WATCH THIS VIDEO OF KATE AND GERRY INSIDE THE STRASBOURG PARLIAMENT. He denies they neglected or abandoned the children and quite astonishingly states YOU ARE GOING OVER OLD GROUND, IT IS REALLY QUITE BORING! Thanks very much to Di, LGC and others for drawing this to my attention! If he is going to put himself before educated people in a parliament then he is going to have to accept they are going to ask educated questions, demanding to know why he is there, and just how sincere he actually is about childrens' rights.

Hi All

We now have an article in The Times that confirms the McCanns will get access to all evidence against them in July and after that it will be opened up to the public and the press, so we can all see what the case against them involves. It does sound as though the investigation will continue. This is to be welcomed. Moving forward at last and all the speculation will no longer be necessary. If Murat is innocent we will of course find this out to or judge for ourselves from what we see. The disclosure of the details will certainly make an interesting read! I think it is only the McCanns who had something to hide!

Kate and Gerry McCann to be told why police made them suspects in disappearance of Maddy

Madeleine McCann’s parents will be told next month what evidence the police have to make them official suspects in her disappearance, it was announced today.

Portuguese Attorney-General, Fernando Jose Pinto Monteiro said Kate and Gerry McCann will be given full access to the case files relating to their daughter’s disappearance last May.

The police inquiry into Madeleine’s disappearance shortly before her fourth birthday covers homicide, abandonment, concealment of a corpse and abduction. All evidence in the investigation has until now been covered by strict laws of judicial secrecy.

However, Mr Monteiro told the 24 Horas newspaper today: “In July, the process stops being covered by the judicial secrecy."

This will mean that the thousands of pages of witness statements and other evidence will be made available to the McCanns and their lawyers before being opened to the press and public

Mr Monteiro said that the disclosure of the evidence would not affect the ongoing investigations or possibility of changes.

“We won't rest until the child is found,” he said. “The fact that the judicial secrecy is lifted has nothing to do with the development of the investigations.”

The opening of the files will be welcomed by Mr and Mrs McCann, from Rothley, Leicestershire. They have insisted there is absolutely no evidence against them and the police should concentrate their investigation on stranger abduction.

Mr and Mrs McCann were dining with a group of British friends at a tapas restaurant on the Ocean Club resort in Praia da Luz when Madeleine was reported missing from her bedroom.

The couple, from Rothley, Leicestershire, hope the release of the files will lead to the lifting of their status as arguidos (official suspects) imposed last September. Robert Murat, 34, the other official suspect, will also have access to the evidence which he hopes will clear his name.

However, the release of the information could be delayed for several weeks as Portuguese judiciary starts a month-long holiday in the middle of July.

The announcement came as Mr and Mrs McCann embarked on a series of meetings with MEPs in Strasbourg in a renewed effort to secure backing for a Europe-wide child abduction alert system.

The couple have until July 24 - the close of the plenary session - to collect the signatures needed to ensure that their proposal, in the form of a written declaration, is sent to the EU President and published.

They have chalked up 225 signatures so far, leaving them another 168 to collect.

Mr McCann said: “This is an important issue and Europe needs to work together. We want to get as many signatures as possible but there’s limited time left.”

The couple launched the drive for a United States-style Amber Alert in April, but now fear time is running out in their bid to achieve formal recognition of the scheme.

Such a declaration carries no legal weight in the European Union but the McCanns believe it would help them win the moral argument over whether such a cross-border system is needed.

The couple believe a European version of Amber Alert - which notifies the public via media across the US when police confirm a child has been abducted - would have helped the search for their daughter in the crucial hours after her disappearance.

The McCanns have certainly sent things spiralling - refusing to answer questions by the police or be interviewed is their speciality!

These players must be short of the grey matter though because there have been many cases where girls willingly go up to the bedrooms of well known personalities, especially sportsmen, and then end up with their kiss and tell stories - they would avoid them like the plague if they had any sense!

Well Gerry has never made any real attempt to hide his cynical business plans has he?

To me the worse thing they did in the very early stages was design that brand logo Look highlighting Madeleine's colomboma. This would obviously have signed her death warrant and was stricly against police advice, but as he said, it was a good marketing tool. I think this man is just so odd he really cannot help himself. I think it was in June or late May when he was talking about a one year anniversary event, he clearly had his business plans all figured out. He clearly also had the political backing of the Amber Alert Scheme all figured out at that very early stage, going to the States in early July and saying he wanted to focus on the wider political issues surrounding the abduction of children. They have always talked about all the work that was "going on behind the scenes" in relation to this. The McCanns are so far from normal they just have no perception how normal people view them or how utterly shocked we always have been by their conduct, or often lack of it, from the very earliest stages. Why did they never once mention that massive reward? Everthing they did has so obviously been blatantly premised on the clear assumption Madeleine was never going to be found, that is why they never bothered to look.

Nancy, I was born in Germany, but close to the (around 5 Km) Dutch border. I grew up among people from all nationalities. I have a very good opinion about Dutch people. And they are playing incredible football in this tournament.

Do people also remember Gerry bitterly complaining he had to start using the "Find Maddie Fund" to pay for private detectives to look for her in September, because the police were no longer looking. How incredibly perverse, and yet, in the early stages he was saying the Fund was just set up because all that money was pouring in from the public and they had no plans to use it for private detectives, it has "enabled us to get lawyers in place and get a lot of legal help". But lawyers do not find missing children do they, they defend parents who are responsible for their children being missing, this fund was always their "Defence Fighting Fund" and Clarence Mitchell just admitted it is being used to pay legal costs.

If Gerry likes the Americans so much, how come he did not instruct one of the many massive and expert agencies in the States, whose specific person is tracking abducted children? To me this was another clear give away, appointing a bunch of crooks with the public's money, M3, who, as Mr Marco said, took on the job because Marco was the only one who agreed with Gerry McCann's "hypothesis" Madeleine was abducted by paedophiles. Not that Mr Marco knew anything at all about missing children or paedophiles, he cynically pointed out to The Times, he had to do some internet research on that. Marco made the most absurd claims he would have her back for Christmas and then joker Mitchell tells us "operationally we are very satisfied with M3". What for announcing he was right on the tail of the abductors? Mr Marco is every bit as much of a joker as Clarence Mitchell and I am sure has every bit as much belief in the "innocence" of their "clients".

I cannot really exchange with you on the football. Does anyone remember George Best, Bobby Charlton and Nobby Styles, I used to like it then:-))))))))

I remember going to Holland when I was about seven and also going into Germany. We were never allowed to have lots of sweets and ice cream. I was just amazed at the people we met and how we kept getting these fab big ice creams, more than we could eat. We stayed in one place in Holland and my sister and I decided to play jumping off the headboard and smashed the bed, but the Dutch landlady was so lovely, ah children love to play. I think we were a couple of real brats!

RacistandXenophobic MumFromHell is not that subtly threatning Viv and myself, saying that we are soon going to have a big shock, implying we will be sued. If the McCanns want to sue me because I say I find them child neglecters, I'll be in court tomorrow. Ok, not tomorrow because the weather is really good now and I don't want to miss it, but by the end of the summer I can squeeze them in my shedule. Furthermore, if I was to be sued because I say (and I'll say it till I die) that the McCanns are crappy parents, unworthy of Madeleine, Sean and Amelie, selfish creatures who put their selfish pleasures in front of their toddlers' security and health, supposedly distraught parents who refused to cooperate with authorities who were and still are trying to find out what happened to their daughter, then, she (RacistandXenophobicMumFromHell) and her lot would all be sued because of the accusations they have thrown at the PJ. And all their accusations have been saved and are where they should be. Just in case.

In circumstances where proof and evidence are adduced that the child suffered assault, illtreatment, neglect, abandonment or exposure that caused the child unnecessary suffering and injury,
this shall be contrary to the best interests of the child, and in such situations, a parent or guardian who subjects a child to such illtreatment is guilty of an offence and liable to a fine or imprisonment ( Children's Protection Act).


CHILDREN ACT, 2001

PART 12 Protection OF Children
Cruelty to children.

(1) It shall be an offence for any person who has the custody, charge or care of a child wilfully to assault, ill-treat, neglect, abandon or expose the child, or cause or procure or allow the child to be assaulted, ill-treated, neglected, abandoned or exposed, in a manner likely to cause unnecessary suffering or injury to the child's health or seriously to affect his or her wellbeing.

(2) A person found guilty of an offence under this section shall be liable—

(a) on summary conviction, to a fine not exceeding £1,500 or imprisonment for a term not exceeding 12 months or both, or

(b) on conviction on indictment, to a fine not exceeding £10,000 or imprisonment for a term not exceeding 7 years or both.

(3) A person may be convicted of an offence under this section—

(a) notwithstanding the death of the child in respect of whom the offence is committed, or

(b) notwithstanding that actual suffering or injury to the health of the child, or the likelihood of such suffering or injury, was obviated by the action of another person.

(4) On the trial of any person for the murder of a child of whom the person has the custody, charge or care, the court or the jury, as the case may be, may, if satisfied that the accused is guilty of an offence under this section in respect of the child, find the accused guilty of that offence.

(5) For the purposes of this section a person shall be deemed to have neglected a child in a manner likely to cause the child unnecessary suffering or injury to his or her health or seriously to affect his or her wellbeing if the person—

(a) fails to provide adequate food, clothing, heating, medical aid or accommodation for the child, or

(b) being unable to provide such food, clothing, heating, medical aid or accommodation, fails to take steps to have it provided under the enactments relating to health, social welfare or housing.

(6) In subsection (1) the reference to a child's health or wellbeing includes a reference to the child's physical, mental or emotional health or wellbeing.

(7) For the purposes of this section ill-treatment of a child includes any frightening, bullying or threatening of the child, and “ill-treat” shall be construed accordingly.

Actually, it might come as a breath of fresh air, seeing as the style of most MPs these days seems to be to answer any question except the one they've been asked...

Well they have reported me to Carter Ruck "and all relevant authorities" about 50 times over the last six months. Did they not even realise Carter Ruck would not be taking instructions from them!

Last time I spoke to my local police I explained they say the McCanns are innocent, I cannot repeat what he said in response to that, I am promised I would not !!

I lost count how many times I am in for a big shock and my blog being closed, good job I did not hold my breath (although I am sure they would not agree about that):-)))

How foolish and stupid they look with all their silly threats!

Given they talk about us so much, they obviously have a big inferiority complex, understandable really given the quality of the posts and arguments people make on this blog!

Viv, I have also talked about this with 'relevant authorities' (and believe me, I really mean relevant authorities in this case) and their reacion was, well, lolololololol! :-) Some people seem to forget that in Portugal there are lawyers too. And some of them, live really near. What these people fail to understand is that some of us know EXACTLY what we can say in public and what to discuss in private. And let's make things clear, the reason why I say I don't believe in the murder theory has nothing to do with fear of being sued. I have never believed that theory and I have good reasons not to. If I did, I would say so. Like I said many, many months ago to DesperateSassy on DE: I don't believe the McCanns killed Madeleine. I do believe she died because they abandoned her and her siblings.

I think Gerry might say, well you know I have no sympathy for people who cannot make proper arrangements to get their mortgage paid for them. If they just made the effort to set up a fund, get it properly incorporated, use the media as it is meant to be used to fill up their coffers, use some of the fund to make sure they get the right type of legal advice. Yes it can be hard work, I have worked damn hard for the Two million or so I made from my Fund but at the end of the day, I had a massive mortgage to pay so these people who just do not use what is so readily available from people's pensions and income support, really do bore me and do not deserve any sympathy at all. They are just jealous of my 4 x 4 and five bedroomed house but are not prepared to make the effort at all. With a little effort the public will fund this type of lifestyle.

I can just see the headlines on Sky and The Daily Mail:

McCanns start sueing individual blog sites who dared to say they are responsible for the death of Madeleine. Clarence Mitchell announced that funds are once more running low, Kate's new wardrobe and makeup artist have taken a toll together with their massive travel budget and huge fees to a trained nanny, who the McCanns have been forced to employ due to the unfair public criticism of them leaving the children to fend for themselves. The McCanns are confident that individual blog site owners will just hand over the running of their bank accounts to Gerry McCann, or Income Support and Child Benefit Books etc. He feels this is necessary and Mr Marco has increased his monthly propaganda fees to find Madeleine and feels sure the public will understand and, as ever, give the McCanns 100% support in the stance they have now taken. It is felt individual bloggers will not be able to afford legal advice and so will just want to settle with the McCanns as suggested, and thus the McCanns can ensure they continue their policy of obtaining money from anywhere they can grab it. John McCann has kindly agreed to run other people's bank accounts for them and cash their income support at the post office to add to the "Find Madeleine Fund". He is doing this for a very nominal monthly fee of about £3000 which is remarkably generous of him.

Yes, I also said right from the start that advertising Madeleine's stigmatic eye all over the world was one way to sign her death warrant! Whoever advised them on that must have been barmy, and if they thought about it themselves then they made a really crass decision! It will come back to haunt them that's for sure!

If they had advertised a million pound reward immediately she went missing, without any mention of her eye stigma, the chances are that someone would have returned her for all that money, but who would take a child anywhere who could be recognised all over the world!

Those two have doctorates, but I wouldn't use their minds for anything more than what wine to drink with a batch of tapas quite honestly!

Nancy, the PJ Union guy said on National TV that the PJ begged the McCanns not to reveal Madeleine's eye detail because the PJ knew that if Madeleine had been abducted, revealing that would kill her straight away. The McCanns decided to reveal it anyway.

They are not exactly eloquent speakers are they?

How do you think amber alert would have helped (surely a question she may have anticipated) well er that is really hard to answer..and as for it is really quite boring, if you was Cameron or Brown would you be saying "oh gosh he is great, must get him on the selection list". Kate, working to protect children???? they are good at scamming money though, professional con merchants, what a profession eh!

I can only speak for Opus on the intelligence front, of course, and will tell you that his simplicity in understanding life betrays an inate intelligence not many people (well, doctors, frankly) possess.

You're right, what am I thinking? Of course the McCanns had to do a world tour to not find their daughter. After all, the Queen is getting on a bit and we know she's not entirely convinced of Charles' suitability for the job, so K&G are doing the country a great service. (Never mind, Madeleine. Some things are just more important).

Do you reckon they'll offer Paul Burrell a job? He's another loyal servant in the name of the monarchy...

Funny they haven't been back to Portugal to look for their daughter, though. But what would she be doing there??

Has anyone ever found out just why K&G hired M3? They made up their minds pretty quickly who to hire! Someone they know must have given them the name but why M3? They certainly weren't cheap and they certainly hadn't any experience in finding abducted children!

Could it be they didn't really want an outfit who were experts in child kidnapping in the first place; surely someone used to dealing with paedophiliac gangs would have worked out long ago through their many contacts that Madeleine hadn't been abducted in the first place!

re your earlier blog - that Gerry appeared to have made plans a year in advance.

I know you don't really go with conspiracy theories, but do you think that Madeleine could have gone missing to give important backing to the Amber Alert Scheme and ID Cards, which could be related to it.

It seems far fetched that her disappearance was planned for that purpose, but stranger things have happened with events only being found out years afterwards.

I know we have the forensic evidence and the cadaver dogs responses but I can't get it out of my head that Kate responded to a question once about what could be happening to Maddie, with 'we know she is alright and that she would be giving her tuppence worth to whoever took her!

All speculation of course, but that's all we can do really until all the PJ's evidence comes out.

In the photograph with the McCanns it is true to say that Mr McMillan-Scott looks like he has a lot on his mind, contemplative and concerned.

I think the reality is, Gerry sees himself as clever in the field of politics and used the Amber Alert to score himself a political victory to caste them in a favourable light and this was always planned. I think it was a diversionary tactic but not the reason for Madeleine to disappear, he is a user and he does think he is very smart. It seems to me much in the same way he used Murat and his "friends", all part of his scheming masterplan to exculpate himself and Kate.

Maddie has gathered support from all over the world it is sad, but it is poignant and it is very important. Her parents are not the ones deserving of support and I think MEP's should have made it very plain they should be assisting the police with their enquiries, not playing politics.

I have not had the courtesy of a reply to my emails to Mr McMillan-Scott or David Cameron, not that I would ever vote conservative anyway!

Talking about the McCanns helping the police with their enquiries, makes me wonder whether any of the tapas friends who left their children alone have been interviewed either by the Social Services or the Leicestershire Police.

I know they instructed solicitors but havn't heard anything further about their situation since the PJ's came to interview them.

Intimidation, scare tactics, invasion of privacy whatever everyone wants to call it, we have seen it all over the last 13 months or more. I lurked on the DM since the beginning of the case, I had my own suspicions whether they were involved or not. But the day the Portuguese Police made them arguidos was the day that I thought; yes they could be involved in Madeleine’s demise. I knew in my heart and mind that they least they were guilty of was neglect.

Many of us frequented the Daily Mirror forum, The Hunt For Maddy, we all made some good friends and topics of all nature were allowed to be discussed in the beginning, no censorship, no heavy handed modding. But then things deteriorated, satire was banned, humour was frowned upon. I know some people can’t see the funny side of this, but if you even tried to work out how they would do a reconstruction, with all the various timelines, it would be like a sketch from Benny Hill. In the last dying days and weeks of the DM Forum, people posted and then they were jumped upon, insulted, abused and vilified. What for? Just asking simple questions about why a little girl was left alone to fend for herself whilst her parents wined and dined. And because people found inconsistencies in statements and in timelines, connections between people and so forth.

Then one fine day a forum was made up, full of satire and many of us joined, unfortunately it was trolled, but what we found was that we enjoyed satire and discussing and debating the case. Due to circumstances the person that created that forum felt that he could not go on. Then came BarArguido, well we all know what happened there and on Saturday 24th November 2007 the3arguidos came to life, yes it was difficult especially after the escapade with BarArguido but we stuck together and we created a community.

We as a community have grown in strength and in my personal opinion we are a threat to those that want to see the good doctors allowed to break a nations law and walk free without facing the consequences.

As a forum we have had our ups and downs, but with this recent episode, well it is beyond beggars belief. Maybe Nbrado did feel grieved and out of revenge put the database up. Well for that he will have to be held accountable for, if the Police press charges. But what he has done has not betrayed us as a forum solely, he has betrayed Madeleine McCann, a little girl whose voice is lost in this whole affair. Even recently her father writes a blog and forgets to mention her. That is something that I can not truly understand. I would dedicate every blog to my daughter and mention her not treat her as an after thought.

Well by Nbrado uploading that database, he has given every chimp and troll and opportunity to bring this forum to its knees. But we have an option, we do not succumb to intimidation, we do not bow down and feel threatened because a few PM’s are posted. Come on anybody can alter PM’s, these could be fabrication of the real PM’s. To me the last few days remind me of a last ditch attempt to create as much hassle for us and a lot of praying on their part that mods and admin get fed up and pull the plug. Why? Because in less than a month the files of the case will probably be released for viewing and then the world will see, what exactly did go on in Portugal on that weeks holiday. That is when we will see people join us to discuss what was in those files. We are a pain in their side and if we can get just one more person questioning them and demanding answers and spreading the word it is not right to leave children, then we are spreading the word.

So we are a forum have a choice, we stand by our beliefs, we do not give into intimidation and remove our posts and leave the forum, because I think if we start doing that then one by one Madeleine’s voice is being taken away.

Some might not agree with forum policy and we are open for discussion, but as it has been said many times before when you visit someone’s home do you make the rules or the householder? So I am prepared and I know the mods are prepared to be in this for the long haul. We want to see Justice served and we want Madeleine to have a voice. Also when this case is over, we hope that many of you don’t just walk away and we continue our community and our friendships and find other topics to discuss. This is one forum in my eyes, that is not going to shut because of somebody sending me nasty e-mails, threatening me or intimidating me and I know the mods all feel the same.

So now it is over to everyone else, we are in it for the long haul and I hope everyone stands with us and demands to see that justice is served and Madeleine has a voice.

It was about a special kind of savoury pastry that is a traditional Afrikaner delicacy that she filled with curried mince. Said the locals loved it. I don't like that vetkoek. It fills me up more quickly than an American style pizza.

1 - I thought there were no sources in the UK because there were no such things as leaks (not!).
2 - If the article is right and the British Police and the McCanns are on opposite sides (and I always believe the police and suspects are) then it may be wise to put some pros on suicide watch. ;-)

The comments on the Troll site are a tragedy really, even if they do give us all a laugh! If you didn't laugh you would cry!

However, what you said about their grandchildren teaching our great grandchildren - you never said a truer word and it's a scandal that anyone is allowed to leave school with such an appalling level of English!

I was fortunate enough to have parents who wouldn't let me get away with anything less than good standards in any subject.

It seems that even our university students these days graduate with a standard of English far less than a 100%. So what hope is there for those that don't even reach basic standards? (not including those who suffer from dyslexia of course).

The rot set in during the 60/70's when certain politically correct MP's began to change the education system in the UK and the content of an English composition, say, was thought more important than the spelling and pronunciation and the 'don't bother about the spelling or vocabulary' attitude was brought in, so those with lower intelligence (or more to the point, couldn't be bothered) weren't made to feel inferior.

We are now seeing the results of these idiotic decisions. But that's MP's for you - if it works, just change it!

I am constantly amazed at the high standard of English of those from other countries who blog on here and other forums.

Well nothing but the best for the McCanns then, who feel that the PJ's have not followed up every single lead and sighting!

Did the McCanns ever look for Madeleine themselves is a question I'm sure the Leicestershire Police will be thinking!

Kate and Gerry believe that Madeleine is still alive and hope the police files may contain information which could yet lead to a breakthrough!

Just what makes them believe that Madeleine is still alive, when everything points to the conclusion that she isn't, especially if, as they believe, she was taken by a paedophile.

Obviously they would hope and pray so, but how can they be so sure of it?

It also mentions M3 who apparently use various other sources to gain information about the whereabouts of Madeleine.

It seems to be an eternity since these amateur sleuths (as far as child abduction is concerned) came up with anything positive - they certainly seem to be getting money for old rope as they say!

Another thought - are the McCanns getting legal aid? If so, it will be the taxpayers who foot the massive bill!

If the McCanns are paying, is it coming out of the Madeleine Fund, or is Uncle Brian footing the bill again?

They seem to have an endless supply of cash - probably sent in those little brown envelopes to an address in Rothley!

Off for some brekky now, so see you all later - I've always been an early bird, but I never seem to gather any worms - not like some people I could mention!

The intresting bit about that article is that not only are they suspecting the PJ's job and competency (as they have always done), but they are also considering the British Police incompetent. So, they think that the PJ doesn't follow every 'sighting' and 'lead'. They think that the PJ sends all that info to the British Police. And they assume the British Police are in on it, and basically refuse to find Madeleine. Even the idiotic pros must be shivering by now. They are treating the British Police, exactly the way they have always treated the PJ. Hilarious. Oh my, I can't wait! :-)

If I were them, I really wouldn't antagonise their own police force. It's not a very good idea. One thing is to antagonise a police force after running away from a country and being safely home. Another is to imply their own police force is more incompetent than M3 (as if that's even possible). British officers must be loving it. Tee hee hee.

Morning All

If the first hour of a child going missing is so important then why did the McCanns wait the best part of an hour before calling the police?

IF the McCanns will leave no stone unturned why have they not answered every question the PJ asked them and why have they not gone back to help in a reconstruction.

Gerry thinks it is sooooo Boring to keep talking about the fact they NEGLECTED their 3 very small children nearly every night of their holiday...

Also why was it so important that the world believed she had been taken? She could have wandered off they left her alone in a strange apartment even after she had told them she had cried along with her baby brother the night before they just left them. It is far more likely she did wander off to try and find them.

As a Mother of 2 girls who have always slept really well and had a good routine when they were small every so often I would look up and see a cute sleepy child in their PJs rubbing their eyes saying they want a glass of water or they couldent sleep. A cuddle and a carry back to bed and normally they were asleep in seconds...

I hate to think what would have happend if I had not been there no doubt (especaily if I had left the door unlocked) they would have just kept walking until they found me.

The fact this was not a posibility from minute one the alarm was raised is strange.

Gerry may find the fact that he and his wife are terrible parents boring but they are Guilty of Neglect and they want us to belive that Madeleine was taken and they wish they had been there when she had been? Well Gerry as boring as I may be the obvious point is if you had been where you should have been and she really was taken then she would not have been.

But as you need to convince the world she was taken and could not of wandered off I find that just one of the many things that makes me feel that something happend to Madeleine and you know exactly what it was.

Madeleine was Beautiful and if you really believe there is a chance she is still alive answer the bloody questions stop the spin the whole world knows you left them alone and even people defending you can try and say it was ok but if they believe this then they are as a sick as you because if she was taken the NEGLECT allowed it to happen.

Before any one jumps on me saying no one has the right to take a child I agree 100% the world is full of sick people who enjoy hurting and abusing children the lot of them should be locked up for good no chance of parole. But it is also true to say no child should ever be neglected so the parents can enjoy a night out and any parent found to have done so should be investigated by Social Services and taught how to care for a child and then if they are very lucky get to keep the children with regular checks.

Madeleine McCann: parents' court bid for information

Kate and Gerry McCann are to ask a High Court judge to order the release of police documents which they hope will kick-start the search for their missing daughter Madeleine, The Daily Telegraph can disclose

The McCanns hope their application to Mrs Justice Hogg will result in Leicestershire Police opening their files on scores of reported sightings of Madeleine, most of which have been passed on to them by police in Portugal, where the four-year-old disappeared in May last year.

Until now police in Leicestershire, the McCanns' home county, have refused the couple's requests for information about sightings, saying they are bound by the terms of an agreement with Portuguese police.

But Mr and Mrs McCann, who retain the services of a Spanish-based detective agency, are anxious to make sure that every possible lead has been checked out, which they believe the Portuguese police, whose investigation is gradually being wound down, may not be able to do.

The Telegraph can also disclose that Madeleine was made a ward of court last summer at the request of the McCanns, to empower judges to act in her best interests in any legal dispute such as the case which is about to be heard.

Clarence Mitchell, the McCanns’ spokesman, said: “I can state that on the instigation of Gerry and Kate McCann Madeleine is a ward of the High Court of England and Wales.

“An application has been made on Madeleine’s behalf by her parents for disclosure of certain documents. The hearing is currently scheduled for July 7 in the High Court in London.

“It has been the stated intention of Gerry and Kate McCann to leave no stone unturned in doing everything necessary to search for their daughter, as would any parent.

“This application is just part of their search for Madeleine.”

Madeleine’s status as a ward of court has never been disclosed by her parents, who quietly made a wardship application in the High Court just weeks after she went missing.

The couple’s legal team had advised them to ask for Madeleine to be made a ward of court because wardship status gives the courts certain statutory powers to act on her behalf in legal disputes such as the one which has arisen with Leicestershire police.

They still believe their daughter is alive and hope the police files may contain information which could yet lead to a breakthrough.

The case is listed to be heard in open court on July 7 in the Family Division of the High Court in London, and is expected to be contested by Leicestershire Police, according to legal sources.

Clarence Mitchell, the McCanns' spokesman, said: "Kate and Gerry have always said that they will do whatever is necessary to find Madeleine and that they will leave no stone unturned in their search for their daughter.

"They will take whatever legal steps are necessary if there is information out there that can assist their private investigation into finding Madeleine. Beyond that I cannot make any comment."

Mr Mitchell said the hearing would not involve any attempt by the McCanns to clear their names by proving they were not involved in their daughter's disappearance from a holiday apartment in Praia da Luz. They remain official suspects, or arguidos, in Portugal.

In recent months the couple have become increasingly frustrated at the slow progress of the Portuguese investigation, and they suspect that many possible sightings of Madeleine have not been followed up at all.

If they are given access to the police files on reported sightings, each one will be looked into by private investigators retained by the couple.

For the past year the McCanns have employed Metodo 3, a Barcelona-based detective agency, to carry out an investigation in parallel with the Portuguese police inquiry.

The agency has checked out sightings as far afield as North Africa and South America – all of which have proved to be false – using either its own staff or affiliated firms, which it says it can do far more quickly than the police.

In one instance earlier this year, the agency ruled out a sighting of Madeleine in Chile within three hours of receiving a tip-off, by employing local investigators to track down the girl concerned. The agency argues that police would have taken days to achieve a similar result because they would have been hampered by bureaucracy and official procedure.

Earlier this week Portugal's Attorney General suggested that police files may be opened up at the end of July, but the McCanns fear his comments may prove to be another false dawn.

What I find Intresting is the fact that if the police had any clear lines to investigate a sighting they would do so.

I find the fact that they had to ask damming for them as reading this it looks like the police dont want to give it to them.

And why would the police not help a couple all they could if their child was missing???

We shall see when the evidence is made public in July maybe it will show everyone why some of us dont believe a bloody word they say..
