered notes [x] are from astro, for clarification purposes only. It should also be recalled that this injunction was granted exclusively based on the evidence that was provided by the Applicants. The Defendants were only allowed to oppose the injunction after it had been granted.

CONCLUSION – 09-09-2009

In this process of common injunction that is being handled at this court and section under the number 1143/09.0TVLSB, the Court decides to reply to the factual matter that appears in the initial request, and that has been subject to proof in fulfilment of the Appeals Court Decision [article 13, in the factual segment that appears on page 15 of said decision, articles 58 to 67 and 92 of the corrected initial request] [1], as follows:

Article 13: Not proved;

Article 58: Not proved;

Article 59: Proved that curricular pieces concerning the first Defendant [2] are published on the internet, referring to him as an honest, structured, socially accepted man, namely for the performance of political posts;

Article 60: Proved that the media focus hit the first Defendant;

Article 61: Proved;

Article 62: Proved that the first Defendant knows the meaning and the extent of an archiving dispatch within a criminal process;

Article 63: Proved that the first Defendant knows who holds power over the inquiry, who can open or reopen it, and under which circumstances that can be done;

Article 64: Proved that the first Defendant knows what defamation and injury are;

Article 65: Proved that the first Defendant knows what it means not to be at the service of criminal investigation;

Article 66: Proved that the first Defendant has professional experience and is of adult age;

Article 67: Proved that by divulging his thesis about the events of the 3rd of May, 2007, in Praia da Luz, the first Defendant, with the assistance of the three other Defendants [3], saw his person promoted and earned money.

Also proved that the first Defendant wished to intervene in local political life.

Article 92 – Proved that the Defendants intend to disseminate the book and the DVD all over the world, earning financial, commercial and social profit, deepening the suffering of the two first Applicants [4] and rendering the search for the third Applicant [5] more difficult.

**

For the preceding decision concerning the matter of fact, the Court has pondered the documents that have been appended to the process, as well as the depositions from the questioned witnesses [6], in the segments in which they revealed direct knowledge about the facts that they were questioned upon. The Court has also used judicial presumptions, namely in the answers to articles 60 and 62 to 66.

Concerning the depositions of witnesses 1 to 4, it has to be noted that those have been essentially characterised by the transmission of their opinions, deductions and personal convictions. It was nevertheless revealed that they manifested direct knowledge of the increase in difficulties and obstacles to the ongoing private investigation that searches for the third Applicant, which is being promoted by the first and the second Applicants, each time that new editions or the announcement of future editions of the book, interviews with the first Defendant, or divulgations of the DVD take place.

The depositions, especially from the third and fourth witnesses, were equally considered, concerning the direct knowledge that they demonstrated over the intensification of the suffering of the first and second Applicants, each time de first Defendant’s thesis was newly divulged – whether through the existence or the announcement of a new edition of the book, or a new divulgation of the video or by the occurrence of interviews – mainly due to the repercussions that such events have on the search for the whereabouts of the third Applicant and due to potentiating the knowledge of said thesis by the fourth and the fifth Applicants [7].

Concerning the fifth witness, although her knowledge of the facts that she was questioned about comes from a set of investigative tasks that tend to sustain the allegation that is made in this injunction, what is certain is that, together with the documents that have been appended to the process, it was possible to establish that the book in question has already been subject to a Spanish edition in May 2009, a French one in June 2009, a German one (also for the Swiss and Austrian markets) in June 2009, then an Italian and a Dutch one, and Defendant ‘Guerra e Paz’ has also launched an edition in Brazil [8].

This is, in synthesis, the basis for the previous decision concerning the matter of fact.

**

REPORT

The five Applicants move the present injunction against the duly identified Defendants on page 38 [given the fact that the initial request with the corrected numbering, which has been appended on 20/05/2009, is being attended to], alleging, in synthesis, that the first Defendant’s thesis about the events that took place in Praia da Luz in May 2007 – which relate to the disappearance of the third Applicant, which took place at that time -, which have been put into the book that he authored, that was published by the second Defendant, that sustains the video that was produced and marketed by the third Defendant and was broadcast by the fourth Defendant as a television documentary, have already violated several rights of all of the Applicants and cause them fear of future, serious and hardly repairable damage of the following rights:

a) The rights of Madeleine (the third Applicant) to her moral and physical integrity and to a fair and adequate investigation into her disappearance, in the future;

b) The rights of Sean and Amelie (the fourth and fifth Applicants) to their moral and physical integrity and to a fair and adequate investigation into the disappearance of their elder sister, in the future, as well as their right to the reservation of private and family life and to the good name of the family that they belong to, their right to freedom and to security;

c) The rights of Kate and Gerald McCann (the first and second Applicants) to their image, to their good name, to their good reputation and to the preservation of the integrity of their private and family life, their right to freedom and security, the right to their moral integrity, the right not to be treated in a degrading, cruel or inhumane way, the right to enjoy, like any other citizen, the guarantees of the penal process.

On these fundaments, they conclude by requesting the determination of the following measures:

a) The prohibition of sale and the order to seize, for destruction, the books and the videos that are still left at shops or any other deposits or warehouses;

b) The prohibition to execute new editions of the book or the video, or of other books and/or videos, that defend the same already criticised thesis, and that are destined to be sold or divulged by any means, in Portugal;

c) The prohibition to cede the editing rights or the author rights on the contents of the book or the video, or of any other books and videos on the same subject, for publication in any part of the world;

d) The prohibition to cite, to analyse or to comment, verbally or in writing, on parts of the book or of the video that defend the thesis of death of the third Applicant or of the concealment of her body, by the two first Applicants;

e) The prohibition to reproduce any comment, opinion or interview, where said thesis is defended or can be inferred;

f) The prohibition to publish statements, photographs, or any other documents that are allegedly connected to said book and video or said thesis.

According to what was established by the Appeals Court’s Decision and considering what has resulted from the production of evidence during trial, the following FACTS are proved in an indicative way:

12 – Between the publication of the Portuguese edition, on 24/07/2008, and the publication of the book’s French edition, in May of 2009, the fourth Defendant broadcast a television programme that was produced by the third Defendant, that reserved the possession of the corresponding rights for itself;

13 – The first broadcast of said television programme took place on the 13th of April of 2009;

14 – The second broadcast of this television contents took place on the 12th of May of 2009;

15 – That programme was broadcast in Portugal at least those two times;

16 – That programme/video is intrinsically based on the contents of the book “Maddie A Verdade da Mentira”;

17 – In that video the first Defendant again sustains his thesis, that the third Applicant is no longer alive, that her death took place inside the “Ocean Club” apartment and that the parents, the first and second Applicants, concealed their daughter’s cadaver;

18 – At least two million and two hundred thousand people watched that programme’s first broadcast;

21 – The DVD is publicised, at least, on the third Defendant’s website;

22 – The first and the second Applicants are married to each other and the parents of the third, the fourth and the fifth Applicants;

23 – In the Criminal Inquiry in which the first and the second Applicants were made arguidos, an archiving dispatch was issued concerning them, as per appended copy, pages 145-173;

24 – Madeleine Beth McCann has been missing since the 3rd of May of 2007;

25 – There are curricular pieces published on the internet, concerning the first Defendant, referring to him as an honest, structured, socially accepted man, namely for the performance of political posts;

26 – The focus of the media has hit the first Defendant;

27 – The abovementioned curricula (item 25) reveal a man who “studied engineering”, obtained a university degree in juridical and criminal sciences and was a PJ agent/inspector for 27 years;

28 – The first Defendant knows the meaning and the extent of an archiving dispatch within a criminal process;

29 – The first Defendant knows who holds power over the inquiry, who can open or reopen it, and under which circumstances that can be done;

30 - The first Defendant knows what defamation and injury are;

31 - The first Defendant knows what it means not to be at the service of criminal investigation;

32 - The first Defendant has professional experience and is of adult age;

33 - By divulging his thesis about the events of the 3rd of May, 2007, in Praia da Luz, the first Defendant, with the assistance of the three other Defendants, saw his person promoted and earned money.

34 - The first Defendant wished to intervene in local political life.

35 - The Defendants intend to disseminate the book and the DVD all over the world, earning financial, commercial and social profit, deepening the suffering of the two first Applicants and rendering the search for the third Applicant more difficult.

OF THE LAW

From the Applicants’ allegation, it becomes clear that they understand that several of their rights – all within the scope of personality rights – have already been violated by the divulgation of the first Defendant’s thesis concerning the events that are related to the third Applicant’s disappearance in May of 2007. A thesis according to which the third Applicant would have passed away on the 3rd of May of 2007 in the Praia da Luz apartment, and her cadaver concealed by the first and second

After the production of evidence, performed in fulfilment of the Decision, it was established that the book that was authored by the first Defendant [and although after the injunction was interposed] was in the meantime the subject of a Spanish edition in May of 2009, a French one in June of 2009, a German one (also for the Swiss and Austrian markets) in June of 2009, and later on, an Italian and a Dutch one, and the Defendant “Guerra e Paz” also launched an edition in Brazil, facts that allow for the conclusion that the Defendants intend to disseminate the book and the DVD over the world, obtaining financial, commercial and social profit (cfr. answer to article 92).

On the other hand, it resulted demonstrated that the dissemination of those materials (book and DVD) deepens the suffering of the two first Applicants and renders the search for the third Applicant more difficult (cfr. answer to article 92): each time the first Defendant’s thesis is newly divulged, the suffering of the first and second Applicants intensifies – whether through the existence or the announcement of a new edition of the book, or a new divulgation of the video or by the occurrence of interviews – mainly due to the repercussions that such events have on the search for the whereabouts of the third Applicant and due to potentiating the knowledge of said thesis by the fourth and the fifth Applicants.

Thus translates the threat of future lesions or the worsening of those already verified to the Applicants’ personality rights.

The protection of personal integrity in its two dimensions, physical and moral, is consecrated by the Constitution (cfr. article 25, number 1 of the CRP [11]), and it should be articulated with other means for the protection of personal rights, such as those foreseen in number 1 of article 26 of the Constitution, that is, the rights to personal identity, to the development of personality, to civil capacity, to citizenship, to the good name and reputation, to image, to word, to the reservation of intimacy of private and family life, and to legal protection against any form of discrimination, constituting the fundamental seat of the designated general personality right, as well as the direct expression of the basic postulate of human dignity as admitted in article 1 of the Constitution, a basic value and the first reference in the matter of fundamental rights.

The ordinary law, on the other hand, generically names, in article 70 number 1 of the Civil Code, the defence of individuals against illicit threats of offences against their physical and moral personality (from that mention and from the precepts that are subsequent to it, one infers the existence of a certain set of rights that are connected to personality, as the right to image, to the reservation of private intimacy, the right to a good name and reputation), with number 2 foreseeing that the person that has been threatened or offended can request the injunctions that are adequate to the case’s circumstances, with the purpose of avoiding the consummation of the threat or to attenuate the effects of the already committed offence.

On the other hand, number 1 of article 381 of the Civil Process Code, and concerning non specified injunctions, establishes that whenever someone shows a based fear that someone else causes a serious and hardly repairable lesion to his or her right, that parson can request the conservatory or anticipatory injunction that is specifically adequate to ensure the effectiveness of the threatened right.

By handling the preceding juridical considerations with the established facts, the objective fulfilment of the conditions for the establishment of the injunction that is destined to safe keep the Applicants’ rights is verified.

Nevertheless, and just as mentioned in the Appeals Court’s Decision, one must pay attention to an eventual conflict of rights.

In fact, both the writing of the book, and its divulgation and that of the thesis that is defended in it, namely through the DVD and through interviews, configure the exercise of freedom of expression, and as far as the third Defendant is concerned, also that of freedom of the press and the media.

Those rights of the Defendants, as well as those of the Applicants that were noted above and that are at stake, have equal constitutional standing, and therefore it is peacefully understood that when there is a conflict in their exercise by different holders, and because there is no relationship of predominance of one towards the other, one must seek within the circumstances of the specific case, the fair measure of contraction of one of them, or even of both, in order to render the adequate exercise of each one of those rights viable. That solution is contained in article 335 number 1 of the Civil Code.

Therefore, taking into account that the thesis that is presented by the first Defendant, through the adequate means that are placed at his disposal by the other Defendants, raises the suspicion of the involvement of the first and second Applicants in the practice of criminal actions, albeit in a negligent way, among the general public, and that they, having been made arguidos at a given point in time, saw the criminal inquiry archived in relation to them, one has to conclude that it must be the rights of the Defendants that cede to the rights of the Applicants.

On the other hand, the divulgation of the thesis that the third Applicant passed away on the 03/05/2007 raises difficulties for the investigation into what happened and the search for her whereabouts. The contrary hypothesis that is defended by the Applicants, that the third Applicant is still alive, must be taken into account, and if it is verified, then her life and her wellbeing may depend on the search for her whereabouts, and these rights of her must also make those of the Defendants cede.

Therefore, and having reached this point, we conclude that the injunction is to be granted, nevertheless, and as far as the requested measures are concerned, it has to be taken into account that those requested under d), e), f) and, partially, under b) are directed against an undetermined universe of addressees, and can therefore only be granted concerning the Defendants.

As for the compulsory pecuniary sanction, taking into account the financial capacity of the Defendants that are companies (to which the requested injunctions of apprehension of books and DVDs are destined), the profits that have already been obtained through the sale and the divulgation at hand, and taking into account the interests that are in conflict, we see it as adequate under article 829-A of the Civil Code.

DECISION

Under these terms and due to the exposed fundaments, the Court grants the present injunction and, as a consequence, decrees as follows:

a) The prohibition for the Defendants to sell the books and the videos that are still in stores or in other deposits or warehouses, and the obligation for the Defendants to collect them and to deliver them to the depositary that is nominated below;

b) The prohibition for the Defendants to perform new editions of the book or the video, or of other books and/or videos, that defend the same thesis, and that are destined to be sold or published by any means whatsoever in Portugal;

c) The prohibition for the Defendants to cede the editing rights or the authorship rights over the contents of the book or the video, or of other books and other videos about the same theme, for publication anywhere in the world;

d) The prohibition for the Defendants to cite, analyse or comment, verbally or in writing, on parts of the book or the video that defend the thesis of death of the third Applicant or of concealment of her body by the first two Applicants;

e) The prohibition for the Defendants to perform the reproduction or comment, opinion or interview, where said thesis is defended or from where it can be inferred;

f) The prohibition for the Defendants to publish statements, photographs, or any other documentation that is allegedly connected to said book and video or said thesis.

Moreover, the Court condemns each one of the Defendant societies to pay a compulsory pecuniary sanction in the amount of 1000 euros for each day that the prohibitions or the order to apprehend the books and the videos are not respected.

The depository of the books and videos, whose collection is ordered, is the lawyer who represents the Applicants.

Expenses by the Applicants to be attended in the main action.

MCCANNS TO FOCUS ON THEIR DEFENCE -MADDIE MAY HAVE BEEN MURDERE

Let's not forget yet another McCann firm of detectives Hogan International and how the McCanns wanted to FOCUS ON THEIR DEFENCE  I would suggest by deflecting everyone from what they really did, had Maddie kidnapped to cash in.  Even within the last few days we have their idiot Mr Krugel back on the scene, looking for Maddie's body.  Then we had another who we know is in their pay, the barmy Mr Correia, attorney for Leonor Cipriano who says Goncalo's men beat her up and he turned a blind eye, do you believe that? The MuckCanns want you to!   My comments are in green.

Oh the complex web we weave, when first we set out to deceive!...

The court will decide today to extend the secrecy
The court of Portimão shall pronounce today on the request for the extension of the secrecy of Justice on the case concerning Madeleine McCann, the English girl that vanished last May 3, from the resort of Praia da Luz, in the Algarve, where she was spending her holidays with her parents.

The first suspect of the case, the Luso-British Robert Murat, has taken this legal status last year, in May 14, so it is today that the eight months deadline foreseen by the Law is ending. The Public Prosecution did advance the exceptional complexity of the process to justify the request for the extension of the deadline.

In addition to Robert Murat, the father and the mother of the child who are now in England, Gerry and Kate McCann were also made formal suspects.

New company questioned

Few days after having announced the replacement of the Spanish detectives, Metodo 3, by Hogan International, a British company, the McCanns are already criticized for their choice. It's the British company itself that reported to the British press that they have no experience in this type of investigation, being themselves almost exclusively devoted in the locating of missing heirs.  So they would be pretty good at "locating" witnesses for the McCanns.  They would also be very good at making inquiries into the assets of those people the McCanns would like to sue and make a load of cash out of.  The McCanns whole raison de etre!  But Mr Hogan is an ex officer with the Met and after suing a newspaper, quickly disappeared from Team McCann.  Do you think he might be a police witness against them?  I would not be the least surprised to hear that!

The McCanns bring in cold-case detectives to investigate

The McCanns have hired a detective who investigated a 7/7 suicide bomber. Noel Hogan is conducting a "cold case" review.
The former Met detective superintendent, who runs the agency Hogan International, in Farnham said: "I have been reinterviewing witnesses that were out in Portugal at the time."
It is understood these include friends of the McCanns.
Hogan International was investigating Jermaine Lindsay in the run-up to the 7 July attacks in London in 2005 after a bank became alarmed by his spending patterns

New detectives hired by the McCanns are criticized

A former Scotland Yard detective hired to search for Madeleine McCann is conducting a private murder investigation to discredit police evidence against her parents.  Now who could have guessed the McCanns were into smearing and discrediting the Police "evidence AGAINST them".  The Police have evidence that they were immediately telling lies about the shutter/window being jemmied open.  The Portuguese Prosecutor has just told us they were telling lies about checking their children every 30 minutes, THEY DID NOT.  Gerry McCann gave  a statement to the police the following day 4 May 2007 saying he and Kate entered the apartment to check on their children via the front door with their key.  But on 10 May gave another statement and said he was wrong about that, actually, they both entered by the rear patio door that THEY LEFT OPEN.  Careful Kate immediately contradicted Gerry the following day, she said she entered to check the children via the open patio door.  But in all other respects their statements read like the utterings of a couple of parrots, word for word entirely similar.  Including how Madeleine apparently complained to both of them with the same words at breakfast that morning, "why did you not come last night when me and the twins were crying".   Then we have the Smith family who believe it was Gerry McCann they saw carrying Madeleine off towards the beach around 10 pm that night.  Kate raises the erm "alarm" at around 10 pm, maybe Gerry was rather breathless at that point.  Now this is just a brief summary of some of the serious evidence against Kate and Gerry McCann that they were quite obviously involved in the disappearance of their daughter and were immediately telling the police contradictory and unhelpful lies.  So, how did they think Mr Hogan was going to DISCREDIT THIS EVIDENCE AGAINST THEM.  Their problem is they have always lived in a fantasy world of believing they can tell us all they are model parents, and we will all just say, Oh OK then, now how much would you like for your Defence Fighting Fund to fight all these odious policemen in Portugal and UK who are just trying to fit you up, quite obviously!
But last night fears were raised that Noel Hogan might not be up to the job.
Mr Hogan, who runs a private detective agency, has re-interviewed British witnesses including the McCanns holiday friends.

He is also understood to have gone through the McCanns’ own statements in minute detail with the couple.  That must have been a difficult taks for him.  Did he have both of Gerry's conflicting statements or a new one, written by?? When the McCanns attended their Brussels "seminar" (to lecture MEPs about how Amber Alert would obviously have "saved" Madeleine, apparently) their "statements" got mysteriously leaked at the same time.  The gloves are off with the Portuguese Police roars Clarence.  But this was at a time when Rebelo was in charge of the investigation and there as absolutely nothing being released to the press from the inquiry.  The statements were leaked from Spain and it later appeared to transpire that these were not actually the  police statements (how could they be, the PJ had those).  They were further statements that Kate and Gerry had given to Metodo 3.  So, I would suggest Mr Hogan was even being duped when he was going through these apparent statements with the McCanns.  He was not being allowed to see the duplicity and lies contained within the original statements taken by the Portuguese Police where Gerry even starts to argue with himself.
In a startling twist, Kate and Gerry’s lawyers have ordered that their own inquiry into Madeleine's disappearance, while on holiday in Portugal last May, should focus on the theory that the three-year-old was killed and her body hidden.
Hogan International, which specialises in asset investigations,(the McCanns like detectives who can pry into other peoples' assets to see if they are worth suing. Bit like Metodo 3, we were all nonplussed, why "Fraud investigators" to look for a missing child, because actually they are good at smelling out money and getting some offensivev dirt on those they wish to discredit for their paymaster, like erm, Robert Murat and Goncalo Amaral, perhaps? Even me! )  is taking over the case after the McCanns benefactors voiced dismay at the lack of tangible progress made by the Spanish agency Metodo 3.  If you were only instructed to place listening devices to Robert Murat's  car, stalk Goncalo Amaral and gather some dirt on him, make criminal allegations against hm and try and get witnesses to back it up (like Leonor Cipriano for example, convicted child murderer )find some disreputable people who were prepared to say what the McCanns wanted to hear, you probably would not be making much progress in finding Madeleine!
Sources close to the inquiry say the two firms have a history of rivalry after previously clashing over conflicting investigations.  Maybe one attempting to be reputable (Hogan) and one who always saw things from Gerry McCanns point of view from day one, Mr Marco of Metodo 3.  I have never looked for a missing child and know nothing about paedophiles so I did some research on them on the internet!  It is almost like he was taking the McCanns ill gotten gains with one hand and having a good laugh at them /giving them a good slap with the other.  Did they actually instruct him to say he would bring Maddie home for Christmas or was he having another pop at his paymasters?  Maybe he was trying to blackmail them and say I do not want £50,000 per month for this, try trebling it.  Is that why we were being told at the time that Mr Kennedy and the Fund were paying him??

In an exclusive interview with the Sunday Express, Mr Hogan revealed that his previous experience of missing people cases was limited to tracing beneficiaries of wills. He also admitted that despite the high profile of the Madeleine investigation, his 12-strong team of former detectives and ex-SAS men were already handling around 5,000 cases.

Speaking from his office in a rundown tower block in Aldershot, Hants, Mr Hogan refused to say how much he was being paid. He said: ‘I don’t want to become part of the circus surrounding Madeleine. I am not allowed to go into operational detail and I just do what I am told.  Of course, Clarence Mitchell has always been very particular to point out that he will not discuss "operational detail" of what "our" investigators are doing.  Well that "our" would seem to mean, Clarence Mitchell, that you take ownership of fraudulent activities, that tell the public Maddie is being looked for with their money, but in reality, that is just a lie.  Bent witnesses and people to sue are being looked for, to discredit the police and make the McCanns/you too rich!

‘We deal with all matters of investigation, but it is true that normally the missing people we deal with are those who have inherited something and then disappeared. We have never dealt with a missing child.

‘I am not going to boast about success rates like Metodo 3, because that did nobody a favour. We have one office and there are 12 people who work here. If I need to I can bring other people in.

‘When the police have a big case they do not stop investigating all the others they are working on.

‘I have a lot of people who I know who are ex-policemen and know how to handle a criminal investigation.

‘The Portuguese police have put a complete closedown on any facts. Well then who did keep briefing the press, or need we ask!  Normally in this country you would have a liaison officer with the family.’

Another former Scotland Yard officer, who has given unofficial advice to the McCanns, from Rothley, Leicestershire, last night voiced his concern at the appointment. He said: I cannot understand why they have chosen to go with Mr Hogan because he simply does not have the resources or the back-up to conduct a major investigation.

The advice I have given to the McCanns was to urge them to request a meeting with Scotland Yard and to ask them to take over the British side of the investigation. The Yard has a very sophisticated and well-resourced kidnap squad, which deals with more than 300 abductions a year, far more than any other force in Britain. Forces from around the world turn to them for advice.

My view is that the McCanns should not waste money with private investigators but should get the best police in Britain on the job.
Why have the McCanns never taken his advice and asked British Police to look for Madeleine, accepted the likes of Mr Hogan and all the others are just a waste of time?  Well we know the answer to that!
I think the role of Leicestershire Police is confused. At first they sent officers to Portugal to offer liaison assistance to the McCanns but now it appears they are investigating them on behalf of the Portuguese. It has become a mess.  What he is saying here is that liaison officers are given to families who are the victims of serious crime.  So Leicester Police went out there and they provided them.  Kate lost her temper with them after they asked her "Where is Maddie".  Of course that is not acting in the role of supporting her as a victim, that is acting against her as a suspect.  That is what this officer means by it has become "a mess".  It is difficult to a force to suddenly have to change tack in this way, hence SOCA being brought in to assist in what is obviously a very complex investigation including very major fraud.  CEOP too, the division specialising in sexual abuse of children.  None of this looks the least bit promising for what Gerry McCann repeatedly tells us "there is absolutely no evidence that Madeleine has come to any harm".  Coming from a man who a witness heard within an hour of her disappearance telling his relatives on his mobile, Maddie had been "abducted by a gang of Portuguese Paedophiles" and given that he has not seen his daughter (we assume) for three years, come May, that is a very perverse observation to make to say the least!

Last night Mr Hogan retorted: I was in Surrey Police for four years and the Met after that. I finished top of my CID course but decided to leave to start my own business.

I am not a disgraced former policeman. I deal in professional investigations and I have been doing this a long time.
Control Risks Group, which is advising the investigation on behalf of the McCanns billionaire backer Brian Kennedy, are also reported have taken on a larger role.
But no significant new lines of inquiry are being examined and, despite an overwhelming response to their Christmas appeal, the McCanns have been advised to focus on their own defence.
A source close to the family said: The investigation is working towards a resolution and we have to consider that Madeleine may have been murdered.  So maybe feeding the notion that Madeleine is dead, cashing in on that by suing people when you know that could never be proved  is a good means of defending yourself from an even more sinister crime, having your daughter abducted so that you can kill to birds with one stone, get rid of a child you no longer want and make a fortune in the process.  IMO this is the smokescreen, this is what the McCanns have been doing all this for. Including paying for a really sick "poster campaign" to feed some pretty sick killings scenarios to the public, all designed to throw them off the scent.  Believe in a stranger abduction, believe that abduction did not happen, but it did IMO and they arranged it.
I would ask people to just ponder a few things, Tony Bennett stalking and harassing the McCanns and repeatedly insisting THERE WAS NO ABDUCTION THEY KILLED MADELEINE, then have a look at the reputation of Tony Bennett.  Buy my leaflets and READ THE TRUTH.  But when you read his leaflets it was a pack of ill judged lies!  Assertions with absolutely no evidence to back them up.  So who was getting a cut out of "sales" - Team McCann.  Just ponder one more thing, who is the most credible and reasonable witness you could listen to, who would not lie before a Portuguese Judge, Mr Menezes, the Prosecutor. HE SAID THERE IS A 50 50 CHANCE MADELEINE MAY  STILL BE ALIVE AND HE SAID THE MCCANNS COULD HAVE BEEN CHARGED WITH KINDAPPING / TRAFFICKING HER.  That, I would suggest is the truth and why there is an ongoing investigation in the UK as we try to find her, if she is still alive.

We have been working to the theory she may have been killed and all the possible scenarios are being considered.
Of course we hope very much that she is alive but nothing can be ruled out.

Eight months after Madeleine vanished, Portuguese detectives have made it clear they think Kate and Gerry staged an abduction in an attempt to provide a smokescreen for a more sinister crime.

ONE MILLION POUNDS SPEND UP! ACCOUNTS 2008-2009

Wiz, you are better at accounts than me but I gather you did not want the job, so had a look and tried my best xx

The accounts are set out showing income and operating surplus for the year 2007-2008 alongside the current accounting year, 2008-2009 (headed up 2008, 2009) This shows that at the beginning of the financial year, April 2008 they had an operating surplus of just over one million pounds. During the year these accounts cover (period April 2008 to April 2009) they had an income of just £629,000 as opposed to £1.8M the previous year but spent during this year quite massively, a whopping £975,000 on "merchandising and campaign costs" and £31,000 on "administrative expenses" which were far higher the previous year at £141,000. But the previous year those merchandising and campaign costs were much lower at £673,000. I am no accountant but you can see that there was an increase on those costs of some £300,000 this year which seems to rougly equate with what got "Halligened". Certainly during that year, I would like to know how the McCanns can justify spending over one million pounds, particularly when income to the fund had dropped to only £673,000 which therefore leave them in the situation of having blown the operating surplus they had and they finish up with £690,000 left in the Fund as at the end of this accounting period which would have been April 2009. Clarence seems to be telling us it is now lower than that. One is inexorably drawn to the conclusion that not only did £300,000 get "Halligened" about £600,000 has gone into some black hole. The legal action against Goncalo Amaral was apparently started in May 2009 which is just after the end of this accounting period but it says in the accounts that action was funded from this. It therefore seems to me there has been the most collosal expense to the Fund of defending Kate and Gerry McCann with lawyers and I do not think it is legitimate to describe this as "campaign and merchandising costs". Of course another way of looking at this is one has to speculate to accumulate. The Fund has now lost its ONE MILLION POUND operating surplus and it seems like one heck of a coincidence that is what they want from Goncalo, but, it seems to have cost about half a million to try and get there. Thus the dichotomy, two purposes for the Fund, one defend Kate and Gerry, two, make money for Kate and Gerry. There is a further cost noted on the accounts of some £19K odd which is said to be valuing the asset at the time of its purchase rather than what it is worth now. That sounds to me like a nice shiny new car some time back. The price is right, Gerry !

It would seem Kate only got just £30K in admin costs to "help" her this year, whether that was for a secretary for Kate or for Kate personally I am not sure, but sure she could have had a little out that black hole of the most profligate spending spree one could imagine.

Thanks, as ever, to Joana Morais for producing these on her blog.

CHAIRMAN'S STATEMENT
The Chairman presents his statement for the year.

On 3rd May 2007, Madeleine McCann was abducted in Praia da Luz, Portugal. The events of that day touched the heart of many, in countries around the world. Donations started to flood in. In response to this, Madeleine's Fund was established.

The aims of the Fund are to help find Madeleine, to support her family and to bring her abductors to justice. Any surplus funds will be used to help families and missing children in similar circumstances in the United Kingdom, Portugal and elsewhere. The Fund has 7 directors.

We have continued to concentrate on ensuring that Madeleine is not forgotten and that the search for her continues. We have:

• provided finance for a team of investigators to lead a private search for Madeleine

• financed the translation of the full set of files released by the Portuguese police, enabling our team of investigators to follow up all potential leads

• paid for legal representation for Kate, Gerry, Sean and Amelie in Portugal, enabling them obtain an injunction banning Mr Amoral [sic] from repeating his fabricated claims about Madeleine's abduction

• funded an awareness-raising campaign to ensure that Madeleine is not forgotten, the key part of which is our website

• provided some administrative support to Madeleine's family in maintaining the impetus of the investigation

Last year I referred to the public apology made to Madeleine's parents, Kate and Gerry, by the Express Group following months of inaccurate speculation and accusations in the media. Other newspapers followed suit with accompanying donations to Madeleine's Fund. In addition, an apology was made to the friends of Gerry and Kate who were in Praia da Luz at the time of Madeleine's abduction.

Rather than accepting libel damages, the friends requested that a donation was made to the fund. This has enabled us to continue our search for Madeleine. On behalf of the directors of Madeleine's Fund, I thank Kate, Gerry and their friends for continuing to forego any personal financial recompense to ensure that the search for Madeleine continues.

Following the end of the financial year we were delighted to hear that Madeleine's parents, brother and sister had been successful in obtaining an injunction banning sales of Mr Amoral's [sic] book and banning him from repeating his claims.

These fabrications had hindered the search for Madeleine and were a barrier to potentially valuable information being passed on to the police. Our team of investigators continue to diligently review police files, witness statements and follow up every potential lead in the search for Madeleine.

Although the majority of donation income for the year arose from family and friends donating libel damages, we have a number of loyal donors continuing their support.

For this we are grateful. As expected, income in the new financial year is lower than last year and we continue to review all our expenses to ensure value for money.

The directors regularly discuss the strategy for the Fund to ensure that finances are available to achieve our main objective, finding Madeleine.

The Board of Directors would like to take this opportunity to thank everyone who has supported the search for Madeleine. The level of financial support, the amount of time given up and the numerous messages of support sent to Madeleine's family have been overwhelming. All messages of support sent to the Fund are passed to Gerry and Kate, and appreciated by them. We will continue to ensure that Madeleine is not forgotten and will leave no stone unturned in our search for her.

MCCANNS POSSIBLE CHARGES KIDNAPPING AND TRAFFICKING SAYS PORTUGUESE PROSECUTOR

Gerry McCann: "We thought it
was possible this could hurt her.
Her abductor might do something
to her eye.
But in marketing terms it was a good ploy."

Carlos Anjos, President of the PJ's Union ASFIC:

"If that situation had been of an abduction,
it would have been terrible for the child.
Because if that child were to be sold, or
something else
... She was as good as...
it was her death sentence. That situation,
that day, advertising that photo,
was simply the death sentence of that child."

What does this say about laughing, smirking, suing, Gerry McCann? Madeleine's own father?

This was the most important evidence in the case in Portugal recently and I believe, what the Portuguese Judge hearing it will be most influenced by. He was the lawyer in charge of the case, he does not exaggerate or cogitate, he only states the facts. H

11:23 : It is the attorney who was in charge of the original inqury into Madeleine's disappearance, Jose Magalhaes e Menezes

11:25 : His testimony is marred by a high-pitched whine of feedback from the microphone - and the fact the screen can't be seen by the public

11:26 : The McCanns can't see the person giving evidence. Mr Amaral can, but doesn't seem to be looking at him. This indicates to me that although (perhaps) Goncalo had summonsed Mr Menezes to give evidence on his behalf, he knew he would not be particularly supportive of Goncalo's insistence there was evidence of "death".

11:26 : Mr Amaral's lawyer is cross-examining the witness.

11:37 : Mr Menezes is saying that English police sniffer dogs were brought to Portugal to help in the search for Madeleine.

11:38 : He says that the decision to make the McCanns 'arguidos' - suspects - was taken by the police and then confirmed by the public attorney.

11:39 : The decision to designate Kate and Gerry as 'arguidos' was taken after the sniffer dogs carried out their searches.

11:40 : There were several possible charges that could have been brought against the McCanns: kidnapping and selling a child were among them. s. This clearly suggests to me that the prosecutor actually believes it is more likely this is what the McCanns did with Madeleine.

11:48 : The witness was asked what the probability was of Madeleine still being alive. He replied that he thought it was 50/50. This clearly implies that he thinks it is at least as likely that Gerry carried Madeleine off alive, as I do.

11:55 : Mr Menezes said that a claim made by the McCanns on the first day after Madeleine's disappearance was not true

11:57 : He claimed that although the parents had been checking on Madeleine, it was not as often as every 30 minutes Both of these comments confirm that the prosecutor is perfectly happy to say quite categorically, the McCanns have told lies, and the McCanns are not challenging this statement.

11:56 : The witness said that Kate and Gerry's report that they had been checking on their daughter every half an hour was inaccurate

12:01 : Police intercepted text messages sent by the McCanns because they were suspicious of the parents' role in Madeleine's disappearance. Suspicious of "their role" in Madeleine's disappearance, he is not saying they killed her although that could clearly be included.

12:02 : The text messages sent by Kate and Gerry were never admitted as evidence gathered as part of the investigation. It is unfortunate we do not get an explanation as to why they were not admitted but I would suggest that is because they are admissible in a British court and the decision had been taken to deal with the McCanns in UK. As a prosecutor he would have been involved in this and his position would not allow him to offer any comment in a public hearing in a civil court.

12:08 : Mr Menezes said he has not read the book written by Mr Amaral that triggered this case, Maddie: The Truth Of The Lie. He is not a close and supportive friend of Goncalo Amaral that much is obvious. Neither did he think he could learn anything by reading it but that is hardly surprising given the knowledge he obviously has which would be far more than Mr Amaral.

12:18 : A report signed by Chief Inspector Tavares De Almeida said that Madeleine died in the flat in Praia da Luz, the witness adds. He is merely confirming Mr Almeida wrote this report but is not confirming or denying the content of it or offering any opinion at all on the content of it.

12:19 : Now it's the turn of the McCanns' legal team to cross-question the witness.

12:24 : The McCanns' lawyer makes the point that 'evidence' usually sightings - has suggested Madeleine is still alive

12:25 : He says that the McCanns are not responsible for generating any of this 'evidence' that their daughter is not dead. I am assuming this is a comment by the McCanns' lawyer and really it would have been better if he had not said it because it is utterly damning to the McCanns given it clearly implies there is suspicion against them that they are responsible for false sightings of Madeleine. He let a new cat out of the bag we had not heard before!

12:26 : Another of the McCanns' lawyers moves to quiz the witness - literally. She gets out of her seat and walks right up to the video screen This clearly implies total panic in the McCann's legal team at this point. I am assuming the male lawyer who just made the above pretty serious gaffe is junior to Ms Duarte who it would appear sprang to her feet.

12:33 : She says that the McCanns were always totally prepared to come back to Portugal to take part in a reconstruction of the disappearance This is a typical remark for a desperate lawyer to come out with, say something good about your client that cannot be argued with. Of course, what she does not mention is, the McCanns friends refused point blank to come back for the reconstruction so that put paid to it without the McCanns seeking to defy Portuguese Police (given they were arguidos they had no choice but to attend) They defied them in a more subtle way with a little help from their friends.

12:34 : The McCanns' lawyer asks the witness whether he understands the title of Mr Amaral's book to imply some sort of dishonesty by the McCanns. That is the problem with this, we are getting questions but not answers and vice versa on occasions where the writer could not keep up with the exchange.

12:38 : Who suggested the checking of the McCanns' text messages, Mr Menezes is asked. The police, he replies. This was a dumb question for the McCanns lawyer to ask, in my opinion. I suppose she hoped the answer would be Goncalo Amaral because she wants to imply this one officer was just victimising the McCanns. As it is, all she has done is draw attention to the fact the police were so suspicious of the McCanns they were intercepting their communications with a view to obtaining evidence against them.

12:39 : The text messages were never considered as part of the investigation because the judge did not allow it, the court hears So here he is telling us that Portuguese Judges refused to admit this evidence as part of the investigation. This may inform us as to why he states the McCanns could have been charged with kidnap and trafficking. Remember Gerry received 14 text messages the day before Madeleine disappeared and four the day after, all of which he wishes to completely deny. I believe this does confirm that it had been decided there was strong evidence to indicate Madeleine may have been kidnapped, may still be alive, it may have been arranged by the McCanns and for her safety this MUST BE KEPT CONFIDENTIAL. British Police confirm this investigation is ongoing. I believe that Portuguese Judges knew exactly what was suspected against the McCanns, knew the British would deal with this and internationally, and Goncalo Amaral just had to be stopped, including leaks to the press when he was in charge of the investigation. Why else would Portuguese Judges, seemingly be deliberately frustrating the investigation. In my opinion they were not, they were preserving the confidentiality of the investigation and thereby the safety of Madeleine.

12:45 : The senior lawyer for the McCanns has approached them on the front bench of the public gallery for a quick huddled conversation. This demonstrates just how crucial this evidence was, she was seeking further instructions from her clients. It might have been something along the lines do you wish me to ask him any further questions, clearly they did not!!

There is so much that is incredibly damaging to the McCanns that has come out of this court hearing. I believe there is a very strong chance that when Mr Smith saw Gerry carting Madeleine off she was drugged but still alive. Gerry feels he can sue Goncalo Amaral for saying they disposed of her body because maybe that is not what he did. Thus he reasons, I have been libelled and I want money. But it just shows what a perverted and arrogant fool he is to open such a nasty can of worms.
