Hi all I have just updated with this pic which Dolores sent to me of a foreign couple being driven to police station on 10 May by PJ - does anyone know any more about who these witnesses may be? Viv x

Hi All and what a remarkable turn around for Clarence Mitchell. As soon as he realises the negative impact of his announcement the McCanns will not celebrate Madeleine' birthday we get a contradictory headline saying they will, but Gerry has some appointments. This must rate as one his least slick performances in the press to date! "Sadly for them it is just another day without Madeleine" was meant to make us feel sorry for THEM! Wrong again, Clarence! See the way these two completely contradictory headlines come up on a news search..is this really what you call manipulating the media Clarence!








I was beginning to think M3 got the push, but in the second article it would seem they are the mystery investigators continuing to follow up "potential" leads of Madeleine's "apparent" abduction. Since September 2007 I have yet to see any potential leads emanating from M3 or the rest of Team McCann. Of course Clarence does not want to go into detail about all of these leads...Now I cannot imagine why not...(!!)




Although their new hotline does sound like an attempt to pervert the course of justice by interfering in the police investigation, it seems to me it will not, because, as ever, the McCanns only want to talk to people who can give information to feed their fantasty investigation about "abduction" so the proper police witnesses will not be bothering to call. I am sure that by now both Leicestershire Police and PJ have learned to completely ignore this rubbish and not be distracted from the proper investigation. This has as much to do with the McCanns wanting to rubbish Portuguese Police by stating they did not follow up leads from celebrity grabbing hoaxers such as Gran Cooper..maybe they had something better to do!

The parents of missing Madeleine McCann will not mark her fifth birthday today – describing it as 'just another day' without their daughter.
Kate and Gerry McCann vowed to not do anything special on the grim milestone and continue to search for their little girl.
'Gerry will be at work and Kate will be at or around home,' said their spokesman, Clarence Mitchell.
'Sadly for them, it is just another day without Madeleine.'

The McCanns believe the intense publicity which has surrounded their daughter's disappearance will fade away after her birthday.

Madeleine McCann's parents were marking their missing daughter's fifth birthday privately at home today.
A low-key party was being held for the benefit of her younger brother and sister, three-year-old twins Sean and Amelie, yet it was "just another day without her" for Gerry and Kate McCann, said their spokesman.
He said: "Obviously, without Madeleine home yet, this is sadly just another day without her in many respects.
"Gerry and Kate will, of course, mark her fifth birthday, as much for Sean and Amelie's benefit as anything else, but they will do this privately within the family."

Relatives were expected to visit the McCanns' home in Rothley, Leicestershire, today.
Mr McCann, a consultant cardiologist at Leicester's Glenfield Hospital, has a number of clinical appointments but he and his wife were due to be together at home for some part of the day.
"They will not be doing anything in public other than reiterating the need for anybody with information to please come forward
and contact our new phone line launched earlier this month - 0845 838 4699," said Mr Mitchell.
"We have had a very, very good and encouraging response so far. The emails have run into thousands and there have been hundreds of calls."
After more than a year of potential leads and reported sightings of their daughter, the McCanns take news of fresh information in their stride.
But Mr Mitchell said Metodo 3, the private investigation firm working on their behalf, was following up several promising leads, submitted after the campaign launch, "with some degree of urgency". He would not go into detail about those leads.
The McCanns want anyone with information about Madeleine to call them on 0845 838 4699 or email investigation@findmadeleine.com or anonymous@findmadeleine.com.


The couple could, however, report that their recent appeal for information has drawn thousands of emails and hundreds of phone calls.

We have no space in our Diary to accommodate a reconstruction for our lovey Margaret as we are too busy working on Strategies, Agendas, Marketing Ploys, PR, On Line Shop, Amber Alert (make this world a better place for dumped children) and Risk Assessments etc to take part in something that is a waste of time as far as we are concerned. However if you let us write the script and our dear pal Jonny film it in the UK then no probs, we will forward the bill to the PJ prompt payment please upon receipt.


Shame on them for not participating in an official reconstruction that might actually determine what happened to the child they left alone in a holiday flat with her 2 year old twin siblings night after night. IMHO.
No wonder the extension was granted.

Hiya all

with the reconstruction I wonder if the PJ will just invite everyone and even if they do not turn up it will go ahead and conclusions drawn from that exercise without their input. I think they are caught between the devil and the deep. If they do turn up their lies and the impossibility of what they are saying will be shown up, but if they do not then what other witnesses say will be taken to be accurate and they will not have the chance to change that. Either way they are going to be charged. The PJ know they are guilty but give them just one last chance to turn up and prove their innocence. If they do not then the obvious inferences will be drawn from that. That is the way the operation of the law of evidence generally works. Someone states what you are alleged to have done, if you cannot provide a reasonable explanation then inferences of guilt can be drawn from that failure to explain. It will be just one more piece of evidence against the McCanns. Only guilty people refuse to offer any explanation. I believe the PJ will video the reconstruction and produce it in court. I also believe they have a number of witnesses who will go towards proving that what the McCanns and their friends are saying is a pack of lies.

Many pregnant defendants are still put on trial and incarcerated. Pregnancy is not an illness in itself. Even if Kate is ill as a result of her pregnancy the best it could do would delay any trial, it would not prevent it.

I do wonder though if her extradition lawyer may say she is too ill, mentally, to face extradition and trial. Even if he did I wonder whether this would be successful. Normally we will allow extradition to take place, providing we can get safeguards the accused will be treated fairly e.g. allowing adequate breaks in the trial process and psychiatric care etc. being mentally ill does not stop defendants from being put on trial (except in the case of murder where the defendant would be found guilty instead of manslaughter .. he lacked the capacity by reason of insanity from forming the mental intent to commit murder), and there is still the prospect they could face trial in the UK.

ROB Thanks for the link to the BBC article which I post below. This is a great example of how the media are supposed to report. They simply state the facts so that they do not prejudice any impending trial of the McCanns. People have to use their judgment as to what it is actually telling them but I think my prediction may be right by September they will be charged, in the meantime Murat has to be kept quiet. The McCanns know they are guilty and they know that the police know that too. They make one last desperate plea to see the file prior to having their arguido status renewed which they knew full well was coming!

Judge extends Madeleine secrecy

A Portuguese judge overseeing the Madeleine McCann inquiry has extended judicial secrecy by a further three months, court officials have confirmed.

The files would otherwise have been open for consultation from Thursday by those involved in the case, including Madeleine's parents, Kate and Gerry.

They are formal suspects, as is Briton Robert Murat, but all deny involvement.

Madeleine, of Rothley, Leicestershire, disappeared from a holiday apartment in the Algarve on 3 May last year.

Secrecy rules loosened

The decision by the judge, which was widely expected, follows a request from prosecutors in the case.

It means that neither the formal suspects in the case nor other interested parties, including the media, can gain access to details of the investigations until mid-August.

Most Portuguese legal experts are reported to believe that legislation that took effect last year, loosening Portugal's strict secrecy rules, will not permit yet another extension.

The McCanns were officially named suspects, known in Portugal as being given "arguido" status, in September.

They launched a new campaign for information ahead of the first anniversary of Madeleine's disappearance.

They had also called on Portuguese detectives to open their files, so they could find out what leads were being pursued.

It did occur to me after I made that post that should her lawyers wish to try and make such a plea she has just provided very powerful evidence against such a conclusion by taking part in 18 media reports and travelling to Brussels and the States etc.Clearly not the conduct of someone who is seriously mentally ill. From that I think we have to conclude no such attempt to avoid extradition would be made.

Doing a disappearing act is another way to avoid extradition, but somehow I just dont see them doing that. Although who knows, all that money would help them to disappear! They are clearly very desperate to avoid being incarcerated so it is an option we cannot rule out, but what of the twins. Would they dump them on relatives and then disappear?

The media do not have to print anything favourable to the McCanns, they can simply give a bald version of the facts as here and I think it is a very responsible piece of journalism with a clear message..

Seising of passports would come under bail conditions and that is a very difficult one because the McCanns are not in the jurisdiction of Portugal. I am not sure I know the answer to that because you would need to have very detailed legal knowledge about international law and how it interacts across different jurisdictions which I do not have. In short you would need to be someone like Mr Caplan and I am not up there!

Thinking it through can you imagine any UK port allowing the McCanns to leave if they produced their passports? Criminals who seek to escape have to get false ones or maybe they could just leave by private plane or boat. The McCanns do have bail conditions from the Portuguese that they cannot leave their home address for more than 5 days without informing the police and our own police would enforce that I believe and be keeping an eye on them. There always seem to be police in the road. Ostensibly this is to protect the McCanns and I accept there may be a few complete nutcases they need protecting from, but it would also almost certainly be to keep an eye on them.

Both Murat and the McCanns have these conditions as to residence, it is a pretty standard bail condition. There are clearly more stringent bail conditions that could have been placed on them, e.g they could have been detained in custody or prevented from leaving Portugal and had to stay at one address with daily reporting to the police there. This is where I think they had a lot of help to enable them to get out quick.

In Portugal do they have such a thing as a Public Enquiry. Once this case has progressed to conviction, would Portugal publically want an explanation as to why they had their hands tied in this case. I do think one day they deserve a very public apology from the UK.

I have the feeling from what I have head that Socrates and Brown have worked together to avoid /reduce political damage in this case. Portugal is one of our oldest allies and maintaining good relationships would be considered extremely important. I do not think Portugal would go for so openly and publically blaming the UK. In any event if, as you say, the McCanns are charged and convicted what could we be blamed for?

If reports are true that the UK held up the processing of the rogatory letters and in the initial days provided a quick escape route for them before the PJ had a chance to complete the enquiry as it happened over a weekend, then the British Goverment could be seen to having unnecessarily interfered with a serious investigation, IMO.

I’ve been thinking about the questions Kate would not answer and the trip back to Portugal for the reconstruction.

The McCanns lawyers would probably have encouraged them to answer most questions as long as they didn’t incriminate them. Which of course the questions wouldn’t if they had done nothing wrong. So as Kate did not answer a number of questions the inference we can draw is that they she was advised by her lawyers not to answer certain question which means there is something to hide.

The McCanns Portuguese lawyer says he does not know yet if the McCanns will return for the reconstruction. I again think their lawyers will advise them not to return as it will incriminate them. So again the inference that can be drawn, if they do not return, is again that they have something to hide.

Imo opinion if they return to Portugal and take part in the reconstruction they will be arrested whilst on Portuguese soil to prevent long drawn out extradition laws. Which no doubt the McCanns will fight tooth and nail.

I may be wrong but I’ve always thought the pj have drawn this out to make the McCanns nervous and angry. In that state, they might make a slip and for all we know they may have done so.

I’ve just taken this from 10th May 07 – Mccannfiles.com – does this confuse matters? The last paragraph is interesting though who are the English couple referred to – does anyone know?

He told detectives that he saw a man of English appearance photographing his daughter, described as strikingly similar in appearance to Madeleine, on April 30 in Sagres, a town just a few miles from the holiday complex where the McCann family was staying.

The witness, who with his German wife has two children aged two and four, said he chased the man, who fled, jumping into a car with a woman and another man before speeding off. Mr Lourenco is believed to have provided the authorities with a photograph taken on his mobile phone. The witness has told officers he was "100 per cent certain" they were the same people caught on CCTV with the girl matching Madeleine's description hours after she went missing.

An image of a pair of pyjamas, identical to those which Madeleine had been wearing when she disappeared, is released.

The McCanns spend most of the afternoon and evening being questioned at the police station in Portimao: Kate is questioned for 9 hours and Gerry is questioned for 14 hours, eventually leaving the station at 3.00am in the morning.

While the McCanns were at the headquarters, according to local media reports, another British couple were interviewed at the same station. They were not arrested and were driven from the station concealed by a blanket.

I wonder why the German witnesses have been rarely mentioned and sort of kept under wraps - no pictures of them in the newspapers in the UK as far as I know; could it be the PJ's are keeping some vital evidence from them as far away from the media as they can? And perhaps those witnesses will be their ace in the hole at the reconstruction!

K&G have said they won't go unless it is filmed as a Crimewatch programme, obviously because not only will they make more money that way, they will get another chance to pretend how absolutely devastated they are by it all and put on a first rate act for the million viewers who will be watching. I can't see the PJ's agreeing to that somehow and why should they put themselves out for the McCanns when they have done everything they can to put them down in the minds of the public?

What I find interesting about this extract is the fact the McCanns were being subjected to intensive grilling by the police only one week after Madeleine went!

Given the number of hours they were detained and the fact there was a release at 3 am they were being treated as suspects, not witnesses !

You know what I think this other UK couple gave damning evidence against the McCanns and were took in to give a statement at the same time as the McCanns were taken in for a grilling on the basis of it. The witnesses got covered by a blanket to protect them and their identity from being released to the media. It sounds to me that within a week the PJ had some very powerful evidence against the McCanns..

Hi Germans are very frequent visitors to Portugal so it is likely they are fellow holidaymakers who have given damning evidence. But the first woman that can be seen in the pic above looks like a local to me in that she is distinctly Portuguese/Spanish natural skin colour.

I think the PJ's are much more on the ball than most people realise and I reckon they have plenty to throw at the McCanns when the time is right.

I imagine there will be a few daggers pointed at the PJ's by CM tomorrow in the papers regarding the 3 month extension on the arguido status and also about the reconstruction on the 29th! I bet the McCann team are at this very moment thinking up a plan of action!

Thanks for the link to the BBC article. For once they have printed exactly as is, instead of leaning over backwards to try and put the McCanns in a good light.

Let's hope this is a step towards the media throwing off their cowardly image as far as the McCanns are concerned. Maybe they are beginning to realise they are just going to end up with egg on their face if they continue with their sycophantic leanings towards the McCanns!

Only one reporter so far and that is Jon Gaunt of The Sun (a newspaper I would normally not touch with a barge pole) has had the courage of his convictions in this case.

I imagine if and when this case does go to Court the lawyers will have crates of witness statements!
What wouldn't I give to be on the jury to see the Tapas 9 tie themselves in knots!

I am a Protestant by upbringing; Methodist; the 'militant daughter of the church'. I am someting else by life's experience, although my family and my faith determined what I am.

My mother was raised in an ardent Catholic family, descended from Irish and Spanish stock, although she married into a Protestant family, and chose to convert.

Maybe that's why I feel for Kate and Gerry, although I think for Madeleine. I act for children, not errant adults. I write for adults, free speech, the ongoing inquiry into one question: admidst life's woes, what do we choose to be, and to do? It is our choice. We are no one's toy.

Good evening all

Tylersmum had a good point on 3As about Jane Tanner seeing Maddie supposedly carried off.

Seeing the position of the bed in apartment 3A, the abductor would have had to pick Maddie up with head to the right and feet to the left, but Jane Tanner described the abductor as having Maddie the other way round.

IMO there would then have to be two abductors but Jane only saw one!!! So, are we to assume another was waiting outside the window, would Maddie not have woken up being passed out into the cold air??

This all seems to be wrong to me unless, she was drugged.

I'm popping in and out of here in between other stuff today.

Yes; I'm sure the witness statements are already bursting at the seams on the PJ's files too! The McCanns know that and that's why they are trying to get hold of whatever documents they can to prepare their defence if, and it's a big but possible if, the time comes when they feel they need to.

Regarding the McCann's turning to their Catholocism, I think they may very well decide to do that but only when things start to look a bit dodgy for them! According to K's mother they were not practising Catholics. They went to the local Church in PdeL for comfort but then when back in the UK they just turned their backs on the priest who comforted them.

Let's face it,they've had a year to assuage their guilt with the Almighty but it seems the most important thing to them is that pot of gold on the horizon not their faith which might be able to move mountains but not these two it seems. Sorry if I sound cynical Leigh! Of course, it's never too late for anyone!

The McCanns and their legal team had hoped restrictions on the release of the file from the inquiry in Portugal would be lifted tomorrow.

The move now means Gerry and Kate, who were named as formal suspects in their daughter's disappearance, face a summer of uncertainty over what police have done to find their daughter.
The couple, from Rothley in Leicestershire, became so frustrated at the dearth of information on the inquiry that they urged anyone who came forward as part of the official investigation to contact them.
They had hoped that the police dossier would be made public this month.
According to Portugal's new penal code, the initial period of secrecy for an investigation now lasts eight months, at which point details of evidence and interviews can be made public.
It is understood this period is being interpreted by judges as eight months on from September 15 last year, the date the code was changed.
But the McCanns' lawyers have told them that the Portuguese authorities can grant two three-month extensions.
It is thought this could leave the couple in the dark until November 15, when prosecutors must decide if they are charging them.
The couple's spokesman, Clarence Mitchell, said: "We cannot comment on reports in Portugal that the judicial secrecy period has been extended by another three months as Kate and Gerry's legal advisors have yet to be officially informed of any such decision.
"However, if it's the case, it's clearly disappointing and Kate and Gerry's lawyers will of course continue to press for the opening of the police file.
"You have to ask yourself how the period of secrecy remaining in place for such a long time actually does anything to help find Madeleine."
Interpol is reportedly investigating a possible sighting of Madeleine on a plane to Sao Paulo.
Mr Mitchell added: "As always, Kate and Gerry are not investing emotions in this. They want to hear from authorities or from our own investigative arm as to whether such sightings have any validity or not."”

You are right about the way Madeleine would have been carried if the bed was in the same position as in the NOTW video, but I seem to remember seeing Madeleine's bed next to the twins when videos first came out about the supposed abduction.

In my humble opinion the only way Madeleine could have been abducted was if the McCanns and their friends were lying about time checks and if it's true they didn't have watches and mobile phones, how the heck did they know what time they checked anyway. Not all bars have clocks on the wall!

I agree that it is never too late for anyone, and I agree with your implied criticism: the McCanns are 'convenient converts'. There is no sincerity in their association with the Catholic faith. They use it when it suits them.

I'll stop now. The memory of Father Pacheco and His Holiness makes me emotional. Emotion will not resolve this case. Tough minds will, aided by tender hearts who need our protection.

Don't get me started about no watches and mobiles. As I pointed out when this statement was made by the pink Mr Blobby, I have yet to see one picture of any of the Tapas without a watch, also the evidence from the staff at the Tapas bar was if I remember correctly, Gerry spent most of the evening on his mobile!! Says it all really.

In the past the Daily Mail have seemed to leave no stone unturned to side with the McCanns, but I notice the comments made by the public are these days mostly anti, so perhaps they are being deluged with protests at the way they have reported this case.

Just who do the McCanns think they are to try to dictate to the PJ's what documents they should be allowed to see or not. Lawyers of course, if the case is in their own territory are entitled to have sight of documents, but this crime happened in Portugal and the McCann camp should remember that! And they should start co-operating themselves as that DM reader said!

Guilhem Buttut, an investigative reporter for the newspaper, said he had seen "hard evidence" about Madeleine's death in a report now in the hands of Portuguese prosecutors, the metro.co.uk news website reported.
Buttut said toxicological tests on the liquids "proved the little girl had ingested medicines, without doubt sleeping pills, in quantities large enough to cause an overdose".
Sources close to the investigation said earlier this week that police discovered an 88 per cent DNA match to Madeleine in the boot of the McCanns' rented Renault Scenic.
It was also reported that hair was found in the boot, allegedly showing that her body had been in it.
The McCanns are reportedly planning their own independent forensic tests on the hire car.

A family friend said the car was being kept in a "safe place", believed to be a pound at Faro airport in Portugal, The Independent newspaper reported today.

The latest revelations come as Portuguese media reported that police wanted to question Madeleine's mother Kate yet again.
Sources close to the McCanns said they were not aware of plans for a second interrogation.
Police may also quiz her about her diary, which police are seeking, along with her husband Gerry's laptop computer.
There are suggestions the diary has already been seen by detectives who took photocopies but police want to examine it in more detail.
Overnight, a warrant was passed from Portuguese authorities to British police to go to the McCanns' home in Rothley, Leicestershire, as early as today.

Portuguese newspapers said yesterday that they had seen the photocopies of extracts.

Correio da Manha said Mrs McCann wrote in the diary that her children were "hysterical" and exhausted her.
It also said her husband gave her little help with family chores.
"She complains frequently that her children are 'hysterical' and speaks of Madeleine as a child whose excess activity exhausts her," the paper said.
The daily Publico said Mrs McCann's worries about her children's behaviour and her difficulties disciplining them were contained in the diary.
Social workers have also visited the MCanns to discuss the welfare of the couple's two-year-old twins Sean and Amelie.
It is standard practice for a mother or father named as a suspect overseas to have their case considered by British authorities.

Let us hope so but as I said a dangerous time because anyone who has done what they have to cover actions is very likely (IMO) to strike out in a defiant way which will make further headlines. You asked for an explanation, so this is it, although I would rather not give it.

When people suspected of heinous crimes use sophisticated methods to evade honest inquiry, it is usually because their egos cannot accept that they are capable of wrong doing.

We are all capable of wrong doing. That is the human condition. That is something most of us learn at an early age. We learn humility. We learn to aplogosise, make amends, and accept forgiveness.

People who cannot do that are likely to take extreme measures when they fear being found out.

ECOLAB could tell more on this subject, I suspect. She is a professional in this area.

I'm just telling you what I know from practical experience; not academia.

Sorry, Di. This is a 'dangerous time' for Kate, Gerry, Sean and Amelie, as baththeory says.

No journalist would want to be the cause of someone's death. I said last year on the DE that the McCanns should be on 'suicide watch'. They cannot accept responsibility for their actions.

They need a better defence than they have received so far, I think. They are getting no sincere, independent help. They are getting the sycophantic, cynical, mercenary assistance that will drive them to desperate actions.

Only Kate's Mum speaks the truth, in my opinion. Only Kate's Mum cares enough to speak for Kate.

The reason I want this couple investigated in a courtroom is because in life I believe their is a moral force that some times sways and sometimes falls away. When it does so it sucks the life out of me and many others.

However, it usually triumphs even if it takes time to show.

I would love such a moral force to show itself legally and then I will feel that a 3yr old's life was not in vain and the world I am bringing my two children into is worth it.

The NSPCC and CVOC are two UK charities, dedicated to the protection of all children; they are all worth it - with or without court proceedings, in my opinion.

The UK Govt and media need these charities more than they need the McCanns - and they all know that.

Rogério Alves (one of their Portuguese lawyers) said that Kate and Gerry are willing to return but that it does not depend only on them because their friends also have to be here. I bet that is going to be their next excuse: well, we really want to go, but 'our friends' don't so there's no need to because there will be no reconstruction. :-)

Portugal, with a population of approximately 10.6 million, is a constitutional democracy with a president, a prime minister, and a parliament elected in multiparty elections. National parliamentary elections in February 2005 were free and fair. Civilian authorities generally maintained effective control of the security forces.

The government generally respected the human rights of its citizens; however, there were problems in some areas. Police and prison guards occasionally beat and abused detainees, and prison conditions remained poor. Lengthy pretrial and preventive detention remained a problem. Violence against women and children were problems. There was discrimination against women and ethnic minorities, and trafficking for forced labor and for sexual exploitation.

RESPECT FOR HUMAN RIGHTS

Section 1 Respect for the Integrity of the Person, Including Freedom From:

a. Arbitrary or Unlawful Deprivation of Life

There were no reports that the government or its agents committed arbitrary or unlawful killings.

b. Disappearance

There were no reports of politically motivated disappearances.

c. Torture and Other Cruel, Inhuman, or Degrading

Treatment or Punishment

The constitution and law prohibit such practices; however, there were credible reports of disproportionate use of force by police and of mistreatment and other forms of abuse of detainees by prison guards.

During the year the Inspectorate General of Internal Administration (IGAI) investigated new reports of mistreatment and abuse by police and prison guards.

Prison and Detention Center Conditions

Prison conditions remained poor, and guards continued to mistreat prisoners occasionally. Other problems included overcrowding, inadequate facilities, poor health conditions, and violence among inmates.

Most of the guidelines and legislative proposals the government adopted in 2004 to reform the prison system had not been applied in practice. However, some improvements were made during the year, including a decrease in prison overcrowding and continued personnel training.


According to the director general for prisons, approximately 35 percent of the 11,875 total prison population was infected with HIV/AIDS or hepatitis B or C or both. The largest number (at least 20 percent) were infected with hepatitis C, while at least 10 percent were infected with HIV/AIDS. According to the directorate general for prisons, 91 persons died in prisons during 2006, 74 from illness; 14 were reported to have been suicides. The government's AIDS prevention and treatment program continued in two major prisons on a three‑year trial basis, and the prison service instituted a needle exchange program.

Although there was a youth prison in Leiria, at times juveniles were held with adults elsewhere in the prison system. Pretrial detainees were held with convicted criminals.

The government permitted visits by independent human rights observers, and prisons were visited during the year by the Human Rights Committee of the Portuguese Bar Association and by news media for spot reports and articles. The country also cooperated with the International Committee of the Red Cross; the director general of the ICRC, Angelo Gnaedinger, visited Lisbon in October for a conference on humanitarian principles.

d. Arbitrary Arrest or Detention

The constitution and law prohibit arbitrary arrest and detention, and the government generally observed these prohibitions.

Role of the Police and Security Apparatus

There were approximately 50,000 law enforcement officials, including police and prison guards. The ministries of justice and internal administration are primarily responsible for internal security. The Republican National Guard (GNR) has jurisdiction outside cities, and the Public Security Police (PSP) has jurisdiction in cities. The Aliens and Borders Service has jurisdiction over immigration and border issues.

There were media reports that some members of the security forces committed human rights abuses. In 2005 the IGAI received 207 complaints of human rights abuses. The majority of complaints were against the PSP and the GNR (118 and 76, respectively). The complaints included physical abuse, threatening use of firearms, excessive use of force, illegal detention, and abuse of power. Each complaint is investigated by the IGAI, and punishment for officers found to have committed abuses ranges from temporary suspension to prison sentences.

The major problems within the police forces were understaffing, insufficient training with firearms, and inconsistent or weak law enforcement. Police corruption was an isolated problem. During the year police officers received professional training, and the government regulated their actions through mechanisms established by law.

An independent ombudsman chosen by the parliament and the IGAI investigates complaints of abuse or mistreatment by police; however, nongovernmental organizations (NGOs) criticized the slow pace of investigations and the lack of an independent oversight agency to monitor the IGAI and Ministry of Interior.

Arrest and Detention

The constitution and law provide detailed guidelines covering all aspects of arrest and custody, and the authorities generally followed the guidelines. Persons can be arrested only based on a judicial warrant, except that law enforcement officials and citizens may make warrantless arrests when where there is probable cause that a crime has been or is being committed or that the person to be arrested is an escaped convict or a suspect who escaped from police custody.

Under the law an investigating judge determines whether an arrested person should be detained, released on bail, or released outright. A suspect may not be held for more than 48 hours without appearing before an investigating judge. Changes in the penal code went into effect on September 15. Under the new regulations, investigative detention for most crimes is limited to a maximum of four months for each suspected crime; if a formal charge is not filed within that period, a detainee must be released. In cases of serious crimes, such as murder, armed robbery, terrorism, and violent or organized crime, or crimes involving more than one suspect, investigative detention may last up to 18 months and may be extended by a judge to three years in extraordinary circumstances. A suspect in investigative detention must be brought to trial within 14 months of being charged formally. If a suspect is not in detention, there is no specified deadline for going to trial. Detainees have access to lawyers from time of arrest, and the government assumes any necessary legal costs for indigent detainees.

Lengthy pretrial detention remained a problem, although the authorities made some progress reducing the length of time persons were detained before trial. As of December 15, 2,454 individuals (21 percent of the prison population) were in preventive detention, a decrease of 3 percent from the previous year. The average detention time was eight months (down from 26 months), while approximately 20 percent of preventive detainees spent more than one year in incarceration.

e. Denial of Fair Public Trial

The constitution and law provide for an independent judiciary, and the government generally respected judicial independence in practice.


Critics, including the media, business corporations, and legal observers, estimated the backlog of cases awaiting trial was at least a year.

Trial Procedures

Jury trials can be requested in criminal cases but were rare. Civil cases do not have jury trials. Defendants are presumed innocent and have the right to consult with an attorney in a timely manner, at government expense if needed, and the right of appeal. They can confront and question witnesses against them, present evidence on their behalf, and have access to government‑held evidence. These rights were generally respected in practice.

Political Prisoners and Detainees

There were no reports of political prisoners or detainees.

Civil Judicial Procedures and Remedies

There is an independent and impartial judiciary in civil matters. Citizens have access to a court to bring lawsuits seeking damages for, or cessation of, a human rights violation. There are administrative as well as judicial remedies for alleged wrongs.

f. Arbitrary Interference with Privacy, Family, Home, or

Correspondence

The constitution and law prohibit such actions, and the government generally respected these prohibitions in practice.



Section 2 Respect for Civil Liberties, Including:

a. Freedom of Speech and Press

The constitution and law provide for freedom of speech and of the press, and the government generally respected these rights. An independent press and judiciary and a functioning democratic political system combined to ensure freedom of speech and of the press.

Internet Freedom

There were no government restrictions on access to the Internet or reports that the government monitored e‑mail or Internet chat rooms. Individuals and groups could engage in the peaceful expression of views via the Internet, including e-mail. According to a December survey by the National Statistics Institute, 40 percent of the population between the ages of 16 and 74 used the Internet; however, the rate increased to 81 and 90 percent for high school and university graduates, respectively. Internet access was available in all public elementary and high schools. All federal government offices and 97 percent of hospitals had Internet access.

Academic Freedom and Cultural Events

There were no government restrictions on academic freedom or cultural events.

b. Freedom of Peaceful Assembly and Association

The constitution and law provide for freedom of assembly and association, and the government generally respected these rights in practice.

c. Freedom of Religion

The constitution and law provide for freedom of religion, and the government generally respected this right.

The law provides a legislative framework for religious groups either established in the country for at least 30 years or recognized internationally for at least 60 years. Qualifying religious groups receive benefits including full tax‑exempt status, legal recognition to perform marriages and other rites, permission for chaplain visits to prisons and hospitals, and recognition of their traditional holidays.

The Roman Catholic Church maintains an agreement with the government that recognizes the legal status of the Portuguese Episcopal Conference, and allows citizens to donate 0.5 percent of their annual income taxes to the Roman Catholic Church.

Legislation approved on June 28 gives marriages performed by well‑established non‑Catholic groups legal status equivalent to civil ceremonies. Religious groups such as Jews, Muslims, Baha'is, Evangelicals, and Adventists may now marry within their own religious communities without also having to register in the civil registry. Previously, only Catholic marriages were automatically recognized as legal.

Also on June 28, the government appointed former prime minister Mario Soares as chairman of the Religious Freedom Committee, the first time a non‑Catholic was named to this position; Soares is agnostic.

In November the government officially recognized Scientology as a religion.

Societal Abuses and Discrimination

The Jewish population was estimated at 3,000. On September 25, approximately 20 tombstones in Lisbon's Jewish cemetery were vandalized. Two youths, aged 16 and 24, were arrested; they were released with restrictions on their movement and were awaiting trial at year's end. On October 6, government ministers, members of parliament, and Muslim, Christian, and Baha'i religious leaders gathered in Lisbon to demonstrate solidarity with the Jewish community. The speakers strongly denounced the incident and the minister of the interior declared "today, we are all Jews." The parliament approved resolutions condemning the vandalism and underscoring that the constitution guarantees full rights and freedoms to Jews.

d. Freedom of Movement, Internally Displaced Persons, Protection of Refugees, and Stateless Persons

The constitution and law provide for freedom of movement within the country, foreign travel, emigration, and repatriation, and the government generally respected these rights in practice. The government cooperated with the Office of the UN High Commissioner for Refugees and other humanitarian organizations in providing protection and assistance to refugees, returning refugees, asylum seekers, stateless persons, and other persons of concern.

The law prohibits forced exile, and the government did not employ it.

Protection of Refugees

The law provides for the granting of asylum or refugee status in accordance with the 1951 UN Convention relating to the Status of Refugees and its 1967 protocol, and the government has established a system for providing protection to refugees. In practice the government provided protection against "refoulement," the return of persons to a country where there is reason to believe they feared persecution. The government granted refugee status or asylum.

The country's system for granting refugee status was active and accessible. In addition to refugees and applicants for political asylum, the government also provides temporary protection to individuals who may not qualify as refugees under the 1951 convention and its 1967 protocol. In 2006 the country granted humanitarian protection to seven persons, and granted asylum to 23 persons.




Section 3 Respect for Political Rights: The Right of Citizens to Change Their Government

The constitution and law provide citizens with the right to change their government peacefully, and citizens exercised this right in practice through periodic, free, and fair elections based on universal suffrage.

Elections and Political Participation

Free and fair national parliamentary elections were held in 2005. Political parties could operate without restriction or outside interference.

There were 64 women in the 230‑member parliament and two women in the cabinet. There was one member of a minority group in the parliament; there were none in the cabinet.

Government Corruption and Transparency

The law provides criminal penalties for official corruption, and the government generally implemented these laws effectively. There were no reports of corruption in the executive or legislative branches of the central government during the year; however, there were media reports of corruption involving local government officials. The highest‑profile corruption cases involved mayors Fatima Felgueiras, Valentim Loureiro, and Isaltino Morais. Felgueiras (Socialist Party), who went abroad from 2003‑05 to escape arrest, was accused of embezzlement and abuse of power, and was being tried in court at year's end. Loureiro, a Social Democratic Party (PSD) mayor and chairman of the board of the Portuguese professional soccer league, was accused of corruption and influencing of referees in Portuguese soccer; his trial was scheduled to begin in February 2008. Morais (PSD) was accused of tax evasion, corruption, and money laundering, and was awaiting trial.

Public officials were subject to financial disclosure laws. The Central Directorate for Combating Corruption, Fraud, and Economic and Financial Crime is the government agency responsible for combating corruption.


The constitution and law provide for public access to government information, and the government provided access in practice for citizens and noncitizens, including foreign media.



Section 4 Governmental Attitude Regarding International and Nongovernmental Investigation of Alleged Violations of Human Rights

A number of domestic and international human rights groups generally operated without government restriction, investigating and publishing their findings on human rights cases. Government officials were cooperative and responsive to their views; however, most of the groups continued to complain about the slow pace of investigations and remedial actions.

The country has an independent human rights ombudsman who is responsible for defending human rights, freedom, and the legitimate rights of all citizens. The ombudsman had adequate resources and published mandatory annual reports and special reports on such issues as women's rights, prisons, health, and the rights of children and senior citizens.

The parliament's First Committee for Constitutional Issues, Rights, and Liberties and Privileges, exercises oversight over human rights issues. It drafts and submits bills and petitions for parliamentary approval. During the year these included petitions to revise legislation on missing persons (including children) and to provide Internet access to the handicapped and elderly. Credible human rights NGOs considered the committee's work valuable.



Section 5 Discrimination, Societal Abuses, and Trafficking in Persons

The constitution and law prohibit discrimination based on race, gender, disability, language, and social status; however, discrimination against women and ethnic minorities persisted.

Women

The law makes rape, including spousal rape, illegal, and the government generally enforced these laws. Statistics were not available, however, for the number of persons prosecuted, convicted, or punished.

Violence against women, including domestic violence, continued to be a problem. Penalties for violence against women range up to 10 years' imprisonment, depending on the seriousness of the offense. Similarly, penalties for sexual harassment in the workplace range up to eight years. In 2005 the government established the Portuguese Structure against Domestic Violence, which launched a nationwide awareness campaign against domestic violence, trained health professionals, proposed legislation to improve legal assistance to victims, increased the number of safe houses for victims of domestic violence, and signed protocols with local authorities to assist victims. The government encouraged battered women to file complaints with the appropriate authorities, and simultaneously offered the victim protection against the abuser. In addition recent legislation allows third parties to file domestic violence reports. Authorities handled more complaints of violence during the year, but the increase may have been due to these measures to encourage reporting rather than an actual increase in violence against women.

During the first six months of the year, 8,387 cases of violence against women were reported to the Association for Victim Support (APAV); more than 86 percent of these involved domestic violence. The APAV is a nonprofit organization that provides confidential and free services nationwide to victims of any type of crime.

The law provides for criminal penalties in cases of violence by a spouse, and the judicial system prosecuted persons accused of abusing women; however, traditional societal attitudes still discouraged many battered women from using the judicial system.

According to the head of the government‑sponsored Mission Against Domestic Violence, approximately 10 percent of cases were brought to trial. The vast majority were resolved outside the court system by lawyers who mediated between the parties. In 2005, according to the Ministry of Justice, there were 870 court cases related to domestic violence and only 460 prosecutions.

The government's Commission for Equality and Women's Rights operated 14 safe houses for victims of domestic violence and maintained an around‑the‑clock telephone service. Safe‑house services included food, shelter, and health and legal assistance.

Prostitution was legal and common, and there were reports of violence against prostitutes. Pimping and running brothels are illegal and legally punishable. The new penal code raises the penalty for sex with minors between the ages of 14 and 18 from two years' to three years' imprisonment.

Sexual harassment is a crime if perpetrated by a superior in the workplace. The penalty is two to three years in prison.

The Commission on Equality in the Workplace and in Employment (CITE), which is composed of representatives of the government, employers' organizations, and labor unions, is empowered to examine, but not adjudicate, complaints of sexual harassment. Reporting of sexual harassment was on the rise. According to a 2004 study conducted by the Higher Institute for Labor and Entrepreneurial Sciences and published by CITE, one out of three women claimed that she had been a victim of sexual harassment, which ranged from offensive gazes to sexual propositions, insults, and threats of coerced or unwelcome touching.

The civil code provides women full legal equality with men; however, in practice women experienced economic and other forms of discrimination. Of the 367,312 students enrolled in higher education in the 2005‑06 school year, 55 percent were women. Women made up 62 percent of the working population and were increasingly represented in business, science, academia, and the professions, but their average salaries were about 23 percent lower than men's.

Discrimination by employers against pregnant workers and new mothers was a common problem.

Children

The government was strongly committed to children's rights and welfare. Nine years of compulsory, free, and universal education were provided for all children through the age of 15. Practically all children attended school; however, 31.1 percent dropped out before completing high school during the 2005‑06 school year. The government also provided preschool education for children age four and older.

Child abuse was a problem. The nonprofit APAV reported 287 crimes against children under 18 years old during the first six months of the year. Approximately 85 percent of the cases involved domestic violence.

The high‑profile trial that began in 2004 of persons accused of involvement in a pedophilia operation at the Casa Pia children's home in Lisbon continued at year's end. The eight accused reportedly abused 46 children and faced charges that included procurement, rape, sexual acts with adolescents, and sexual abuse of minors.


There were reports that Romani parents often used minor children for street begging.

Trafficking in Persons

The law prohibits all forms of trafficking in persons; however, there were reports that persons were trafficked to, from, and within the country.

Portugal is primarily a destination and transit country for women, men, and children trafficked from Brazil, Eastern Europe, and, to a lesser extent, Africa. Some victims were trafficked to the country for forced labor. The majority of victims from Brazil were trafficked for the purpose of sexual exploitation. An estimated 5,000 women, mostly Brazilians, were trafficked to the country annually.

Trafficked persons generally lived in hiding in poor conditions. Some trafficked workers were "housed" within a factory or construction site, and some were not paid. Moldovan, Russian, and Ukrainian organized crime groups reportedly conducted most of the trafficking of Eastern Europeans. The traffickers frequently demanded additional payments and a share of earnings following their victims' arrival in the country, usually under threat of physical harm. They often withheld the identification documents of the trafficked persons and threatened to harm family members who remained in the country of origin.

The government increased its antitrafficking efforts and reported that it actively dismantled trafficking networks during the year, and reduced their overall presence in the country. The government continued to cooperate with other European law enforcement agencies in trafficking investigations.

All forms of trafficking are illegal. The newly revised penal code, in effect since September, explicitly criminalizes labor and sex trafficking and increases penalties for both types of trafficking offenses. The penalty for trafficking is 12 years in prison.

The government provided subsidies for victims to obtain shelter, employment, education, access to medical services, and assistance in family reunification. The government also provided legal residency to many trafficking victims, although most victims were repatriated. Some NGOs assisted the government in tracking and providing legal, economic, and social assistance to trafficking victims. Victims who initially were detained were later transferred to NGOs for protection and assistance. The government operated 20 National Immigrant Support Centers throughout the country to provide immigrants, including trafficking victims, with multilingual information and assistance, and provided funds to enable NGOs to offer shelter and other assistance to trafficking and other victims.

The government sponsored antitrafficking information campaigns and public service announcements throughout the year. It broadcast various programs on state‑run channels to educate and inform the general public, including potential trafficking victims and consumers. A statistics‑gathering unit within the Ministry of Interior was established in January to assist the government's antitrafficking efforts by monitoring trafficking more effectively.

Persons with Disabilities

The law prohibits discrimination against persons with disabilities in employment, education, access to health care, or the provision of other state services, and the government effectively enforced the law. The law also mandates access to public buildings for such persons, and the government enforced these provisions in practice; however, no such legislation covers private businesses or other facilities.

The Ministry of Labor and Social Solidarity oversees the National Bureau for the Rehabilitation and Integration of Persons with Disabilities, which is responsible for the protection, professional training, rehabilitation, and integration of persons with disabilities, and for enforcement of related legislation.

Other Societal Abuses and Discrimination

There were no reports of societal violence or discrimination based on sexual orientation or against persons with HIV/AIDS.




Section 6 Worker Rights

a. The Right of Association

The law provides workers with the right to form or join unions of their choice without previous authorization or excessive requirements, and they exercised this right in practice. Approximately 35 percent of the total workforce was unionized.

b. The Right to Organize and Bargain Collectively

The law allows unions to conduct their activities without interference, and the government protected this right in practice.

The law provides for the right to strike, and workers exercised this right in practice. During the year there were strikes in the education, health, transportation, and agriculture sectors. If a long strike occurs in an essential sector such as justice, health, energy, or transportation, the government may order the strikers back to work for a specific period. The government has rarely invoked this power.

Police officers and members of the armed forces have unions and recourse within the legal system, but they may not strike.

There are no export processing zones.

c. Prohibition of Forced or Compulsory Labor

The law prohibits forced and compulsory labor, including by children; however, there were reports that women, men, and children were trafficked to the country for labor, and women were trafficked for sexual exploitation.

d. Prohibition of Child Labor and Minimum Age for Employment

The government effectively implemented laws and policies to protect children from exploitation in the workplace. The minimum working age is 16 years. There were instances of child labor, but the overall incidence was small and was concentrated geographically and by sector. The greatest problems were reported in Braga, Porto, and Faro, and tended to occur in the clothing, footwear, construction, and hotel industries.

The government's principal body to address, monitor, and respond to reports of illegal child labor is the Plan for the Elimination of Exploitation of Child Labor. The Ministry of Labor and Social Solidarity is responsible for enforcing child labor laws, and generally it did so effectively.

e. Acceptable Conditions of Work

The monthly minimum wage, which covers full‑time workers, rural workers, and domestic employees ages 18 and older, was approximately $588 (403 euros) and did not provide a decent standard of living for a worker and family. However, widespread rent controls and basic food and utility subsidies raised the standard of living. Most workers received higher wages; the Ministry of Labor estimated the average monthly salary of workers, excluding public servants, to be $1,190 (817.80 euros).

The legal workday could not exceed 10 hours, and the maximum workweek is 40 hours. There is a maximum of two hours of paid overtime per day and 200 hours of overtime per year, with a minimum of 12 hours between workdays. The Ministry of Labor and Social Solidarity effectively monitored compliance through its regional inspectors.

Employers are legally responsible for accidents at work and are required by law to carry accident insurance. The General Directorate of Hygiene and Labor Security develops safety standards in line with European Union standards, and the general labor inspectorate is responsible for their enforcement. According to the Inspectorate General for Labor, there were 160 deaths from work‑related accidents during the year. Workers injured on the job rarely initiated lawsuits. Workers have the right to remove themselves from situations that endanger health or safety without jeopardy to their employment, and the authorities effectively enforced this right.

If they really thought a paedophile has Madeleine, how dare they sleep at night, considering they themselves, made a bad judgement call and left the child alone!
It was only for "that minute" of course, because this is how long it took the abductor to "take" Madeleine.

Hell I would have walked to Portugal to assist the police to "free" my child from the damn paedophile.

The PJ has proposed the last week of May as a date to do the reconstruction of what happened at 3rd of May of 2007 in Praia da Luz. "If it is not done at that time, probably will not take place", explained a source connected to the process - "the secrecy of justice was enlarged till August and there is left only three months to conclude the enquiry and to elaborate the final report".

According to the same source "it was not possible to make the reenactment in the first date that was proposed (yesterday or today) because some claimed that the date was not feasible". Although the request for this proceed was made through the rogatory letters approved by the British justice - what obliges their fulfillment by the McCanns and friends - any of them can allege personal circumstances. "As to the new date, if someone alleges the impossibility of coming, we will see if he/she is someone essential to the reenactment to decide if it will be done or not".

So if the McCann's still refuse to go to Portugal, I would imagine it would be possible to continue with the reconstruction using someone else in their place.

I think the important people are the tapas 7, so as long as they attend I am sure all the discrepancies will become very obvious.

Of course you would go through hell to get your little child safely home, regardless if your life was put at risk or not, and so would any mother who is in grievous pain worrying about where her daughter is and what she is going through.

If Kate is so frail, just why is she always willing to gad about giving interviews, traveling to Brussels etc. It's far more stressful travelling by train and giving speeches at Conferences than getting on a free, no doubt first class, flight to Portugal!!

Excuses, lies, and guilt in my opinion! They should be damned well ashamed of themselves and I hope the press will let them know just what the majority of the public's reaction is to their reluctance to co-operate with the PJ's to help find Madeleine!

I can honestly say that is the first time I've seen Kate actually giving way to her emotions!! However, it doesn't change my mind that they are not telling the whole truth of what happened to Madeleine - there are too many other pictures of the pair of them laughing as if they haven't a care in the world! If she does ever show emotion, as in that video, I tend to think that she is crying for her own fears rather than about what is happening or has happened to Madeleine!

In one of the other videos linked on there she describes the bloggers who get some kind of kick out of hurting people!! Just what did they expect from the public when they jumped in their car and went off at high speed to Faro airport away from their daughter's plight, without actually searching themselves! this was to save their own necks after they were made arguidos, not long after proclaiming to the world they would leave no stone unturned!!

I just wish when watching these videos that the interviewers would give them their tuppance worth, as Judge Judy would if she had the chance! Although I have to say that Jane Hill made a brave attempt at it, whichis more than the men interviewers seem to!

Well Mr Pink I can answer your last sentence for you the period of secrecy has to remain under Portuguese law until the investigation is finished. The investigation is not finished and the Portugues police seem to think your employers are involved, therefore, by charging them the whereabouts of Madeleine might be found out sooner rather than later. They have the answers.

With regard to the reconstruction Clarence Mitchell says: “Kate, Gerry and friends are willing to take part. But why now, a year after she went missing? What is the value?”

Well Mr. Pink I’ll answer that one as well. As you know this re-enactment is to confront the various witnesses and highlight the discrepancies in statements they have given. The statements given a year ago still stand today. This could of course incriminate your employees so I perfectly understand why they do not wish to return.

Surely he would be asserting their innocence here, stamping his foot saying what the hell are the PJ doing by concentrating all their energies on them, these innocent victims of a child abduction?

But he just implies that Madeleine was abducted and, in doing so, seems to assume that everyone else thinks she was, too, and thus thinks the PJ are rubbish.

But this is contrary to what most people believe. So why is he so lame in asserting they had nothing to do with it?

And in Rat's video clip, what Kate doesn't say explain is why they WEREN'T out searching for their daughter. If Madeleine had wandered off, or been taken and abandoned, wouldn't they have had a better chance of finding her if they had been looking for her?

Wouldn't that have been the instant, frantic, AUTOMATIC thing that a parent of a missing child would do without thinking about it? So much so that wild horses couldn't have stopped them?

Just as there was an absence of good parenting here, the case against the McCanns seems to consist as much of an absence of normal behaviour as it does tangible evidence towards their complicity.

By the mere fact that the McCanns and the Pink Troll question the validity and value of a reconstruction is at odds with their apparent willingness to assist the PJ. The PJ as the investigating authority believe it will be of significant value so it is not down to the suspects to question the significance of such an event. What possible harm could it do, unless they were involved, alternatively if innocent it would hasten their release from Arguido status, and one would assume they would jump at the chance to clear themselves???

The parents of the missing child never physically looked for their daughter, they left others to do that. Yet all we hear from them and are expected to believe is there is no evidence to show M has come to any harm. Why do they keep repeating this? I find this strange language from parents who as they say 'know' their child has been abducted. Get your butts on a plane to PT and do the right thing is MHO. My own opinion is they do not return for fear of not being allowed to leave.

Plus there is always the chance they would be arrested whilst on Portuguese soil.

This is one of the rare times I've seen Kate(and Gerry) actually giving way to her(their) emotions.

BUT, BUT when there is a striking discrepancy between the sayings and the actions (when what you say at a certain moment, do not fit with what you do at this moment!), I feel convinced, that they are hiding a very dark secret!

A lawyer friend told me many years ago that liars need perfect memories; humans do not have perfect memories.

I suspect you know that. I'm just confirming your perspective on the video, and other matters.

It is obvious that the McCanns latest appeal centred on encouraging anyone who told anything to investigators to get in touch with them is a ploy in their desperate attempt to remind themselves, as much as inform themselves, of who said what and when.

A desperate act by desperate people, in my opinion (IMO!).

Another ploy doomed to fail, just like so many other diversion tactics.

When I ask Kate and Gerry to confess and I say the One True Faith awaits their honest confession, I do so because they claim to be devout Catholics, yet their actions say otherwise.

If they believe the Catholic church is the One True Faith, then they should abide by its morals, and give their true confession.

Beyond that, there is the ultimate One True Faith, I think. The faith in truth, and the pursuit of it, wherever it leads.

That is the One True Faith pursued by investigators, inquirers, the public, and their public servants (including the British diplomats who warned the UK Government against giving unquestioning, preferential aid to the McCanns last May and since then).

When wrongdoers are punished for lying over the death of Madeleine, there will be a long struggle ahead to repair the damage the McCanns have done to the reputation of the UK, diplomacy, and most importantly, the cause of child welfare - seriously undermined by the McCanns' expensive campaign to assuage their own guilt by maintaining that leaving infants unsupervised, night after night, was 'within the bounds of responsible parenting'.

It wasn't. It isn't. It endangers other children when the McCanns and their supporters persist with this lie, I think.

Ecolab: it may be that this sad story is truly in its death throes. Truth will out, I think.

Dumbo Rosiepops claims the United Kingdom have a good human rights record in comparison with Portugal. Unfortunately she shows what an ignorant fool she is, because had she troubled to check the link to HUDOC that I provided she would have seen that we are considerably worse than Portugal, who actually have virtually no cases recorded against them. I know of course that Rosie's talents for research do not go beyond reading the Sun, The News of the World and of course The People and adopting what they write as her brand of fact, which just shows what an uneducated moron she really is. Dungeon fiend Fritzl sneaked incest grand-daughter out of cellar for treatment while his wife was on holiday

Mr Wabl made similar allegations after Natascha's disappearance in 1998 but was fined for defamation.

He has now returned to the court seeking to have his criminal record erased.

He told the State Court in Graz: "I contacted the mother early on and something never felt right about her. I have dealt with numerous disappeared and abused children but I never met a mother who gave up hope so quickly. She was quite unique."

He produced a string of witnesses who painted Mrs Sirny as a dubious character, including one who insisted she had known Priklopil well and another who said she often hit her daughter.

Natascha disappeared on her way to school in March 1998 and Mrs Sirny, who was separated from the girl's father, was initially a suspect in the police inquiry.

Shortly afterwards, a Vienna newspaper published lurid photographs of Natascha, wearing lipstick and riding boots, brandishing a whip and showing her private parts, which had been found at Mrs Sirny's flat.

Amid public outrage, Mrs Sirny dismissed the photographs as "harmless horseplay".

But an eminent psychiatrist declared them to be "highly sexually charged and taken for the sexual delectation of the person behind the camera."

No charges were ever brought against Mrs Sirny, however.

The court heard from a neighbour called Anneliese Glaser, who once worked at a delicatessen owned by Mrs Sirny and claimed she had little time for her daughter.

She said that the day before Natascha disappeared she had returned from a trip to Hungary with her father, only to find the flat empty because her mother was out with friends.

"The next day she vanished. The police asked me: 'What do you think?' And I said either something happened that night or Sirny sold her.

"I never saw her abuse the child but she would come to me often and the red fingerprints of Sirny would be clearly visible in her face where she hit her.

"When Natascha resurfaced in 2006 I saw the picture of Priklopil and I recognised him instantly. He was at her shop with another man when I was there repairing the electrics."

Madeleine McCann has been missing for over six months and more DNA tests still point towards the parents as primary suspects.

New forensic tests support the overall theory that both Kate and Gerry McCann could have been involved in their daughter's disappearance. Even the prominent story they pitched to local authorities doesn't make much sense, but if we are to base truth upon facts, the DNS tests would provide that truth.

The second batch of tests, conducted at a laboratory in Birmingham, include the detection of the girl's DNA which is believed to be from Madeleine's bodily fluids and hair. The DNA was found in the McCanns' rental car which the natural parents drove 25 days after, she went missing. In other words, how did the body fluids and hair get there if they rented a clean automobile 25 days after the child went missing?

DNA experts say the bodily fluids found in the rental car came from a corpse and that the body was moved and the volume of absorbent material found is too great for it to have been transferred via Madeleine's toys, clothing or other items such as towels. Test experts also believe that the official results clearly show no definitive evidence to clearly indicate the direct involvement of any other person.

The McCanns were named as suspects by Portuguese police in September, soon after the first batch of forensic results were sent to Portugal.

But they strongly protest their innocence and insist their daughter was abducted as they dined with friends nearby. The real question is, why would you leave a three year-old at home alone in the first place?

Kate and Gerry McCann believe that the publication of the headline "PJ believes that the parents killed Maddie" put public opinion, world-wide, against them

The former director and a journalist of the extinct weekly newspaper "Tal&Qual" (T&Q) were formally accused of defamation by the parents of Madeleine McCann due to the publication, on 24th of August last year, of an article which read: "The PJ believes that the parents killed Maddie".

Emídio Fernando was heard yesterday afternoon, in the capacity of arguido, in the enquiry section of the PSP (Public Security Police), in the Avenida de Cintura do Porto de Lisboa. The journalist Catarina Vaz Guerreiro, author of the text for that front cover had already been heard, at the end of 2007.

Due to problems notifying the former director of "T&Q" it meant his hearing was only possible yesterday at the PSP inquest headquarters.

24horas knows that the McCanns - who at this procedural phase do not request any civil compensation – claim that the publication of that piece of news changed the perception of international public opinion, relative to their alleged involvement in the disappearance of their daughter.

Two weeks after the publication of the "T&Q" headline, Kate and Gerry were formally constituted as arguidos in the "Maddie case".

The McCanns logically should take the opportunity to clear their names by returning to PDL, assist the reconstruction, answer any outstanding questions that the PJ may have.

If after all this they are cleared, then sue who they like, but at this stage to be sniping at whoever and threatening to sue is just plain stupid, especially as they do not know what the PJ have against them and it could be devastating,(do not throw stones in a glasshouse) so it is not wise to rile others until they as the suspects are cleared, as this type of threat has worn very thin now. It is probably just another excuse not to return to PDL and public opinion according to the Pink Troll on RTE's The Late late show, had swung in their favour via the internet etc. so thats a contradiction for a start in their claim against T&Q.

I feel very sorry for Mrs Fenn. What must she have gone through listening to that poor child crying for so long. It was reported she heard her crying Daddy, Daddy. When a child feels they have been punished, and they want it to stop they would ask that person to stop. Did Madeleine feel she was being punished? Those cries will haunt Mrs Fenn forever. I hope someone offers her some kind of councelling.

The question also needs to be asked why did the Paine's take a baby monitor when they dined somewhere it was out of reach.

I do not want them getting off with neglect charges just because they had a baby monitor. They are as bad as the rest.

I would only take 2 or 3 minutes for a child to be in serious danger, ie., choking falling etc. no way even with a monitor would they reach them in time.

To be honest Stella I never believed that about Madeleine saying "Why didn't you........" They are focussing on 3 may. Remember the last photo also? People must believe that Madeleine was alive on the 3rd of may.

My opinion is that the lot of them should be charged.
To put it mildly, they were reckless and do not deserve any sympathy whatsoever.
My question is, why all these hot shot reportres haven't asked them about the Chaplin restaurant.
It was good of Gerry to say they will never do it again.
The guy must be off his rocker.

Dolores, exactly.

These monitors were designed so that when you are asleep in your own bedroom you can here into the baby's bedroom just next door, and if necessary be in there in 2 seconds flat. They were not designed for neglecting children by putting them in a dangerous position.

Like you I do not believe any child would say something like that either. Did they not think by releasing that people would think how cold and callous they are. But if they are trying to build a defence by media and it was more important to sve your neck and not your reputation, I guess it would be important to make up crap. They do seem to be focusing on having us all believe what they want us to believe.

Just popping in briefly. The McCanns were at Chaplins the night of 1st May and Mrs Fenn reported Madeleine crying to the Ocean club who went and got the Mcs. No crying was heard on the 2nd May in fact Payne (apartment 5B) tells us “I was in all night on 2nd May and I heard no crying.” Well that is correct as Madeleine was crying on 1st May. However, this begs the question why Kate then tells us that on the morning of 3rd May Madeleine says “why did you leave us crying last night”. Imo Kate just transferred what Madeleine might have said on the morning of 2nd May (when this statement would have fitted) to the morning of 3rd May to give the impressions Madeleine was alive and well on 3rd May. Hence the leak of this information by M3.

I agree with you. He also said something like, it could have been worse the twins could have been taken also.
What an eejit he is to make such a crass comment.
Kate's explanation regarding M saying why did you not come when Sean and I were crying is vomit inducing. These two have no idea what a parent is, IMHO.

I only found out recently that the Paine's were in 5b and not Tanner and O'Brien, but this still does not explain why Clarence said Rachel Oldfield was in 5b all night and did not hear anything. Why was RO in the Paine's room all night?

One year after alleging that he had joked about being the “no.1 suspect” in the police hunt for Madeline McCann, The Scotsman has apologised to Robert Murat and admitted publishing defamatory allegations about him.

In April, Murat legal actions against 11 British newspapers and Sky News for stories linking him to the investigation and accusing him of being a prime suspect.

In an apology yesterday the paper said: “On 15 May an article about Robert Murat headed ‘Madeleine: He jokes of being 'No.1 suspect'’ was published in which we reported a number of defamatory allegations about Mr Murat in connection with the abduction of Madeleine McCann.

“The article wrongly accused him of ‘hanging around’ the scene in a manner which recalled the Soham murders.

“Likening his behaviour in this way to that of Soham murderer, Ian Huntley, suggested that he was involved in the abduction of Madeleine McCann. It was a seriously defamatory allegation and wholly untrue.”


The apology continued: “We also wrongly implied that he had been unfeeling and insensitive about Madeleine McCann’s disappearance and had lied about his role in the police investigation. That was not our intention.

“We accept that Mr Murat was assisting the police investigation into Madeleine McCann’s disappearance and that his behaviour was entirely proper throughout, and we are happy to make that clear.

“We apologise to Mr Murat for the hurt, distress and damage to his reputation caused by the article."

The Johnston Press-owned paper did not pay out any damages.

Murat, who lives in the Portuguese town of Praia de Luz where McCann went missing, came to the attention of the press after she disappeared in May 2007. He appeared in several articles at the time as someone that was helping police with their inquiries.

He is suing through London solicitors Simon, Muirhead and Burton on a conditional fee agreement.

2 Weeks ago I saw an interview with a Spanish interviewer. And one of the last questions to Kate was: You were the last one to see her alive what were her last words or the the thing she did?

And Kate had problems answering and said smth like she was loving lot of fun.

And than Gerry grumbled smth and said I was the last one to see her alive.

Have you seen this interview also?

No I have not seen that interview, it sounds as dismal as most of their interviews. He says he was last to see her alive. So does that mean she is dead. Strange choice of words for someone who purports that there is no evidence whatsoever to suggest that M has come to any harm.

I cannot for the life of me understand how Murat has got such an unreserved apology like and clear admission he was libelled but NOT also got damages! What are his solicitors playing at!!

I wonder if there is some error here..If there is a conditional fee agreement with the solicitors it means they take a proportion of his damages, but here it is suggested there are no damages for them to dip into..unless Murat does not want the money and the paper just paid his legal costs, but surely not..

I don't understand the apology,only for solicitors to benefit from it,it really is not very clear to me ,unless he has had a private settlement.
Correct me if I am wrong in thinking this,as I know very little about libel law.

Hi everyone - great posts you all!

I've always thought that the Tapas 9 lied about the time checks and that they probably were very few and far between, and if it wasn't for the forensic evidence it would help their story that Madeleine was abducted, so the only reason they would lie is to protect their own necks and jobs! Did anyone actually see them leaving the tables every purported half hour and checking on the children?

I have also found it very hard to believe what Madeleine was supposed to have said on the morning of the 3rd, i.e. why didn't you come when Sean and I were crying - it's just not something a child of that age would say; children forget quickly and she would have just got up as normal the next morning after sleeping, maybe a bit miserable after an interrupted sleep pattern. Listening to Kate telling this story only makes it even more unbelievable - she doesn't lie convincingly in my opinion!

I've also often wondered why the Tapas 7, who are supposed to be their bosom pals have never come out strongly to protest the innocence of Kate and Gerry! Even Jane Tanner didn't put in too much a defence, apart from trying to convince people she saw a man carrying a child. She didn't put over a convincing protestation of their supposed involvement in Madeleine's disappearance.

And why did these well heeled parents not use baby sitters? I think there must have been a very good reason why they didn't!! Was it because there were things going on they didn't want baby sitters involved in?
