1485 “Okay. Just finally, Fiona, I just want to ask you, you are aware that there is going to be a re-enactment over in Portugal, it is either going to be at the end of April or into May?”
Reply “Umm”.
1485 “How do you feel about attending that re-enactment?”
Reply “Well I’ve made my feelings clear in a letter, erm, already. Erm, my feelings are, I would do absolutely anything if I felt it was going to help bring, find Madeleine or find who took her. Erm, my reservations are, at this point, how doing the re-enactment is going to achieve that or advance the search in any way. And, obviously, there is a lot of apprehensions about doing it, just in terms of the media and they way we’ve been treated, the way the media would react to us doing the re-enactment, how they’d sort of physically actually manage to do a re-enactment without massive media intrusion, erm, and how the information would be used, I mean, we all know that we’re telling the truth of our actions on the night and if doing a re-enactment were going to be for the purpose of trying to find holes or, you know, in our movements and statements and try and rubbish our statements, then we know that’s not going to help find Madeleine, because we know, we were there, and we know we’re telling the truth, so I wouldn’t be happy to do it if that was the reason for doing it. I’d just like to be convinced how it’s going to move the investigation on really, erm, to find Madeleine”.
1485 “Yeah”.
Reply “And, at the moment really, we’ve got no reason to trust the motives of doing a re-enactment when Kate and Gerry are still aguido and, if they’re aguido, I think we’ve all got to be implicated, because I just don’t see how Kate and Gerry could have done anything that’s been suggested without us all being in on it, you know, it’s just impossible”.
1485 “Is that it?”
Reply “So, you know, that’s a big stumbling block really”.
1485 “So, at this present moment, you are saying you wouldn’t?”
Reply “No, I mean, we haven’t really had any, been given any information about how it’s going to be used and that’s the information that I think we would all need if we were going to do it and, obviously, there’s no point one of us doing it without everybody doing it. So, I think, you know, as far as I’m concerned, I’d only do it if everybody else was doing it, otherwise it’s pointless. And I still don’t see, erm, I think, emotionally, it would be hideous to go back and have to do an re-enactment, I really do, and I don’t see how, erm, emotions couldn’t affect the way it was done, because it would just be horrific, I mean, imagine, you know, Jane having to relive that, Kate having relive that, any of us having to relive that, you, you couldn’t do it without it being an emotional thing”.
1485 “Yeah”.
Reply “Erm, so I just, I just don’t see, I mean, in my eyes, doing it, it would be beneficial if actors and actresses did it because they don’t have that emotion and you can still direct them to exactly what you were doing and where you went and your movements. So, so I still don’t, we still haven’t had an answer to that really, that side of it”.
1485 “Okay. Alright. At this stage I have got nothing else to say to you”.
Reply “Umm”.
1485 “As you are aware, the interview is being monitored and it may well be that they have some further questions, but at this present moment, there are no more further questions”.
Reply “Okay”.
1485 “Alright. Actually there is. Sorry. Do you have your phone?”
Reply “Yeah”.
1485 “I just want to clarify your, did you take your mobile with you?”
Reply “I didn’t. My mobile had actually broken before we went on holiday, so we just had Dave’s mobile”.
1485 “Right. So did anybody use your mobile whilst you were away?”
Reply (shakes head)
1485 “No?”
Reply “They couldn’t have done, no”. 1485 “No. Could you just see if you have any of these numbers in your phone?” (So he thinks her mobile was being used, even though she thought it had been left at home)
Reply “Yeah”.
1485 “07XXX XXXXXX”.
Reply “07XX. I’ll look for 07XXX”.
1485 “The last digits are going to be XXX, that is going to be easiest”.
Reply “XXX”.
1485 “Sorry, you must have loads. Also look for one that ends in XXX as well”.
Reply “Ah XXX. Is it 07XXX XXXXXX?”
1485 “Yeah”.
Reply “That’s my, Simon XXXXXXXX, my brother-in-law”.
1485 “It is who, sorry?”
Reply “Simon XXXXXXX, he’s my brother-in-law”.
1485 “Is there any reason why he would have been called?”
Reply “We did speak, well it couldn’t have been off my phone, is this from my phone?” (this implies someone was using her phone whilst she thought she had left it at home broken, now who could that have been, I wonder)
1485 “Well it is possible that it, no, it wouldn’t have been off your phone”. (almost spilt the beans and then thought no leave her in the dark)
Reply “No”.
1485 “It would have been off”.
Reply “It would have been off Dave’s”.
1485 “Dave’s, yeah”.
Reply “We did speak to him, yeah”.
1485 “Did you actually make any calls yourself?” (maybe have triangulation want to be sure who was making the calls)
Reply “Erm, I used, I Dave’s phone. I’m trying to think who phoned Simon. I think Dave phoned Simon the following morning, erm, just because he’s another pragmatic, sensible thinking person”. 1485 “Yeah”.
Reply “Erm, I mean, you know, we would have phoned all our family that following day anyway”.
1485 “Umm”.
Reply “But we had a lot of calls from him. Plus he’s, he was, erm, just wanting to be of help really, so he did phone a fair bit as well, just in terms of, he organised for, erm, mobile phones, erm, you know, Portuguese mobile phones to be sent out to use, he, you know, he runs a business in XXXXX, erm, and financially as well, he was offering help if we needed, you know, money”.
1485 “Is there anybody other than family that you rang then?”
Reply “Erm, I rang the Children’s Nursery, tut”.
1485 “Have you got that number in there?”
Reply “Erm, yeah. I think I might have texted them. Erm, XX, sorry, it’s 01XXX XXXXXX”.
1485 “Okay”.
Reply “What was the other ending that you wanted, XXX?”
1485 “XXX, yeah”.
Reply “Sorry, I didn’t get to the last ones. 07XXX XXXXXX?”
1485 “That is it, yeah”.

Reply “It’s his mobile number, yeah”.

Reply “(inaudible). XXX. 07XXX XXXXXX, that’s Karen XXXXX, which is Dave’s sister”.
1485 “The next one is a Portuguese number, well it is a short number, it is 91XXXXXXX?” Reply “I don’t, I wouldn’t have that in this phone, erm, it’s a Portuguese number. Is it a Portuguese mobile number?” (If her phone was broken and left at home, as she thought, how was it ringing a Portuguese number the following day, odd that)
1485 “I don’t know. It is just too short for, because ours are normally eleven, aren’t they?”
Reply “Yeah, we, because, as I say, (getting rather flustered here) Simon did organise, erm, a Portuguese mobile phone for us to use out there, erm, which we’ve still got at home, I couldn’t tell you what the number was for that mobile, but I used that once I was out there, you know, to contact, you know, Dave or, or any of them, I’ve texted on it”.
1485 “Somebody would have rang it or texted it?”
Reply “Yeah, tut, I’m just trying to remember how much I used it, you know, every day. Again, I mean, if I had Dave’s mobile phone bills, which I think we did give to somebody actually, it might have been Kate and Gerry’s Lawyers actually, but we did use those. I can’t remember how much I used them and how much I used the Portuguese phone, but we certainly had a Portuguese mobile”.
1485 “Yeah. It sent a text to XXX, which is Dave’s phone”.
Reply “Uh hu”.
1485 “On the fourth of the fifth, so it is the following night”. Reply “Yeah”. 1485 “At twenty-two zero two”. Reply “So we would have been at the Police Station”. 1485 “And then twenty-two zero eight”. Reply “Sorry, from which phone, because we wouldn’t have had the Portuguese phone by then?” 1485 “It would have sent, the Portu, well I’ve got the Port”. Reply “I don’t know how quickly the phone arrived”.

(so what the police officer is saying is that this Portuguese phone that Simon Payne apparently arranged to send over was already with them by the following night and someone was using it to text Dave's phone from the police station. That kind of implies that was Fiona and she was letting Dave know how much trouble they were in, perhaps? But as she later goes on to admit they all swapped their phones around so not sure who was texting who really)
1485 “Yeah”. Reply “I can’t imagine it was that quick”. 1485 “The Portuguese phone, or that number, sent a text to Dave’s number at twenty-two zero two on the fourth, the following night?” Reply “So it was when I was being interviewed that evening. I don’t think our phones came out that, I can’t imagine they would have been out by then, on the Friday night, so I don’t know. I’ll just check it isn’t, are you sure it’s a Portuguese number? Just read the number out again, I’ll just check it”.
1485 “It is 91XXXXXXX”.
Reply “Yeah, it is a funny number, isn’t it?”
1485 “It has only got nine digits as opposed to our eleven”.
Reply “Yeah. No, I haven’t got that number on and I can’t think, I can’t think who could have sent a Portuguese number at that point. Dave might recall when our mobile phones came out, but I’m sure it wasn’t, it couldn’t have been that quickly, erm”. (Well you know Fiona maybe Gerry and Payne already took Portuguese mobiles with them and your "broken" phone too?)
1485 “Okay. Here is another number that ends in, it looks like it ends in XXXX”.
Reply “XXXX”.
1485 “It might not necessarily be a mobile number”.
Reply “Erm, Dave’s mum, Diane PAYNE. Is it 0044 XXXX XXXXXX?”
1485 “Say that again?”
Reply “I’ve got 0044 XXXX XXXXXX?”
1485 “That is it, yeah. Who is that, sorry?”
Reply “That’s Diane PAYNE, it’s Dave’s mother”.
1485 “Yeah, there was calls made on the fourth from Dave’s mobile number?”

Reply “Well it was purely letting people know what had happened really and obviously there was a lot of concern back home as soon as the, the news hit, erm”.
1485 “And would you have made those calls from David’s phone or would Dave have made them?” Reply “No, Dave made, Dave spoke to his family, (officer again establishing who exactly was using the phone) I didn’t speak to this family”.
1485 “Okay. The next one, I think it is 02XX, so it could be a London number. XXXX it ends it”. Reply “XXXX. No, that’s not in my mobile, but I’m just recalling, I did make some phone calls on behalf of Kate, erm, the following morning and those, it’s a shame, because we’ve all swapped mobiles, you see, and not all of them were transferred, (now why on earth would they do that!!) but I’m pretty sure, erm, I rang at least two on Dave’s phone, just to let them know, again, you know, what had happened”.
1485 “Is that in the morning?”
Reply “Erm, that would have been, yeah, the following morning. (by the following morning they had all started swopping their mobiles around, how strange) I mean, I would be just saying to Kate, you know, ‘What can we do. What can we do’, and that was just one of the things, she said, ‘Look, just everyone will be panicking at home, just’, you know, ‘if you can contact a few people’. So, yeah, those might be numbers that I wouldn’t have now in my mobile that”. (but on her account above how could they be on her mobile when she says it was left at home broken, is she admitting she knows it was taken by Dave and being used?)
1485 “Dave could well have them?”
Reply “Well he’s changed his mobile as well because his died a death, (oh dear Dave all these broken phones and only certain numbers get carried across on the SIm card, umm) so I don’t think all his numbers are, you know, they weren’t all saved on the SIM card. But it’s easy enough for me to find out if they are, erm, friends or”. (or WHAT Fiona??)
1485 “Okay. There is two more left anyway. The first one is, it is a mobile number and it ends in XXXX”.
Reply “XXXX. Is that 07XXX XXXXXX? That’s a friend of mine, Lisa XXXXXXX”.

Reply “She lives near to us in Leicester, erm”.

Reply “I would have called her and, I think, at that point, it was just to check on the house, erm, she had a key to my house and she’s a good friend as well”.

I was just looking for a reason why Fiona Payne could just fly out at a moment's notice to assist Kate in Portugal, maybe I found it!

I like the way she says they all have to be implicated, spot on Fiona!

Dear God I remeber Kate texting from the police station I do think the PJ should have questioned them on the same day so they had no idea what each other were being asked and what was being said...

Poor Fiona is scared of the press yet smugly walked a few steps behind St kate to try and help her friend scam some more cash to pay the directors wages I mean find Madeleine....

They must all feel pretty sick that they screwed up with the mobile phones they hold on them more information than anyone could imagine and the service providers can see all....

whoever is protecting this gang of child neglecting idiots needs a reality check or more children will go missing or be killed because the McCann Mantra goes we all do it...

No we bloody dont most of us love our children more than life itself....

But it is ok because Fiona Phillips has rubber stamped it I am a celeb and I leave my kids alone in a hotel while we have dinner and it was soooooo funny as they were knocking on doors trying to find us ha ha ha...

THE parents of Madeleine McCann are holding a star-studded party to boost their fund to find her.
Kate and Gerry, both 41, are charging £150-a-ticket to attend the dinner and auction as the 1,000-day anniversary of their daughter’s disappearance draws near.

Invited guests include Virgin tycoon Sir Richard Branson, 59, Harry Potter author JK Rowling, 44, and Radio Five’s Nicky Campbell, 48, along with the McCanns’ backer, Scottish double- glazing tycoon Brian Kennedy, 49.
The bash at The Roof Gardens in Kensington, west London, on January 27 will swell the dwindling coffers of the fund. Nearly £2million has been donated since Maddie, then three, vanished on May 3, 2007. The McCanns insist Maddie was abducted from their Portuguese holiday apartment.
But Kate and Gerry fear donations may dry up after they attended a Portuguese court last week to ban a book about the case.
Ex-detective Goncalo Amaral, 50, claims Maddie died in an accident and the McCanns covered it up. The case was adjourned until next month.

But Kate and Gerry fear the fallout from the wild allegations could stop people donating. The fund, now at less than £400,000, would be empty by spring without a fresh injection of cash.
Kate said: “The fund is not depleted but we are aware, given the uncertainty of our situation, that we need to plan ahead to continue the search.” The party is expected to raise £100,000.

Hmmm….they must now be thinking win or lose against Amaral they might not get the dosh and equally the same applies to their action against the Portuguese TV company – hence the party.

It will be interesting to see who turns up at this party and nails their colours so clearly to the mast. I suspect most will just send a cheque and scribble an apology. Needless to say their will be a kerchink of the cash registers as some hedge their bets.

Even more interesting will be whether the celebs will want to be associated with this lot, at least publicly, as the long term fallout could severely damage or tarnish their carers or images. Nobody in the public eye likes to be duped.Open your cheque books celebs and be given a ribbon or balloon in return.


I thought the article in the Independent yesterday was rather good overall and suggests something awful happened in the apartment hence the reaction of the dogs.

Re the mobile phones and all sharing what a load of shi*. My children would not allow me to borrow their phones as such items are almost like a diary ie personal. This Tapas lot share everything. Yeah a big secret.

I see The Star suggests that the proceedings in PT last week may have damaged the chance of more donations. I cannot believe that there are gullible people still donating. Then again there are many who read the comics, The Scum, Star and Mail.

Hello guys, well I am wondering whether to buy a ticket and pop along and just ask Fiona to explain to me how they got those Portuguese mobiles from Simon Payne in the UK to use at the police station the very next night.

I might also ask her to explain how calls were being made in PDL on her broken mobile that she left at home. Or no, maybe I should ask David or Gerry becaue the police clearly caught her off guard with that one.

But then I could also ask her how David's mobile he was using out there also conveniently died a death and how certain numbers can be transferred across on a sim card but certain numbers are not. Bit convenient that!

Just to keep Photon happy on MM I could also ask her whether she is still just a trainee anaesthetist after all these years and why she did not mention that to the police, but suspect she may say, well I did say I was a registrar! Having the children and going on to three days a week has held up my career, just a tad. But you know Fiona, I think you did even worse things than that, that may hold up your career even more!

I dont understand they have 400k left in the fund just what are they spending it on???

If I saw a child that looked like madeleine I would call the police but that has been made imposible by all the many diffrent pictures of her the McCann's have put out there why Oprah's age progressed picture was not good enough is beyond me and they have replaced it with an image of a child who looks about 12....????

why do they need a fund most of it has been paid out to the board as wages they have been conned out of a chunk of it and are pleased with the results their legal fees are being paid out of the fund Madeleine requires no lawyers.....

They could well be responsible for her death due to force or accident due to their neglect what other criminal gets to take money out of a fund set up for the victim of their crime????

Enough is enough I cant blame JK Rowling for wanting to help when Madeleine went missing but her continued support would be very strange.... she is an inteigent woman she has children as a Mother would she forgive herself if as a result of a piss up her child was abducted would she laugh her head off on her missing childs birthday? No she would not and would she be happy if her partner stayed silent when being questioned?

Why give money to a fund that has never really searched for her it has all been about finding reasons why it could not possibly have been Gerry and Kate....

For gods sake a 3 year old child is missing at best due to her parents neglect we see a pathetic Kate and Angry Gerry moaning more about the lack of cash than the fact their child is missing enough is enough....

but we do not know if JK Rowling is coming back on board with the McCanns, we only have The Star and The Express ( the same group and who the McCanns have successfully sued and appear to write anything now to appease the McCanns)

It is not beyond the wit of Team McCann to use the name of stars to suit their own peculiar agenda. How must Vic Beckham feel!

The McCanns just cannot be charged with the death of Madeleine until such time as there is proof of a death. No prosecutor is going to go to court with nothing more than the dogs and inconclusive forensic evidence. Even forensic evidence alone is not enough to secure a conviction and Gerry is right in saying the dogs are no more than "intelligence". Grime himself confirms they are not evidence, that evidence has to come from forensics and it did not. That may well be due to a clean up but that does not alter the legal situation.

I still believe the evidence that we have been allowed to see and UK authorities attitude displayed towards this would tend to suggest they feel the McCanns were more likely involved in her kidnapping.

How and why would they have Portuguese mobile phones available for use the very next night. Why would they be using Fiona's mobile in PDL that she says she thought was broken and left at home?

This is just not consonant with a sudden death on holiday it is consonant with a planned and deliberate disappearance.

Madeleine: TVI denies bias ionline

Yesterday, TVI denied any bias in broadcasting the documentary that is based on Gonçalo Amaral's book "Maddie – The Truth of the Lie", which has temporarily been removed from the market after an injunction was filed by the parents of the English child that went missing in the Algarve.

Margarida Teotónio Pereira, the television station's international programming director, who was heard as a defence witness during the third injunction trial session, asserted that "TVI tried to buy a documentary in which the McCann couple presented their version" about the disappearance of their daughter, in 2007, in the Algarve.

The channel's senior official recalled that in April 2009 the station's then general director, José Eduardo Moniz, "didn't want TVI to be connected to a documentary that defended Gonçalo Amaral's thesis", thus they advanced towards buying the programme "with exclusive and original images", in which Kate and Gerry McCann reconstructed the facts.

That documentary in which the McCanns intervened, which was produced by British television Channel 4, would allow, as the witness mentioned, to oppose the one that had been produced by Valentim de Carvalho, based on the former Polícia Judiciária inspector's book, which was broadcast by TVI for the first time on the 13th of April 2009.

Both Margarida Teotónio Pereira and the station's market studies technician Paulo Gonçalves Soares said that the documentary had been preceded by a written explanation about the existence "of other points of view" about the matter, not binding TVI, at a time when it "was known that another documentary would be available on the international market".

The channel struck an agreement with the British distributor to buy the Channel 4 documentary, but on the 28th of April, Margarida Teotónio Pereira received an e-mail that confirmed a phone call from a few days earlier, in which the McCann couple impeded the broadcast on the Portuguese channel.

"We wanted to have the opportunity to show another story about a matter that was of major interest and that was very important to TVI, not only because of viewer shares", she said, stressing that the British couple vetoed the Portuguese channel because they were not satisfied with news that had been broadcast before.

At the judge's request, the written communication from the distributor, refusing the broadcast, was annexed to the process, because it was deemed important for the channel's opposition to the McCanns' argument, that the spreading of the thesis of Kate and Gerry's involvement in their daughter's disappearance damages the investigation.

The Channel 4 programme ended up being acquired and broadcast by SIC only days later, on prime time, with TVI repeating the broadcast of Gonçalo Amaral's documentary at the same time, merely for "share reasons".

Both on the first and the second broadcast, Margarida Teotónio Pereira said that at TVI "it was not discussed; the fact of the documentary being broadcast" on a date that preceded the PJ investigation's archiving dispatch, from the Republic's prosecutor in Portimão, which was written on the 1st of July of the same year, and notified on the 29th.

That matter was raised by the McCanns' representative, Isabel Duarte, who is going to file a criminal action against Gonçalo Amaral over breaching the judicial secrecy.

The nest session has been scheduled for the 10th of February, with closing arguments.

In this process, Gonçalo Amaral stands accused of disseminating conclusions that the McCanns consider to be unsustainable, of the little girl's death in the apartment, simulation of abduction by the parents, and concealment of the cadaver..

The Judge thought it was important that the McCanns refusal to allow TVI to purchase their documentary and put it on air to counter Goncalo's is annexed to this process. This does not look good for their claim to damages. TVI were effectively offering to immediately "make amends" and the McCanns refused to allow them to do that. Therefore they did not display any intention to continue to damage their reputation and libel them by supporting the claims of Goncalo Amaral to the exclusion of their own point of view.

Well it is not all about the PHONE is it.... It is about the SIM CARD.... When Mr Hope left his phone in his trousers before we went on holiday and they went through the washing machine we took his sim with us and every so often he put it in my phone to see if anyone had called and of course it had all his contacts on the sim card...

So David may have had need of her sim and used it in his phone....

She may not have known or thought his card was in his phone when he was making dodgey calls and sending dodgey texts????

As for JK Rowling no she has not accepted but it would be lovely to hear an apeal for any information about Madeleine from her offering her million pound reward it is never mentioned and if there child was really missing you would assume the parents would be pushing it....

If all these celebs were so in love with the McCanns they would surely have kept the fund well topped up and there would be no need for the begging bowl? They can invite Parsons Nose, The Tapas 7, Lorraine Kelly, Fiona Phillips,The Scum, The Star, The Mirror and Mail and Pinky, oh I nearly forgot Punch and Judy (aka Richard Madley and Judy). All class acts or what? Should be a good night.

Good point and I had not thought of that, they did not need to take Fiona's actual phone, just her sim would do for when David or Gerry wanted to pop it in their phone and make some dodgy calls.

I continue to think this looks like a setup of the ladies and they did not really know what was going on.

I cannot help but wonder if Kate persists with her I must find Maddie because that is what she truly believes? The only problem is she is not telling what she truly believes about her husband and David Payne?

I do not think we can ignore the fact that the two camps seem to be splitting off. A certain Pro McCann is increasingly making herself more obvious in attacking Fiona Payne but supporting David, jmo of course.

The many telephones of the Payne’s. I find the police interview with Fiona Payne very confusing. Having established there are a number of phones available to her and her husband it isn’t clear which one the interviewer is talking about.

My take on this is the interviewer had evidence of one of the Payne’s phones being used at a location both deny ever being in. Not who they were telephoning but from where they telephoned. Hence the interviewer asks did anyone else use your phone.

Speculating if the pj believed the McCanns’ concealed a corpse; it’s possible that they also considered that one or more of the T9 help them in this task. So if a call or signal from a mobile used by the Payne’s is pin pointed to an area they say they were not in then why are they lying.

Despite Jane Tanner’s fantasy about bundle man which gave the McCanns’ a hook to hang their abduction theory on it is Fiona Payne who is closest to the them and was staying next door. It could be argued the Payne’s are more likely to be involved than the others.

But could Simon Payne have got Portuguese mobiles to them by the very next night, from UK? I just do not see how that is possible? Unless, because he is in the business as Fiona says, he arranged for them to pick them up from somewhere. but again, the very next day after Maddie went missing they are messing about getting Portuguese mobiles. And Gerry receives four texts that day, the existence of which he chooses to completely deny. If Goncalo is going to bring some evidence to court about this all I can say is go for it! Then the British people can start demanding this man's immediate arrest.

Fiona Payne's report was very interesting. I have to agree with Hope, it is possible to take a sim card out of one mobile and transfer it to another, but only if the mobiles are on the same network or if the phone you are putting the sim card into has been unlocked. For instance my sim card will not work in hubbys and vice versa as we are not on the same network. Fiona is also correct when she says some were saved on the phone. When saving phone numbers to your phonebook some are saved to sim and others to phone. When the sim is removed the saved to phone numbers are not available on the sim card.

With regard to the Portuguese phones, I thought I read somewhere on 3A's that the Tapas had given their phones to the PJ and they had been issued with Portuguese phones, could be totally wrong though as there is so much to remember.

I don't blame Clarence for leaving a sinking ship, but how on earth can he even think of becoming an MP with his now tarnished background. Oh sorry forget that comment he would make a very good one ;o))

I was out last night so just reading back.

It was interesting to see the statement by CM. He has forged a new career out of this case and has managed, with the help of Carter Ruck, to silence the British Press, suppress anti McCann news and put a positive spin on everything.

But it appears against his advice the Mcs go to Lisbon, now everything he has contrived to prevent being made public has become available for all to read. All his efforts over the past 2 ½ years has been destroyed.

He does well to distance himself from the McCanns as future employers might think the Lisbon fiasco was carried out under his advice and wouldn’t employ him.

Mitchell is well qualified for a MP; he is a confident lying windbag, the primary credentials for anyone wishing this career path. But defending to the hilt child neglecters or worse is a no go. Someone with such lack of insight or overt money grabbing tendencies, really isn’t good enough even for the Conservatives. He could only consider becoming an MP if the Mc aren’t outed!

These are just two of the comments the papers were reporting about Madeleine's abduction after the family were first contacted.

Interesting to remember that Jon says the abductor went past the twins to get to Madeleine and repeats it once more.

Now we have to remember Kate & Gerry said the abductor came in through the door and left through the window. I thought Madeleine slept to the left of the bedroom door which means the abductor would not have to go past the twins to get to her, however he would have to pass the twins to leave with Madeleine through said window. Or could it be Jon is actually telling the truth as many of us have actually thought, Madeleine slept in the bed beneath the window.

The way I am reading his comments to the press is that he was told the abductor came in through the window, which was before Kate & Gerry had to back track and say they had left the door open, because the shutters had not been jemmied, or am I reading too much into this. What I am trying to say is Jon certainly is implying the abductor came through the window, which we know did not happen.

I think the Jon Corner’s quote is implying the alleged abductor came in through the window hence the alleged damage to the shutters – he suggests the window was the access point. He believes at the time of his statement the shutters had been forced from the outside therefore any abductor would have to have come through the window and squeeze by the twin’s cots to get to Madeleine’s bed by the door.

His belief was obviously what he had been told by G&K and what he believed to be true at that time.

Subsequently, we know the window and shutters had not been forced - but at the time of Corner’s statement he did not know this.

The story about the forced shutters is strange I’ve always thought someone was meant to damage the shutters to give the appearance of a forced entry. Perhaps they were interrupted and their plan not carried out. Jes Wilkins could have been the one who interrupted plans – just a thought.

One thing I do know there is no support from friends or family of the McCanns apart from Fiona as Viv says.

I do wonder just how Kate's parents are holding up, especially her father. Yes Rosie, I do have a heart. Kate's father was not well when Madeleine went missing, so I cannot imagine what he is going through now. No matter what differences we all have I wish him well. I would not like to be going through what they are going through. I believe Kate's family had been kept totally in the dark.

However, I think they are now up to speed.

It never made any sense did it once it was established that the shutters were not forced there was simply no need for it to be mentioned....

I believe Gerry was supposed to force it open got interupted by Jez and never had the chance to tell Kate.... The abductor getting in and out through a window would not have worked comming in the window and out the door would work but not the other way round....

for them to admit they left the door unlocked proves no one belived them about the window it has been tested and was not forced....

Hope/di Thanks for further explanations. If you look below the police officer intervenes after she has said well it could not have been off my phone and says it would have off Dave's and a bit later he goes to say

The way he cuts himself off here mid sentence I think you have provided the explanation, he was going to say that it...could have been your simcard but then thought better of it, because that would obviously have seriously frightened Fiona! He just wanted to find out how much she knew, knowing that her phone (or sim) was obviously being used in PDL but her story is it was broken and left at home. These are the sort of things that clearly tell police they are on the right track!

Di, in relation to the Pt mobiles, you will see that she clearly confirms here that Simon Payne, David's brother arranged those for them:"....he organised for, erm, mobile phones, erm, you know, Portuguese mobile phones to be sent out to use" and prior to that she says: "I'm trying to think who phoned Simon, I think it was Dave the following morning". Here I think Fiona knows she is on very dodgy ground, knows mobiles were being swopped around like there is no tomorrow and is stalling for time whilst she vaguely tries to extricate herself, "I think" is always a good one when you do not want to commit yourself. What she means is god knows which phone was used but she knows the police have checked them all.

But Di, it is clearly possible the Pt Police also loaned them mobile phones to keep in contact with any new information and to track them!

The police do sometimes give significant witnesses a mobile to use or women at risk of serious harm etc.

What is not possible IMO is for Simon Payne to have got those Portuguese mobiles out to them the same day as Dave spoke to him, remember Gerry had FOURTEEN UNEXPLAINED TEXT MESSAGES THE DAY BEFORE MADELEINE DISAPPEARED.

I think Simon Payne is also involved.

I also think the Pt Judge Frias deliberately blocked the calls from being part of Goncalo's investigation because Brit Police wanted them blocked because they are the key to this case. Goncalo did not stand a chance of solving this case, he was being kept in the dark due to press leaks.

Judge Frias's decision was upheld in the Appeal Court in Evora and I remember thinking at the time what a strange thing to do. Portuguese Judges are blocking Portuguese Police from being able to solve this case. Now it all makes sense.

Brit cops realised what they were dealing with and tipped more senior people off in Portugal. It was all over Goncalo's head.

The investigation into the disappearance of Madeleine McCann, in Praia da Luz in May 2007, began as if it were a kidnapping. But "Kate and Gerry McCann were made defendants because the evidence gathered during the investigation pointed to death, simulated rape and concealment of the corpse of the child," he said yesterday in court, the chief inspector Tavares de Almeida, one of the researchers who had PJ the case at hand to be removed - in early September 2007 - when he asked for the change of coercive measures to arrest "to prevent their departure from Portugal."


'When we talked about in accidental death. Even the prosecutor Magalhaes Menezes [owner of the process] believed in the death of Maddie, as Kate's own at some point. But PJ has no power to impeach and the case was filed, "said Tavares de Almeida - before the McCanns - the first session in response to the injunction which prohibited the sale of the book the former PJ inspector Gonçalo Amaral 'the Truth lie.

'The dogs detected blood and body odor in the apartment and rental car. And all that was collected was in conjunction with elements of the laboratory of Birmingham not to be discrepancies. But oddly enough, after the first results have shown that 15 out of 19 alleles of the DNA sample from Madeleine coincidence came to tell who had contaminated the samples' accused Tavares de Almeida.

The thesis of the death and concealment of the corpse was also advocated by the Inspector Ricardo Paiva, who was liaison officer between the PJ and the British family. "I share the statement Gonçalo Amaral in the book. Maddie died, probably in a tragic accident, and all signs point to which parents have hidden the body, "he said.

The thesis was presented by the Director of the National Counter-Terrorism, Luis Neves - 'a simulation of abduction, concealment of a body and accidental death cases are' - and the prosecutor Magalhães e Menezes - 'is more likely that the child is dead' .

The McCann couple is not obliged to testify on this hearing. This hearing is just regarding the injunction that banned the the book and the documentary, it's called an «Apenso». Maybe in the main action, their lawyer and legal mandatory(representative) will read a carefully designed statement to express the McCanns claim for 1,2 million euros, but still I don't see why would the McCanns put themselves on the uncomfortable position of having to face the 'contradictory' - the opposition made by the lawyers of Gonçalo Amaral, Guerra e Paz, TVI and Valentim de Carvalho that would subsequently follow if they wished to make a sworn statement. Obviously this is my opinion only, I have no idea what the McCann legal team tactic is.

In a heated exchange with reporters outside the court in Lisbon, Gerry McCann insisted there was "absolutely no evidence" to support the claim that his daughter was dead, before the court heard more challenges to the McCanns' account of events.

As Madeleine's parents returned for a second day of the libel trial over claims about their daughter's disappearance, Gerry McCann appeared rattled as he argued with Portuguese journalists about the claims of officials involved in the investigation. "There is absolutely no evidence that Madeleine is dead and there is absolutely no evidence that we were involved in her disappearance," he said.

This morning the court heard fresh evidence questioning the disappearance of Madeleine. Former senior police officer and criminologist Francisco Moita Flores told the hearing that the McCanns' legal challenge to permanently ban a book by Gonçalo Amaral, the officer who initially led the Madeleine inquiry for Portugal's CID, the polícia judiciária (PJ), was "pathetic".

He dismissed the couple's claim that Madeleine was abducted from the apartment they were staying in at the Algarve resort of Praia da Luz, telling the court it would be impossible to pass a child through the flat's window. Giving evidence via videolink, Flores defended the Portuguese investigation into the case, praising Amaral as a "good professional".

"I'd like to remind everyone that it's the book that's on trial and not Kate and I," he said. "Over the last two days you've heard a lot about Mr Amaral's thesis that Madeleine is dead. There is absolutely no evidence to support that thesis. A thesis without evidence is meaningless."

He added: "There is a little girl missing who still needs to be found and we will keep going until Madeleine is found."

The McCanns, both 41, from Rothley, Leicestershire, say their main motive for fighting the appeal against the book ban is the fear that people will stop looking for Madeleine if they think she is dead. Gerry McCann said: "This is a legal process that we're going through to protect our daughter and our family." When asked whether it was worth the emotional cost for the couple to attend the court case, he added: "Do you have children? Anyone who has children would go through the same process."

Gerry McCann returned to Britain this afternoon because of work commitments, but Kate McCann will stay in Portugal for the rest of the hearing.

The trial is expected to last three days, but the judge could order further hearings before making her ruling.

Simon Payne may well have sent out handsets to them but I doubt he would have got the sim cards in England...

When my husbands best friend lived in New Zealand we sent him handsets when ours were upgraded and when he met his wife out there we bought her a really modern phone that would have cost her a fortune in NZ all they had to do was put a NZ sim in it...

If they did not buy the sims themselves someone may have given them to them out there???? If they were making secret calls I bet they felt really clever if they put a new sim in their old phone the police would have nothing....

But they are not that clever because if the police were tracking them and therefor their phone calls when they were somewhere quiet it would prove that they were using a new sim and the number would have been traced linked to them and tracked...

If a few people were on the phone at the same time they could eliminate the others by checking the account details and they would also know the numbers the McCann's and co had been calling so which ever new sim was calling those numbers it would not be hard to work it out....

I do so hope Team McCann were not under the miss guided illusion that PAYT phones hold no records??? Way back when they first came out I worked for Vodafone and every call and text was logged it could not be accesed by everyone but Managers could look at every phone call and text sent if the police asked us for call details (with the correct paperwork) they could have access to the lot....

So maybe this is some of the evidence not released by the PJ in the files???

But if DAvid only spoke to his brother Simon on the morning of the 4th how is it that Simon got those phones to them on the evening of the 4th for them to be using them as the police obviously know that they were! That is quite obviously impossible!

I think this again demonstrates planning, the very next day they had Portuguese mobiles to use which they assumed would confuse the police.

Gerry McCann defended his legal action against a detective who led the investigation into his daughter's disappearence, saying his book had damaged the search for Madeleine. Gerry flew home after the second day of the trial and Kate was joined by Fiona Payne, a member of the so-called Tapas seven group of friends.

However there have been worrying reports regarding her husband, David, who was also amongst the group. Dr. Katherine Zacharias Gaspar told Leicestershire Police on May, 16, 2007, [report was only sent to the PJ on 24 October 2007] that she and her husband were friends of the McCanns and went on holiday with them and the Paynes in September 2005. During this holiday an incident stuck in her mind.

"I was sitting between Gerry and David and I think both were talking about Madeleine (...). I remember David saying something to Gerry about "she", meaning Madeleine 'would do this'. While he mentioned the word 'this', David was doing the action of sucking one of his fingers, pushing it in and out of his mouth, while with his other hand he was doing a circle around his nipple (...). I remember being shocked by that."

Gerry also told reporters outside the court that there is 'absolutely no evidence' that Maddie is dead, after the testimonies of three members of the Portuguese Police expressed their suspicions of her death during the hearing.

The extensive analysis that is carried out on all telephone communications that were made by the nine English people during their entire stay in Portugal is an important detail of the official investigation into Maddie’s disappearance.
It is Jane Tanner who reveals to the English police that David and Fiona Payne used a Portuguese mobile phone at the time when Madeleine disappeared, a situation that was not even unique given the fact that Kate and Gerry McCann also had phones with a Portuguese chip at their disposal, some of which were never known to the PJ.
When questioned in England about her own phone communications, Jane Tanner identifies all of the correspondents as being friends or relatives, yet fails to identify the owner of a Portuguese mobile phone whom she calls and sends text messages after Maddie’s disappearance. The question would never be clarified.
Another important detail that none of the documentaries – the Portuguese one, based on Gonçalo Amaral’s book and the English one under the “direction” of Gerry McCann – explains is the contradiction between the various witnesses, concerning Kate McCann’s movements.
To the Leicestershire Police, Jane Tanner, when questioned about that matter, says that she didn’t see whether or not Kate left the table during dinner because she “was back in her room at that moment” and only saw her again after the disappearance, “when she (Kate) was running near our apartment with Fiona Payne”.

Di, thanks for posting the report, almost a year old from Levy where has picked up on what I am currently highlighting - the Paynes immediately having Portuguese mobiles to use and the McCanns having Portuguese chips in their handsets.

To me this suggests the thinking was the crime took place in Portugual because the police there would just not be up to scratch.

They knew full well that any use of British mobiles would be fully recorded and trackable by UK Police.

But I think they seriously underestimated the professionalism of the PJ and just how co-operation there would be, in accordance with EU law between Portugal and UK. This was never going to be what they wanted it to be. A Portuguese investigation that they could concurrently just rubbish in the British press, it was always a joint investigation between UK and Portugal and now they have seriously come unstuck because Portugal do not have too much to do with it anymore. UK have all the evidence that our Portuguese friends amassed for us and it will be used in a UK court against them.

Wiz, I too have a great deal of sympathy with Goncalo Amaral. He was suddenly faced with an intelligent and highly disreputable bunch of people who came to Portugal to get rid of Madeleine and discredit him and the PJ. He has bemoaned lack of training and experience in such cases, but who, in reality, could have appropriate training for Kate and Gerry McCann and The Paynes in particular. Pt clearly do not have the level of serious crime we have in the UK and the resources necessary to deal with such a case. Is that the fault of Goncalo Amaral and is it his fault the case landed on his desk? Of course not. He became completely offended by the vicious and deliberate attacks against him/the PJ, I would have been too! The man is a caring human being at the end of the day xx

Fiona Payne was trying to explain that Simon Payne is in the business I take it she means mobile phones. I continue to think it is more likely he provided the tools they needed for this job and the police know this to be a case of planned child trafficking.

I think Goncalo was hampered in this investigation in that UK authorities are very secretive people and would have been keeping much of the best information to themselves because they always intended to prosecute this lot themselves and would be very mindful of the fact Maddie may still be alive and any leaks would undoubtedly put her life at risk. I think Rebelo understood his role rather better, it was to assist and complement UK, not to try and actually prosecute them in Portugal.

Kate and Gerry McCann will mark the 1,000th day since their daughter Madeleine disappeared with a star-studded fund-raising dinner and auction.

Around 180 famous names and wealthy supporters of the Find Madeleine fund are expected to attend the private bash at the stylish Kensington Roof Gardens, in London, on Wednesday, January 27.

Money raised from the event through tickets sales and an auction of items donated by the fund's backers will be split between the Find Madeleine fund and two other charities.

Guests are thought to have been asked to pay £150 per head for a meal and entertainment.

Family spokesman Clarence Mitchell said Kate and Gerry, both 41, of Rothley, felt it was right to mark the occasion.

He added that the party would provide a financial boost to the fund, which currently stands at around £500,000. The event would make at least £27,000.

Among the guests reported to be attending are Harry Potter creator JK Rowling, BBC Radio 5 Live presenter Nicky Campbell, Scottish double-glazing tycoon Brian Kennedy and billionaire and venue owner Sir Richard Branson .

Mr Mitchell said: "The public have been very kind over the last three years and continue to make donations, but the fund directors look to the future and, while there is no crisis, it is prudent to consider ways of keeping a funding stream running so the search can continue – not that the search will stop if the money runs dry."

Mr Mitchell previously told the Leicester Mercury that the fund would run out by March or April of this year if further donations were not forthcoming.

At its height the fund stood at more than £2m after it was inundated with financial support by well-wishers in the 10 months after Madeleine vanished from the Portuguese holiday resort of Praia de Luz in May 2007.

Half of the money raised from next week's event will go to the Find Madeleine fund; the other half will be split between the charities Missing People and Missing Children Europe.

Mr Mitchell said: "Kate and Gerry both feel that they do very good work for missing children and adults and it is only right that they benefit."

The McCanns, from Rothley, are currently embroiled in legal action against former detective Goncalo Amaral in an attempt to ban his book Maddie: The Truth Of The Lie, which claims their daughter is dead.

Mr Amaral was the first head of the Portuguese police investigation into Madeleine's disappearance.

However, he was later taken off the case.

Ah yes Joe those 24 photos that mysteriously disappeared. I agree Levy has been discredited, but was hoping he perhaps might be trying to salvage his reputation.

Couldn't agree more the tapas are pure scum. It could be that some of the tapas initially were totally innocent but were dragged into the frame or threatened. That in my book makes them just as quilty as it is never too late to come clean and I am sure they would be given full protection.

Gerry comes across as a very troubled person. The one thing we can all see is that he has an extremely quick temper and loses control at the drop of a hat. Kate's expression is always, oh no not again get a grip. The only thing I can't decide, is Gerry covering for Kate or is it the other way round. Or are they both as bad as each other.

So Leicester Mercury are gently pointing out that Mr Mitchell NOW says there is no crisis and they have half a million but previously said the MONEY WOULD RUN OUT BY MARCH OR APRIL THIS YEAR. But there again, as we know, the McCanns can blow half a million in very quickly, they just Halligen it away:-)))

For every apparent pro McCann newspaper article, there does appear to be a bit of a sting in the tail!

For me, I have no doubt Gerry is pretty seriously disordered and entirely agree when he starts Kate just looks completely horrified, oh no, not again. I believe he planned all of this with Payne.

But Kate, what a conundrum! Is she this almost innocent battered and controlled wife or is she just about as bad as him. On that one I really do not know! She is much cleverer than him and does not have an explosive temper. She is clearly far more charming and popular than him, but that could just be what makes them such a great team!

Sometimes people who are devoid of emotion and have an almost icy level of self control can be just as sinister.

I have often read with incredulity of this apparent plan by the McCanns that they would not cry or show emotion before the cameras just in case the abductor got off on it.

That is strange because crying is a spontaneous human emotion that just cannot be controlled. It is this level of controlling behaviour they both demonstrate, and the bizarre excuses for it, I think, that causes the public to think this really is the couple from hell.

The People settled the case last autumn agreeing to give McGuiness an apology and £5000 damages to a charity of her choice, plus her legal costs. Withers has now presented the paper with a schedule of those costs – which, the Media Law Bulletin revealed last week, amount to £78,000.

By chance this emerged just as Lord Justice Jackson published his review of civil litigation bills, which recommended ending the system under which a losing defendant in a CFA case to pay a “success fee” to the victories solicitor as well as the premiums for any legal insurance taken out by the winner. Jackson described CFAs as “the major contributor to disproportionate costs in civil litigation in England and Wales,” noting with appalled amazement that in some cases the solicitors’ fees were “more than 10 times the amount of damages finally paid out.”

Withers insists its costs – more than 15 times as high as the actual damages – are “entirely reasonable” for protecting its client’s reputation. “Obtaining a fulsome apology was her primary concern,” the firm adds, demonstrating that none of the money was spent on employing anyone with a working knowledge of English. The dictionary definition of “fulsome”, as any fule kno, is “sickeningly obsequious,” “nauseatingly affectionate” and “excessive” – the last of which is also a fair definition of the chutzpah of Messrs Withers.

Aside from an odd choice of word there, what an interesting way to explain why they only got her £5K. So we are not talking of any major damage to reputation then!

Of course we know what their primary concern was, the £78,000!

It just makes you wonder how they have the audacity to comment at all.

I am a bit sus about this announcement now from Jack Straw, not IMO the most trustworthy of politicians. I know that is a play on words:-)))

Remember all the pre election hype about banning fox hunting, but Oh shucks not enough parliamentary time left to bring it through the Commons and into law, shame that. Although it sort of made it eventually when Blair had plenty of time to consider the fallout to him.

I have a feeling this will go nowhere this side of the election and then if we get the tories, would they wish to stop this monstrous greed and rewards properly obtained for protecting the rich? Hummm

Well if they can do it without the fund no one needs to donate any more moeny to it if it costs nothing to search....

Then again they dont spend very much on searching do they most of the fund is spent making them look good (and they dont so they may as well stop wasting their sorry Madeleines money on lawyers)...

I would like to know what leads they have because as far as I can see the only leads they ever have although from one end of the spectrum to the other are only produced to show they could not have possibly taken her themselves....

A mother was jailed today for prtending her child was ill and the poor lad went through years of treatment he did not need... She sounds mentaly ill to me no excuse for the poor boy but she has been jailed and he was removed (eventualy from her) to somewhere safe. She fooled drs and celebs for years I dont hear anyone saying poor thing....

Yet neglect your childen for a night in the bar and riches beyond your wildest dreams will come your way,,,,

I have amended the heading to the above post from Simon Payne, to Simon Aldridge as other posters had pointed out to me it was in fact Fiona's sister's husband she was referring to, not David's brother as I had wrongly assumed.

Louise lives in New Zealand we are told and yet, Simon Aldridge, her husband, operates a business in Doncaster. I am still not clear why or indeed how he would supply Portuguese mobiles to the Paynes that they were using the following night from the police station, or indeed who "Alan Middleton" is?
