Court Case( Injunction) in Lisbon 14th January 2010
We are currently in Lisbon for the trial to determine whether the injunction against Mr Amaral's book and DVD should remain in place. This trial is about whether the book is a true reflection of the official judicial process in to Madeleine's disappearance and whether its contents damage the ongoing search for Madeleine, her siblings and our reputations.
Mr Amaral's book and DVD contains some information from the PJ files but there is a lot in the files which is not in Mr Amaral's book. Hence it is highly selective and therefore biased. Mr Amaral's book contains his opinions rather than fact. His opinions differ from the findings in the PJ file. The conclusions of the latter are: 1.there is no evidence that Madeleine is dead and 2. there is no evidence that Gerry or I are involved in Madeleine's disappearance. This is very different to the theories and conclusions of Mr Amaral. It is logical and common sense that spreading these theories as Mr Amaral did (and continues todo) damages the search to find our little girl. If the general public (and the Portuguese people in particular) are bombarded day in and day out with such theories, this will eventually 'colour' their understanding and judgement -lies and inaccuracies become fact. If people subsequently believe that Madeleineis dead and that we are involved in her disappearance then they will not look for Madeleine, will not consider any suspicions about others which they may have and will not come forward with information. We consider this highly detrimental to the search for Madeleine.
There are few points which have been raised in the last few days which I would like to address specifically:
Abduction theory:For us, there is only the abduction theory possible because we were not involved in Madeleine's disappearance and we know Madeleine did not wander off by herself. It is obvious and right that the police should consider other theories initially.
There may be only one theory for you and Gerry, Kate, I suppose those with a criminal intent have to stick to a theory otherwise people might laugh at them. But given you left your children alone how do you KNOW Madeleine did not wander off by herself? She could easily have got through the patio door that you say you left open, right by that large swimming pool. You know a normal mom could not have sat there and left her children alone in those circumstances. I suspect British Police actually do believe in the kidnapper theory but they tag a bit more on to that, child trafficking, you know what you are being investigated for. It was very helpful of the Portuguese senior police officers and prosecutor to confirm at the hearing the investigation of you considers three incredibly serious offences against Maddie, MURDER KIDNAPPING CHILD TRAFFICKING. They are not theories, they are what they think you and your husband are capable of! Why do you say the police should only consider these theories initially? Because you and your husband think you can tell the police what to do? Did you fall out with all of them because they would not? Have you considered suing Leicester Police for failing to find Madeleine also? After all, they were there too and to this day they say they are still looking for her. What happened to your plan to sue the PJ for One Million for failing to find Madeleine and why did it become a personal issue just picking on the one police officer? Is it helpful in terms of securing ONE MILLION that you can also pursue his publishers and the TV Company. Why did you refuse to allow the same TV company to put your own documentary on for a fee of £35,000 so that your own side of the story could be told in Portugal as well as Goncalo Amaral's ? Is that because you thought it would spoil your planned claim for damages in the sum of ONE MILLION. In Uk we have a name for that sort of behaviour, it is called "abusing the process of the court". There is another applicable maxim, he who comes to equity must come with clean hands". Getting damages for libel is an equitable remedy that IMO you are most certainly not entitled to. You briefed the press far more than anyone during secrecy of justice and even put your star witness, Tanner on Panorama!
The window: I described to the police officers exactly what I found that night, as it was and is highly relevant and I knew that every little detail could be helpful in finding my daughter which is our only aim. The window which is a ground floor window was completely open and is large enough for a person to easily climb through it. Whether it had been opened for this purpose remains unknown. It could of course have been opened by the perpetrator when inside the apartment as a potential escape route or left open as a 'red herring'
"My" daughter Kate? Is there a parting of the ways here, or are you telling us Maddie is not Gerry's daughter also? Have you now become a qualified lawyer or a qualified police investigator now Kate? Who are you to say what is and is not "highly relevant"? I think what is highly relevant in relation to the supposed open windows is the fact that the only forensic evidence found on them was your fingerprint, on the inside! You said on Panorama that someone "broke into the apartment and stole Madeleine". But there were no broken shutters, no forced window. That was just a lie wasn't it Kate? Now you tell us they may have opened it from the inside, yes the fingerprints confirm that, don't they Kate. Oh and well done for only taking best part of three years to think of that one, oh those hard hours at the computer poring over the files. In three minutes your fantasy abductor came through the patio door that you apparently handily left open for him, drugged all three of your children, opened the window from the inside and the shutters and then ran out with the silent Madeleine. Miraculous, lol! Oh, I forgot, he waved to Gerry, Jane and Je\ Wilkins as he passed by. As Gerry said on Panorama these evil predators had been stalking and staking out for days but on the night forgot their car, lol. And these fantasy bafoons even have time to think of "red herrings", funny you mention that one Kate!
The dogs: We realise that the behaviour of the dogs was the turning point in the investigation for the PJ. The use of dogs has proved to be problematic and unreliable in previous cases
(please refer to the Jersey ‘Haut de La Garenne' case and other research published about their use and reliability). It is vital to note that alerts by such dogs are classified as intelligence rather than evidence, as police officers familiar with their use will verify. These alerts must be supported by forensics in order to be used as evidence. The results of the forensic examinations did not identify any blood or Madeleine's DNA. To suggestor use the dogs´ reactions as evidence is simply wrong and abusive.
If the findings of the dogs are so trivial and cannot possibly incriminate you Kate, why have you made such a fuss about the claims of Goncalo Amaral, could it be money you can make out of it?
The proposed reconstruction: The suggestion of a reconstruction of our movements and other key witnesses at the crime scene and/or surrounding area in the early days following Madeleine's abduction was declined by the PJ as 'not usual' for Portugal. When the PJ finally requested a reconstruction to take place in 2008, Gerry and I were still arguidos and as such would have attended for a reconstruction. Some key witnesses (including some of our friends)declined to attend the planned reconstruction as they were not convinced of the aims and usefulness of it. In particular, as the reconstruction was not to be shown to the media (and hence the general public), they did not feel it would help to find Madeleine. Had the intention been to show it to the general public, it may have 'jogged' memories and encouraged people to come forward with information. It should be added that other key witnesses were not invited to attend.
The Police deal with investigations into missing children in confidence. The police wanted to bring back to Portugal those witnesses who THEY had assessed were key to the disappearance of Madeleine McCann, the two prime suspects, Kate and Gerry McCann and their friends who, having consulted lawyers decided they would not go for fear of incriminating themselves. Of course innocent people have nothing to fear and would be only too happy to fully co-operate with the police in seeking to find a missing child. The Police have said that a media circus which Gerry McCann laughingly accepted on Paxman he organised is most unhelpful to a police investigation. That and making lots of money are the key reasons the McCanns persist with their media circus and vile campaign against Portugal and their police which they commenced in the early hours of 4 May 2007 demonstrating their cold and calculating intent to discredit those they KNEW would be investigating them.
Our team is confident that the injunction will remain in place because none of thewitnesses thus far have been able to prove in court that Mr. Amaral's right to express his opinion is superior to the rights of our family to peace, respect and protection of reputation, and above all, the right to continue the search for our daughter Madeleine effectively and without hindrance. As has been made clear this week, Mr Amaral's ‘thesis' is not supported by any evidence. The search for Madeleine must go on until we find her and bring her abductor(s) to justice.
I would say it is the job of the Police to find Madeleine and, as Leicester Police recently put it "those behind the disappearance of Madeleine McCann" who they make clear they intend to bring to justice, of course if it was Portuguese people or any other nationality, Leicester Police would not have jurisdiction. But as we have seen, Kate and Gerry McCann do not wish to work with the Police in either Portugal or even their local force. That is because Police in both UK and Portugal know exactly who is "behind the disappearance of Madeleine McCann", her own parents, with the assistance of their "friends" who refused to attend a police reconstruction.

You know what Kate, I think I am just too nice to you. How come you are laughing and happy just days after Maddie went in PDL but when you are after a million quid nearly three years later always look so agonised, oh well guess I just answered my own question. Do you think that when you instruct your lawyer to make vicious and pointless criminal complaints against Goncalo Amaral people will feel sorry for you and think you are such a sweety? On day 3, Gerry having run home to UK, it does not seem to me that Fiona Payne is doing much to support Kate in what must clearly be a very distressing and intimidating situation with the throng of press. How can she feel it is worth the personal sacrifice to do this? She looked very ill last December and I feel has been ill for a very long time..now she is instructing Duarte to take criminal proceedings against Goncalo Amaral? Why Kate? If your husband wants to pursue this vindictive war, let him come and take the strain, you ought to get back to your children!

Then we have Gerry McCann and Kate McCann arriving for yesterday's hearing. Pictures really do tell stories, I think, and Gerry thinks it is OK to just swan off and leave her to it? Did he not notice how distressed she was, first time around? Of course what we see from Gerry second time around is not distress, it is the dawn of reality and just pure unadulterated fury. How different they are.
13.1.10 Gerry and Kate arrive for the second day in court knowing things are most definitely not going their way. As Gerry furiously and repeatedly lunges at Sandra Filgueiras, Portuguese Reporter, shouts her down and raises his hand to her, Kate closes her eyes in horror. I am sure she has been there many times before, it really is time to call it a day you know Kate. Just watch this evil man in action on BBC video here with his mask well and truly removed as he arrived for court this morning already in a rage after a terrible day for them on Sky News reporting all the factual findings against them from senior police and the senior prosecutor in the case. They lied from day one. Of all the horrible displays of rage from Gerry in front of the press even, this just has to be the worst I think. He really looks like he is having to fight with himself to stop himself from attacking her. Stop the video a few times and look at the horrific facial expressions and violent body language. He only manages to calm himself when a mail reporter saves the situation by chiming in with a calming comment. It is unexpectedly announced on the second afternoon of the trial that Gerry has to rush home for urgent work committments. As we can see above, the arrogant smile before the proceedings started got replaced with complete fury. Now if I was his lawyer, I would have sent him home too! McCanns 'Want Justice' At £1m Libel Trial

Kate and Gerry McCann arrived in Lisbon for the start of their £1m libel trial against a former police chief saying they want to see justice done for their missing daughter.

The couple are in the Portuguese capital for a three-day hearing at which they will seek £1m in compensation and a final ruling preventing Goncalo Amaral from repeating claims he made about them.
The lawsuit had originally been due to be heard in December, but had to be postponed after Mr Amaral's lawyer was taken ill.
Mr Amaral was in charge of the investigation launched when Madeleine McCann disappeared shortly before her fourth birthday during a family holiday in Praia da Luz in May 2007.
He was taken off the case the following October after criticising British police in a newspaper interview.
Mr and Mrs McCann were named by police as "arguidos", or suspects, but that status was lifted when the investigation was shelved in July 2008.
The same month, Mr Amaral published a book called Maddie: The Truth Of The Lie, in which he claimed the youngster was dead and called into question the McCanns' account that she had been abducted.
Gerry McCannNo-one can be allowed to say that our daughter can't be found without very good evidence.
A Portuguese judge granted an injunction in September last year banning its further sale or publication.
The former policeman was also prohibited from repeating his claims about Madeleine or her parents.
Arriving at Lisbon Airport, Mr McCann said: "We're just here to continue the search for Madeleine, and to protect our own family, and their human rights.
"No-one can be allowed to say that our daughter can't be found without very good evidence. That's what this court case is about."
Mrs McCann said: "We're looking for justice."
The couple, both 41, from Rothley, Leicestershire, are not expected to give evidence during the hearings, although they are thought to be planning to attend them all.
They have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter.
This would seem to indicate that the camera belonging to the McCanns and the video, I assume belonging to David Payne as we can see he was recording them on the holiday bus, were immediately seised by police and by 8 May in UK being analysed. The date and time had never been set, stuck in 2002. So, come on Gerry, I would like to know how you produced that last image of Madeleine with the time and date on it. Presumably unaware of the mounting evidence police were gathering against you, even at that stage.
It would also be interesting to know what the contents of the 73 deleted pictures are that the police managed to recover.
The police extensively researched how Gerry could have immediately had available two 6 x 4 prints of Madeleine on Kodak xtralife paper. It would seem they concluded that the only way he could have had them available was to bring them from home. This is a specially laminated picture that prevents it from staining even if drinks spill on it and prevents fading etc, not available in PDL, which is hardly surprising given these pics were handed over in the small hours when no photo shops would be open in PDL (about 3 hours after they " reported her missing" erm perverting the course of justice there). But there are a number of outlets around his home in Leicster that will produce this nice long lasting and durable pics for you. Again, demonstrating that Gerry McCann is not really so smart as he thinks he is and no wonder LP announce they will keep on investigating this case until they bring to justice "those behind the disappearance of Madeleine McCann). No surprises who they are alluding to there!
See also article from the Guardian dated 25 May 2007 where they emphasis in the opening lines it was THREE WEEKS TO THE DAY before the McCanns released this apparent last photo of Madeleine. Given it was supposedly taken by Kate, is this a bit of blame allocation/self protection by the scheming Gerry McCann, who, oddly enough had just popped back home to the UK, then he triumphuntantly returns with his handiwork. I would say, a picture of Madeleine from the previous year.

Statement of: Stuart William Martin

1. I am employed by Hampshire Constabulary as a Detective Constable and am currently stationed in the Hi-Tech Crime Unit. I hold a Batchelor of Mechanical Engineering and Management degree from Liverpool university. My duties include the retrieval and examination of evidence from computers and other digital media and the investigation of computer crime. I have successfully completed two courses held by Guidance Software Inc in relation to their forensic software tools.
I have also successfully completed one course held by Access data Corp in relation to their forensic data tools.
2. On 8th May at 21.00 hours, the following was delivered to my home address by PC 178 Barham, requesting they be examined to establish if they contained pictures and video footage of a hotel complex in Praia da Luz.

On 9th May 2007 at 08.30 I delivered this video camera in the sealed bag number CD 48113 to the imaging unit at Hampshire Police Support headquarters, Netley for examination. I conducted no examination of this bag and contents.

On 9th May 2007 I commenced my examination of a sealed plastic bag seal number CD48115 with two exhibit labels attached marked 64 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 2) and 32 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 3).
5. This bag contained a power lead and cable, a black camera case which contained an Olympus C50 camera and a memory cad holder which contained one card.
6. I identified NALF/2 as the memory card which was installed in the camera and NALF/3 as the card in the memory card holder.
7. NALF/2 is an Olympus XD 64 MB memory card number MXD64P3L922905RN9 0223 MAD.
8. NALF/3 is an Olympus XD 32 MB memory card number MXD32P3RO34505RN20235 MAD.
9. I imaged NALF/2 using Guidance Software Inc computer forensic software called Encase version 5.

11. I examined the data from the two cards and located 43 pictures in the live area of the two cards.
12. I produced these pictures as identification references SWM/3019/01 to SWM/3019/43.
13. On checking the camera I found that the time and date was not set on the camera and it was recording the time and date as 0000 hours on 01/01/02. This did not change during the examination. None of the pictures SWM/3019/01 to SWM/3019/43 have any created dates recorded. The last written time and date for each of them is recorded as 0000 01/01/02.
14. Last Accessed represents the date the file as last examined. Whether the Last Accessed Date is triggered depends on the nature of the examination. Opening a file will trigger the Last Accessed Date, as will looking at the file properties and browsing the file structure with Windows Explorer. Examining a file on “write protected media” such as a floppy disk will not trigger this date, neither will examining a file on a compact disk or DVD.
15. Last Written represents the time and date that the contents of the file was last changed. The Last Written date and time is unchanged by the process of copying a file from one drive to another.
16. The creation date and time of the file is usually when it is written to the surface of the disk, subject to the accuracy of the computer clock that was used to perform this task. When this date and time is seen to be after the last written date and time it shows that the files has been transferred from another media.
17. Starting Extent represents the physical location of the starting cluster of the file.
18. Using my forensic software I was able to locate 73 pictures files in the unallocated clusters which had been deleted and were no longer accessible to the camera user.
19. I produce a report containing each of these picture identification reference SWM/3019/01 to SWM/3019/43. (THESE DO NOT APPEAR TO HAVE BEEN DISCLOSED!!)
20. I produce a compact disk SWM/3019/44 containing pictures SWM/3019/01 to SWM/3019/43 and report SWM3019/45. I have also copied the pictures and the folders as they appear on the cards, to this disk.
21. Unallocated clusters
22. Unallocated clusters are clusters on a drive that are not currently assigned to a file. Also called free space. A file may either occupy one or more clusters. The clusters that a file occupies are not necessarily contiguous. Some of these clusters may still contain data from files that have been deleted but not yet overwritten by other files.
23. When the data is extracted from the unallocated clusters there are not imes and dates or file names attributed to the data. My forensic software therefore saved the data in file format and named the files according to the location of the data within the unallocated clusters.

Madeleine, then aged three, appears giggling as she dangles her feet into a swimming pool beside her younger sister Amelie and her father, Gerry.
The photograph was taken by her mother, Kate, as the family of five enjoyed their holiday at the Ocean Club complex in the tranquil Algarve resort.
Later that evening, the McCanns left the three children sleeping in their apartment while they ate at a tapas bar a few metres away.
On one of their half-hourly checks they discovered that Madeleine had disappeared, while two-year-old twins Amelie and Sean remained in their beds.
Despite reports of sightings from as far afield as Marrakesh in Morocco, and Crete, police admit that they have no idea where she may be. Believing that she may have been driven across the border into Spain and, from there, to anywhere in Europe, the McCanns are preparing to travel across the continent to spread the hunt for her, starting in Spain.
A British billionaire has offered the McCanns the use of a private jet, although the family are said to be wary of doing anything that makes them look like celebrities.
"We need to start finalising our plans for interviews in areas of Europe where the coverage of Madeleine's disappearance has been limited," Gerry McCann wrote yesterday on the website dedicated to finding his daughter.
As the family's ordeal enters its fourth week today, there have been suggestions from people close to the McCanns that they are concerned about the flow of information from the police to them.
"While they remain content with the overall thrust of the investigation they do at times hope that their questions and concerns are addressed more quickly," a source close to the McCanns told the Press Association news agency.
"They fully comprehend the restrictions that the Portuguese legal system places on everyone involved in this, but naturally as parents who want their little girl back some of the delays that are occurring are frustrating," he added.
Madeleine's uncle, John McCann, said the family remained determined to explore "all ways" of getting Madeleine back. "That will focus on the criminal investigation but we have to - as a family - be open to other ways."

Insp. Paiva states that a distraught Kate McCann called him in the early hours of the morning in July 2007. During this call, Kate McCann confessed that Madeleine’s remains could be found upon a hilltop in Praia da Luz. The call was made at a time when Gerry McCann was out of the country. Kate stated at some point during the conversation that she had dreamt that Madeleine had been murdered.
I can find no rational reason to doubt the words of Insp. Paiva.
Thus, I believe that Kate was trying to lead the investigators to Madeleine’s remains. This likely occurred for one of the following two reasons, or quite possibly a mixture of the two: 1) Kate may have being suffering from a guilt complex, she needed her daughter found, she needed to relieve her guilt; 2) she believed the police were already drawn close to identifying what really happened to Madeleine. This undoubtedly would have placed Kate under immense strain, and the certainty of catastrophe following arrest would have all most certainly have been at the forefront of her mind - she was prepared to meet her demons face on.
It is under such conditions that those harbouring guilty secrets, particularly women, are prepared to surrender. I believe Kate was placed in such a situation. With her narcissist husband out of the way Kate was extremely vulnerable, thus, she grasped the opportunity to bring her sweet Madeleine home and suffer the consequences.
So, why is Madeleine’s corpse still to be found? It is quite possible that Kate lost her courage, fear took hold and thoughts of losing her remaining children sobered her up; thus, the true deposition site was not revealed. Or she just got lucky when the search failed to locate Madeleine’s remains. There is also the chance that Madeleine’s body had been moved without her knowledge. Strange thing is Kate has always held an attraction for a certain hilltop in Praia da Luz!
Either way Kate McCann retains her weighty burden: one day she will have to relieve herself if she is to survive.

Insp. Paiva states that a distraught Kate McCann called him in the early hours of the morning in July 2007. During this call, Kate McCann confessed that Madeleine’s remains could be found upon a hilltop in Praia da Luz. The call was made at a time when Gerry McCann was out of the country. Kate stated at some point during the conversation that she had dreamt that Madeleine had been murdered.
I can find no rational reason to doubt the words of Insp. Paiva.
Thus, I believe that Kate was trying to lead the investigators to Madeleine’s remains. This likely occurred for one of the following two reasons, or quite possibly a mixture of the two: 1) Kate may have being suffering from a guilt complex, she needed her daughter found, she needed to relieve her guilt; 2) she believed the police were already drawn close to identifying what really happened to Madeleine. This undoubtedly would have placed Kate under immense strain, and the certainty of catastrophe following arrest would have all most certainly have been at the forefront of her mind - she was prepared to meet her demons face on.
It is under such conditions that those harbouring guilty secrets, particularly women, are prepared to surrender. I believe Kate was placed in such a situation. With her narcissist husband out of the way Kate was extremely vulnerable, thus, she grasped the opportunity to bring her sweet Madeleine home and suffer the consequences.
So, why is Madeleine’s corpse still to be found? It is quite possible that Kate lost her courage, fear took hold and thoughts of losing her remaining children sobered her up; thus, the true deposition site was not revealed. Or she just got lucky when the search failed to locate Madeleine’s remains. There is also the chance that Madeleine’s body had been moved without her knowledge. Strange thing is Kate has always held an attraction for a certain hilltop in Praia da Luz!
Either way Kate McCann retains her weighty burden: one day she will have to relieve herself if she is to survive.

The more I read about Amaral and his book the more I am convinced all he wants is justice for a 3 year old child,,,
I dont think he cares anymore about the legal process as it has corupted by the McCanns and their supporters...
He wrote that book praying they would sue him as they had sued every other person who did not bow down and accept their BS and Gerry played right into his hands...
This could go on for years through the European Court of Human Rights and by that time everyone will know how little the McCanns tried to find the child they said was snatched by peadophiles...

Statistically speaking and even on basic probability Madeline is most likely dead if she had been snatched by paedophiles. Even putting Amaral's thesis aside that is fact. So the McCanns assertion is against probability and added to this the massive profile they created made it a sure certainty if their thesis was to be accepted. IMO they should have left well alone after getting out of PT, but no, they want to crucify the very man who actually looked for their child with his team for something that they were most probably responsible for. They will never find peace as long as this is unresolved, the ball as always is in their court.(oops that's a nasty word they do not like to hear)

I think Kate Gerry and Goncalo are now locked in a really nasty battle that is going to cost a lot of money.
It seems like it is more to do with their personal pride now and swiping back at each other. Kate and Gerry are utterly deluded if they feel the public are actually going to believe they are doing this for Madeleine.
And it does serve them right, the more they litigate and engage in this hate fest with Goncalo, the more comes out, and the more the public mistrust and dislike them.
It did come up in court, Ricardo Paiva, I think my most favourite detective on the case, they should not have advertised Madeleine it would clearly put her life at risk, and they found their marketing selling wrist bands etc bizarre.
This was always about trying to amass a fortune and the real thing they hate Goncalo for is he stopped them doing that and made a fortune from a book himself, exactly what they had planned to do.
There is only one way that Madeleine can be safe and well, if they have put her with someone so that they know that she is. But that I very much doubt. They demonstrated no concern for her safety as Ricardo Paiva pointed out and they are still demonstrated no concern for her or their other children as Kate leaves them for three days at a time go and pursue this ugly business.
I think we just have to wait and see how this develops and what British authorities decide to do with them. But so long as they keep playing with the media we will be here, they need to understand that much!

If I had been treated the way he has by the English Press I would have written a book as well... Even now they are trying to say he said F the McCann's although to be fair if they were 100% behind the McCann's they would not have shown Gerry playing Mr Angry....

I think that is what this whole ugly business stemmed from. The McCanns were briefing the British press against Amaral and his officers from the VERY FIRST NIGHT.
As early as 4 May 2007 we saw those criticisms appearing in the press. And the more the PJ kept investigating the McCanns the worse it got. So Goncalo starts counter briefing. I think that did get him the sack along with insisting on the death in apartment theory. Even if that theory is correct, putting it in the public domain puts the chances of a successful prosecution of Kate and Gerry in severe jeopardy. The PJ answered back some of the criticisms of them as a group, Goncalo should not have taken this on as a personal matter, it has caused him enormous personal grief.
Back to Fiona Payne, see the report below. I kept commenting on the Daily Express that Kate was covered in bruises. I was savaged by the pros for saying that, complete denial.
But then, a full 18 months later, we get this, Fiona Payne admitting she WAS COVERED IN BRUISES THE NEXT DAY, and telling us that was due to Kate bouncing herself off the walls.
The McCanns and The Paynes have a complete answer as to what happened to little Madeleine McCann and it is not the last surprising Fiona gets sent to keep any eye on Kate and watch she does not spill the beans. We can see from the photograph above, it hardly looks like she is supporting Kate as she stands back and allows the pack to descend. Of course it could well be said, Kate's agonised looks as this takes place, is all part of their game.

KATE McCann had a haunting premonition about the holiday on which daughter Madeleine went missing.
She told a close pal before the trip had been booked: "I don't know why, I've just got an uneasy feeling about it."

She told an officer: "This always haunts me. Kate ... what she said ... she was unsure.
"Gerry was quite keen but Kate said, 'I don't know why, I've just got an uneasy feeling about it.'
"And I don't know why she said that. I don't think even she knows."
Fiona's husband David, 42, said: "Kate didn't feel quite easy about it."
The details emerged during interviews given by the Tapas Seven - David, Fiona, her mum Dianne Webster, 64, Dr Russell O'Brien and his partner Jane Tanner, both 37, Dr Matthew Oldfield, 39, and his wife Rachael, 37.
They spoke to cops in April at Enderby, Leics.
The documents, which have been seen by The Sun, total more than 1,000 pages.
Asked how Kate appeared after Madeleine's disappearance Fiona, an anaesthetist, said: "Awful. I've never seen such horrible raw emotion in my life and I've seen a lot of it in my job.
"She was bereft. She didn't know what to do, she was panicking, extremely frightened for Madeleine and was wondering where she was or what was happening to her.
"And the helplessness of not being able to do anything, what should she be doing, what could they do.

Di, I did like the video in the Beeb so I am not having a go about that and I honestly did check that East Midlands report and could see no mention of them bleeping anything by Goncalo. But I did not listen to the whole tape but seemed to go through the whole story, or so I thought!
I got up this morning and then got Luke up, was upstairs on the net and he shouted up mom I think the roof is leaking there is water coming through the light down here. I said erm but the roof is not above the living room! A pipe had split in the landing upstairs so we had to rip up all our lovely oak floor for plumbers to come and fix it. One step forwards two steps back, I just don't think I will ever quite finish getting this house right!

.I think the McCanns really like the doggy/death theory being run and run, it is a marvellous money earner for them.
They deliberately blocked TVI from running their own Channel 4 documentary even though it clearly casts them in a favourable light. Do you think when they did that they had one eye on the money, what this has always been about. They are not just suing Goncalo Amaral but the publisher and TV company also. That way they make sure they get their cash.
Same cynical plot with the Daily Express, firstly one sits back and waits for at least 12 months for lots of erm "libel" to have been done to them, that puts the damages bill up. They wait until there is so much of this doggy story being repeated they just cannot fail. They have lawyers and they know doggies cannot give evidence of any death in court. They know there is no other evidence. The nice man from the press complaints commission said to Gerry, now look Gerry I can intervene and stop the Daily Express, I can do this privately with the minimum of fuss to protect you, Kate and your reputations. What did Gerry say, no don't you dare, we want to sue them! Now if you think about these two examples very carefully maybe you will spot a game plan going on. They do not give a toss about the doggy stories, they love them, they want them oft repeated, they do not want the stories countered or stopped, that would stop the cash tills ringing.
As for am I joking? Well Goncalo Amaral is saying that if the court make a permanent injunction he will fight it through the courts and go all the way to the European Court of Human Rights. Now does it sound like he thinks he is going to win? I believe the Judge will do what British Police want her to do, shut both the McCanns and Goncalo Amaral up.

If, as has been suggested in Portugal, there was a “media circus” around the disappearance of Madeleine McCann, then it is the Portuguese police who are the clowns.

You would never guess it but Kate and Gerry McCann are not actually on trial in Lisbon.
Madeleine’s parents have brought legal action against detective Goncalo Amaral, who they accuse of libelling them in his book, Maddie: The Truth Of The Lie.
But the Portuguese plods have used the libel case to declare open season on the McCanns. One former policeman, Francisco Moita Flores, told the court that only the “distraction” of the “media circus” prevented the McCanns from being charged with negligence.
“No one believed it was an abduction,” he told the court. “It was a fairytale, a fable.”
But if Madeleine was not abducted, then what happened?
The Portuguese police were shown up as a bunch of clueless amateurs by the Madeleine case, and – shamed, embarrassed, infuriated – they turned their rage on the McCanns.

Even now, the Portuguese cops treat Kate and Gerry McCann with a grotesque lack of respect.
Asked if he cared that he had hurt the McCanns, Goncalo Amaral told a BBC reporter: “No, f*** the McCanns.”

Oh dear apparently I am going to be exposed by Amaral. So he is on to a loser there. But he has swanned about Europe and tried to convinced the world in the most ludicrous and arrogant manner, he has made himself thousands of euros out of a little child he failed and now when he gets a little back, when the tables are turning on him, he starts blubbing like a big girls blouse!
Typical of a bully, has to save face by bullying someone he perceives as being weaker than him. This is typical of a misogynistic bully boy.

One other thing, if Amaral cannot find a British lawyer to represent him to sue the papers which had the potential to be very lucrative, how is he going to get a lawyer to sue me? For what possible gain? I expect he is looking for another cash cow now he has been deterred from making money out of a innocent child. Well the Madeleine is an innocent unable to fight back, her parents were pushed beyond the realms of their tolerance before they fought back. Not that I would need it to recognise it as such. However, thankful for small mercies, Goncalo Amaral was found guilty of very serious crimes and not upholding the letter of the law he swore to uphold, he was give an 18 month prison sentence, suspended.
Thanks to the dilligence and the untiring efforts of Leonor Cipriano's lawyer 'Dr Marcos Aragao Correia', Goncalo Amaral was convicted of perjury (lying under oath) lying and withholding evidence of a torture of a female witness (Leonor Cipriano) while she was held in custody, she was forced to confess to the murder of her daughter, which she did not commit.
Dr Correia, is s till battling on Leonor's behalf and has lodged an appeal to have her freed from prison, which will be heard in the Porutugese Supreme Court of Justice.
Thanks to Dr Marcos Aragao Correia, hopefully justice will be done and Leonor Cipriano will soon be released from prison.
Portugal needs MORE people prepared to stand up and fight against INJUSTICE and fight for JUSTICE for people who have obviously been wronged and suffered a gross miscarriage of justice like Leonor Cipriano.
Dr Correia, has put his own personal safety on the line by doing this and has opened himself up to accusations, lies and slurs against his character, by no less than Goncalo Amaral!
We as a forum and as a blog, will continue to support Dr Correia as long as he needs us.
Amaral should have gone to prison, but he was let off lightly. This is the state of the justice system and endemic corruption in Portugal and this is why the EU should give Portugal its marching orders!
If the EU does nothing, the EU already accused of corruption, will be viewed as even more corrupted.
It emerges now that in and around Portugal, there have been sex attacks on the children of holiday makers actually inside their holiday apartments, in the month leading up to Madeleine McCann's abduction and two assaults afterwards, equally as serious and telling is that these assaults were combined with burglaries on the properties.
As usual this VITALLY IMPORTANT information had been reported but was NOT acted upon and was buried on purpose in 70.000 pages in the official police files.
Neither was the true extent of just how many KNOWN paedophiles were actually resident in and around Praia da Luz at the time Madeleine was abducted. Not least one particularly British born CONVICTED paedophile, Raymond Hewlett. Apparently all the known paedophiles in the area all but one is British and one predatory paedophile (nationality unspecified) lives just 500 yards from where Madeleine was abducted!
In view of all this information now emerging, why have the Portuguese police kept this secret? Goncalo Amaral cannot be blamed solely for this, some of the blame for this must fall on Paulo Rebelo, who took the investigation over after Amaral was sacked!
Just how deep does this apparent corruption go in Portugal's police?
This while investigation is beyond the realms of names like circus, joke and farce, it has slipped into something much more sinister than this, it is now showing all the signs of corruption and a possibly a paedophile ring operating in and around the Algarve, especially centering on Praia da Luz.
Portugal had NO sex offenders register ate the time Madeleine disappeared and despite all the fiasco since, it still has NO DNA based sex offenders register, Portugal is in effect a have for paedophiles.

The Gaspers statement is very worrying they did not give it out of spite they know the McCann's and spent a holiday with them. Would Tony Parsons, Jan Moir, Fiona Phillips all be happy for their own children to spend the day alone with Gerry and David?

The PJ may have made mistakes but they were told what they were allowed to do from very early on. The McCann's spin machine was in full flow from the 4th May with the first two lies "WE all do it" "It was like having dinner in your back garden" .
No we dont and no it was not if they are lying about the checking then that could have given the abductor a much bigger time frame if they are not lying then it makes it impossible.
Janes sighting could not have happend because Gerry and Jez did not see her why would she need to lie if not covering for Gerry who was she covering for. It is not rocket science where was her husband what had he been doing all evening away from the table?

Why do all these smug so called journalists hate Madeleine so much. Her Parents were so concerned on holiday about her she was dumped all day in a creche even eating there at times and even after she told Kate she had been crying and no one came was Neglected along with 18 month old twins so her parents could go to the bar to have me time with their friends?
Kate looked terified on the 4th May Gerry was nervous in the days that followed she was back to looking lovely with matching accesorys perfect make up and the occasional whistful expresion on her face. There are many stories of them sat on their varanda with family enjoying a meal some wine with family chatting and laughing watching people search for their daughter???
They never searched the night she went missing as it was too dark she could have been hiding round the corner scared to death but they knew there was no point or just did not care...
They are still responsible for 4 year old twins and from their own documentry things at home are not natural (which could be down to the filming to be fair as it is not normal to have cameras in your house) but they dont seem to care if Daddy comes in or not....

I am convinced Amaral only wrote his book to get the McCanns into a court room as he knew something was very very wrong no DNA in the apartment Gerry having to go home to get some of Madeleines DNA that in itself is very odd as for the open window it was not forced and would have been a stupid escape route as there was an open door. Ok so we wake up tomorrow morning and all over the news is the following story...
Parents of a 3 year old child and 18 month old twins are in police custody in Portugal this morning for child neglect.
The 38 year old Dr's from England were arrested when they got back to their apartment after eating in a bar leaving their 3 young children home alone.
Their eldest daughter 3 year old Madeleine was found in a distressed state crying for her parents 500 meters away from the apartment at 10pm local time.
All three children are ok and now in the care of local social services waiting for the McCann's family to come over to take them home.
It is still unclear what will happen to Mr and Mrs McCann they have lawyers who are advising them this morning.
Mr McCann said it was ludicrous we all do it and it was like having dinner in your back garden.
From what we understand the Bar they were eating in was no where near the apartment.
Ok so we see that on SKY what would our thoughts be??? Would we raise a fund to get them out of jail or would we all be thinking how the hell could they leave their children alone???
Can you imagine the headlines evil parents, Dr Neglect the press would have a field day...
But all three children are safe and well it was wrong it was stupid but thank god none of the children were hurt dead or missing,,,

I was reading yesterday in the Mail a columnist by the name of Jane Moir. Private Eye would no doubt call her Ms Polly Filler. She suggests the McCanns are right to fight for their innocence but in the midst of a lot of sycophancy she twists the knife, only a small twist but I thought I would copy a few of her quotes below. This is still a pro McCann article but a milepost perhaps in the British Press’s approach to the Mcs. My comments in brackets below.
“For the McCanns, the dread fight continues not only to find their daughter, but – even now – to try to clear their names. I think the refusal to allow to allow TVI to put on their side of the story is pretty fatal for Kate and Gerry in now wishing to claim damages for libel.
In our libel law there is the notion of immediately making amends, this is what they offered to and the McCanns refused!
If I was the judge I would feel they were seeking to abuse the process of the court to claim damages they are not entitled to.
Kate claims this damages the search for Maddie, well then why on earth did she not want her documentary to be shown to the Portuguese people who clearly should be among the best pool of witnesses there are!!
Maybe they thought the offer of £35000 was small beer in comparison with their favoured figure for any legal action they pursue, a massive one million.
Oddly, just the same figure they were bandying about they wanted to sue the Portuguese Police for.
I think they decide the figure first and then look for someone to sue!
They are nothing better than dishonest fraudsters!

Court Case( Injunction) in Lisbon 14th January 2010
We are currently in Lisbon for the trial to determine whether the injunction against Mr Amaral's book and DVD should remain in place. This trial is about whether the book is a true reflection of the official judicial process in to Madeleine's disappearance and whether its contents damage the ongoing search for Madeleine, her siblings and our reputations.
Mr Amaral's book and DVD contains some information from the PJ files but there is a lot in the files which is not in Mr Amaral's book. Hence it is highly selective and therefore biased. Mr Amaral's book contains his opinions rather than fact. His opinions differ from the findings in the PJ file. The conclusions of the latter are: 1.there is no evidence that Madeleine is dead and 2. there is no evidence that Gerry or I are involved in Madeleine's disappearance. This is very different to the theories and conclusions of Mr Amaral. It is logical and common sense that spreading these theories as Mr Amaral did (and continues todo) damages the search to find our little girl. If the general public (and the Portuguese people in particular) are bombarded day in and day out with such theories, this will eventually 'colour' their understanding and judgement -lies and inaccuracies become fact. If people subsequently believe that Madeleineis dead and that we are involved in her disappearance then they will not look for Madeleine, will not consider any suspicions about others which they may have and will not come forward with information. We consider this highly detrimental to the search for Madeleine.

There are few points which have been raised in the last few days which I would like to address specifically:
Abduction theory:For us, there is only the abduction theory possible because we were not involved in Madeleine's disappearance and we know Madeleine did not wander off by herself. It is obvious and right that the police should consider other theories initially.
The window: I described to the police officers exactly what I found that night, as it was and is highly relevant and I knew that every little detail could be helpful in finding my daughter which is our only aim. The window which is a ground floor window was completely open and is large enough for a person to easily climb through it. Whether it had been opened for this purpose remains unknown. It could of course have been opened by the perpetrator when inside the apartment as a potential escape route or left open as a 'red herring'
The dogs: We realise that the behaviour of the dogs was the turning point in the investigation for the PJ. The use of dogs has proved to be problematic and unreliable in previous cases
(please refer to the Jersey ‘Haut de La Garenne' case and other research published about their use and reliability). It is vital to note that alerts by such dogs are classified as intelligence rather than evidence, as police officers familiar with their use will verify. These alerts must be supported by forensics in order to be used as evidence. The results of the forensic examinations did not identify any blood or Madeleine's DNA. To suggestor use the dogs´ reactions as evidence is simply wrong and abusive.
The proposed reconstruction: The suggestion of a reconstruction of our movements and other key witnesses at the crime scene and/or surrounding area in the early days following Madeleine's abduction was declined by the PJ as 'not usual' for Portugal. When the PJ finally requested a reconstruction to take place in 2008, Gerry and I were still arguidos and as such would have attended for a reconstruction. Some key witnesses (including some of our friends)declined to attend the planned reconstruction as they were not convinced of the aims and usefulness of it. In particular, as the reconstruction was not to be shown to the media (and hence the general public), they did not feel it would help to find Madeleine. Had the intention been to show it to the general public, it may have 'jogged' memories and encouraged people to come forward with information. It should be added that other key witnesses were not invited to attend.
Our team is confident that the injunction will remain in place because none of thewitnesses thus far have been able to prove in court that Mr. Amaral's right to express his opinion is superior to the rights of our family to peace, respect and protection of reputation, and above all, the right to continue the searchfor our daughter Madeleine effectively and without hindrance. As has been made clear this week, Mr Amaral's ‘thesis' is not supported by any evidence. The search for Madeleine must go on until we find her and bring her abductor(s) to justice.
I think the McCanns are libel shoppers, remember the action against Tal and Quai, which they then dropped. They went bust, no money in it for them, lol!
I fear they will be a long time getting any money out of Amaral as well.
As far as McCann saying that the dogs are not reliable. How many times in their careers so far have they proved unreliable??? That is the question that needs to be asked first then decide on that basis how good or bad they are. She has no other explanation for the reactions.

Now Kate, as the window is high up the abductor would have to stand on the bed that was beneath the window to even attempt to climb out with Madeleine, quite how I am not sure as the window only half opened, but interestingly the bed was not disturbed either.
Can I just remind everyone, it was Kate on the evening of the 3rd whilst at the tapas bar with her friends saying, she had left the patio door open in case Madeleine came looking for them. It is in the files.
Yet Kate told the PJ she would never have wandered and insisted she was abducted and that was the only line they should be following.
If people out there cannot see this stinks then I rest my case.
The only thing keeping me going after all this time, is justice for a little girl who was never given a chance.

I think the public will just become numb from the number of times now they have read the McCanns killed Maddie and hid her body and how dreadful this Portuguese Goncalo Amaral really is.
I don't think the McCanns have the nous to realise you can saturate a project and just make people think well how nasty to keep saying that about this Pt cop who just did his best and is entitled to believe what he wants to believe.
This concept that they killed Madeleine they have personally brought back two years after it died down. It is saturating peoples' senses and clearly making that mental association between a nasty campaign against Pt police and a couple that just will not shut up but these horrible things they apparently did keep surfacing. If Kate actually believes this will convince the public of how innocent they are she is even more mad than I ever gave her credit for. I also think she is far more scheming than I ever gave her credit for, given it now seems to have become her campaign!
joe, all I want from this Pt Judge is justice and a fair application of the law.
I fully accept that Goncalo needs to shut up about his death theory, but what I do not want to see from this judge is an award of damages to the McCanns. That simply would not be justice at all!!
Maybe I have not put that quite correctly, if Goncalo had just said it was a theory, that would have been OK.
The reason I feel that he has to be silenced by a fair application of the law is that he went further than that. He said on one occasion, the little girl is dead, and on another he said that he would prove exactly how she died, on the documentary. He should not have gone that far. I think he may have very good reasons for having done that, but so far as the law is concerned, he was out of order!

I agree with you re Amaral, what I meant was it may take a long time for them to get any money (if it goes their way) out of Amaral as he will continue to take it as far as possible.
I agree the Law should be observed, but having said that Amaral was savaged and lambasted from the first instance. They destroyed his career. They invented the abduction theory and all the other misinformation, and it is quite ironic that they expect integrity and fair play from opponents when they appear to observe anything but themselves. I am not surprised that Amaral has had to fight fire with fire as distasteful as it is, not that I agree with everything he says or does but the Macs campaign as been pure Machiavellian.

The main thing I find really strange about the whole thing is the fact they keep insisting she could NOT have got up and walked out of the apartment...
They have no way of knowing this to me it just proves they practiced their lie knew what they were going to say and how they would act and NO one wasn allowed to differ from their version of events...
When Gerry called Mrs Fenn he said it was important everyone belived she had been abducted or words to that effect and that is just odd???
If your child is missing she is missing how it happend is not important if she was snatched because she wandered off it makes no odds...

The documentary which Amaral helped make for Portuguese TV can also be seen, subtitled, on YouTube, while numerous websites continue to rake over the same small disputed scraps of evidence which he uses in his book to crudely smear the McCanns. Indeed, he will soon be visiting Britain to give a talk at the invitation of a virulently anti-Kate and Gerry group known as the Madeleine Foundation. All of which sounds like healthy free speech to me. The McCanns' pain shouldn't give them carte blanche to silence those who say things they don't want to hear.
Unfortunately, this is what they have done from the start. These are people who issue solicitors' letters the way other couples send out wedding invitations. There's even a website now devoted to people who claim to have been "Gagged By (The) McCanns", with the tagline: "Has Team McCann tried to silence you?" Free speech isn't so free when you're working on a shoestring and your opponents have multi-million pound funds at their disposal.
The McCanns insist they act this way only because they don't want a sense of defeatism about Madeleine's fate to dilute the continuing effort to find their daughter. That's understandable, though Kate McCann's claim last week that the proceedings have "shown again there is no evidence that Madeleine came to any harm" are bewildering, to say the least. Sniffer dogs who had been trained to detect the presence of cadavers and blood both reacted strongly in the couple's holiday apartment. Something bad happened there, even if there is not a scrap of credible physical evidence that it had anything to do with them. It seems like another example of a couple who have never exactly come across as warm or likeable in the public imagination doing themselves no favours, especially when so many questions remain to be answered about that awful night and the following weeks.
They can't have it both ways, demanding that interest in the disappearance of Madeleine remains high while also continually asserting their right to control the tenor and nature of that interest.
Goncalo Amaral's claims need to be rebutted, not censored. That's the real tragedy. It's coming up to the third anniversary of this little girl's disappearance, and the effort to find out what happened to her has become swamped in an unseemly battle among people desperate to protect their own reputations. It could drag on for years.
The McCanns will soon be back in court seeking €1m in libel damages against Amaral. By the time all this is concluded, Madeleine McCann might as well be known as, "Madeleine Who?" for all the progress which will have been made to bring closure to the saga.

I think your post highlights the reason why we look at the McCanns' with suspicion - things just do not add up.
They can only argue she could not have walked out of the apartment, perhaps looking for them, because she was drugged and they knew that this was impossible. Everyone even the McCanns' would initially have thought this is what happened.
If Gerry said to Mrs Fenn it was important that everyone knew she was abducted again at this point he could not be sure this to be the case unless of course this was part of his staging.
That apartment should have had an abundance of MBM’s DNA not to have any would simply mean the apartment had been thoroughly cleaned. Hm…

I keep thinking about Gerry saying there was no need cover her up because it was warm, clearly implying she was just lying on top of the bed with no sheet on. But is this how you would put a child to bed? He said she never moved from how they put her when he looked down and thought how beautiful she looked. But Jane Tanner stresses how COLD it was that night, wearing a big jumped belonging to Russell and thinking oh what a bad parent, bare feet, no blanket.
I presume police forensics can tell Maddie never slept in that bed and Gerry needs to find an explanation for that. Remember STu Prior wanted some of the forensics covering up. I have always thought that might relate to these apparent mixed samples and sexual abuse but it could be far more simple than that. I remain convinced the police have clear evidence the McCanns are telling even more lies than we know about, but still they lack vital evidence to make charges.

It is beyond reality that there was no DNA from Maddie not sure if there were any finger prints but if not that shows thorough cleaning as kids get everywhere (espcialy under the table with stick paw prints)...
I have often wondered if the PJ would have been daft enough to trust all the evidence to the FSA after the problems they had with the British I would hope they covered themselves and kept a sample back.... Or did GA keep something back?????

I do wonder if Maddie was ever in the apartment and another child played her part at the creche bizare and crazy theory I know but as the photos of her were so diffrent and younger one child looks very much like another which is why the photoshoped one from the pool was needed but then there is the tennis picture sooooo????
All very strange but it would be intresting to know what else is in those files and if Gerry did not know about Kates phone call I wonder what else she said he does not know about????
