Home Office launches secret review into Madeleine McCann's disappearance
The Home Office has secretly begun a review that could lead to a fresh police inquiry into the disappearance of Madeleine McCann.
Says who? Clarence Mitchell?

By Robert Mendick
Published: 9:00PM GMT 06 Mar 2010

Missing Madeleine McCann Photo: PA The move follows the release of 2,000 pages of evidence last week which Portuguese detectives are accused of having failed to fully investigate.

According to sources close to the McCanns, Alan Johnson, the Home Secretary, has ordered officials to examine the 'feasibility' of British or Portuguese detectives looking afresh at all the evidence.

'Madeleine McCann leads ignored' Kate and Gerry McCann met with Mr Johnson last year to plead for help in their search for Madeleine, who vanished without trace in May 2007 from a holiday apartment in Praia da Luz, Portugal.

The couple have also met with John Yates, the Metropolitan Police Assistant Commissioner, who has headed up a number of high profile inquiries in recent years.

He is said to be "sympathetic" and to have made "general offers of assistance".

The source said (Clarence Mitchell presumably): "The latest we have heard from the Home Office is officials are undertaking a 'scoping exercise' to look into the possibility of a review of the case.

"They are looking at all the options. It is basically a feasibility study.

"Kate and Gerry met with Alan Johnson to request a review is done. Hopefully any political intervention can unlock obstructions that might be in the way."

Pressure is now being put on Portuguese authorities to agree in the first instance to a three-day review of the case that could be held at Interpol's headquarters in Lyon in France.

The McCanns will hope the Home Office can persuade their Portuguese counterparts to co-operate in a case review.

The review – were it to go ahead – would involve British police working with Portuguese counterparts as well as experts in child abduction across other European forces.

The Portuguese police have been heavily criticised for their handling of the case which led to detectives naming the McCanns, both doctors from Leicestershire, as arguidos – or suspects – in the case and accusing them of involvement in her disappearance.

Their arguido status was subsequently lifted and the police investigation shelved.

But with the senior officer in charge Goncalo Amaral now widely discredited and facing financial ruin after being sued for libel by the McCanns over a book he wrote, it may become harder for the Portuguese to refuse the request for a thorough review.

The revelation that possible leads – many passed to Portuguese police by the McCanns' own private detectives – had apparently been ignored will add to the clamour.

Last week, details emerged of a series of possible sightings of Madeleine, who was just three when she vanished.

Guilhermino Encarnacao, who was in charge of the Policia Judiciaria in the Algarve, died two weeks ago from stomach cancer.

Mr Encarnacao was convinced Madeleine had died in her parents' apartment and was a major source of a series of off the record briefings to journalists against the McCanns.

A Home Office spokesman said: "We can confirm that the Home Secretary had a private meeting with Kate and Gerry McCann.

"Leicestershire Police stand ready to co-ordinate and complete enquiries if further information comes to light in the UK; or if requested to do so by the Portuguese authorities, who continue to lead on the overall investigation."

The spokesman refused to discuss what talks took place at the meeting or whether there was the chance of a review of the evidence at Interpol.

The spokesman added: "We are not going to comment on the outcome of any private meeting with the McCanns."
Then we had a series of articles in the Yorkshire press saying West Yorkshire Police were to take over the case and then we get this:

By Lucy Panton

British police are to launch a new probe into missing Madeleine McCann after massive failures were found in the Portuguese investigation.

Our top child protection cop Jim Gamble has completed a fresh look at the three-year-old investigation for the Home Office.

He told ministers there were huge holes in the original inquiry that need to be revisited if they want to "come close" to reaching UK standards.

It will come as a bitter pill for Portuguese investigators who have fended off criticism since Maddie disappeared in 2007.

But parents Kate and Gerry McCann, both 41 and both doctors, are "delighted" at the move.

Failures in the original investigation are said to be "so gaping" that British authorities feel it is their duty to look at it again.

This time police will review all the leads using technology and standards expected in a homicide or kidnap case in the UK.

Mr Gamble, head of the Child Exploitation and Online Protection Centre, found a basic failure to collate information and join up links that should have been made.

Telephone records were not properly analysed, missing early opportunities for leads.

And Kate and Gerry McCann were named as Arguidos, or formal suspects, by Portuguese police - something that the review says would not have happened if the probe had been carried out in the UK.

Mr Gamble found no evidence sufficient to make them suspects. His findings have now been formally submitted to the Home Office with recommendations to re-investigate.

The damning review has now set the Association of Chief Police Officers the difficult task of trying to decide who takes on the mammoth task. It is already predicted to be "an extremely costly" investigation that, even if done properly, will probably never be solved.

A source said: "It is something that has to be reviewed. It is only right that the McCanns are given the satisfaction that everything that could be done has been done. It now comes down to who is up to the job."

The Home Secretary Alan Johnson is expected to announce that the new probe will NOT be carried out by Leicestershire police, the McCanns' local force. The review has highlighted failures within their handling of the case and ruled them out of the review.

Instead ACPO are now asking around their top cops to see who could take on the very difficult and complex investigation.

The source added: "It will be extremely costly and sadly is unlikely to result in a positive outcome.

"As much as we would all like this to end with good news for the McCanns, the fact is there have been a lot of missed opportunities and no-one will ever be able to reclaim the time and evidence lost."

Two thousand pages of evidence released earlier claimed Portuguese detectives failed to follow up leads.

Home Secretary Alan Johnson ordered officials to examine the "feasibility" of British detectives having a fresh look at all the evidence back in March.

Kate and Gerry McCann, of Rothley, met Mr Johnson to plead for help in their search for their daughter who vanished aged three from a holiday apartment in Praia da Luz, Portugal.

People need to cast a critical eye over the plants the McCanns are consistenly putting into the press.

It starts with them attacking Ricardo Paiva and saying they want the case re-opened in Portugal, they want to look for Maddie but they need the Portuguese Police to help them. Simple enough. If Maddie had been taken by a stranger only Portugal would have jurisdiction to investigate and prosecute that. They make a few comments to try and repair the damage they have done to relationships with the Portuguese and their Police. This is a couple who are very desperate to be seen to be innocent. They need that case re-opened there to make them look innocent. But that is not going to happen. Portugal have just about had enough of the time wasting McCanns and their "dreams and visions". We all know who Madeleine's abductors were, the two men the GASPARS are talking about, David Payne and Gerry McCann. Just before Madeleine is about to start school she is taken on holiday by these two thugs and they arrange for her to just "disappear into thin air". Some may think that was incredibly convenient.

Then the next part of the McCanns strategy starts to unfold. So Portugal has shelved the case, who is investigating them now, the same people who have always been investigating them, CEOP and Leicester Police. So it is hardly surprising that we see all those reports in the papers, instigated by the McCanns, constantly attacking Leicester Police in particular. In the latest one in the News of the World, the furious McCanns now aim the broadside at the Portuguese Police again having been totally rebuffed by Portugal. And of course their old enemies, Leicester Police. Then we get a really concerted attack going on, on the internet, attacking Jim Gamble and CEOP as well. I can see what is going on and I am going to continue to point it out.

Gerry and Kate went to the High Court way back in April 2008 demanding to know what was on British Agency files, that is what they really feared. For their cheek, Madeleine was made a Ward of Court and they were told to go and get lost. But they never give up!

Now we have a quaint little gang of bloggers continuing to tell us there is a UK coverup and the McCanns are protected, that is not the way it looks to me!!

Dr Gaspar, former friend of David Payne and Gerry McCann tells it like it really is on these "group holidays" that David Payne likes to arrange with all the little kiddies there.

Last Name: GASPAR
Forenames: KATHERINA ZACHARIAS
Date of Testimony: 16/05/2007
Number of Pages: 8

I give this declaration in relation to the MCCANN family who are currently in Portugal. The MCCANN family is composed of Gerry MCCANN, his wife, Kate MCCANN and their three children, Madeleine, age 4, and Sean and Amelie, who are twins and of 2 years of age.

As it is widely divulged, Madeleine is not with her family presently, and has been missing for the last two weeks.

I will begin by explaining that I am married to Savio Gaspar and that we have two daughters, E*****, who is almost 3 and I***** who is now one year old. I have been married to Savio for 11 years. I am a general practitioner like my husband. I met my husband when we were (page 1) working together in Exeter, around 14 years ago.

To explain in what way we met the MCCANN family, I would like to state that my husband knows Kate, given that both attended Dundee University between 1987 and 1992. At that time, Kate's name was Kate HEALY. I met Kate and Gerry for the occasion of their wedding, around 1998, in Liverpool. Both Savio and I went to the wedding because since Savio was an old friend of Kate, we were both invited to the event.

As far as I know Savio did not know Gerry before the abovementioned wedding. After that time, we met as friends and about three times we spent weekends away together. I would say become close to be intimate friends of Gerry and Kate.

Unknown said...

I remember that in 2002 or 2003, Savio and I spent a weekend with Gerry and Kate in Devon. We maintained contact with each others via phone.

In 2002/2003 Savio and I were living in Birmingham and the MCCANNS in Leicester.

In September of 2005, Savio, I and Ellena, who at the time was 1 and a half years old, spent our holidays abroad, in Majorca. We went (page 2) on holidays with Kate, Gerry, and Madeleine, who should have been around 2 and a half years old and with the twins, Sean and Amelie, who were just months old. I remember that I was pregnant with Isabella.

On those holidays, with us, were as well friends of Gerry and Kate.

There was a couple, whose names were Dave and Fiona, and whose family name was PAYNE, I believe. I think that they were married and had one daughter with about 1 year old, named Lilly. I remember that on those holidays, Fiona was pregnant.

There was another couple, whose names were Tara and Stuart, and whose family name I cannot remember who were also on holidays with us. They had two boys, of 1 and 3 years old, whose names I do not remember. I did not know these two families until we went on holidays together. From memory, I think that it was David who organised these holidays and we all stayed together in a big house in Majorca.

We spent a week on holidays, however, the MCCANN family and the PAYNE family stayed for two weeks. I think that Tara and Stuart, and their two children, also stayed for just one week.

Two or three days had gone by, all of us staying in Majorca where, in general terms, we had fun (Page 3) with our children. Possibly around the fourth or fifth day abroad, I remember an incident that stayed recorded in my head. I say this in this way, because I have thought many times about the incident that I am about to describe.

Unknown said...

One night, on holidays, the adults, that is, the couples that I mentioned, were on a patio outside of the house where we were staying. We had been eating and drinking.

I was seated between Dave and Gerry who I believe were both speaking about Madeleine. I don't remember the conversation in its entirety, but it seemed they were discussing a possible scenario. I remember Dave telling Gerry something like "she", referring to Madeleine, "would do this".

When he mentioned "this", Dave was sucking on one of his fingers, pushing it inside and outside his mouth, while with the other hand he made a circle around his nipple, in a circulatory movement over his clothes. This was done in a provocative manner and carried an explicit insinuation in relation to what he was saying and doing.

I remember that I was shocked at this, and looked at Gerry, and also at Dave, to see their reactions. I looked around (page 4) as if saying "did anyone else hear this, or was it just me". There was a nervous silence registered in all the conversations and afterwards, everyone began talking again.

I never spoke to anyone about this, but I always felt that it was very strange and it wasn’t something that someone should do or say.

Besides this [incident], I remember that Dave did the same thing once again. When I refer to this, I want to clarify that it was during a conversation in which he was talking about an imaginary situation, though I could not say exactly what about. I believe that he was talking about his own daughter, Lily, though I'm not certain. He put one of his fingers in his mouth and slide it in and out, while the other hand drew a circle around his nipple in a provocative and sexual manner. I believe that he was referring to the way that Lily, would behave or do it.

I believe that he did this later on, during the holidays, but I cannot be sure. The only time, besides this one, that I was with Dave and Fiona was several weeks after the holidays, when Savio and I met up with Gerry, Kate, Dave and Fiona at a restaurant in Leicester.

I am absolutely certain that he said what he said and that he did the gestures that I referred, but that could have occurred in the restaurant in Leicester, though (page five) I believe that it was later on, in Majorca. When I heard Dave doing and making this a second time, I took it more seriously.

Unknown said...

I remember thinking whether he looked at the girls in a manner different from me or from the others. I imagined that maybe he had visited Internet sites related to small children. In short, I thought that he was interested child pornography on the internet.

During our holidays I was more attentive at bath time after hearing Dave saying that.

During our vacation in Majorca, it was the fathers who took care of the children's baths. I had the tendency to walk close to the bathroom, if it was Dave bathing the children. I remember telling Savio to be careful and to be there, in case it was Dave helping to bathe the children and, in particular, to my daughter E*****. I was very clear about this, as having heard him saying that had disturbed me, and I did not trust him to give bath to E***** alone.

When I heard Dave say that a second time, it reinforced what I already thought in relation to his thoughts about girls. During our stay in Majorca, Dave and his wife, Fiona, accompanied by this daughter Lily, took Madeleine (page 6) with them to spend the day, in order to give Kate and Gerry a bit of rest and time to be with the twins. When I say this, it is not that I was worried about Madeleine's safety, since she was also with Fiona and Lily, and also with Dave, as far as I know.

As I already mentioned, I was only with Dave and Fiona on one occasion, after Majorca, and I have not spoken to them since that time. In the last two years, we have met, as a family, with the MCCANN, once in a while. That happens mainly at the children's birthdays, a time when we get together.

The first time I had knowledge of the terrible news about Madeleine's disappearance through the radio, my thoughts went immediately to Dave. I asked Savio if Dave was also on holidays with the MCCANN in Portugal but he did not know.

I watched TV meticulously, and watching the coverage of the news, I understood that Dave was there, because I saw him, in the background, on the television images during the first days after the Madeleine's disappearance. Based on that, I believed that he was on holidays with the MCCANN in Portugal. Today, Wednesday, the 16th of May of 2007, at 17:40, I gave DC Brewer an A4 page containing 2 photographic images. I am going to reference these images as (ref KZG/1) (probatory element) that may (page seven) be presented as mean of proof, if necessary. These photographs were taken during the holidays in Majorca. In the photographs, Dave is wearing a white t-shirt and the woman in the photograph corresponds to his wife Fiona. The man who is holding the glass of wine in the photograph is Stuart. These photographs were taken while we were at Majorca.

and then we have the email exchange between Ricardo Paiva and DC Marshall, headed up "David Payne", leaving nothing to the imagination about who they think is involved, when it was happening, afternoon/early evening and that both Payne and his wife have been further questioned and are telling lies to British Police.

Leicestershire Police: Follow up to Gaspar statements PJ Files

Processos Vol. XIII
Pages 3909-3915

To: Ricardo Paiva - Polícia Judiciária
From: DC 1756 Mike MARSHALL - Leicester Police Constabulary
Ref: David Payne
Date: October 24, 2007

Ricardo,

As requested, appended are the statements of Arul and Katherina Gaspar.

I read carefully the written statements given by David Payne but was not able to extract any other information besides what is already known.

He declares that he saw Madeleine, for the last time, at 17H00 on 3/5/07 in the McCann's apartment. Also present there were Kate and Gerry. He did not indicate the motive for being there or what he was doing. Similarly he does not indicate for how long he stayed.

When asked with whom he was on the afternoon of May 3rd, he declares that this information was already offered to the police and he cannot remember if anyone else was there.

He does not remember what he was wearing that afternoon.

He took part in the searches, having carried out most of them alone. He was at times accompanied by Matthew Oldfield.

He did not partake in the searches realised on the 4th of May, because, on this day, he spent to majority of time in the police headquarters.

For many of the questions, he does not give a complete answer, affirming simply that he has already given this information/declaration to the Portuguese police.

I examined again the declarations of Fiona Payne. In her depositions, she states that she went to the McCann apartment, around 19H00, on the 3rd of May, together with Kate. She states that 10 minutes later, the husband arrived; it is not clear which husband she refers to, if to Gerry or her own husband.

Her responses to the written questionnaire are vague, given that, she continues to answer to the questions with "they conform to my earlier deposition" or some similar statement.

Ricardo Paiva pointed out at the recent appeal hearing of Goncalo against him being injuncted that unfortunately, he prevented other theories from being explored as to what happened to Madeleine.

We can see that once he had been removed from the investigation, British Police were able to confide in Ricardo Paiva and get on with the job. Unfortunately, Goncalo actively prevented "Justice for Maddie" by insisting on going up a blind alley, set up by Gerry McCann.

Just found an old post of mine, now I wonder if Murat's mummy actually set up a stall saying Maddie disappeared at 7 pm on 3 not 4 May because that would be completely spot on!

viv on Mon 21 Sep 2009, 6:25 pm

For that interesting statement, so Robert's mother set up a stall telling everyone Madeleine disappeared at 7 on the 4 May, rather odd /defensive disinformation by mummy there. We know the lengths mothers will go to, to protect their children. Rhys's killer's mother is currently doing time for trying to save her son by telling wicked lies and frustrating the police investigation.

Was it the brilliant Sandra Fileguiras again who said, and do you know Robert Murat, provoking that angry response from Gerry, I am not going to comment on that, prior to almost ripping Kate' arm from its socket, as he dragged her off. Robert flew back into Pt on 1 May if I recall from UK. On 2 May Gerry received a series of 14 text messages the contents of which he does not wish to reveal and saw fit to delete. Were they from Robert, who I just have to admit has always looked decidely shifty to me. Including when he sat there with that alert and earnest look on his face, completely silent as reporters interviewed, I think it was his mother and aunt. The of course he becomes a millionaire from this just like the McCanns, then he does a synchronised talk at Cambridge, at the same time as Clarence is at Oxford. Once he even said he had sympathy for the McCanns and Maddie still needs to be found, maybe he would know all about that?

Sandra Fileguiras is very much on the ball and I bet knows exactly what happened, how cute of her to ask Gerry such a pertinent question.

I would suggest you toddle off and read he Order of Mrs Justice Hogg where she states Madeleine was made a Ward by the Court on 2 April 2008, and at the end of her Order of 7 July 2008 confirms that Wardship and that it will stay in place until further order. Mrs Justice Hogg also makes quite plain what the McCanns were applying for the previous year, return of Maddie if found by a foreign jurisdiction, i.e. the complete antithesis of the Order Mrs Justice Hogg made the following year! She also made quite clear what they were applying for the following year, enforcement of that order but they withdrew it due to being opposed by British Police Agencies and our Attorney General.

In short if you do not know what you are talking about and cannot be bothered to read and find out what is so clearly written, why bother? I have practiced in family law/am qualified in it and therefore have no need of assistance from you and the Order is clear enough on its face I would have thought for even you to understand, I have to believe therefore that you continue to tell foolish lies on behalf of your paymasters!

I remain extremely concerned about Martin Smith, who "hopes this will help the McCanns", spoke to Brian Kennedy and was to speak to Metodo 3. Proper police witnesses could not be approached in this way. No wonder his wife refused to make a statement. I think it is these sort of lies/Kennedy going around bribing witnesses with all his money etc, that will help to crack this case.

On McCann files there are numerous instances of him appearing in the press but this one and the timing of it is probably the most significant.

Maddie: Irishman provides dramatic new clues Daily Mail (appeared in paper edition only)

EXCLUSIVE: Tourist met rude man carrying child in blanket on night Madeleine vanished

By SANDRA MURPHY, VANESSA ALLEN
January 3, 2008

AN IRISH holidaymaker has spoken publicly for the first time of his disturbing encounter with a man carrying a child wrapped in a blanket on the night Madeleine McCann disappeared.

Now investigators hired by Madeleine's parents hope Martin Smith and his family can provide a crucial breakthrough.

Speaking from his home in Drogheda, Co. Louth, Mr Smith recalled the sighting, which is strikingly similar to one by a friend of the McCanns, Jane Tanner. In hindsight, the retired Mr Smith said, the mans rude behaviour should have aroused his suspicions.

He explained: "The one thing we noted afterwards was that he gave us no greeting.

"My wife Mary remembered afterwards that she asked him, 'Oh, is she asleep?' But he never acknowledged her one way or another.

"He just put his head down and averted his eyes. This is very unusual in a tourist town at such a quiet time of the year."

Their description of the barefoot child and the man, who wore beige trousers, echoes that of Miss Tanner, who said she saw a man carrying a sleeping child away from the McCanns apartment about 9.15pm.

Though the Smith family believe they met an almost identical man closer to 10pm, the coincidence prompted them to contact police after they returned to Ireland. Mr Smith said: "Luz is such a small place and so quiet, we felt a duty to tell police and let them decide if it was important."

Last night, McCann family spokesman Clarence Mitchell said detectives from the Spanish agency Metodo 3 now hoped to speak to the family. "Metodo 3 is being very methodical, working through a number of people they think might be able to help them, and this family will be on their list."

On the night of the disappearance, Mr Smith was dining with his wife in the Dolphin restaurant in Praia Da Luz, where they are frequent visitors.

The couple were with their daughter Aoife, their son Peter and his wife Sile,as well as four grandchildren Tadhg, Cole, Aisling and Eimear.

All nine met the man holding a child but their recollection differs slightly from Miss Tanner's.

"In the image she gave, the man was holding the child forward in his arms. The man we saw had put the child over his shoulders. But Luz was very, very quiet at that time of the year and the likelihood of two young children being carried around like this is very small.

"Also, our timings are a bit different. She saw the man at 9.15pm. We say 9.45or 9.50pm and the sighting was only a five-minute walk from where the child was staying.

"I dont know if this information will help the McCanns. We kept interested in whats going on but we tried to avoid the limelight."

The father of six yesterday said the Irish family would do anything they could to help the McCanns find their missing daughter.

"We have not been contacted by the private detective hired by the McCanns, and have had no contact with the investigating police since May 26 last year.

"But anything we can do to help try to solve it, we will." Recalling the event she witnessed, Mr Smith said it was some time before the family realised they could be star witnesses

"We were out the night it happened. My son and his family were leaving on the Friday and we were going for a family meal. We went home about 9.50pm and we heard nothing at all about Madeleine McCann until the next day.

"I was taking my son Peter to the airport and on my way back, I heard that a kidnapping had happened in the village of Luz.

"We were looking at all the commotion on Sky News and we really felt quite helpless.

"We had two grandchildren with us at the time, aged four and five, and it had a terrible effect on them.

"They all wanted to sleep in the same room as us until we went home on the Wednesday.

"We were home two weeks when my son rang up and asked was he dreaming or did we meet a man carrying a child the night Madeleine was taken. We all remembered that we had the same recollection. I felt we should report it to the police.

"I rang the Portuguese police and they took a statement from me on the phone. Then they asked me to make a statement to gardai, which I did in Drogheda two weeks after the disappearance.

"Two days later, Leicestershire police got on to us and said they wanted to speak to all nine of us. But we felt there was no point dragging grand children and the whole lot out to Portugal so just my eldest son, Peter, and youngest daughter, Aoife, and I flew to Luz to make a statement.

"The police were fairly busy and the station was pretty typical. They didnt seem to be the most efficient police you ever came across but they are probably no different to police anywhere else. We were interviewed separately and told them what we saw, and showed them on the map where we met the man and child.

"We spent the whole day there from 10.30am to 7pm with an interpreter. That day, May 26 last year, was the last time we had any contact with the investigation.I remember clearly because it was my wedding anniversary.

"I told them we went for dinner at the Dolphin Restaurant and then went on to have just one drink in Kelly's bar, just 50 yards away.

"We would normally have stayed out longer but my son and his family were going home the next day.

"As we made our way back to our apartment in Estrella da Luz, we met a guy with a child that appeared to be asleep.

"It looked like a blonde child, and I thought she might be four years old, as she was the same size as my grandchild who was with us.

"It was around 9.55pm and it was getting dark and he was looking downward so I couldnt tell you exactly what he looked like.

"None of us was 100 per cent sure what he was wearing but we all told police he was wearing beige trousers and a darker top. We all put him in his early 40s. I didnt think he was Portuguese." Insisting he knew chief suspect Robert Murat visually for years, Mr Smith told police the person he saw carrying a child could not be him.

"I told police it was definitely not him because the man wasn't as big as Murat. I think I would have definitely recognised him."

Originally there were press reports Tanner saw this person with a child wrapped in a blanket but in the end it seems she decided the child was not. Now we have Mr Smith saying she was, what a comedy show!

Madeleine's blanket was given to the dogs were are told to try and pick up her scent so she clearly did not leave the apt in it!

Hi All,

Reading through the weekend press it’s clear to see the pink one spinning like a dervish the whole way through the published articles. So what’s up?

The third anniversary of Madeleine disappearance looms near and no one has been arrested, Murat’s legal action against the Tapis mob will shortly be taking off, plus of course Halligen could spill the beans about what his remit really was when employed by the McCanns.

It would appear diversion tactics are in order from the McCanns. Hewlett death 4 months ago is now reported in the Sun – not so much news but history. The News of the World follows this up with ‘the police are to launch a new probe into Madeleine’s disappearance.’ The Leicestershire police are given a quick slur by the paper, or should I say the pink one, who suggests they are not up to scratch and will not be involved in this new probe.

Just as we wonder why the McCanns would be so interested in reopening the case Jim Gamble gives us the answer, “the new probe will be costly and will probably not solve the mystery.” Ah well that’s all right then - the T9 can breathe again.

I personally can only see all this as diversionary tactics laced with the continuous by- line of “would the McCanns go to such lengths if they were guilty”. Well of course they would for just that reason - to look innocent.

Unknown said...

They both seem to have rather a lot to say about Robert Murat as well, whether they recognise him whether they saw him or not. I do not think the police were wrong to maintain him as a suspect alongside the McCanns, particularly given these two incredulous McCanned witnesses who supposedly saw Maddie being abducted hours after she had already gone!!

Hello Wiz and what an excellent post, it is so refreshing to read someone who sees it just the way it is !

I liked that, not so much news but history, lol. They have to save these little nuggets for release at the right moment, they have a schedule to keep to and I am sure Hewlett timed it just right for them, well no matter they can adjust accordingly:-0)))

Gerry was immediately insisting tracker dogs be brought in to pick up Madeleine's scent.

He also seemed to be at pains to point out in interview the routes he took with her, if memory serves he kept mentioning this shortcut.

Also and I need to check this I think those dogs with Maddie's blanket for the scent (which may have been for that purpose and not actually had her scent on at all) but if it did, just stopped dead at the Batista Supermarket. Like she went by car from that point.

Any thoughts Wiz?

I just have some dim and distant memory now about a big black car pulling up there, can you remember?

Oh just another thought about that NOW report, which as you rightly point out contains mostly what Clarence wants to spin.

The bit about insufficient evidence and the McCanns would not have been made Arguidos at that point in UK. Well aside from the obvious defect there, we do not have arguidos in UK, he is probably right about that. Purely on the basis of the dogs and without corroborating evidence from forensics the McCanns would not have been alerted by UK police to what they had at that stage. No they are much nastier than that, they would have waited until they really had something to hit them with and I think that is exactly what they are doing now, hence Gerry's application to the High Court in his desperation to get his mitts on those files. Did he really think Mrs Justice Hogg would back him and tell the police to hand over their investigation files to him, what an utter fool!

Gamble is obviously involved due to the sexual abuse/exploitation issues and to me it has been pretty clear from day one they were financially exploiting her, indeed I would go so far as to say that was one of their major motivating factors, aside from covering up what she had been subjected to, the poor little angel.

These flashbacks of Martin Smith weeks or even months later are very unnerving and very typically McCanned!

Hi all

I fail to see how anyone can do a full and proper review of this case when the PJ are witholding several files. I would also be very surprised if they just handed them over after the way they have been treated. Was it not previously said by a source close to the McCanns, that Yorkshire Police would be reviewing the case, the very same Police that were investigating Hewlett, or have I got that wrong.

The blanket is interesting Viv, Jane went from seeing a man carrying a bundle to a child in a blanket then not in a blanket, to it could have been a women.

Goncalo Amaral also has a great interest in a missing blanket. Perhaps the blanket given to the dogs was Amelies and not Madeleine's.

Hiya Di

I wonder if the word "review" has entered into Gerry's thinking and vocabulary because all investigating police forces do conduct reviews when they have so far not got to the stage of being able to prosecute the known perpetrators?

I think this would be the source of Gerry crossing swords with the Home Office, to complain about Leiceser Police and insist they are "reviewing" the case from the wrong point of view and that this should be carried out in Portugal, after the removal of good police officers like Ricardo Paiva who know all about Gerry McCann and David Payne. He is then conducting a media campaign to attack firstly the LP and then secondly in his fury the PJ also having firstly tried to speak some conciliatory words about them in the video above immediately after the Goncalo case?

I think he would be demanding someone else other than those forces so far involved who clearly believe him to be guilty should be looking at it all again. IMO Madeleine probably was abducted, he just needs to insist that it was later that night and not by him, Kate, David Payne etc.

"Who filmed him, then. Why did this person put that fragment on the air, knowing it was lethal to GM?"

I think it was quite obvious David Payne filmed Gerry on the holiday bus saying he was not here to enjoy himself and being his usual aggressive and abusive self. I also think it would have been David Payne who put that on the net, to move suspicion away from himself, but of course it might have been someone like Special Branch..

The police etc do like to wind suspects up and then watch/bug the results.

This is a terribly serious case and it is not going away for the culprits. The government also know the public want a result, I have personally written to Gordon Brown on this.

Oh lol Di

That Textusa theory is such absurd propaganda I can hardly bear to read it.

It follows the current Tony Bennett line, either she was abducted by a stranger and this character Smith who one can quote from various newspaper reports saw that abductor or of course she died in the apartment and it was a little accident.

Nice try to cover the truth but I find it quite pathetic!

Unknown said...

And as for the PJ withholding several files, that is just not the case. British Police have all of the files in accordance with European law.

Unknown said...

Then we have "Ironside" rushing around telling everyone what a "bully boy" Jim Gamble is.

Well to Gerry McCann, David Payne and his ilk, I am sure they feel that way.

Unknown said...

Well indeed those Irish connections, including repeatedly to this site, are just a bit too much of a coincidence. Serious police witnesses just do not keep on chatting to the press, do they! Surely that would harm the search for Madeleine that they profess to be so concerned about, although not concerned enough for Martin Smith's wife to give a statement to the police about what she supposedly saw, this Gerry apparition, lol! Amusing really even dropping in he was "rude", Gerry does know how others perceive him and does have a sick sense of humour. Very sick.

I also have my suspicions about the Smith family and there involvement in this case. I do not intend to proffer any speculation as I have not been privy to unpublished investigation details so I resort to looking at their involvement on face value and common sense.

Details of the supposed Smith sighting was submitted to the police and also widely publicized by the British media which must have been instigated by the Smiths or someone closely connected to them, otherwise the information would have been treated as confidential as would be the case in any criminal investigation. So then, as a result of the alledged sighting the Smiths were required by the police to give statements which can be seen from the case files released into the public domain.

Having once given their statements they appear to have vanished from the face of the earth. It has been suggested that perhaps they had a menacing visit from some double glazing salesman or such like and their silence bought but once so far into the mire why would that be necessary? Why indeed would you try to buy someones silence when statements have already been taken by the police - is it not a bit late by then?

If they are to be taken seriously by the police they would not be in a position to decide whether or not they are further required in connection with the investigation. That decision would be made by the police and the Smiths would have alternative but to comply - double glazing salesman or otherwise! Lets not forget also the Irish connection that repeatedly shows itself - a little too much of a coincidence don't you think?

Good post also from Zodiac on Claudia's blog. I would just say that Gamble is not making any comment at all, the McCanns are just spinning what he is supposedly thinking and doing in the News of the World. I do believe he views this as an abduction with the parents involved and involving sex offending. It is all there in Zodiac's post, people just fail to join up the dots, even Lee Rainbow's specialty and also Dr Rebelo, sex offenders and homicide. Poor little Maddie. The prospects are very bleak for her but we can certainly conclude the police are not certain she actually was murdered and may be still alive, but if she is, how utterly terrible and what is she suffering? This is what people fail to realise when they just keep proclaiming she is dead and it was just an accident.

This case is simply terrible and the attitude of people who even attack one of the most senior men in the UK to investigate and prosecute such a case, Jim Gamble, really is awful. How on earth can they say they want justice when they just keep on attacking British Justice?

This business about Portugal retain primacy is just absurd. I cannot accept that Zodiac actually believes that UK agencies do not have jurisdiction to prosecute UK offenders who went abroad to commit such a terrible crime.

Is Gamble contradicting Lee Rainbow the country’s most senior criminal profiler? Who wrote:

"In the summary of the 30-page report Mr Rainbow wrote: “The potential involvement of the family in the disappearance of Madeleine McCann cannot be discarded, and it can be considered that, when pondering the basis for research, this hypothesis deserves as much attention as the criminal with sexual motivations that has been previously prioritised."

http://joana-morais.blogspot.com/2010/02/mccann-twins-may-hold-clues-says.html

And also this:

'Criminal profiler Lee Rainbow recommended that police on the Algarve investigate the doctor and his wife Kate because of 'contradictions' in his statement.'
'The contradictions in Gerald McCann's statement might lead us to suspect a homicide. This is a lead that should be investigated.'
The lawyer added: 'Portuguese police had only considered the abduction theory. It was British police who said they must consider homicide as well.'
Mr Cabrita did not outline what ' contradictions' had been found in Mr McCann's statements and refused to give any further details after the Lisbon hearing.
Mr Rainbow, 37, leads a team of five criminal profilers at the NPIA, and specialises in sex crimes and murders.

Note that the article states that the National Policing Improvement Agency is a Home Office Agency!

'The Home Office agency, which describes itself as 'part of the police service'

Also Mr Gamble. What about the British sniffer dogs Eddie and Keela and their indications?

So is Gamble stating he knows more than the PJ, LP, Lee Rainbow and the British sniffer dogs? They were all wrong and his review is fact. Did/does Gamble have the withheld files? If not. Then how would he even be close to knowing anything? Are we the British public just expected to believe that Portugal (who retain primacy in the investigiation) will just allow McCann/Ceop/Johnson to take over their investigation?

Unknown said...

and here is another one on J Morais blog who has clearly not taken leave of his/her senses and can spot spin from reality, of course Gerry McCann wants us to believe he is being protected at the highest government levels etc, he may even want to believe it himself but it is complete and utter rot! Since when did any British law enforcement agency or government protect a gang of sick child abusing criminals. You are going down Gerry McCann, now spin that!
-----------

@ 170 Sorry but Ive just finished reading some of truthseekers blog and I dont believe one word of it- the thing that grabs me almost immediately is the mention of Madeleine's name in an aricle that defies belief in fact given Gerrys propensity for trying to hint that powerful forces are protecting him I reckon this is likely to be all his own work its certainly not serious journalism.

This Jim Bates you are so fond of Ironside, seriously misled the police by claiming he was an "expert" and had a degree level education. LIES. He acted for the Police against a Mr Virdi which led to him being falsely accused of racism which cost the London Met very dearly in a number of high value employment tribunal claims. You see this "expert" Jim Bates, said that he could prove Mr Virdi sent that "racist hatemail" to himself!

He has acted for the "defence" i.e. paedophiles and that has led to acquittals, I remain deeply concerned about your faith in this man, but just for completeness here is a BBC article about him from 2006, long before the Maddie case.

Mr Jim Bates stands for everything you do, fraud and a whole lot worse.

Child porn witness faces inquiry
By Steven Shukor
BBC News, London

Mr Bates has worked on dozens of Operation Ore cases
A computer analyst who has given expert testimony in highly sensitive court cases is being investigated over concerns about his credibility.
Jim Bates has served as a witness in dozens of cases related to Scotland Yard's inquiry into internet child pornography, Operation Ore.

But doubts have been cast over his competence after it emerged he had misled a court about his qualifications.

If [Jim Bates] was appearing as a defence witness it may be appropriate to challenge his credibility

CPS statement
Shy Keenan, of Phoenix Survivors, which offers support to child abuse victims, said Mr Bates should not be allowed to work as an expert witness while he is under investigation.

"Surely his involvement in such matters should be suspended at least until after the very serious questions regarding his alleged qualifications and expert status have been officially dealt with."

"This matter could potentially lead to a review of all involved cases or indeed further proceedings."

High-profile

Mr Bates told BBC News he accepts he erred in claiming he had a Bachelor of Science in Electronic Engineering in court documents.

He is under investigation by the Child Exploitation and Online Protection (CEOP) centre, which is affiliated to SOCA (Serious Organised Crime Agency).

But he accused CEOP of harassment and leaking information to the media in an attempt to "discredit" him after highlighting what he claims were serious flaws with several Operation Ore investigations.

Mr Bates is president of the Institution of Analysts and Programmers (IAP) and has been involved in high-profile cases as an expert witness both for the prosecution and defence.

I have evidence to prove Operation Ore was based on a completely false series of premises

Jim Bates
He was used as an expert witness for the Metropolitan Police against Gurpal Virdi, the Sikh officer wrongly accused of sending racist hate mail to himself and colleagues.

Unknown said...

However, Mr Virdi was exonerated and reinstated with a formal apology in 2000 after an employment tribunal ruled he had been the victim of racism.

Mr Bates has previously served as an advisor to Scotland Yard's computer crime unit and lectured at the police training school at Bramshill.

False statement

In court papers dated September 1998 seen by BBC News, Mr Bates states: "I hold a Bachelor of Science degree in Electronic Engineering".

In 2004, it emerged that he held no such qualification and had never been to university.

The Crown Prosecution Service (CPS) has since advised its prosecutors to "challenge his credibility" in cases where Mr Bates appears as a defence witness.

"Prosecutors would have to disclose to the defence that allegations have been made against Mr Bates if we were using him as a prosecution expert," said a CPS statement.

"If he was appearing as a defence witness it may be appropriate to challenge his credibility."

Mr Bates said he now mainly works as an expert witness for defence teams, including cases involving child pornography on the internet, but that the credibility allegations were hindering him.

"One of the effects of being targeted like this means that as an expert witness, counsel will understandably be reluctant to employ me directly because of such issues regarding my integrity," he said.

He said he has been gathering evidence to prove certain officers involved in Operation Ore had been careless with their investigations with a view to clearing his name.

"I have evidence to prove Operation Ore was based on a completely false series of premises and police officers should have been aware of this if they had done their job properly," he said.

Unknown said...

So let me see, will Mr Jim Bates be called as an erm, cough, "expert witness£" for Gerry McCann and David Payne?

Nothing would surprise me!

Unknown said...

"One of the effects of being targeted like this means that as an expert witness, counsel will understandably be reluctant to employ me directly because of such issues regarding my integrity," he said.

Mr Justice Owen :

The claimants are husband and wife (Mr and Mrs Jim Bates). On 9 September 2008 a search warrant relating to their premises at Stone Lodge, Drayton Road, Neville Holt, Market Harborough was issued in the Bristol Magistrates' Court, the second defendant, on the application of an officer of the Avon and Somerset Constabulary, the first defendant. The warrant, which was issued under section 8 of the Police and Criminal Evidence Act 1984 ("PACE"), was executed on 11 September. The claimants seek an order quashing the search warrant, and a declaration that the entry and search of their premises, and the seizures made in the course of the search, were unlawful.

The first claimant holds himself out as an expert in the forensic examination and analysis of computer based material. He has given evidence on many occasions as an expert witness in civil and criminal cases involving computer based material. On 6 March 2008 he was convicted at Leicester Crown Court on 4 counts of making a false statement and 1 count of perjury. The charges related to untrue statements that he had made over a number of years as to his qualifications. He was sentenced to 6 months' imprisonment suspended for 2 years and ordered to pay £1,000 towards the prosecution costs.

Quote Jim bates

Jim Bates says it could be the biggest police scandal this country has ever seen

Bates: "The evidence I have collected over the six years since I first became involved in Operation ORE is extremely sensitive and undoubtedly includes information that the police (particularly CEOP) would prefer not to see revealed. It is likely that this evidence will eventually lead to exposure of the biggest police scandal that this country has ever seen."

Following Jimbo's 'review' I categorically agree with his assessment that there were big holes in the investigation. My own review carried out during the past 5 minutes comes to the following conclusion.

Some of the biggest holes in the investigation are:

# refusal of the BRITISH to supply financial records
# refusal of the BRITISH to supply medical records
# refusal of the BRITISH to supply telephone records
# delaying by the BRITISH of the forwarding of witness statements crucial to conducting a proper investigation

In short, the refusal of the BRITISH authorities to cooperate in a serious and impartial investigation as demonstrated by the above really does disqualify their right to criticise in any way, shape or form. Perhaps Jimbo is the biggest hole in the investigation since he was involved almost within hours of the 'alarm' being raised. Perhaps ***hole would be a more appropriate description in his case.

Hi Claudia...Arul Gaspar in his witness statement says the ONLY reason they did not see the Paynes was because they were friends of the Mccanns...neither of them say the friendship with the Mccanns stopped for this reason.

To be honest Claudia I no longer believe this conversation even took place.

Later the Mccanns, Gaspars and Paynes met for dinner without the children...Katherine says, but she is not sure, whether Payne made this gesture again there or on holiday. Well I am no longer sure either..of anything Katherine Gaspar has to say.

I think David payne is a warm loving father who loves children...the photographs show this...they were having a great time in PDL until disaster struck.

and here is "Bren" on 3 Arguidos link to that post, Bren likes to put all links up for new posts on Text USA, people should think long and hard what they may be getting involved in here. They may be quite innocently wanting to get involved in a discussion about what happened to little Maddie, but the reality is something very different, the reality is a bunch of people who hate Jim Gamble of CEOP, because his after them! :

They like to keep insisting this is just a Portuguese investigation, the British cops have nothing to do with it, but they do and that is what these people fear the most.

Bren was posting on Missing Madeleine last night, rallying the troops telling them once Jim Bates won his case, Jim Gamble would be done for and then we would get Justice for Maddie.

As I sat reading it, it disappeared before my eyes and now the main Maddie thread is not available for public view, very strange.

What sort of people would support Jim Bates who has accessed so many sordid images of children claiming he is an expert which he has been prosecuted for and found guilty of and attack the very man who catches people like this?

People who are paedophiles themselves and are "hiding a big secret".

Just keep on attacking CEOP/Jim Gamble for wanting to try and save children from this all too common sort of ordeal, Bren, Ironside and Co and then have a look at your face every morning. What do you see?

Paedo on Facebook snared me in web of lies
Brave Jessica tells how she was preyed on at 15

JAILED: Watson forced sex on victim

TRICKED: Jessica and mum Maxine (Masons News)

EVIL: Murderer Chapman
Shock probe into the 'new Twitter', chatroulette.com
Investigation uncovers pervs using latest chatroom craze.
Read Facebook is a paedo playground

By Matthew Acton & Jane Atkinson, 21/03/2010

A CONVICTED paedophile called himself Lone Ranger to target a horse-mad 15-year-old on Facebook and steal her innocence in a string of vile sex attacks.

By day freed pervert Paul Watson wormed his way into young Jessica Hunt's trust as she tended her beloved pony at his stables.

By night he preyed on her through the internet, bombarding her with TWO THOUSAND flattering messages.

Cunning Watson, 44, masked his identity from everyone except Jessica using the name of the old TV cowboy hero. And after several weeks of grooming he pounced - forcing her into sex in the back of his van.

Then the cowardly creep again used Facebook to con Jessica's silence, promising a new life, a big house in the country with land and lots of horses.

But now 16, and with Watson behind bars for four years, Jessica today bravely waives her right to anonymity to warn other youngsters of the dangers lurking on the social network site.

She revealed: "I didn't feel I could tell anyone what was happening. At first I felt excited someone was taking an interest and saying nice things but I now realise it was all just lies so he could do what he wanted to me.

"When he started to abuse me, I felt alone and scared. There should be easier ways to report when someone's intimidating you. I'd hate what happened to me to happen to someone else. That's why I'm speaking out."

Revelations of Jessica's ordeal come just a week after Facebook fake Peter Chapman was jailed for the rape and murder of 17-year-old Ashleigh Hall - and the same week Facebook REJECTED a Government appeal to install a panic button on users' home pages.

Incredibly Watson was disqualified from working with children when he was convicted of molesting another 15-year-old in 2005. But he slipped under the radar by registering the stables, near Nottingham, in his unsuspecting partner's name. Jessica met the couple in October, 2008, when she and mum Maxine, 42, were hunting somewhere to house her Shetland pony Alfie.

Jessica said: "They were really nice to me. At first Paul was just friendly and a laugh. Sometimes I'd catch him looking at me which made me feel uncomfortable, but I shrugged it off."

By February, 2009, unknown to his partner, Watson had gained Jessica's trust and was homing in as a Facebook "friend". As Jessica used the website to vent her private feelings Watson soon picked up she was vulnerable and presented himself as a kindred spirit. She said: "When I was upset I'd post updates saying 'I hate my life' or 'I want to be happy.'

Unknown said...

"A few weeks later Paul wrote, 'I wish I knew what my happy ending would be.' I wrote, 'I wish I knew what mine was too!' Immediately he sent a private message asking: 'What would your happy ending be?' I just replied 'To be happy again.' "

Brave Jessica Hunt tells how she was preyed on at 15
Now the monster was in a perfect position to take advantage.

Jessica recalled: "He started sending really nice, sympathetic messages saying that if I ever needed to talk to anyone he was there. I started to believe he really cared about me."

Watson signed all messages with four kisses. Commenting on Jessica's Facebook photos, he'd say: "You look really cute." After Jessica got glasses, making her self-conscious, he wrote: "You look like a sexy secretary."

When Friends and relatives saw what was happening online they alerted Maxine that her daughter was talking to a "Lone Ranger" with lots of personal information. Maxine said: "I should have investigated properly but Jessica accused me of being nosy. When she said this Lone Ranger character was just Paul I let it rest. That was a mistake."

Then evil Watson made his move. "I was at the stables by myself one morning when Paul arrived," said Jessica. "We went for a walk and he kept holding my hand. I'd never had that attention from boys before. We sat down and he leaned in, trying to kiss and cuddle me.

"I said, 'I can't!' But he just pushed me on to the ground. I didn't know how to say no. I knew it was wrong, but I felt really pressured."

Sly Watson kept up constant Facebook contact with Jessica, telling her he loved her, and when she turned 16 they'd be a proper couple and live the country dream.

A few weeks later he pressured her into full sex when she was still 15. "We went for a drive and he pulled into a layby," said Jessica. "I'd no idea where I was and didn't feel I could escape. I kept saying 'I can't do this!' as he moved closer to me, but he was really persistent. I didn't know any way to get out of it."

Wily Watson went to extreme lengths to keep his crime under wraps. He told Jessica SHE would be in trouble if it got out. And she came under increasing pressure for sex. "He threatened to hit me if I didn't give in," she said.

After five months' abuse, Jessica cracked and told all to a friend's mum, a social worker. When Watson was arrested, Maxine was devastated to learn his record. She echoed demands for Facebook to instal panic buttons on users' home pages to instantly alert the Child Exploitation Online Protection Unit. She said: "That would flush out these paedophiles."

Last night a Facebook spokesman said: "Nothing is more important to us than the safety of the people who use our site. We have a variety of measures they can use to protect themselves from unwanted contact and we strongly encourage their use."

Home secretary Alan Johnson said...

THIS terrible case highlights that young people should be given as much protection as possible online, and need to know where to turn for help.

We met Facebook to ask them to sign up to the Child Exploitation and Online Protection Centre's 'report abuse' button, which helps young people if they think they face danger.

Hundreds of websites have already signed up and we hope Facebook agrees soon. But we know parents can also play a vital role in helping keep children safe on and off line which is why we recently launched the 'Click Clever, Click Safe' campaign to help them.

Unknown said...

I will tell you what I see in people like you, Bren, Ironside, the same as I see in Kate and Gerry McCann, people who could not care less about the innocence of children or their right to safety, they are only concerned about what adults want and how they can get away with it.
