WHY I PUT US ON TRIAL BY KATE MCCANN - WE WANT £1M/JUSTICE/OH AND TO SEARCH FOR MADDIE - TIME AND DATE WAS STUCK ON THEIR CAMERA?


Court Case( Injunction) in Lisbon 14th January 2010

We are currently in Lisbon for the trial to determine whether the injunction against Mr Amaral's book and DVD should remain in place. This trial is about whether the book is a true reflection of the official judicial process in to Madeleine's disappearance and whether its contents damage the ongoing search for Madeleine, her siblings and our reputations.

Mr Amaral's book and DVD contains some information from the PJ files but there is a lot in the files which is not in Mr Amaral's book. Hence it is highly selective and therefore biased. Mr Amaral's book contains his opinions rather than fact. His opinions differ from the findings in the PJ file. The conclusions of the latter are: 1.there is no evidence that Madeleine is dead and 2. there is no evidence that Gerry or I are involved in Madeleine's disappearance. This is very different to the theories and conclusions of Mr Amaral. It is logical and common sense that spreading these theories as Mr Amaral did (and continues todo) damages the search to find our little girl. If the general public (and the Portuguese people in particular) are bombarded day in and day out with such theories, this will eventually 'colour' their understanding and judgement -lies and inaccuracies become fact. If people subsequently believe that Madeleineis dead and that we are involved in her disappearance then they will not look for Madeleine, will not consider any suspicions about others which they may have and will not come forward with information. We consider this highly detrimental to the search for Madeleine.

There are few points which have been raised in the last few days which I would like to address specifically:

Abduction theory:For us, there is only the abduction theory possible because we were not involved in Madeleine's disappearance and we know Madeleine did not wander off by herself. It is obvious and right that the police should consider other theories initially.

There may be only one theory for you and Gerry, Kate, I suppose those with a criminal intent have to stick to a theory otherwise people might laugh at them. But given you left your children alone how do you KNOW Madeleine did not wander off by herself? She could easily have got through the patio door that you say you left open, right by that large swimming pool. You know a normal mom could not have sat there and left her children alone in those circumstances. I suspect British Police actually do believe in the kidnapper theory but they tag a bit more on to that, child trafficking, you know what you are being investigated for. It was very helpful of the Portuguese senior police officers and prosecutor to confirm at the hearing the investigation of you considers three incredibly serious offences against Maddie, MURDER KIDNAPPING CHILD TRAFFICKING. They are not theories, they are what they think you and your husband are capable of! Why do you say the police should only consider these theories initially? Because you and your husband think you can tell the police what to do? Did you fall out with all of them because they would not? Have you considered suing Leicester Police for failing to find Madeleine also? After all, they were there too and to this day they say they are still looking for her. What happened to your plan to sue the PJ for One Million for failing to find Madeleine and why did it become a personal issue just picking on the one police officer? Is it helpful in terms of securing ONE MILLION that you can also pursue his publishers and the TV Company. Why did you refuse to allow the same TV company to put your own documentary on for a fee of £35,000 so that your own side of the story could be told in Portugal as well as Goncalo Amaral's ? Is that because you thought it would spoil your planned claim for damages in the sum of ONE MILLION. In Uk we have a name for that sort of behaviour, it is called "abusing the process of the court". There is another applicable maxim, he who comes to equity must come with clean hands". Getting damages for libel is an equitable remedy that IMO you are most certainly not entitled to. You briefed the press far more than anyone during secrecy of justice and even put your star witness, Tanner on Panorama!

The window: I described to the police officers exactly what I found that night, as it was and is highly relevant and I knew that every little detail could be helpful in finding my daughter which is our only aim. The window which is a ground floor window was completely open and is large enough for a person to easily climb through it. Whether it had been opened for this purpose remains unknown. It could of course have been opened by the perpetrator when inside the apartment as a potential escape route or left open as a 'red herring'


"My" daughter Kate? Is there a parting of the ways here, or are you telling us Maddie is not Gerry's daughter also? Have you now become a qualified lawyer or a qualified police investigator now Kate? Who are you to say what is and is not "highly relevant"? I think what is highly relevant in relation to the supposed open windows is the fact that the only forensic evidence found on them was your fingerprint, on the inside! You said on Panorama that someone "broke into the apartment and stole Madeleine". But there were no broken shutters, no forced window. That was just a lie wasn't it Kate? Now you tell us they may have opened it from the inside, yes the fingerprints confirm that, don't they Kate. Oh and well done for only taking best part of three years to think of that one, oh those hard hours at the computer poring over the files. In three minutes your fantasy abductor came through the patio door that you apparently handily left open for him, drugged all three of your children, opened the window from the inside and the shutters and then ran out with the silent Madeleine. Miraculous, lol! Oh, I forgot, he waved to Gerry, Jane and Je\ Wilkins as he passed by. As Gerry said on Panorama these evil predators had been stalking and staking out for days but on the night forgot their car, lol. And these fantasy bafoons even have time to think of "red herrings", funny you mention that one Kate!

The dogs: We realise that the behaviour of the dogs was the turning point in the investigation for the PJ. The use of dogs has proved to be problematic and unreliable in previous cases

(please refer to the Jersey ‘Haut de La Garenne' case and other research published about their use and reliability). It is vital to note that alerts by such dogs are classified as intelligence rather than evidence, as police officers familiar with their use will verify. These alerts must be supported by forensics in order to be used as evidence. The results of the forensic examinations did not identify any blood or Madeleine's DNA. To suggestor use the dogs´ reactions as evidence is simply wrong and abusive.


If the findings of the dogs are so trivial and cannot possibly incriminate you Kate, why have you made such a fuss about the claims of Goncalo Amaral, could it be money you can make out of it?

The proposed reconstruction: The suggestion of a reconstruction of our movements and other key witnesses at the crime scene and/or surrounding area in the early days following Madeleine's abduction was declined by the PJ as 'not usual' for Portugal. When the PJ finally requested a reconstruction to take place in 2008, Gerry and I were still arguidos and as such would have attended for a reconstruction. Some key witnesses (including some of our friends)declined to attend the planned reconstruction as they were not convinced of the aims and usefulness of it. In particular, as the reconstruction was not to be shown to the media (and hence the general public), they did not feel it would help to find Madeleine. Had the intention been to show it to the general public, it may have 'jogged' memories and encouraged people to come forward with information. It should be added that other key witnesses were not invited to attend.


The Police deal with investigations into missing children in confidence. The police wanted to bring back to Portugal those witnesses who THEY had assessed were key to the disappearance of Madeleine McCann, the two prime suspects, Kate and Gerry McCann and their friends who, having consulted lawyers decided they would not go for fear of incriminating themselves. Of course innocent people have nothing to fear and would be only too happy to fully co-operate with the police in seeking to find a missing child. The Police have said that a media circus which Gerry McCann laughingly accepted on Paxman he organised is most unhelpful to a police investigation. That and making lots of money are the key reasons the McCanns persist with their media circus and vile campaign against Portugal and their police which they commenced in the early hours of 4 May 2007 demonstrating their cold and calculating intent to discredit those they KNEW would be investigating them.

Our team is confident that the injunction will remain in place because none of thewitnesses thus far have been able to prove in court that Mr. Amaral's right to express his opinion is superior to the rights of our family to peace, respect and protection of reputation, and above all, the right to continue the search for our daughter Madeleine effectively and without hindrance. As has been made clear this week, Mr Amaral's ‘thesis' is not supported by any evidence. The search for Madeleine must go on until we find her and bring her abductor(s) to justice.


I would say it is the job of the Police to find Madeleine and, as Leicester Police recently put it "those behind the disappearance of Madeleine McCann" who they make clear they intend to bring to justice, of course if it was Portuguese people or any other nationality, Leicester Police would not have jurisdiction. But as we have seen, Kate and Gerry McCann do not wish to work with the Police in either Portugal or even their local force. That is because Police in both UK and Portugal know exactly who is "behind the disappearance of Madeleine McCann", her own parents, with the assistance of their "friends" who refused to attend a police reconstruction.

You know what Kate, I think I am just too nice to you. How come you are laughing and happy just days after Maddie went in PDL but when you are after a million quid nearly three years later always look so agonised, oh well guess I just answered my own question. Do you think that when you instruct your lawyer to make vicious and pointless criminal complaints against Goncalo Amaral people will feel sorry for you and think you are such a sweety? On day 3, Gerry having run home to UK, it does not seem to me that Fiona Payne is doing much to support Kate in what must clearly be a very distressing and intimidating situation with the throng of press. How can she feel it is worth the personal sacrifice to do this? She looked very ill last December and I feel has been ill for a very long time..now she is instructing Duarte to take criminal proceedings against Goncalo Amaral? Why Kate? If your husband wants to pursue this vindictive war, let him come and take the strain, you ought to get back to your children!

Then we have Gerry McCann and Kate McCann arriving for yesterday's hearing. Pictures really do tell stories, I think, and Gerry thinks it is OK to just swan off and leave her to it? Did he not notice how distressed she was, first time around? Of course what we see from Gerry second time around is not distress, it is the dawn of reality and just pure unadulterated fury. How different they are.

















13.1.10 Gerry and Kate arrive for the second day in court knowing things are most definitely not going their way. As Gerry furiously and repeatedly lunges at Sandra Filgueiras, Portuguese Reporter, shouts her down and raises his hand to her, Kate closes her eyes in horror. I am sure she has been there many times before, it really is time to call it a day you know Kate. Just watch this evil man in action on BBC video here with his mask well and truly removed as he arrived for court this morning already in a rage after a terrible day for them on Sky News reporting all the factual findings against them from senior police and the senior prosecutor in the case. They lied from day one. Of all the horrible displays of rage from Gerry in front of the press even, this just has to be the worst I think. He really looks like he is having to fight with himself to stop himself from attacking her. Stop the video a few times and look at the horrific facial expressions and violent body language. He only manages to calm himself when a mail reporter saves the situation by chiming in with a calming comment. It is unexpectedly announced on the second afternoon of the trial that Gerry has to rush home for urgent work committments. As we can see above, the arrogant smile before the proceedings started got replaced with complete fury. Now if I was his lawyer, I would have sent him home too! GERRY McCann angrily dismissed Portuguese detectives’ claims that his daughter Madeleine is dead as he arrived at court today.

Senior officers involved in the case told a hearing in Lisbon yesterday of their belief that Maddy died in her family’s holiday flat and that her parents faked her abduction.

Returning for a second day of evidence, Gerry McCann and his wife Kate insisted that none of the claims were new.

Mr McCann was asked by a Portuguese reporter whether it was worth the emotional cost for the couple to attend the court case.

He replied: “Do you have children? Anyone who has children would go through the same process.”

Lisbon’s main civil court is hearing an attempt by former police chief Goncalo Amaral to overturn a ban on his book questioning the McCanns’ account of what happened to Madeleine.

Speaking as he arrived at the court building hand-in-hand with his wife, Mr McCann seized on public prosecutor Jose Cunha de Magalhaes e Meneses’s testimony yesterday that it was “50-50” whether the child is dead.

Mr McCann said: “The most important thing yesterday was what the prosecutor said, there is absolutely no evidence that Madeleine is dead and there is absolutely no evidence that we were involved in her disappearance.

erm Gerry, this is what the prosecutor actually said and I have to see I see absolutely no evidence that he said there is absolutely no evidence you are involved in the disappearance of your daughter:

“That is the conclusion of the process and that is what we are here debating - the conclusions of the process versus the conclusions of the book.”

Chief Inspector Tavares de Almeida told the court yesterday he believed that Madeleine died in her family’s apartment in the Algarve resort of Praia da Luz on the day she went missing.

He said the main evidence for this was the findings of British police sniffer dogs sent to Portugal to examine the flat.

Mr McCann said the evidence of the police witnesses called by Mr Amaral’s lawyers did not surprise him.

Mr Amaral’s lawyers argue that the material in his book - Maddie: The Truth Of The Lie - is contained in the official Portuguese police files for the case, many of which were made public in August 2008.

Arriving for today’s hearing, Mr Amaral said he was “very happy” that his police colleagues had repeated in court what was in the files and in his book.

The McCanns, both 41, from Rothley, Leicestershire, say their main motive for challenging the former policeman is the fear that people will stop looking for their daughter if they think she is dead.

Explaining why the couple launched legal action against Mr Amaral, Mr McCann said today: “This is a legal process that we’re going through to protect our daughter and our family.

“We’re looking for new information to help the search.

“The question of course is who is looking for Madeleine and who has been looking for Madeleine over the last two years, and that is us and our investigators.”

Mr McCann will return to Britain this afternoon because of work commitments, a spokeswoman for the couple said.

Fiona Payne, one of the friends who was on holiday with the McCanns when Madeleine disappeared on May 3 2007, is flying out to support Mrs McCann.

McCanns 'Want Justice' At £1m Libel Trial

Kate and Gerry McCann arrived in Lisbon for the start of their £1m libel trial against a former police chief saying they want to see justice done for their missing daughter.

The couple are in the Portuguese capital for a three-day hearing at which they will seek £1m in compensation and a final ruling preventing Goncalo Amaral from repeating claims he made about them.

The lawsuit had originally been due to be heard in December, but had to be postponed after Mr Amaral's lawyer was taken ill.

Mr Amaral was in charge of the investigation launched when Madeleine McCann disappeared shortly before her fourth birthday during a family holiday in Praia da Luz in May 2007.

He was taken off the case the following October after criticising British police in a newspaper interview.

Mr and Mrs McCann were named by police as "arguidos", or suspects, but that status was lifted when the investigation was shelved in July 2008.

The same month, Mr Amaral published a book called Maddie: The Truth Of The Lie, in which he claimed the youngster was dead and called into question the McCanns' account that she had been abducted.

No-one can be allowed to say that our daughter can't be found without very good evidence.

A Portuguese judge granted an injunction in September last year banning its further sale or publication.

The former policeman was also prohibited from repeating his claims about Madeleine or her parents.

Arriving at Lisbon Airport, Mr McCann said: "We're just here to continue the search for Madeleine, and to protect our own family, and their human rights.

"No-one can be allowed to say that our daughter can't be found without very good evidence. That's what this court case is about."

Mrs McCann said: "We're looking for justice."

The couple, both 41, from Rothley, Leicestershire, are not expected to give evidence during the hearings, although they are thought to be planning to attend them all.

They have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter.




This would seem to indicate that the camera belonging to the McCanns and the video, I assume belonging to David Payne as we can see he was recording them on the holiday bus, were immediately seised by police and by 8 May in UK being analysed. The date and time had never been set, stuck in 2002. So, come on Gerry, I would like to know how you produced that last image of Madeleine with the time and date on it. Presumably unaware of the mounting evidence police were gathering against you, even at that stage.

It would also be interesting to know what the contents of the 73 deleted pictures are that the police managed to recover.

The police extensively researched how Gerry could have immediately had available two 6 x 4 prints of Madeleine on Kodak xtralife paper. It would seem they concluded that the only way he could have had them available was to bring them from home. This is a specially laminated picture that prevents it from staining even if drinks spill on it and prevents fading etc, not available in PDL, which is hardly surprising given these pics were handed over in the small hours when no photo shops would be open in PDL (about 3 hours after they " reported her missing" erm perverting the course of justice there). But there are a number of outlets around his home in Leicster that will produce this nice long lasting and durable pics for you. Again, demonstrating that Gerry McCann is not really so smart as he thinks he is and no wonder LP announce they will keep on investigating this case until they bring to justice "those behind the disappearance of Madeleine McCann). No surprises who they are alluding to there!

See also article from the Guardian dated 25 May 2007 where they emphasis in the opening lines it was THREE WEEKS TO THE DAY before the McCanns released this apparent last photo of Madeleine. Given it was supposedly taken by Kate, is this a bit of blame allocation/self protection by the scheming Gerry McCann, who, oddly enough had just popped back home to the UK, then he triumphuntantly returns with his handiwork. I would say, a picture of Madeleine from the previous year.

They know it is you Gerry, and one day you will get what you deserve, ARREST!

Statement of: Stuart William Martin

Occupation: Detective Constable 1755

1. I am employed by Hampshire Constabulary as a Detective Constable and am currently stationed in the Hi-Tech Crime Unit. I hold a Batchelor of Mechanical Engineering and Management degree from Liverpool university. My duties include the retrieval and examination of evidence from computers and other digital media and the investigation of computer crime. I have successfully completed two courses held by Guidance Software Inc in relation to their forensic software tools.

I have also successfully completed one course held by Access data Corp in relation to their forensic data tools.

2. On 8th May at 21.00 hours, the following was delivered to my home address by PC 178 Barham, requesting they be examined to establish if they contained pictures and video footage of a hotel complex in Praia da Luz.

On 9th May 2007 at 08.30 I delivered this video camera in the sealed bag number CD 48113 to the imaging unit at Hampshire Police Support headquarters, Netley for examination. I conducted no examination of this bag and contents.

4. 64 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 2) and 32 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 3).

On 9th May 2007 I commenced my examination of a sealed plastic bag seal number CD48115 with two exhibit labels attached marked 64 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 2) and 32 MB camera memory card from Olympus C50 camera Re Praia da Luz holiday 28/4/07 – 5/5/07 (NALF 3).

5. This bag contained a power lead and cable, a black camera case which contained an Olympus C50 camera and a memory cad holder which contained one card.

6. I identified NALF/2 as the memory card which was installed in the camera and NALF/3 as the card in the memory card holder.

7. NALF/2 is an Olympus XD 64 MB memory card number MXD64P3L922905RN9 0223 MAD.

8. NALF/3 is an Olympus XD 32 MB memory card number MXD32P3RO34505RN20235 MAD.

9. I imaged NALF/2 using Guidance Software Inc computer forensic software called Encase version 5.

11. I examined the data from the two cards and located 43 pictures in the live area of the two cards.

12. I produced these pictures as identification references SWM/3019/01 to SWM/3019/43.

13. On checking the camera I found that the time and date was not set on the camera and it was recording the time and date as 0000 hours on 01/01/02. This did not change during the examination. None of the pictures SWM/3019/01 to SWM/3019/43 have any created dates recorded. The last written time and date for each of them is recorded as 0000 01/01/02.


14. Last Accessed represents the date the file as last examined. Whether the Last Accessed Date is triggered depends on the nature of the examination. Opening a file will trigger the Last Accessed Date, as will looking at the file properties and browsing the file structure with Windows Explorer. Examining a file on “write protected media” such as a floppy disk will not trigger this date, neither will examining a file on a compact disk or DVD.

15. Last Written represents the time and date that the contents of the file was last changed. The Last Written date and time is unchanged by the process of copying a file from one drive to another.

16. The creation date and time of the file is usually when it is written to the surface of the disk, subject to the accuracy of the computer clock that was used to perform this task. When this date and time is seen to be after the last written date and time it shows that the files has been transferred from another media.

17. Starting Extent represents the physical location of the starting cluster of the file.

18. Using my forensic software I was able to locate 73 pictures files in the unallocated clusters which had been deleted and were no longer accessible to the camera user.


19. I produce a report containing each of these picture identification reference SWM/3019/01 to SWM/3019/43. (THESE DO NOT APPEAR TO HAVE BEEN DISCLOSED!!)


20. I produce a compact disk SWM/3019/44 containing pictures SWM/3019/01 to SWM/3019/43 and report SWM3019/45. I have also copied the pictures and the folders as they appear on the cards, to this disk.

21. Unallocated clusters

22. Unallocated clusters are clusters on a drive that are not currently assigned to a file. Also called free space. A file may either occupy one or more clusters. The clusters that a file occupies are not necessarily contiguous. Some of these clusters may still contain data from files that have been deleted but not yet overwritten by other files.

23. When the data is extracted from the unallocated clusters there are not imes and dates or file names attributed to the data. My forensic software therefore saved the data in file format and named the files according to the location of the data within the unallocated clusters.

The photograph was taken by her mother, Kate, as the family of five enjoyed their holiday at the Ocean Club complex in the tranquil Algarve resort.

Later that evening, the McCanns left the three children sleeping in their apartment while they ate at a tapas bar a few metres away.

On one of their half-hourly checks they discovered that Madeleine had disappeared, while two-year-old twins Amelie and Sean remained in their beds.

Despite reports of sightings from as far afield as Marrakesh in Morocco, and Crete, police admit that they have no idea where she may be. Believing that she may have been driven across the border into Spain and, from there, to anywhere in Europe, the McCanns are preparing to travel across the continent to spread the hunt for her, starting in Spain.

A British billionaire has offered the McCanns the use of a private jet, although the family are said to be wary of doing anything that makes them look like celebrities.

"We need to start finalising our plans for interviews in areas of Europe where the coverage of Madeleine's disappearance has been limited," Gerry McCann wrote yesterday on the website dedicated to finding his daughter.

As the family's ordeal enters its fourth week today, there have been suggestions from people close to the McCanns that they are concerned about the flow of information from the police to them.

"While they remain content with the overall thrust of the investigation they do at times hope that their questions and concerns are addressed more quickly," a source close to the McCanns told the Press Association news agency.

"They fully comprehend the restrictions that the Portuguese legal system places on everyone involved in this, but naturally as parents who want their little girl back some of the delays that are occurring are frustrating," he added.

Madeleine's uncle, John McCann, said the family remained determined to explore "all ways" of getting Madeleine back. "That will focus on the criminal investigation but we have to - as a family - be open to other ways."

Morning All hope you are all warm and safe....

very intresting about the photo paper which would prove pre meditation (of what I dont know)???

I have been trying to think of innocent reasons for taking along identical photos of your child on holiday? The only innocent thing I can come up with is they wanted her to be a model or child actress and they had shots to give out should a scout be on the look out (very lame and not at all likely but I do try to look at innocent reasons for the weired stuff they do)....

This is very evil and I can only think they knew they were going to give her away or sell her and the photos were photoshoped to show a worse mark to her eye than she really had so she could fade away...

Another sick reason could be she was being abused and the photos were to show people the child they could abuse (that is a very sick thought but something is not right with this but sadly sexual abuse of children is growing with many people being protected...

Any reason for those photos to be taken with them is very sick and it chills me to the core to think she was taken away to be executed at a time that suited them so maybe she was given away after all and maybe she is happy somewhere and would prefer not to be found?

I cant believe for a second that the T7 knew about this on the way to PDL and maybe they dont know what happend to Madeleine after all...

However the fact that they have lied about time lines and been less than helpful tells me a tale was spun to them as well about what happend and there must be something they are all guilty of and are woried sick they will be in serious trouble if they dare to tell the truth...

Anyone of us would be devestated if a friends child was missing and would go out of way to support our friends and do anything we could to help find the child. But would any one of us feel confident about our friends if we saw them laughing with joy 9 days later on what would have been their childs 4th Birthday? I for one think doubts would start to cloud my mind and I would be back to the police to voice my concerns for the victim the missing child.

I see the McCanns return to Portugal again on Tuesday for the hearing of the recently imposed provisional injunction.

Of course all visits to Portugal last year and this year are to do with getting their hands on more money and silencing individuals with different views to their own. They failed to return for the reconstruction but when the ker-chink of the cash registers calls them they having no qualms about returning.

Any money awarded to them will no doubt be transferred to the fund and subsequently ladled out to hapless private investigators, not forgetting of course, to keep family members in paid employment.

All this money apparently frittered away with no end result. I suppose prime suspects spear heading an independent search for Madeleine is unlikely to produce a result!

Hope, I think it does prove that the McCanns went away with the intention of giving Madeleine away or selling her and that is what the police believe. I think it is also the reason the PJ asked Kate, and did you plan to hand over custody of Madeleine to a family member. It suggests a child who was just not wanted and considered expendable. They cashed in so quickly from the moment of her disappearance and clearly knew she might be found again, hence their action in the High Court that she should be returned to them.

When Mrs Justice Hogg had details of the police case against the McCanns the following year, she promptly made Madeleine a Ward of Court and overruled her previous order that they should be given details of the police investigation. That was very clearly because she now knew the McCanns were at the centre of that investigation and there was no way on earth Madeleine could be returned to them. That still does not mean of course that little Maddie is still alive or mean for certain that she was at the time. But I have always said, it is hard to believe they actually went away with the intention to murder Madeleine. But he certainly IMO went away witht he intention to get rid of her and then cash in. The million pounds book and film deals that he planned have clearly been scuppered but there is no doubt he planned them.

I continue to believe the police are desperately trying to find little Maddie and any trail that got left behind, but of course that is now long cold. Hence the police use the powers under RIPA to bug suspects and try and find out more information. I cannot believe that Clarence Mitchell does not exactly know the score and he is either a government plant or deserves to go down with them.

What I cannot get my head around is that there are apparently two separate actions. That would not be allowed in UK courts, you must bring your whole case together in almost all circumstances, so you only get one bite at the cherry. You cannot keep making separate claims against the same person based on the same or very similar facts. (The rule in Henderson v Henderson/abuse of process of the court)

In the process, Kate and Gerry McCann, represented by the Lawyer Isabel Duarte, allege that the book "Maddie, The Truth of the Lie" and the video with the same title divulge the thesis of Gonçalo Amaral, considered unsustainable by them, of the involvement of Madeleine's parents in her disappearence.

Therefore, they requested to the Court the removal from the market, though provisionally, of the book and the video [DVD] produced after the documentary was broadcast by TVI.

In this process, besides the former PJ inspector there were also targeted the publishing house 'Guerra & Paz', the producer Valentim de Carvalho and TVI, attached to the main action, in which the McCann family claimed the protection of rights, freedoms and guarantees.

The parents of the English child who disappeared on May 3, 2007 from the bedroom of a touristic resort in Praia da Luz, Algarve, presented another action against Gonçalo Amaral, with the accusation of defamatory statements; in which they claim damages of at least 1.2 million euros.

In the scope of the claim, a provisional measure of seizure of assets was requested, which was partially implemented, and is waiting for the completion of the due dilligence for its conclusion.

What is holding the Tapas together that is the key to some of this 9 adults could not know what was about to happen before they went away (I find it hard enough to belive that two did) so why are they going along with the altered time line...

I also cant belive they left the children alone if they were about to sell Madeleine as they would have needed to be in control of everything (unless they drugged them all and out of the blue she died as a result sending them into panic mode)....

No adult would alter the truth if a child were missing starting with the childs parents as every detail could help find that child so what are the T7 scared of what trouble could they be in if they told the truth??? I think that whatever they did, they are pure evil. Even if it was an accidental death as the result of negligence, they left her to cry again, on their own admission after she had complained and then mercilessly disposed of her body to save themselves, denying her even the right to a proper funeral. Then they have marketed her and cashed in over a very lengthy time span, again, purely to save themselves and make lots of tax free cash. Via Mitchell they furiously defended their "right" to be the only ones to cash in on little Maddie.

Kate even denied that it was Maddie was known by. Yet all the nannies told the PJ Maddie announced herself to them as "Maddie", not Madeleine. So why would Kate even lie about what she was called? Was this just to make sure that if someone came across Maddie she would not answer to the name Madeleine? Or was Madeleine just considered to be a better marketing ploy? Words really do fail me, at all stages they have done the very opposite to wanting their daughter found. They have supplied us with a load of old photos claiming she was twelve months older on them than she really was. They have given us the most horrible picture of her posed and made up aged about two as representing her then and then images where she looks about 12.

I am afraid there is a big difference between how the McCanns would be treated and how Karen Matthews would be treated. The authorities are clearly concerned about the McCanns "human rights". In the process, the rights of the twins to a normal and happy life seem to have completely passed them by. This is what the McCanns have bought themselves with all that money and their middle class status, misery for the two they have left. There are no words really, are there?

I am a big beliver in Human Rights but when someone takes away someone elses especialy a child it is hard to worry about theirs...

Madeleine was only 3 years old and because they neglected her was able to be taken if they did not neglect her and she was not taken then they either killed her accidently or intentionaly and if she died as a result of an accident such as banging her head there can be no reason to try and cover it up unless they had done something to her that no one must ever see????

Or they arranged an Adoption and not content with getting rid of her thought they would rob pensioners and children to flush the money away on detectives who were as useful as a chocolate tea pot...

Time is going past so quickly but it must drag for them as they realise they are just not as clever as they thought they were.....

I do not think that would bother him one bit. He has clearly absolved himself of all blame a long time ago, if he ever felt any in the first place which is probably nearer the mark. No, if anything this conference will suit his agenda to a tee and he will use the opportunity to further his promotion of the abduction and convincing all around him that they had nothing to do with it. Its all a big sick joke now that shows no sign of ending.

Something is very wrong they are suing Amaral because he wrote a book with the theory she was dead, This was bassed on the police report which said just that...

Kate and Gerry say they have been absolved of any involvement which is a huge lie as they have not been and now the word abduction is not always used when reporting this...

I just wish someone would fight for Madeleine and to hell with the parents after all if they are telling the truth every adult on that holiday seriously neglected their children even when they were sick and Kate is happy to share just how cruel and strange she is by telling the world Madeleiene had cried the night before yet she still could not give a damn and did it all over again...

parents have been jailed for less and sadly for the McCann's the longer this goes on the more odd facts come out and they still have to publish the fund last time it looked dodgey and this time the detectives were fraudsters who they are still happy to say they are pleased they wasted all that money on a crook...

A detective sergeant from Scotland Yard invokes "State immunity" and obligation of secrecy on the investigations of the Maddie case to refuse to testify tomorrow, Tuesday, at the beginning of the trial that opposes the McCann couple to the former coordinator of the PJ, Gonçalo Amaral.

The hearing of witnesses tomorrow at the Civil Court of Lisbon, will be limited to the elements that were requested by the former head of the Judiciary Police of Portimão, most of which also collaborated in the investigation to the English girl's disappearance. The case concerns the order to withdraw from the market all the books "The Truth of the Lie", on which is defended the thesis of Maddie's death and the parental involvement in hiding the cadaver.

The English cop, incidentally with a Portuguese name (José de Freitas), was the liaison officer between the Portuguese and English authorities and the McCann couple. On several occasions he accompanied Kate and Gerry, who would be constituted as arguidos, after being confronted with evidence of human blood and cadaver odor in the apartment at the Ocean Club in Praia da Luz, Lagos. The traces - remember - were detected by the English dogs "Eddie" and "Keela".

As an usual standard in the procedures of the British, all the contacts and signals expressed by the McCanns were registered, including those that contributed to support the decision to constitute them as suspects. And it's relating to that, and to other data, that Gonçalo Amaral seeks a statement.

"Any potential evidence [testimonial] that I can give may be subject to confidentiality and Immunity of the English Public Interest. Furthermore, since all the services that I performed were official, it is applied the principle of State immunity and it will be necessary the consent of the United Kingdom authorities to waive that State immunity before I could be subject to the jurisdiction of the Portuguese courts and to be able to give any evidence, whether relevant or not. The State immunity covering my official acts is that of the United Kingdom and not mine, and can not be renounced by me, but only by the United Kingdom", wrote José de Freitas to the judge of the Civil Court of Lisbon after having been notified, in a letter that JN had access.

The police officer suggests that his witness statement should be instead requested through a letter rogatory or through the British Ambassador [Mr. Alexander Ellis] in Portugal. But subjected to a prior authorization by the English authorities, who have just set a tight regime of secrecy of the process in England. (read the next article )

To be quite frank I do not know what to make of it. The English cop who was to give evidence now says he can’t without the consent of the UK authorities because of state immunity covering his official acts.

He suggests a rogatory letter through the British Ambassador in Portugal is the way forward. Hm…after the last explicably long rogatory letter shenanigans this is unlikely.

The English cop goes onto say "Any potential evidence [testimonial] that I can give may be subject to confidentiality and Immunity of the English Public Interest.”

A lot of may bes there! I cannot not see what this has to do with Public Interest but can see what it is to do with the McCanns interests. It would be nice to speculate the English police are still investigating and a charge will be coming soon but I really do doubt this. I suspect the English cop and the Police Force are afraid to speak out and give their opinion because their thoughts would be seen as deformation and Messrs Carter Fuck would be quickly in action suing the officer involved and the police – whoever gave them the greatest monetary gain!

It is a sad state of affairs!

If the UK Police wanted to push the case along to see if anybody involved could be rattled then this is/was a golden opportunity. What to they do block the guy being a witness. No wonder the McCanns swan around, because there is nothing to touch them and it looks like Amaral's voice is about to be silenced and the duo will be in PT a sure sign of confidence.

Gagging order or in the public's interest?
The Home Secretary wants the trial of a man accused of murdering a prize-winning author held in secret. Why does Britain have public interest immunity?Frances Gibb, Legal Editor of The Times Recommend? (1) Today’s story about the move by the Home Secretary to keep a forthcoming murder trial secret casts a spotlight on public interest immunity — a principle of English common law developed by judges over the centuries.

Government ministers sometimes seek public interest immunity, or PII certificates, in trials to protect official secrets — and so they are often described as “gagging orders” although Sir Nicholas Lyell, QC, when Attorney-General, condemned the phrase as “highly misleading”.

The most famous recent case in which PII certificates were signed was in the prosecution of individuals involved in the Matrix Churchill Arms to Iraq case. The subsequent inquiry under Sir Richard Scott (now the law lord Lord Scott of Foscote) found in its report in 1996 that PII certificates had been issued to keep from defence counsel documents that would have exonerated the defendants on trial.

Public interest immunity used to be called Crown privilege and stems from the same principle as the immunity of the Crown from prosecution in the Crown Proceedings Act 1947. But PII is not limit to the Crown. PII is claimed in both criminal and civil trials when one party seeks an order to stop material being disclosed to the other side.

In 2002 at the trial of Paul Burrell, the butler to Diana, the late Princess of Wales, the prosecution applied to the judge for a ruling that disclosure of certain information would be harmful to the public interest and should not be made public.

The move came after the Queen’s disclosure that she had remembered a conversation she had had with Mr Burrell in which the former butler told her that he had taken items from the late Princess’s home for safekeeping.

In response the prosecution sought to have the information covered by PII. No ruling was made: instead, the trial judge, Mrs Justice Rafferty, said that the PII issue had “been resolved” and the Crown announced charges were to be withdrawn.

Also in 2002, a PII certificate was presented to the court by the Crown Prosecution Service just ten minutes into the hearing in a case brought against the Cornish Stannary Parliament. The Stannary Parliament suggested that the reason was that Duchy of Cornwall had refused to reveal the circumstances in which it transferred several its properties, including Tintagel Castle, to the care of English Heritage.

In another case in 1983, a group of airlines claimed that the British Airports Authority had unlawfully increased landing fees at the instigation of a government minister. The minister disclosed some documents but claimed PII over others. The House of Lords ruled that it did not need to inspect the documents, saying that inspection was required only if the documents were “reasonably likely” to assist or damage a party’s case.

The test is whether damage will be caused to the public interest or to individuals, putting them at risk. Professor Gary Slapper, Director of the Open University Law Programme, said that the basic principles of safeguarding of the public interest was a duty of organisations such as the police and could not be waived by a party or witness who wanted disclosure of sensitive material if the public interest requires it to be excluded.

What if there is a dispute? Then, he says, the judge decides whether exclusion is required after weighing all competing considerations in the balance. “In criminal cases, one of the most important considerations is that, if the material in question, such as the identity of key witnesses, tends to raise any doubt as to the guilt of a defendant, it may be impossible to proceed with the trial unless that evidence is disclosed.”

The judge who must decide whether to allow the PII in the forthcoming trial of Wang Yam, a financial trader from Hampstead, for the murder of Allan Chappelow, the prize-winning author of several books on George Bernard Shaw. Professor Slapper said: “The balance between on the one hand giving the defendant a fair trial by allowing him to know all the details of the case against him, and, on the other hand, keeping secret things that would endanger public safety or national security if generally known, is a difficult one.”

But it was the “great merit” of the system, he added, that it is the judge — not prosecution or defence — who will decide. “And judges, happily, as various home secretaries have discovered in recent history, are not factotums of the government or the security services."

although the above concerns cases where even at trial the government still want it held in secrecy or for some evidence to be withheld, the principle is still the same. Issues like the revelation of police tactics, details of complex child abuse investigations, putting suspects at risk arise just the same in this case and I am not the least surprised UK simply will not allow this officer to testify about an ongoing investigation.

To me, it actually confirms they do have a case against the McCanns!

I was reading about a nurse who is at a tribunal at the moment for amongst other things leaving a baby in a urine soaked cot...

If they are telling the truth about the things she has done she deserves to loose her job...

Yet Rachel leaves her child alone and sniffs through the door to see if her baby has messed itself and Jane leaves a child who is being sick and these two woman are reliable witnesses for the McCann's who are also proud to say when Maddie said she cried they thought so little of her they went out again.....

Why anyone belives a word the McCann's say is beyond me they cant return to search for their child or do a reconstruction yet a sniff of cash and they cant get there fast enough....

On the other hand, is she/he here to gloat because they know the hearing in Portugal is a done deal. Quite honestly it would not surprise me one bit, money talks.

Apparently the McCanns were seen leaving the airport with many bags, perhaps they are planning to bring all GA's books back with them.

Rosie, whether K & G win this libel case or not, the truth will eventually come out, I also think it will be sooner rather than later. If not this government is more corrupt than I thought.

The good news is, more and more of the public are coming round to the truth about the McCanns and they know it stinks!

Indeed, the McCanns have asked for much and given very little or close to nothing! It is unfortunate that not even them, at the moment, speak of the little girl Madeleine McCann (their daughter and co-applicant in the process - even though, unfortunately, no court is aware of her whereabouts, and thus of her legal status) and are more concerned with their public image and with, the theoretical, enormous profits from books and videos which oppose their version of what happened on May 3, 2007.

In the middle of this inglorious battle, one should, however, question: Where is Madeleine? After the archival of the process, what was done to find her?

One of the witnesses presented by the McCanns is Dave Edgar, one of the "private detectives" who, in recent times, has dedicated himself to searching the girl.

Let us make a simple consideration, with so many private detectives that for the last two years, have worked on the case, what has been achieved regarding the location of the little girl, Madeleine? Nothing. Unfortunately, nothing. Why? Is it reasonable to believe that this failure is due to the book of Gonçalo Amaral? Did the whole world lost interest in Maddie due to the arguments of the former inspector Gonçalo Amaral? One of two things: either Gonçalo Amaral is a Genius or the World is Stupid!

The process relating to Maddie case can be reopened. Kate McCann, the mother, just has to answer to one of the more than four dozens of questions that she refused, consciously, to answer in September 2007.

Together with my colleague Peter Gamito, we made the first 3D simulation of the events of May 3, 2007. I have presented arguments to support the conclusion that the abduction theory was untenable. The argumentation, which I repeat now, boils down to this: it were the girl's parents that suggested the possibility of abduction, presenting a sequence of timings for the supervision of the children (not of Maddie alone) which did not exceed, on average, 7 minutes in absolute terms (values that would be severely shortened if relying, in addition, on the movements of the several tapas 9 characters, with the stated stops near the apartment and on the conversations between these characters). What criteria has the McCann couple, or the detectives who they have been hiring, to demonstrate the possibility for an abduction? I confess that I would like to know, at least, one argument that could be put up for discussion and logical argumentation. I regret that so far that has not happened.

Sadly, instead of presenting arguments that could sustain such a thesis, attempts to destruct opposing views are wielded, a fact which doesn't even deserve the adjective of antithesis.

Madeleine McCann is not the daughter of Gonçalo Amaral! Madeleine McCann is the daughter of Kate and Gerry McCann. I regret that the McCanns insist in worrying more with Gonçalo Amaral than with their daughter and that, like in the movie "Fahrenheit 451", believe that firefighters, rather than putting out fires, should burn books...

Someone on JM blog said that the hearing is an appeal by Amaral against the injunction but Pinky would have us believe it is a trial. It was also suggested that the last thing the Macs want is a trial even a libel trial against Amaral so try and destroy him first.

You have a point there about the knew identity. You are right Gerry would not be happy having no fame.

I really do not know what could have happened to Madeleine that her parents and friends were too terrified to admit, other than what has been suggested on this site. I cannot believe all the tapas were involved, therefore why are they not breaking ranks.

Someone somewhere has the upper hand and is controlling what is being released, I notice the pink one has come out of the woodwork again, very apt, government control just when it is needed.

Let's hope GA has something up his sleeve, I wish him all the best for tomorrow.

I also say to Kate & Gerry it is never too late to own up, even to neglect.

I was just thinking if Amaral was able to persuade the court to quash the temporary injunction tomorrow all hell would break loose for the McCanns.

They must have been advised that the case will go their way otherwise it is an awfully risky move to make if there is a chance it could go pear shape.

For 9 Adults to be so proud that they did not give a damn about their children even when they were ill or had been crying only convinces me they are all guilty of something far more evil....

The problem for all of them is it would have to be something really really bad to think pretending to neglect their child and lie about the timeline (when a childs life was in danger they lied?)...

I would not want to walk a minute in their shoes....

Just wish this country would protect children....

Hope, good words to Rosiepops, although I am certain that person needs no reminding of what a disastrous campaign it has conducted.

Does it really believe that win or lose some libel action, that will absolve the McCanns of blame for their daughter's disappearance that Brit cops continue to investigate them for? Will that somehow imprint in the public's mind what this thing has actually sought to suggest, that Goncalo is a paedophile and took Madeleine and she is being held in tunnels beneath PDL by the Portuguese Police. I hardly think so!

We can only be optimistic, perhaps they are there to try and put pressure
on the Judge ( not that they will have to try hard after getting the injunction so easy in the first place) or because they are under pressure to keep a lid on this. I said a few days ago that it would start to unravel for them if the injunction is lifted.

Joe, An appeal by Goncalo against the injunction does make sense because I know he asked for one and Kate and Gerry's lawyer said she did not need them there but she needed their support. It it was a trial they would have to be there.

It is not unrealistic to imagine that is an appeal he may well lose simply on the basis he said he would prove Madeleine died and the final report by the prosecutor says anything but!

Joe, I think as Hope points out above, there is some very strong reasons for the rest of the TAPAS group not speaking out.

Rachel looked terrified in PDL when she returned to try and point the finger at Robert Murat, along with Fiona and Russell.

She also told the most disgusting story, again as Hope relates above about how she left her baby steeped in diarhorrhea and she had to sniff through the door. That story is so far fetched! If you read the rogatory of Payne, it seems pretty clear that as between the Oldfields and the OB's every night someone was supposedly ill and missing from the table. I do not believe they were leaving their children at all, I believe that out of that four, there was always one missing from the table babysitting Grace, and the two OB girls.

The authorities make no secret of the fact this is an international and highly complex investigation. Rachel makes plain she is covering something really terrible to make such claims.

If Amaral had just stuck to the facts his book would still be selling to the annoyance of the Macs. He alas added he believed her to be dead, and of course this is ruining business for the McCanns fund so they sue Amaral for loss of income, they call it damages etc and all the other bull, but it boils down to affecting their little earner, and if she is dead then what is the point or purpose of the fund? Now they cannot have that, Uncle John had tied his flag to the mast and several others. So the real reason is to justify the existence of the fund.

Hiya Joe, I agree that if Goncalo had just stuck to his pretty moderate book the McCanns would have had no cause of action against him.

It was the words I will prove in the documentary and in another interview, "the little girl is dead", that gave them the chance to cash in.

I remain convinced that getting rid of Madeleine and then cashing in is precisely what Gerry McCann and quite probably David Payne too always planned to do.

I read Payne's rog on here a few nights back, it took me ages, but having done so, I am beginning to wonder if I have been wrong about Russell O'Brien and it is just them two. From reading it, it certainly sounds as though Gerry even paid for the special air flights for the Paynes and the McCanns rather than travel to London and have the ones included in the holiday. He also paid an additional £450 to dump his kids all day rather than the half a day that was included. So on top of the cost of the holiday it would seem Gerry McCann forked out at least another £1500 and yet he could not spend about £150 for babysitters?? If you recall the PJ were very interested in his Mastercard spending, I suspect it would detail just how much that holiday cost him, but as they say, you have to speculate to accumulate.

I continue to believe the world will be horrified when they find out the true facts about Gerry McCann in particular and what his wife is just too frightened to own up to, after all, she wanted rid of Madeleine, it would appear.

I can recall loving my dad so much when I was a little girl I actually knew the sound of his car engine and would rush to the front door so excited ready to pounce on him.

But even when Daddy was let in on that documentary the twins just completely ignored him. So he went and got out the milkshakes to make them take notice of him for the cameras. The thing is, when kids are just mad about dad, they do not need a prompt!

Well if I am correct, kate would make the most of the twins and protect them from what she knows Daddy arranged to happen to Madeleine. In fairness I have to say they did seem to be really relating to her newly found momminess, but him!

Hope, I think Kate is so barmy she probably did not realise quite how bad that tuppence worth comment would sound. Maybe she was just genuinely thinking what an incredible handfull little Maddie was, because that was obviously her perception given the comments she made just prior to being made an arguida.

Having said that, I think Kate has often made comments that do clearly indicate in her mind, she has a vision of Madeleine being with someone, to the person who was with our Madeleine... big squeeze on her bruised arm from Gerry.

The McCanns say any damages they are awarded will fund private investigators


The couple launched legal action against former Portuguese detective Goncalo Amaral after he published a book questioning their account of what happened to Madeleine.

Mr and Mrs McCann, from Rothley, Leicestershire, flew to Lisbon ahead of the three-day trial, which is due to start at the main civil court in the Portuguese capital.

The couple plan to attend all the hearings, but do not intend to go back to the Algarve resort where Madeleine vanished more than two-and-a-half years ago.

Madeleine was nearly four years old when she went missing from her family's holiday apartment in Praia da Luz in the Algarve on May 3, 2007, while her parents dined with friends nearby.

Four months later Mr and Mrs McCann were made 'arguidos', or formal suspects, but this was lifted when the investigation was shelved in July 2008.

Mr Amaral led the investigation in the first six months following Madeleine's disappearance.

But he was taken off the case in October 2007 after criticising the British police in a newspaper interview.

In his book Maddie: The Truth Of The Lie, which was published in July 2008, Mr Amaral claimed that Madeleine was dead, and questioned the McCanns' account that she was abducted.

A Portuguese judge granted an injunction in September last year banning further sale or publication of the book.

The former policeman was also prohibited from repeating his claims about Madeleine or her parents.

The McCanns travelled to Lisbon for the opening of the libel trial in December, but the hearing was adjourned until this week after Mr Amaral's lawyer failed to turn up for health reasons.

The couple have previously said any money awarded in damages by the courts would go towards paying for private investigators to look for their daughter.

How every odd to have a trial where one side gives verbal evidence and the other side does not.

Of course I cannot speak for Portugal but in UK, if you just wish to tender written evidence without proving it by going in the witness box far less weight is given to that evidence because you cannot be cross examined upon it. So hum, now let me see if I can think of a reason why the McCanns would not want to give evidence and be subject to cross examination. Oh, I just cannot think!

I think this is a big advantage to Goncalo and his lawyer, or are they sure absolutely certain they are going to win?

I am sure we will all be checking it out on Sky, but wonder if we will only get the McCann approved extracts from this "trial",albeit a very one sided one, lol!

A businessman whose firm helped look for Madeleine McCann and who is wanted in the US for an alleged £1.2m fraud, has appeared in court.


Kate and Gerry McCann ended the deal with Halligen's firm over a year ago


Kevin Halligen, 48, faced City of Westminster magistrates after he was arrested on an extradition warrant in Oxford.

The US Department of Justice issued an indictment for Halligen, from Surrey, earlier this month alleging that he tried to defraud a London law firm of $2.1m (£1.3m).

They claim that he took the money as part of a deal to secure the release of Dutch business executives arrested in the Ivory Coast.

But instead he spent it on a mansion, a gift to his girlfriend, cash machine withdrawals and debit-card transactions, it is claimed.



Madeleine McCann is still missing

He was arrested at a hotel in Oxford on Tuesday where he has been staying for several months under an assumed name.

Following a short hearing at court, he was refused bail and was remanded in custody until December 2, when the case will be heard again.

A spokesman for the McCann family said: "Our association with Halligen and Oakley International ended well over a year ago.

"Given that an arrest has been made it would be inappropriate for us to comment."

English couple wants to avoid that witnesses confirm the thesis that they concealed Maddie’s cadaver

Kate and Gerry McCann are trying to prevent the investigators in the case of the disappearance of their daughter Madeleine from being heard, today, at the Civil Court of Lisbon, at the start of the trial of the injunction that removed the book “The Truth of the Lie” from the market.

The argument for this request that was presented to the judge, over the last few days, is related to alleged “vices” [flaws] in the opposition that was filed by Gonçalo Amaral, the former Polícia Judiciária investigator in Portimão and the author of that book, which defends the thesis of Maddie’s death and the involvement of the parents in the disappearance of the cadaver.

Today, several Polícia Judiciária officers that were summoned by the former coordinator are to be heard, who may eventually corroborate the same thesis. Magalhães e Menezes, the Public Ministry prosecutor who archived the process, has also been summoned.

In the final dispatch, this magistrate also admitted the possibility that the little English child is dead and that the McCann couple did not manage to prove their innocence – because the diligence of the reconstitution of facts was not carried out, due to the English friends being unavailable.

The lawyer who represents Kate and Gerry McCann argues that the facts that have been alleged by the couple in the injunction – which ordered Gonçalo Amaral’s book and the documentary that was based on it, to be removed from the market – should be deemed as fact, because they have not been duly challenged.

And that therefore it is unnecessary to hear the investigators in court, including Tavares de Almeida and Ricardo Paiva, from the PJ in Portimão, Luís Neves, the PJ’s heavy crime unit director, and Guilhermino Encarnação, the former PJ director in Faro. The former PJ inspector, Francisco Moita Flores, has also been summoned as a witness. As JN reported yesterday, another key witness for Gonçalo Amaral was a Scotland Yard officer who cooperated with the Portuguese investigation. In order to refuse to testify, José de Freitas (an English subject, despite the Portuguese name) sent a letter to the court in which he alleges his obligation towards confidentiality and “State immunity” of the United Kingdom.

The McCann couple argues that the constant spreading of the former PJ coordinator’s thesis unjustly places them as suspects – in contradiction with the archiving dispatch – and that it hurts the search for the little girl. They refuse the possibility of death and insist on the abduction thesis.

On the other hand, the former PJ coordinator alleges that he is not the only one to defend the possibility that Madeleine is deceased and the possible involvement of her parents in the disappearance of the body. He stresses that it is based on facts that are gathered within the process – including “indications” that were detected by English dogs.

Wow, just logged onto Sky to get the latest and things look really bad for the McCanns, talk about opening a can of worms!

Isabel Duarte argued that the official PJ files should NOT be admitted in evidence to the court but the court gave ruled that they WILL BE.

Evidence has been given confirming that I was right all along

THE MCCANNS FACED POSSIBLE MURDER, KIDNAPPING AND CHILD TRAFICKING CHARGES.

Not good for Amaral in that it has been said there is an equal chance of her being alive as being dead.

I feel I was right to say he should not have insisted the McCanns killed Madeleine although there is some powerful evidence about the dogs finding both blood and cadaver odour. But are the McCanns going to win this case overall and get massive damages, I really do not think so.

It is obviously all going to come out to the court as to why they were quite properly suspected of the three most serious offences against Madeleine one could possibly imagine.

A report into the disappearance of Madeleine McCann, signed by a police chief, said she had died in the family's holiday apartment, a court has been told.

The lawyer in charge of the original inquiry into Madeleine's disappearance said the report was signed by Tavares De Almeida, who was chief inspector of police at the time Madeleine vanished.

Jose Magalhaes e Menezes also revealed that text messages sent by Kate and Gerry McCann were intercepted by police who were suspicious about their role in their daughter's disappearance.

But the texts were not considered as part of the investigation because a judge would not allow it.

Mr Menezes was the first witness called at a libel trial brought by the McCanns against former police chief Goncalo Amaral. His book claimed Madeleine had died in the family's apartment in the holiday resort of Praia da Luz in May 2007.

But Mr Menezes said he thought the probability of Madeleine being alive was 50/50.

He said the decision to designate the McCanns 'arguidos' - or suspects - was taken by police after sniffer dogs brought to Portugal from England had carried out their searches.

Giving evidence, Mr de Almeida said that the dogs identified blood and the smell of a human body inside the dining room of the holiday flat and in the car the McCanns were using.

The animals also found a scent on a piece of cloth in a flat rented by the McCanns after they left the apartment.

One of the dogs was in a nervous, excitable state, and wanted to get into the room, according to a report by British police, said Mr de Almeida.


No-one can be allowed to say that our daughter can't be found without very good evidence.

Mr de Almeida accused both the British authorities and British police of hindering the investigation by withholding information.

Next to give evidence was police inspector Ricardo Paiva. He was the family liaison officer but was taken off the case at the request of the McCanns.

Asked if he ever got the impression from the McCanns that they thought Madeleine could be dead. He said yes.

The McCanns are seeking £1m compensation and a final ruling preventing Mr Amaral from repeating the claims he made about them.

The McCanns' lawyer told the court that the couple were prepared to give evidence but only after Mr Amaral had done so.

The case may now last longer than its expected three days because a new witness - named as Luis Frois - is being called by the McCann team.

He was taken off the case the following October after criticising British police in a newspaper interview.

Mrs McCann said: "We're looking for justice."

The couple, both 41, from Rothley, Leicestershire, have said that any damages awarded to them would go towards paying for private investigators to look for their daughter.

I think the above comment by Gerry McCann no one can say Madeleine cannot be found without very good evidence is utterly damning.


He is making it a legalistic argument. If you were an innocent parent you would hardly say that. You would simply say, how dare he say we killed Madeleine, there cannot be any evidence of that because it is just not true. Rather than outright deny it, he relies on the apparent lack of evidence. This is as close to an admission he is involved as you will ever get from Gerry McCann and that he just intends to use legal technicalities to continue to do what he has always sought to do, get rid of his own little girl and then cash in.

Maybe he does know there is no evidence of her death because he traficked her though. There must be some bizarre reason he thought he could get away with bringing this case. But Isabel Duarte obviously knows that with that police file against them, they are in serious trouble so far as their reputation is concerned. Maybe technically Goncalo has libelled them, but they were quite obviously involved in some way, maybe just not the way Goncalo insists?

I have been following this on Sky at work and the Breaking News Headline "Madeleine died in the apartment" is very damming and as for the BBC they cant even be bothered to report it...

Sky has always kissed the McCann's butts so reading the headline was a bit of a shock...

The most shocking thing of all is a few of the people I work with know I have followed this and came to tell me The McCann's were guilty because it said she died in the apartment on SKY. I was the one who had to tell them that it was not the case but one of the many strange possibilitys...

I dont think Amaral was ever in it for the money and if they win and he looses the lot somehow I think all he ever wanted was to get the truth out there....

If the British or Portuguise police have any sense at all they will arrest the McCann's before they leave or on their arival home and really start to investigate what they did to their child....

Every child in the country is at risk if un fit parents like the McCann's are allowed to control what is said about their missing child whilst doing nothing to try and find her....

they are guilty of gross neglect if nothing else and for this they should never be allowed to profit from their crime and steal money from people who thought they were helping....

Paiva 4.29 says: The McCanns never pointed me towards any evidence that Maddie was still alive.

Viv - do you know anything about the cloth found in the McCanns villa (cadiver scent) - have not heard of this before only the car and the scent picked up in appartment 5A.

I am hoping the McCanns have gone too far this time. Nonetheless even if everyone involved in investigating this were 99.9% certain Madeleine died in appartment 5A statistically it could be possible to argue, in the absence of a body, she was still alive and no one can be 100% certain she is dead.

Presumably this is what th Mc's believe will win them the case.

I am actually having to pinch myself and say can this really be going so terribly badly for the McCanns, that headline on Sky, Maddie died in the apartment. If Sky were friends with Kate and Gerry that is clearly no longer the case, unless of course, the McCanns really thought this was not going to happen.

In the evidence there seems to be a divurgence of opinion coming out with Goncalo and Almeida firmly behind the death theory and others like Paiva saying they were stopping other theories being investigated. I think that must be right because they both got removed from the case. You also have it being said there was an equal chance she is still alive.

I still feel pretty sure the inquiry did move on to look at child trafficking/ kidnap after Goncalo was removed and that still seems a more likely scenario to me. That does also explain why they put out the duff photos etc and even lied about what Maddie was called insisting it was Madeleine. There is no real reason for others to join a conspiracy if she died in the apartment, but very clearly, they have.

But Wiz, I obviously am not discounting death but for me it would then be murder not accident.

If the forensics and dogs found a small piece of cloth in the apartment that smelled of eau de corpse that is very damning but I do not know much about it. No doubt we will hear more. I think the smaller the piece of cloth the more damning it would be.

I am going to stick by my guns on this and say Gerry McCann is a narcisstic psychopath who planned all this for Madeleine and his decision to take Amaral to court is just typical of such a person.

I continue to believe the world will recoil in horror when we get the full details and I still desperately hope that if she is alive she can be saved.

The McCann ‘Find Madeleine Campaign’ flew in the face of professional police advice. Instead they use companies that sell or promote a product and although this might be appropriate for consumer items it lacks the sensitivity and careful handling needed for a missing child possible being held hostage.

Yes - it will be interesting to hear more about the piece of cloth. As you astutely point out the smaller the piece of cloth the more damming it becomes.

You know maybe even Amaral knew he was wrong, but just picked the least unpleasant scenario and assessed that Gerry is such a pscyho he would sue him if pushed hard enough.

After all that explanation of how she died in the apartment was lame, but look what he has now achieved?

It is almost like he kept playing with Gerry, pushing pushing until he got a result knowing that he would?

The book did not do the trick so he continued...I wonder!

What the McCanns have now achieved is to convince yet more millions of people of their guilt and give access to yet more millions of people as to exactly why that is.

Their slick marketing methods in relation to Madeleine demonstrate the nature of the cold and calculating person behind it all. Gerry did not leave any reasonable person in any doubt whatsoever that he has absolutely no concern for Madeleine whatsoever and his remarks are so crass it highlights his highly abnormal thinking patterns.

We knew the abductor might hurt her but we thought it was a good marketing ploy.

Martin Brunt’s reporting from court and is saying the case was originally to be heard over 3 days but may now go onto the end of the week or even next week. He says the McCann who were not expecting to give evidence - now apparently will have to at the request of Amaral’s lawyer.

I hope that as a result of their own actions in deciding to play this out in PDL and even more people realising what a serious risk of harm they are to children, the Leicester Social Services Department do what they should have done a long time ago and get those twins away from them.

They deserve justice and their human rights respected.

Just how dare Gerry McCann say he is suing to get them £400,000, each, and the same for Madeleine (words absolutely fail me) does he not even have enough normal human feelings to understand that is simply not what they need!!

They need a normal safe loving home, with normal parents who will accept it is their duty to love and protect. It is as simple as that.

If the McCanns’ real reason for this court action was not only to stop Amaral but to obtain some kind of vindication for themselves along with the money of course – their wrong. Just reading my service providers home page. They carry Sky coverage and they’ve had 292 comments (a lot for them) which they have published and nearly all point the finger at the McCanns.

Ho hum…the Streisand effect come to mind with this libel case.

He told us exactly what happend to the child he and his wife neglected when he would not know any more than anyone else as he said he was not there...

Most Criminals give themselves away by talking to much and giving to much information....

I wonder if the press will start to feel braver now and actually print some facts and agree to face the McCann's in court instead of just handing over cash???

After all day one did not go well for the McCann's and it sounds like their lawyer was nearly stamping her feet in frustration???

Jeffrey Archer keeps comming to mind all that money he took from the papers and surprise surprise he gets found out and ends up in jail...

So many things the McCann's could loose their liberty over such a shame none of it will do their missing child or remaining children any good....

Yes Hope it will be a very interesting week. Even if Amaral does not pull this off the McCanns will be very hurt by this action.

To me all their behaviour over the past few years points to damage limitation with regard to themselves. This action could well end up having the opposite affect. Might even get the case reopened – can but hope.

Brunty is reporting that one of the witnesses (didn’t catch who) was phoned by Kate McCann shortly after Madeleine’s disappearance and related a dream she had the previous night.

“I dreamed that I saw Madeleine above the rocks by the beach in PDL”. KM

This was suggested in court to be an indicator that Kate was in mourning for her daughter and further suggested to the police that they were dealing with a murder.

I can’t help thinking the McCanns thought Amaral would be silenced by the temporary injunction and would not oppose. After all they made sure they had all his assets snatched which should have stopped him contesting the injunction. But he did find the money to pay legal costs from somewhere and he did contest it.

The Mc’s would have been in a difficult position if they chose to back down at this point so they’ve had to go ahead.

Hmm….clearly not the right decision even if they win their argument.

I just completely agree with what you have put there Wiz, very astutely put. They are used to using the tactics of bullying and oppression to get what they seek, a life ever after of plenty and with the cloud of what they did to their own little girl finally lifted from them.


Maybe now it is beginning to dawn that is just NOT going to happen!

In my own case against my ex employers they used a battery of bullying, barristers solicitors and lies against just me, but they LOST.

Is he a psychologist or psychiatrist going to the issue of damages due to the impact upon them or, and I think, more likely, is he some forensic/doggy "expert"

who is there to have a pop at Amaral's claims?

Certainly in a UK court if you were claiming such a mega sum and wanted to say it had caused you real harm you would not get it without medical evidence to back it up!

But there again, medical evidence, that is always something they have avoided like the plague.

Gerry could have gone to a doctor and got signed off on the sick for severe psychological trauma over the abduction of his daughter. But it seems to me he wanted to make sure they stayed in PDL and both he and Kate avoided doctors like the plague. Odd that really because seeing a doctor in those circumstances and have meds for shock depression trauma etc would be pretty normal in those circumstances although they did have a bit of counselling, somehow fitting that in among their very busy media schedules. Always a question of getting your priorities straight and I think their exact mental state is something they would wish to be secretive about.

People can see them for what they are once again and if the papers (who have no news to report lately) cash in on Madeleine they will make a fortune for the next year and beyond...

If they just stick to facts and use the pictures of them that are so wrong nothing can touch them...

Amaral may get justice for Madeleine after all...

As for the T7 I really cant think they are having a very nice day today and if they ever want a chance at life they really should be running to the police and telling the truth..

It is the least their children deserve...

What can a witness for the McCann's say???

Amaral has not harmed the search fo their child as they say there have been so many sightings of her... their own detectives know where she is...

No one can know what happend but if the Dogs were correct and the DNA was correct that is conclusive that she is dead...

I know it is not that simple but can you imagine Rose West telling the police what to belive and what happend and not allowing them to ask any questions she did not want to answer???

She could have her say but the police investigated anyway because unless I have missed something when you are a suspect in a crime you are not in control...

the fact the McCann's did take over the investigation and tell people what they must belive (and hire bullies like Rosie to keep us in line)was such a huge mistake...

If she had not held court on the DX this blog would not be here it would have all died down we would have got boered the McCann's would have faded into history...

But no they had to lay down the law and loved the publicity so they only have themselves to blame really...

Well well well what a day, have just read back all the posts.

Well done to Sky for posting the facts from todays hearing, I presume they will also report the facts when the McCanns witnesses take the stand, so expect an about turn.

I do however, think this is a good day for justice for Madeleine.

I do like the fact that it has now been reported that British Police kept info on the McCanns to themselves, not good for this to come out especially for LP.

I also did not know that FSS actually went to Portugal to collect dna then complained it was contaminated!

Lastly, oh dear, McCann's lawyer Isabel Duarte keeps losing it when cross examining a witness, not very professional. Perhaps she has spent too much time with Carter Ruck!!

Yes, very interesting about the possible charges the McCanns could have been charged with, just as you have always said.

Slowly slowly things are starting to unravel let's hope it continues.

However, no matter what happens more and more people are starting to ask questions. Hubby came home from a meeting today and started to ask me questions, after, as you all know not being very interested.

Everyone has internet connection these days on mobiles and believe it or not whilst discussing very important issues in this meeting, someone suddenly shouted Madeleine died in the apt. For the next 10 mins they were all saying my wife has always thought they were not innocent etc.,

If that just means another 6 men have had their eyes opened to the possibility that all is not what it seems, then brilliant.

I had the same thing at work today everyone was talking about it but a few actually told me they had killed her!! Cant believe I actually defended the McCann's by saying no one knew anything for certain although I did add they were lying scum bags and their children should be in care....

Tomorrow will be intresting they may well win the money but this has done them so much harm already...

I was out last night so I’m just reading back.

Luis Frois – hmm… I take it he is some kind of doctor specialising in behaviour maybe forensic may be not. Pay someone enough you can always get the opinion you want. Cynical but true.

Yesterday I mentioned Brunt reported one of KM’s dreams which was analysed as her mourning her dead daughter. This is probably the type of thing that will be explored along with the psychological affect of someone taking away hope from parents who are already traumatised by the disappearance of their daughter.

However, conversely one could argue anyone who suggested that they were guilty in someway would cause the McCanns' stress because it ups the anti that at some point they will be found out. A very stressful situation to be in and one doesn’t have to be a psychiatrist/psychologist to point this out.

I suspect a lot of contentious psycho-babble will be explored by the McCanns' lawyer. It will be interesting to see how Frois gets on under cross-examination. Amaral’s lawyer will be primed and ready for this!

I have to say, and you know my views on what I believe happened to Madeleine, if I saw something that I thought suspicious and considered it might be Madeleine I would report it. So would Amaral’s thesis have stopped me from reporting something about Madeleine whereabouts – no! But whether the judge would agree with this argument is another matter.

What you say is absolutely true. Will a judge see it like that - this is the problem.

Of course we can see through the McCanns’ thin explanation for taking action against Amaral and it is not about people not looking for Madeleine because of Amaral’s thesis. It’s all about him making them look guilty and they need to shut him up. His argument is persuasive and feasible so he has to be silenced at all costs.

Hi Viv,
I know I don't often post but always read your site am delighted that everything is not goiing to plan for the McCanns, they hoped this case would be swiftly over and them a million pounds better off...instead of this Mr Amaral has succeeded in publicising his and the PJ'S beliefs that the kidnap alleged by the McCanns was a lie and cover up by the McCanns, a lot of people who were previously unaware of any of these things have now been publically informed, the front pages of our press are all putting across Mr Amarals views. I realise that they will probably win this case but at the cost of their repuatations, I admire Mr Amaral greatly he is a brave man with morals and I only hope he comes out of all this unscathed and with the right to publish his books.
The McCanns in my opinion will win the case as they have backing from both Governments who both seem determined for them to be presented as victims rather than the neglecting, pair that they are.
I am only glad that Amaral has been able to put his side over and hope that this leads to some tough questions being put to the McCanns.

are still investigating them and really hope that this is the case and one day there will be justice for Maddie. Hope you, your boys and Mum are well Love Lizzy xx

Down at the Express they really love this story. Screaming headlines “Maddie died in Apartment.” Front page, page one and two coverage.

The Express is reporting the McCanns are to introduce a new witness and the case will go on longer than expected. Hmm…I wonder who this can be.

District Attorney Menezes said: The truth is that the McCanns did not seem concerned about the safety of their children. They neglected to take care of them.

A further witness Mr de Almeida told the court that, “well-wishers who gave cash donations to the Madeleine Fund had been conned as the girl was dead and the money was being wasted.”

He said Portuguese police investigated whether they could launch a fraud inquiry to protect the £2M in the fund. But they abandoned the idea after it became apparent they had not jurisdiction – as the fund was held in the UK.

He said. “There was a discussion with the British police about the fund because we couldn’t understand its purpose. We were concerned that there was a fraud being carried out. We asked our British colleagues about it and were told it would be very complicated.

He commented further “The British authorities refused to carry out any investigation into the McCanns or their friends. All they sent us was one A4 piece of paper. We were told the British would not accept an investigation of the McCanns.

I wonder shouldn’t questions as to why the British refused to investigate be asked in parliament? I am not a conspiracy theorist but it sure sounds like a cover up to me.

Now, I hear, he has to go back to UK for urgent work committments. So these are more important than getting justice for his daughter.

Is this his way out of being cross examined, I wonder, or is he finding it necessary to have an urgent consultation with Carter Ruck et al to try and stop the UK flack flying, as it most definitely is. I suppose Clarence will be on overtime rates trying to shut them all up.

Lizzie, I do think Goncalo will lose this case after a fashion. There is no getting away from the fact there is no hard evidence to confirm that Madeleine is dead.

But I do admire him, he has dealt a punishing blow to Kate and Gerry McCann, that they so richly deserve and he most certainly has the moral victory.

I have pointed out before there are always two elements to a big case like this, one liability, there I think he has pretty much lost. But two, quantum of damages that should be paid. I am not the judge, but if I were, I would give them 10p in damages and compensation for all the wrongs they have suffered. It is Madeleine who suffered, the judge will not be in any doubt about that.

Wiz, thanks for your very interesting thoughts that this witness may indeed be a psychologist. In terms of Gerry doing what he is good at, a runner, and Fiona Payne coming to support Kate McCann that does make a lot of sense.

He could not possibly come across as a witness who has been psychologically disturbed by all of this or put the tears on, but Kate, now that is another matter, I think she could. Even so, being the control freak he is, he must be pretty terrified at leaving Kate and Fiona there to face the music. But I think he has even more important things he feels he needs to control back home, the media!

It is not going to help their case at all, if he absents himself from cross examination, that will seriously negate his witness testimony, reducing it to hearsay which will be given far less weight by the court. He is leaving Kate to try and win the case for them. Dirty tactics but all is fair in litigation which is a dirty game.

I think Gerry's sudden need to rush home was an ad hoc decision because surely if it had been planned we would have been told he could only be there for day one.

It looks very bad to me for them and their case and I think we know, as a fact, that when Gerry suddenly needs to rush back to the UK, he has dirty deeds to attend to. I am quite convinced he will be instructing media spinners and lawyers to protect their position because without doubt, Goncalo has done them immense harm, God Bless Him!

There is a fantastically ugly picture of Kate and Gerry in The Sun, but regrettably I cannot copy it.

The story is headed death claim dismissed but a read on and the picture makes very sorry reading for Kate and Gerry.
Gerry angrily shouts out his old mantra the prosecutor says there is absolutely no evidence, but a careful read through what the prosecutor says belies this claim, I am afraid, Gerry. He actually says you told lies from DAY ONE and your claim that you were checking your daughter every 30 minutes (and of course her even tinier siblings) WAS JUST A COMPLETE LIE.

GERRY McCann angrily dismissed claims that his daughter Madeleine was dead as he arrived at court today.

Gerry and his wife Kate were yesterday accused of faking the youngster's kidnap and hiding her body.

The outrageous claim was made in court by a senior Portuguese cop who said of the missing child: "She is dead."

Maddie's distraught mum Kate uttered "No, no" as she listened to the allegations in Lisbon.

They were made by Chief Inspector Tavares Almeida as he gave evidence in support of his former boss Goncalo Amaral.

The McCanns want a permanent ban on Amaral's book — Maddie: The Truth Of The Lie — in which he claims Maddie died in the family's holiday apartment on May 3, 2007

Amaral is trying to overturn the ban.

Returning for the second day of the libel trial Gerry and Kate, both 41-year-old doctors, from Rothley, Leics, insisted that none of yesterday's claims were new.

When asked by a reporter whether it was worth the emotional cost for the couple to attend the court case Gerry snapped: "Do you have children? Anyone who has children would go through the same process."

He added: "The most important thing yesterday was what the prosecutor said, there is absolutely no evidence that Madeleine is dead and there is absolutely no evidence that we were involved in her disappearance.

"That is the conclusion of the process and that is what we are here debating - the conclusions of the process versus the conclusions of the book."

Gerry said the evidence of the police witnesses called by Mr Amaral's lawyers did not surprise him.

"It's evidence we're interested in. There is no evidence that Madeleine is dead, that's what you heard yesterday."

It was said yesterday that sniffer dogs brought from England identified blood in the couple's flat and rental car.

Kate added: "There's nothing new."

Today a former senior Portuguese cop questioned the couple's claim that Maddie may have been passed through the window of their Praia da Luz apartment by kidnappers as she slept alongside her younger twin siblings Sean and Amelie.

Former police detective and criminologist Moita Flores told the court: "I have spoken to respected experts on crime and none of them agrees it would be possible to pass a child through the window.

"It would have been a very stupid person who tried to pass a sleeping child through the window of the McCanns' holiday flat."

Explaining why the couple launched legal action against Mr Amaral, Gerry said today: "This is a legal process that we're going through to protect our daughter and our family.

"We're looking for new information to help the search.

"The question of course is who is looking for Madeleine and who has been looking for Madeleine over the last two years, and that is us and our investigators."

Gerry will return to Britain this afternoon because of work commitments, a spokeswoman for the couple said.

Fiona Payne, one of the friends who was on holiday with the McCanns when then three-year-old Maddie disappeared, is flying out to support Kate.

Wiz, I think that would be a lot to do with it. As a lawyer you have to assess how your client is going to come across in the witness box and give them appropriate advice.

Whilst it more often happens in criminal cases, the advice can often be, you would do your own case so much harm it is better if you do not take the stand.

I think Kate can be relied upon not to just completely lose her temper. Anger is a sure sign that you feel you are losing and not being believed.

But I suspect the decision would have been taken in combination with other issues. I think it is clear from the different expression on Gerry's face from the one day to the other, this has come down on him like a tonne of bricks and really was not expected. He always believes he is going to win because he has put some much manipulative effort into making sure he does. Why Rosie, was even writing pages of drivling dirt on Goncalo in the days and weeks leading up to this and that prat actually believes such measures make a difference.

So I do think the other pressing things that would have called for his attention are the lawyers and the spinners, feeling the need to get back in control of the media in UK, as it were!


As we can see, even The Sun have been most unhelpful, but then again they are only printing what he says. He is his own worst enemy and by keep turning it back to no evidence we were involved in the disappearance of our daughter he really does give the game away. The police do not just suspect him of murdering Madeleine, they know he is capable of perhaps even worse than that.

Take this report from CNN for example where they have clearly spoken to Mitchell. They planned to stay for the whole of the trial. But suddenly this afternoon he has to rush off, it is a sign of everything going really badly for the McCanns. I can just hear Gerry screaming oh fu^k even the fu$king yanks are reporting this, we a fu£ked how can we stop this now, tears of fury..

I do not think the verdict will come quite so quickly. Mitchell gives the impression it will be a simple matter for the Judge.

The reality is she will want to peruse the police file and it will be the most agonising decision for her.

Censure of a police officer who opened his mouth when plainly he should not, but faced with the couple from hell who want paying for him doing that. I would not like to be in her shoes.

I think Gerry’s hasty retreat is on the advice of his legal team – as you suggest. Otherwise why would he leave his wife alone to face a barrage of accusations and just swan off on some lame excuse. That in itself looks very bad and will be perceived as the act of an unloving and callous man. Not an image he would want to portray even if true.

Outside the court he said "That's why we carry on. We have other children who miss Madeleine dearly."

Once again he did not say they missed her and still wants to blame Amaral...

If they were telling the truth I think he would have shaken Kate until she agreed to answer every question put to her and would be on his knees begging for the investigation to be re opened...

Leaving Kate in the hand of smug Fiona is a mistake and I have to wonder if Kate will take to the witness stand.... Yesterday the trial may have gone on an extra two days and today Gerry does a runner...

Sky had the Headline Maddie died in apartment all day yesterday and the DX will make sure they report the facts that cant get them sued...

I am sure Amaral wrote the book to protect his reputation and he knows the truth about what they did to their poor child...

Maybe he does not even believe that she is dead and was instead sold like a kitten but had to do something to get them in a court room...

The stupid fools fell for it hook line and sinker they could walk away with a million and get the book banned...

But he has what he wanted more people know what evil scum they are and they were never cleared and there was a good reason to suspect them both...

Just another few thoughts.

Gerry looked furious when exiting the court this afternoon. What happens to couples in this difficult situation. Recriminations start? Well it was all your idea, as usual, you said we would win? Did he tell Kate to get stuffed and flounce out? It is not at all difficult to imagine them having the most heated of arguments about this. But maybe that is just wishful thinking, if they did what I think they did, the fear of being found out would be so terrific they would likely pull together for that reason, but still it must be very hard for Kate.

The other thing, I am non plussed actually by how short the cross examination of Goncalo's witnesses actually is. The purpose of that of course is to destroy what they have put in their witness statements. If you do not destroy what they have put it is likely to be taken as the truth. Lawyers will avoid seeking to attack something that cannot be attacked and is so utterly damning for their client because in cross examination the witness may come out with something even worse.

I think how incredibly short these sessions are again looks bad for the McCanns and I have to say I am surprised the whole thing was planned at the outset to be wrapped up in just four days!

I just read Gerry saying well we made a mistake in leaving Madeleine alone and that is something we have to live with etc.

He then IMMEDIATELY launched into how the Portuguese cops made a mistake.

I found that really repulsive, it is what I know, as a trained probation officers offenders are particularly adept at, reallocating the blame upon the police.

What makes it worse is we can see from the Pt police file just how hard these cops tried and that in spite of all the additional help from UK cops as one witness said, they still could not charge the McCanns. So I think people will see the reality here, the police made no mistake in suspecting them and Gerry made no mistake in leaving Madeleine alone. It was so that he could carry that poor little girl off at the appointed time, as the Smiths so clearly tell us they saw him doing.

That man is just repulsive.

There was another similar remark about these are the people who are supposed to be finding Madeleine but they suspect us. Yes, they do, every single one of them and so do the British Police. Can it be that they are all wrong and Gerry is right? I hardly think so! What other case has there been of innocent parents continuing to be suspected by the police, none. The evidence is against them, they lied from day one, innocent parents do not do that. Decent parents do not spend thousands on a holiday and extra flights and extra costs to dump their kids every day and then fail to spend a few hundred on babysitters. To me what Gerry McCann did is more than obvious and the reasons he did it. He can call it a mistake, no sensible couple of doctors or loving parents would make such a catalogue of "mistakes".

British and Portuguese Police are against the McCanns for one simple reason, they are guilty in the disappearance of little Maddie McCann.

Ah so from Gerry's own lips, the brilliant Dave Edgar has NO LEADS in the search for Madeleine, but he needs ONE MILLION FOR MORE PRIVATE INVESTIGATORS TO FIND MADELEINE.

Maybe Dave Edgar has to come to the inevitable conclusion that without honesty from the man who walked out of the apartment with Madeleine, Gerry McCannn, he has no leads as to what happened to her from that point onwards..

But I think he was pursuing a sensible line by looking at boats. I wonder have Dave and Gerry had a falling out?

Who will they appoint next? Well I suppose they have to wait for this judge to give them the money first and if I was her, I would NOT do that. Because that is plainly just money for fraudsters employed by a fraudster, Gerry McCann. SOCA investigate serious fraud Gerry, but I am sure you know that!

Fiona and Kate would not go back for the McCann's own version of the reconstruction (best thing for Kate really as they could not have used her anyway as it screwed the whole thing up) but both of them can be there if there is a sniff of a million quid to be had....

I hope the twins are taken care of and someone is there when Gerry gets back to protect them as I really dont know which one of them is better now !!!

The only way Gerry can avoid that direction is to do what he has done and absent himself. If that was not an admittance of guilt or that he just cannot keep his nasty temper...

I have had another very interesting day today. A very good friend, who just would not believe anything other than Madeliene must have been abducted as the parents are Doctors, has been watching live on sky. She phoned me earlier and actually admitted she is sorry for doubting me and is very probably wrong.

I have not discussed the case with her for well over a year so as not to destroy our friendship. However, I told her not to accept my thesis, read all the information out there and she should make her own mind up.If it disagrees with my theory no hard feelings.

I did give her a few helpfull sites, but feel for her having to trawl through two and a half years information.

and thanks for that it is really interesting.

It confirms what we obviously believe to be the case. True Goncalo may lose this case to an extent (but there is the issue about the level of damages which I hope the McCanns will lose) but even so the McCanns have seriously lost because people now know even more about the police case against them. They know they were also investigated for kidnapping and child trafficking which I do not think was common knowledge (although I tried to make sure it was). And of course they now know most importantly of all the prosecutor has never cleared the McCanns or said there is absolutely no evidence against them and that all police are united in holding the McCanns as prime suspects in her disappearance.

So overall, regardless of the formal result following this court case, Goncalo had a resounding win!

I am sure Gerry never planned to come home before the end of the hearing. I believe he was advised to do, as I said earlier damage limitation with the tabloids.

However, I never become complacent as we have seen soooo many ups and downs.

Interestingly Goncalo left the court early, before Gerrys departure. I wonder if this was planned to get the upper hand over Gerry and speak to the journalists first.

I do worry about Gerry Viv, I really believe he is a nasty piece of work and would stitch up anyone to save himself. This trip back home has to be for a reason, and I am sure it is not for work commitments! imo

A lot of stuff has come out now on Sky and they are stuffed for the minute. If it comes to a damages hearing they will run, as the works will be thrown at them and they will be terrified of all the facts being made public. So they may be granted a continuation of the injunction ( already fixed ) but Amaral has inflicted serious damage and he clearly will continue to do so in the future. They are up against the Police who have the FACTS and know what probably happened. I hope they get what they deserve.

Have another look at that BBC video, it is clearly Sandra Filgeuiras who causes Gerry to completely lose control he lunges forward at her and even raises his hand in the most intimidating way. If this is how he can behave towards a woman in public, imagine being alone with him.

When the male starts to question him, you can see him calming down again.



Sandra is a brave lady and certainly knows how to push his buttons and expose the real Gerry, the other side of his mask.

To my mind if the officers that Amaral called as witnesses say Madeline is most probably dead then as expert witnesses ( cadaver dogs etc)they are credible and must be taken seriously. This of course supports Amaral. Added to this the McCanns have never been charged or cleared or official exonerated for that matter as the case is shelved so logic suggests that they should not have been allowed to even bring this injunction in the first place particularly if Amaral's conclusion is upheld by several police officers and his conclusion is an official one ( at least until the case is solved) and not one of a ranting maverick. I maybe wrong,

yet they put a very damming video of a flustered bully on line for all to see....

I actually cringed while watching that it was very sad if only Gerry realised he should never have taken Amaral to court someone must have said it was a bad idea???

I think he is mentaly ill he really belives by comming back he can wipe the slate clean again and it just wont wash...

They have not been cleared and there may not be a lot of evidence that can be used in court but every one of their actions have not been normal.... from the lovely made up Kate the jogging the blogging the anger at anyone who dares to say she may have wandered off to the many very public smiles and laughter when it was if not odd very distastful when such a young child is missing....

Rosie avidly tells the proof is here on this BBC video. I have just sat and listened to it and there is an interview with Gerry McCann, there is no such comment from Goncalo Amaral. Just how desperate are they?

Kate McCann is to be joined by Fiona Payne, a member of the so-called Tapas Seven group of friends, for the third day of a libel trial in Portugal as husband Gerry has flown home.

The McCanns are in court to try to ensure a ban is upheld on a book written by former policeman Goncalo Amaral in which he suggests their daughter died in the apartment from which she vanished in May 2007.

Mr Amaral was originally in charge of the investigation into Madeleine McCann's whereabouts after she disappeared during the family trip to Praia da Luz in the Algarve.

However, he was taken off the case five months later after criticising the British police, and went on to write Madeleine: The Truth Of The Lie, published the following summer.

The book and a subsequent documentary prompted the McCanns to launch a legal fight for a ban and £1m compensation, which they say would be put towards efforts to find Madeleine.

The trial has so far consisted of witnesses called on behalf of Mr Amaral, mostly current or former policemen who back his version of events.

Chief Inspector Tavares de Almeida told the court on Monday he believed Madeleine died in her family's holiday apartment and that her parents covered up the death by inventing a kidnapping.

On the second day Francisco Moita Flores, a former senior policeman who is now a politician, criminologist and writer, told the court it would be impossible to pass a sleeping child through the window of the McCanns' holiday flat.

Their testimony has been challenged by the McCanns' defence lawyer, Isabel Duarte, who pointed out there were other ways in which the youngster could have been taken from the apartment.

The Amaral witnesses have also repeatedly insisted that the case represents an attack on the Portuguese constitution and freedom of speech.

They have also brought up the hostile attitude of sections of the British media towards the local detectives who worked on the case and Mr Amaral in particular.

Mr McCann and his wife Kate, both 41, from Rothley, Leicestershire, have sat together in court throughout, but on the trial's second day Mr McCann left early, saying he had to fly back to the UK to honour work commitments.

Outside court, he said that despite the hostile testimony there was still no evidence whatsoever that Madeleine was dead.

He said: "From our point of view, what's happened in the last two days is in many ways what's expected. These are Goncalo Amaral's witnesses.

"I think it is particularly disappointing that certain police officers within Portimao who considered us as possibly involved in Madeleine's disappearance have not been able to change their minds despite a lack of evidence.

"It is these officers we are dependent on for pursuing the investigation within Portugal."

Her place at Mrs McCann's side in the courtroom will be taken by Mrs Payne, a member of the Tapas Seven group of friends who were dining with the McCanns on the night of the disappearance.

The group were awarded libel damages of £375,000 in October 2008 following untrue reports in two British daily newspapers that they had not told the truth about what happened that evening.

Mrs Payne is a close friend of Kate's and recently ran a charity fun run with her in Leicestershire during which Mrs McCann wore a T-shirt pleading for people not to give up the search for her daughter.

We have heard before that GM is a narcissist. But is he really?

Narcissists are very difficult to be around and unlikely to be married because their behaviour is such their partner would have to walk away if only for their own sanity.

GM appears to display a lot of characteristics of a narcissist. A narcissist can be, when all is going well, charismatic and charming. Deep down they are insecure and feel inferior and continually seek the admiration and positive approval of others which they believe they deserve by right, if they do not receive this that’s well all hell breaks loose. They are brilliant liars and have very selective memories of incidents. All incidents they report will only have things in them that place them in a positive light everything else that happened will not have occurred according to them.

Corner a narcissist in one of their lies, or stand up to them is when all hell breaks loose as they need to hold onto their false belief they are better than anyone else and always right and in control of a situation!

As a narcissist lacks the ability to empathise with others and even the Sainted Kate would not be able to deal with the behaviour of a full blown narcissist.

But Gerry, in my observation of him, has more narcissistic traits that would be considered normal. This is probably why his lawyer did not want to put him on the stand. Under cross examination Amaral’s lawyer highlighting thing that suggest he is in the wrong and an inferior parent etc would cause him to blow up. After all he would think, how dare they say that to him - how very very dare they. That’s almost the narcissist’s battle cry! lol

Narcissists, by the way, believe they are always right and it’s everyone else who is wrong.

I feel he is a narcissist but only rely on my experience with offenders, very few of whom had those traits, of course, and professional training.

Another thing that does stand out for me is his showmanship and relish at being the centre of attention. He really does need to feel appreciated, there is a deep underlying insecurity there I think. I think this is what Paxman was getting at with some pretty cutting remarks, but Gerry did not realise. He just thought the references to his media circus and how he just used it exactly when it suited him was funny!

It is perhaps as well he did not realise on that occasion, because as you say, if anyone challenges their authority, their lies and their beliefs they will react with complete fury.

Paxman, as we know, is highly intelligent and looked very much to me, as though he was deeply analysing Gerry.

I would imagine Ms Duarte has too and you are probably correct, in her assessment he would completely blow a case that she knows is difficult for her anyway!

Sandra is very challenging towards him and what is worse she is a female which I think he has a particular problem with. We have just seen that fury unleashed on her.

I think Kate just looks quite agonised and is stuck in a situation she does not see a way out of. If she tells the police the truth it will be shocking and she knows what will happen to her. I think over the years she has got herself into a situation with him where she has become controlled and does not see a clear way out of what she has allowed to take place. It would have been difficult for her, I think, to cope with a developing situation and three young children to cope with, increasing mental health and probably alcohol problems I think, as a coping mechanism.

I suppose what would seriously worry Ms Duarte is that furious temper, bubbling just under the surface. Even some pretty mild mannered people lose their cool when subject to hostile cross examination, with Gerry it is a certainty. His body language and facial expressions then become so violent in the context of Goncalo and many others feeling that Madeleine died on 3 May one can imagine what Ms Duarte would be concerned the judge may think!

It would be very interesting to know something about this young female judge. What sort of cases does she normally hear? It is very likely she would be well educated in issues such as child abuse, domestic violence and personality disorder herself.

Very often advocates play the case according to the judge. The fact that it is a young female may have further gone against Gerry McCann. It may also have further worried Ms Duarte given he seems to have a problem relating to women, feeling he needs to be in control. Again, the young female judge being fully in control in the court room would be a real issue for him, I think!

Hi Viv your last post 10.30 was interesting I just wonder if everything was so wonderful in the young GM household when he was growing up as sister Phil would have us believe.

Narcissism is thought to develop through, as you suggest bullying, when very young. Being made to feel inferior causes an over compensation for this and the narcisstic personality develops.

If this is true his personality would have taken a big dent when they couldn’t conceive naturally - after all it may be a biological fault on his part something no doubt he would never admit to.

If he is narcisstic it must be a great delight to him to have proven the family wrong and become a hot shot doctor and have a nice life style. Just think how wonderful he must feel having the ears of the world press – he is so important. Further he offers well paid jobs to family members - he now holds the power – no wonder he looks so well after all he has been through.

and he had a compensator for the academia as well, the sport, the showmanship, something else he could excel at which as you say he needs for his battered ego.

Even now he is fiercely competitive, loves sport and must win. Everything to him is something to be conquered, maybe that is what he was bragging about on his inane blogs, was there not some comment about how quickly they jogged somewhere. To us mere mortals it sounded utterly bizarre but in the world of Gerry McCann, he might have been a really bad boy, but he needed to block that out and carry on winning.

If our speculation is right he would be not be able to tell the truth even if undisputable evidence was produced that proved his involvement in his daughter’s disappearance.

His condition would not allow him to do this – he will always be right and everyone else is wrong.

Sky has just showed KM outside the court looking ill and speaking in a long suffering voice. When asked by a reporter did she think things were going her way she slightly hesitated before replying saying:-

“No evidence has been shown that Madeleine is dead and no evidence has shown that we are involved and that is what we have always said.”

Some interesting posts, Wizard you summed up Gerry perfectly.

Viv, Bren says Goncalo did not swear. He said "Forca los McCanns" which means "Good luck McCanns". So typical of our shoddy press to distort the truth. I hope Goncalo takes it further.

Martin Brunt has reported that the McCanns are not happy with what has come out in court which is why they are speaking to the press, damage limitation.

Apparently after today the hearing is adjourned until the 10th Feb when two more witnesses will be called. I don't know who is calling the witnesses.

Interestingly a Portuguese poster has said Goncalo could call the McCanns to be witnesses, I would love him to call Gerry.

It was mentioned yesterday the McCanns’ wanted to call one new witness that was not named previously. As things have not got well for them the other witness you mention is probably theirs as well.

As Amaral has had most of the Portuguese police and their mothers giving evidence it is unlikely to be his further witness.

It seems most witnesses believe Madeleine is dead but until they find a body it would be statistically incorrect to be 100% certain she is. So that would mean it is unproven thus the Mcs will no doubt win this case but if Amaral has to pay compensation this would be a travesty. If I were the judge I would ask Amaral to pay 1 euro in compensation even then I’m not sure that is fair to him because of his legal costs.

Again, I agree with you, that is my assessment of Gerry, no matter what the evidence he simply cannot admit it, that would cause him pure emotional turmoil. He simply must be in control and he just cannot be in the wrong. It is why he just keeps making these lame remarks again that did not work three years ago and they will not work now, but he cannot help himself. We just made a mistake. It is bizarre but that is Gerry. I think that is where a lot of people go wrong with him, they keep trying to assess him by applying the standards and reasoning power of a normal person with normal levels of insight and empathy, but Gerry is just not normal. People just cannot see that he is capable of very wicked and calculated deeds, to them it must be a pure accident. But I find that reasoning so illogical. Do people who really believe that someone who was hardly culpable in their child's death would be there right now in Portugal suing Goncalo Amaral, would he just keep on and on insisting they are innocent, or would he just shut up? Now that would be a normal thing for a parent to do who had killed their child, almost an accident but wanted to get away with it. Not that that is entirely normal of course!

Wiz, I think it has to be said Kate McCann is also in complete denial given her comments, but I am sure they are Gerry approved or god help her. How on earth can she say there has been evidence they were involved?

The star witness, the prosecutor says they lied from day one, he says they lied about checking their children every 30 minutes. That was a crucially damning piece of evidence. Gerry says he checked Madeleine at 9 and Kate at 10, so that is an hour. So what the prosecutor is saying is that insertion of the 30 minute slot at 9.30 by Mat Oldfield is just a lie as I have always thought that it was.

How on earth does she have the gall to stand there and say there is no evidence heard they were involved in her disappearance. Why on earth would they be researching things like kidnap and trafficking, because there clearly is evidence, Gerry McCann was seen by the Smiths carting Madeleine off towards the beach. This couple are heading for disaster!

But in the short term it would seem the instructions are fire every bullet you have at Goncalo Amaral, almost like they want revenge for him being so persistent.

Their lawyer is now saying next week she files criminal charges against him for breaching the secrecy of justice and also seems to be implying fraud on the legal aid too. This fight is getting very dirty indeed!

It does not actually take us long to work out every little move of the chess piece that this scheming and malevolent makes. Well Duarte advised us to sue him and well Kate told her to go for the criminal charges.

Lady Kate, you better stop and think very carefully what you are doing over there, because it seems to me Gerry set you up!

And I am going to sit and patiently wait for a very cogent explanation as to exactly how these further actions against Goncalo are going to help you find Madeleine, do please tell!

Or are you going to continue to be Gerry's puppet instead of finally standing up and doing the brave thing, the right thing. Walk away from Goncalo Amaral get yourself a solicitor and go and see the police who are investigating this case, NOW!

The legal aid – ha this is what caused the problems for the McCanns. By having Amaral’s assets snatched they believed he would not able to contest the case. When he did contest it they had no option but to go ahead.

It’s a wonder we couldn’t hear GM’s rages from home. The case has been adjourned until February if they can prove irregularities in his legal aid application he will not be able to fight his corner in February. Dirty in deed, very dirty the gloves are really off. I think this just proves how damaging this case has become to the McCanns they need to shut him up at all costs.

One thing they say about a narcissist if you take them on be very, very careful as the fall out will be unimaginable. GM will no doubt be in overdrive.

Kate saying there is no evidence against them - she's been saying for so long they are not involved in anyway - she no doubt believes it!

If the two new witnesses Di mentioned are in fact McCann witnesses what are the chances they were rustled up to delay proceeding with a continuation granted in 4 weeks. Plenty of time to dig up information on Amaral’s legal aid application - I suppose they are hoping he will not be unable to continue.

I suppose the press will not ask - if legal aid regularities exist, what is that to do with Amaral saying Madeleine is dead? A chess game indeed!

It is strange to hear everything again (well bits of it)and Gerry has re confirmed for me he is a liar..

He must be mentaly ill not to realise you cant keep saying things that are not true, they have not been cleared of anything and reading the reports in the press that are so say McCann friendly have been printing things that anyone who is not wearing rose tinted specs will re think what they know about this.....

As for their witness maybe it is Dozy Rosie who will tell the court they are angels sent from heaven and it was all Maddies fault for not staying asleep....

I wonder what their families think of them they must be so proud and if Kates Mother is happy her Grandchild is being ignored again I can see where Kate got her Mothering skills from.... I am proud to say my Mother would be on every TV station condeming me if I dared to put myself above my missing daughter,,,

Amaral has no money as they have taken it from him to hold as a reward for Child Neglectors who have spun thier daughters fate into a farce....

He is a very famous guy in Portugal so you would think his legal aid aplication could not hold much back...

At least he has not paid for his defence out of a fund raised to search for a missing child now that really would be discraceful and discusting who could do such a low thing as that???

If he does loose his legal aid I hope a lawyer will represent him pro bono this trial is about justice for a little girl and a stranger who wanted to find her when her parents clearly did not...

What surprises me is the McCanns know she is not dead there is no evidence that she is yet anyone of thier scummy pals could have killed her and hidden her body yet they have all the answers???

Something else I recall reading about people with a controlling sort of personality disorder.

They enjoy setting other people up to fight each other and then sitting back and watching the fruits of their handwiwork.

I am afraid it looks to me like Gerry walked away and left Kate to really go for Goncalo's throat.

When she has brought him to his knees, if she does, will she be perceived by the public how she wants to be perceived, as this sweet and gentle woman who loves her children and wants her Maddie back. Or will she be perceived as the wicked woman who ruined Goncalo and his family? Will she in turn then be seen as the one who simply must have killed Madeleine. Sit back and watch Gerry.

The choice is all yours Kate!

When GM lost the plot whilst being interviewed by Spanish TV sometime ago Kate was very apologetic and made excuses for his behaviour. Her manner was similar to the way an indulgent mother justifies her child’s bad behaviour.

I’m just wondering about the medical reports of the McCann family which never appeared. I have often thought it might mean KM had some depressive problems which would not look good as the pj thought M had been murdered.

Perhaps it’s not Kate at all, perhaps its Gerry’s records that need to remain confidential. Just a thought.

A separate libel hearing due to start in March is being reported on Sky - is that against Amaral again?

No wonder GM said last year they would be making a number of visits to Portugal and even Lady Kate was going too!

I see that numpty Fiona Payne is in Portugal well I suppose she does have a vested interest. She wouldn’t want Kate breaking down and spilling the beans.

I was talking to LGC last night (it is raining in Nice at the moment but she is enjoying living there) anyway she thiks the papers will go careful but probly will print the truth when they are immune from being sued...

The truth has to come out whoever is helping the pair of scumbags is more than likely banging their head against a wall as Gerry just wont shut up he has to have all the cash he can get his grubby little hands on and as their lawyer said a Pandoras Box has been opened and I cant think of anything from that box they would want to share with the world,,,

The Mail had comments today 25 of them and only 1 in support of the child neglectors....

PJ Reis is also questioning the McCanns on twitter.

Interesting times ahead, I hope Goncalo is gathering more evidence against K & G, as Wizard said the gloves are off it's eveyone for themselves now!

What a sad situation this is and it could have been totally avoided if only the McCanns had been truthful from the outset.

The only thing I could say is if Ms Duarte was so confident of winning the main action against him would she bother with the rest? The McCanns own documentary has now come out in evidence before the court, and also the appearance on the Oprah Winfrey Show. And then of course some very damning evidence of their own conduct in the criminal case against them, can they really say they have been defamed?

One thing is for sure as between Goncalo Amaral, Gerry and Kate Mccann they have created their own worst and most expensive nightmare.

I am sorry to say it but it does seem that Goncalo is no respecter of rules, law and procedures. You could add all his infractions together and times them by a hundred, they do not equal what Kate and Gerry did, but he gives the clearest of evidence against himself and is most definitely in trouble!

McCanns accuse Amaral of violating the judicial secrecy

The McCann couple will file a criminal action against Gonçalo Amaral for allegedly violating the judicial secrecy when he published facts concerning the investigation, in his book “Maddie – The Truth of the Lie”.

According to Lusa Agency, the British couple’s lawyer, Isabel Duarte, stated that the action will be filed after a certificate from the trial of the book’s prohibition is extracted, which is expected to happen as soon as next week.

The accusation of violation of judicial secrecy is based on the date when the former inspector’s book was ready, which happened three days after the Republic’s prosecutor wrote the process’ archiving dispatch.

Isabel Duarte defends that “Gonçalo Amaral diffused the process to Guerra & Paz [the book’s editor] when the process was still under judicial secrecy. He diffused facts and he was not authorised to do so”.

The lawyer recalled that the video that was broadcast on TVI is evidence of that infraction, because it was an important piece within the investigation and stated that she is going to file a criminal complaint against the former inspector herself, over “false statements” to the court. According to Isabel Duarte, this accusation is based on statements by Gonçalo Amaral that he has “no real estate [nor any] participation in a firm”, when in reality such is not true.

The former inspector is thus being accused over false statements, of violating the judicial secrecy, and of defamation by the McCann couple and by their lawyer.

I think Duarte will have a job making that one stick. Since he was careful in allowing 3 days after the case was shelved before putting the book out to the public. Him and his editor/publisher could even be considered perhaps privileged and not in violation? Desperate measures indeed and really done to delay the book if the injunction is lifted soon deed. I hope Amaral throws everything at them as he has now nothing to lose now as they have sunk to the depths.

Isabel also stated in court today that Goncalos documentary was shown in Portugal on Madeleines birthday, a complete LIE the documentary was shwon in April and Madeleines birthday is 12 May, get out of that one Kate & Gerry!

They are truly desperate. Come on British press for once report the true facts about this case.
