Prosecution suspended pending questioning of friends/Rogatory letters

Correio de manha 30/1/08

Research: Request for interrogation has not exited from Lisbon Prosecutor empata PJ Darren Staples / Reuters After all, the questioning of friends of the couple have not yet left for Lisbon While senior officials of the Judiciary to the CM regretted the "silence" of the British authorities throughout the month, the services of British justice desfizeram yesterday the mystery: not received "any requests for cooperation to be made questioning the" friends of McCann. And missing contact the Attorney General's Office - which, after all, confirms the unthinkable for PJ. The letters did not follow it. At the beginning of the year had already assured the CM that the letters rogatory were finally in England. The document is of "particular importance" in the research because it contains dozens of questions for potential witnesses to the eight of the night of the crime - on May 3. The Judiciary took months in the preparation of letters. Opening the discussion of all the questions to the British authorities - even under a complex translation into English of some terms. And yet counted with a "support Eurojust in the preparation of letters," the CM confirmed the Portuguese representative in the body of the European Union for judicial cooperation. However, the Deputy Attorney General, Lopes da Mota, confirms that the support of Eurojust "already ended some time ago. And the sending of cards is made from "official communication between the PGR and the Home Office" - the services of British justice. One month after senior officials of the PJ contarem already with the transmission of requests for interrogation, via PGR, here is the response of the Home Office, yesterday afternoon, our newspaper: "It is not our policy comentarmos individual cases, but did not receive any request for cooperation [in Portugal] in the investigation the couple McCann. " Still hours before a high responsibility of PJ assurance that the CM was "impossible" - as much as letters rogatory had another destination, in England, not the Home Office. But by the evening dissipámos all doubts with a clarification of spring's official PGR: "The letters rogatory will be sent through the judicial cooperation of the Attorney General's Office, is finalising its submission." Continue in Lisbon and friends of the couples in question McCann. DETAILS ARRESTS PARADAS Apart from questioning the four friends of the couples McCann, now vacation with the couple in Praia da Luz, the Judiciary also asked in the letters rogatory that were seized personal items to the parents of Maddie - including the daily where Kate has described the behaviour their oldest daughter. PROSECUTION SUSPENDED Any indictment of the prosecutor Kate and Gerry McCann also is suspended in the offices of the PGR in Lisbon - only interrogations to friends of the couple can lead to PJ to a new battery of questions to the two suspects.

Morning Viv

Here's an article from the McCann Files...

Rogatory letters to be re-sent today

24 horas
(Translated from Portuguese)
The Public Prosecution Office is due today to send the rogatory letters containing the questions that are to be asked to the McCanns, to England

The Public Ministry is due today to send the final version of the rogatory letter that is destined to question the parents of Madeleine McCann and their friends again.

This will be the end of a 'soap opera' that began after a magistrate from the British Home Office unauthorized her colleague at Eurojust, the European entity which processes the interchange of judicial issues among the various countries. She demanded that the letter is sent through official channels - which means through the Portuguese Public Prosecutor's Office and the Ministry for Foreign Affairs.

José Lopes da Mota, the president of Eurojust, minimizes saying: "The letter was made with the collaboration of a representative from Eurojust. A magistrate from the Home Office decided that the legal procedures for the sending of the document had not been fulfilled and informed the colleague at Eurojust. After everything was duly analysed, we decided to request Portugal to make the letter again and to send it through official channels."

Pinto Monteiro, the Public Prosecutor, assumes he made a wrong option: "What happened with the rogatory letters is no secret. They were with Eurojust... Some obstacles were raised by the English magistrate. The letters ended up returning, and will now be sent through the international cooperation, which depends upon this Office. They will be sent today [yesterday] or tomorrow [today]."

Carlos Anjos, the president of ASFIC, the Criminal Investigation Officers' Union, was laconic: "At this moment, the ball is not in the PJ's court."

Hi Viv, over on the DE this afternoon, I got the feeling that RS is whistling in the dark for reassurance. The Hipster remarked recently that "it's quiet here, the tide must be turning", someone corrected "Nope the tide's just getting higher". There seems to be a sense that something inevitable is about to happen, and their scared!

Since the Home Office was emailed by at least one forum re the Rogatory Letters delay, and replied, and I believe, JS was asked about it on a news channel too, they must be aware of the deep public interest. Any Government would be commiting political suicide to cover up and delay justice in such a high prifile case. The unprecedented publicity stirred by Clarence et al has created a thirst for JUSTICE for MADDIE. I believe the justice train is leaving the station and will be unstoppable once past the first green light.

If Clara has set up some corrupt web to receive leaks of questions or evidence from the documents I feel sure they will be monitoring it closely too. Perhaps all the freedon they have been granted to play the press and instruct the Retardos has been allowed so wrongdoing can be monitored.
Best to you.

Hello everybody.

I have 2 things I would like to share.
One is that some time at the beginning of January there was a publication that stated, that there probably will not be any movements on the case for 3 months, because Brown needs to win elections and will not let questioning go ahead before that.
If some of his people involved in the case that could be true. We will see.

The other is an interesting quote from Times (some time ago), which says:

Could the McCanns still be fooling everyone?

If they were, it would be a truly extraordinary effort. “It is very difficult for two people to lie over a death, whether it was accidental or deliberate,” said Mike Berry, senior lecturer in forensic psychology at Manchester Metropolitan University. “I cannot see how they would be able to keep up a lie for so long under this media attention.”

My addition to it is - THAT IS WHY they employed spokesman. They were afraid to face people, were afraid of giving themselves away.

P.S. I think as well that interview of Riberio had a purpose.
I do not know the procedure of lifting an arguido status, but, if it possible, it might be a smart thing to do (take a weapon from McCanns hands).

Irina,
Excellent post and I agree that is why they appointed Clarrie as they wanted to use him not just for spin but to answer for them, then too they can say he misrepresented them if there is any repercussions on what has beeb said. I am worried now though that there may be a removal of their arguido status which seems to me a coincidence if it happens that our Government have proved difficult over the requestioning. I think it is odd that the Director of the Pj makes this statement at this time.
He would be very aware of the effect it would have. But suppose we must wait and see what happens.

Anonymous said...

Very good point Irina, however IMO Clarrie seems to do more harm than good, after all, the papers may be publishing all his spin, but few readers seem to fall for it.
He is so predictable nowadays that you can almost guess what he is going to say when he briefs the press( just add some pompous words for the full effect).
I loved the way he tried to confide the fact that British police officers believe that the McCanns are innocent.
Good psychological strategy, to put doubt in the mind of the many doubters (the cops say so, must be true then..) but then with his wages what else would he be saying!!!
If the McCanns are innocent of Maddie's disappearance they should stop all this and go back to Portugal with the other tapas and ANSWER ALL THE QUESTIONS!!
How can they complain that the PJ are not concentrating on finding Maddie when they are clearly stalling the investigation.
Good night everyone.

'Justice is silent,' as the Portuguese say. Anyone notice how very silent UK newspapers are at the moment regarding missing Maddie? How very silent certain forums are?
It took less than a week to silence the morons who are now reduced to posting recipies, can you believe it?!!! Missing Maddie, missing headlines, and some people find the time to post about recipes. Unbelievable.
Justice for Maddie, and every child, in due course. May it be so, in time.
You're winning the debate, my dears. Patience now. That's all we need...and more information in radical sites like this. Vox Populi. It's great to see in a cynical age.
Buenos noches. Ta Viv to you and yours. Have a great week. xo leigh

I hope you don't me saying this, but I've read some of your posts, and think you are absolutely right to say in your last post that that people should just answer EVERY question. Quite right.
Your other posts are v informative. Thank you from another newcomer to the new media of the world weird web.

Thank you Leigh,
The nonsense generated by the parents is unbelievable, due to a mixture of guilt and arrogance.
If it were my child I would be there answering to absolutely everything the PJ wanted to know, not plotting the next convenient press release.
Sadly all this media spin is now about the parents and not Madeleine.
We just have to wait and see, and hope for justice.
Good night.

Hello Lizzy, Leigh and Sickofconspiracies.

There is not enough information really, so there could be different reasons for current statements and delays.

One that PJ see that removal of arguido status will remove any obstacles for questioning. They only need to question friends, and then more likely McCanns will be invited to Portugal for something and charged there. Or, if they refuse to go, charged in UK.

Other reason, more intricate is that the agreement was made between Brown and Portuguese president that the procedures and the charge will be delayed till the elections (as Brown need support of not just and the most the public, but some lobby within). After that he will give McCanns and others on the plate to PJ to fry.

Of course there is another one, which is the fit of total stupidity, and in which I do not believe.

Anonymous said...

Night night Irina.
Again, very plausible points you make. It's best that people keep their eyes wide open in this case, don't you agree? No need to answer. I know you do :-)
Rest well, and thank you for the illuminating post. See you next time. xo

RE: Clarence.

Whatever the first intention of McCanns was it got out of hands.

Because most people who serve them do not know if they are guilty and act in believe that they are not - which makes them look stupid.

And because there are big money to be earned.
And because only certain type of people would agree to do that kind of job - unstoppable idiots (like Clarence or Metodo).

Hi Ana and all

I just read that Correio report the gist of which says that in future Mr Ribeiro should not comment at all to prevent his words from being misinterpreted as they were. That Kate and Gerry remain prime suspect but that it may have been better to keep them as witnesses because they may have co-operated far more in the investigation. Why should they re-evaluate their own procedures just because of the unprecedented nastiness in the media campaign to insist these two are innocent. Again, to me, it just shows what pleasant and reasonable people the Portuguese are! Likewise the newspapers reports simply state the facts - no matter how good or how bad - there is no pre-conceived agenda to pursue - it is making me feel like emigrating to Portugal - a far nicer place.

What I have seen in the UK both in the press and from Clarence Mitchell makes me ashamed to be British. Like we all have a really bad personality disorder. If you are being investigated for the death of your child - this is how you respond! NO WAY.

WE know for a fact that what we read in the Daily Express and the Daily Mail in particular (as well as even lower brands!) is just not capable of belief and omits relevant facts that would damage the pre-conceived view they want to portray. To get a decent newsreport we are forced to go abroad and translate as I am doing here - that is a terrible indictment on British Press.

IRINA

I thought that was a brilliant point explaining for us why the McCanns needed Clarence Mitchell. Because it is so hard to perpetually argue a lie! This will not stop us disliking Clarence but it certainly does aid our understanding of just WHY.

Hi Viv ,

here i am one more time ,I hope everything is ok with you .

Here is the translation of the article briefly:

Research: Suspected on spouses remains
Magistrate asks silence to the Director of the Judicial

Gerry and Kate continue to be the main suspects of the Judiciary.
While source close to the national director of the PJ says CM that when he spoke of "precipitation" was misinterpreted, the President of the Association of Magistrates of the MP responds: "I do not know if he is right or not, but this conduct to rule on cases Pending is extremely worrying. "

Anthony Cluny says that he don`t know the process, but what he is more concern is starting to see that the primary responsibility of the legal institutions do not keep in silence to comment on pending cases - which can lead precisely to misinterpretation. "and leaves implicit appeal to the Director of the PJ, "to not repeat this kind of situation: containment and reserves in the speech" from now on”

In any case, the CM found that the sum of PJ on the eventual death of their daughter by the couple McCann remains. And a source close to Alípio Ribeiro says that the words of the director will have been in the sense that if Kate and Gerry had been kept witnesses, as would dictate the new Criminal Procedure Code (CPP), "perhaps they had not go so fast to England , and would be more cooperative with the Justice. "

The day on which the PJ decided to tighten the siege McCann, searches, surveys and interviews of 11 hours at Kate, for example, "is no other option but left them constituted defendants" - were on September 7 and the new CPP came into force a week later. The current law requires that any "reasonable suspicion" to which someone is accused and, until September 15, "any suspicion that they were obliged to be."

The suspects have been benefited with the measure and "undermined the investigation." If the MP had expected one week by the new law, "it would be possible to keep them witnesses and would be more cooperative with the following steps."

Instead, we are seeing more than two months after an attempt to interrogation to friends of the couple, by rogatory letters that, as CM progressed in the last week, have not yet left the Attorney General's Office.

Viv , i hope this helps ,my English is weak.

Best regards

Ana ,from Oporto

Hi Ana

Thanks so much.

My assessment of senior Portuguese authorities like Mr Ribeiro is that they are intellectual, honest and non-confrontational.

So, with the benefit of hindsight and seeing the response from Team McCann he says maybe it would have been better not to have made them arguidos - we could still have investigated them, perhaps more efficiently, with more co-operation from them, because they are not having to behave defensively. It would have been a better means to an end. To prosecute them for what they did.

Non-confrontational approach also with the rogatory letters. Magistrates does not mean judge in the UK - so I am not sure who raised the issue in the UK the rogatory letters should not have come via Eurojust - probably a lawyer on behalf of the Home Office. Rather than insist the Eurojust route is adopted the Portuguese just go along with what is requested rather than engage in a contest about it. This demonstrates very pleasant people who like to conciliate rather than fight. They simply want to fairly bring the McCanns to justice with minimal unpleasantness - I really admire them for that.

Kindest Regards to you and your wonderful country with a much more pleasant and honest way of doing business!

Good morning,

Only the political pressure from the British have prented the PJ from arresting McCanns in september - nothing new after all

Another paper another article - Díário de Notícias de 04-02-2008

Diário de Notícias - 4/2/2008
link : http://dn.sapo.pt/2008/02/04/sociedade/ ... dicia.html

The statements of Alípio Ribeiro generate dissatisfaction in the Criminal Police

JOSÉ MANUEL OLIVEIRA

The inspectors are against the statements made by the national director

The discontent is installed amidst the inspectors of the Judicial Police (PJ) of Algarve. The problem were the statements made by the national director, Alípio Ribeiro, to the programme "Diga lá Excelência" of the RR and to the newspaper Público, in which he acknowledges there has been "some haste" to constitute arguidos Gerry and Kate McCann for the supposed death of their daughter Madeleine ,nine months ago, in Praia da Luz, near Lagos, where the family spent holidays and the child disappeared. The researchers continue to suspect of the involvement of the British couple in the concealment of the body of the girl on the night of May 3, 2007, although the results of the samples of blood and hair collected are not conclusive.

When the mother of Maddie was heard on 6 and 7 September,at the Department of Criminal Investigation (DIC) of Portimão of the PJ, several inspectors wanted to arrest her. However, the public prosecutor of Portimão, José Magalhães e Menezes, objected to. Even so, and already after Gerry and Kate have returned to the United Kingdom, some researchers involved in the process maintained the conviction that they have evidence that could lead to the preventive arrest of the couple. Only the political pressure from the British have prevented them from going further.

The DN found, that there are people in the PJ that understand that the new declarations of Alípio Ribeiro are nothing more than a situation of bluff, and were only meant to "test waters".

In the interpretation of some inspectors, when the national director of the Judicial Police talked about "precipitation" in the constitution of Madeleine's parents as defendants, that still remain subjected to Term of identity and residence in England, he did it to "see what were the reactions of the McCanns and also the Portuguese. "

Other researchers have confessed their "dissatisfaction" by the assertions of Alípio Ribeiro, saying "it's difficult to work in a country that most resembles a banana Republic. The more you do you can not make a difference" .

Astonished and speechless facing the interview of the national director of the PJ is the lawyer of the Portuguese-British Robert Murat, the first to be constituted defendant in Madeleine's case on May 14, 2007, on suspicion of kidnapping, and after his mother's house was passed through fine comb, about two hundred meters of the apartment of The Ocean Club, where the child disappeared, as well as the inspection to the family's car. "I find this all very strange",said yesterday to the DN Francisco Pagarete.

With a sad voice, the lawyer refused to make more comments. He did not mention if he is also considering requiring to the MP the withdrawal of the status of arguido of Robert Murat. "It is a situation that I have not yet looked at," noted the lawyer which, as the DN advanced at the time, bet in the closure of the case concerning his client from November 13, 2007, when seven months since he was accused were completed. "I do not intend to make any comment in relation to the statements.I will not react in any way," insisted the lawyer, not hiding his surprise by the considerations outlined by the maximum responsible of the PJ.

I HOPE THAT SOME DAY THIS SAGA ENDS AND THAT ALL RESPONSIBLE RESPOND IN JUSTICE TO ALL THE CRIMES THAT THEY HAVE DONE! WE WILL NOT STOP FIGHT AGAINST THE INJUSTICE!THE INJUSTICE WICH ALLOWS CRIMINALS TO MAKE MONEY , THE INJUSTICE WICH ALLOWS NEGLIGENT PARENTS TO SELL THE NAME AND THE STORY OF THEIR DAUGHTER, THE INJUSTICE WICH ALLOWS THOSE WHO HAVE NOTHING TO DO WITH THIS ISSUE,INNOCENT PEOPLE, APPEAR WITH THEIR FACES IN THE PAPERS ..... The McCanns would have been detained by PJ on 7 September but for unprecedented interference by the British Government.

The FSS information broadcast on BBC live that evening - on which they were questioned - is damning.

No Government minister involved himself in interview of main suspects in the cases of Sarah Payne and the Sohom schoolgirls.

Why oh why have they done so with the prime suspects in Madeleine's disappearance ?

A recent headline in our local evening paper was a father sentenced to 7 years imprisonment for shaking his child to death. No Government interference in this case !

As a newcomer from DE Forum, I spent time yesterday reading past articles and very interesting comments over past weeks.

I found out from this site that Rogatory letters were discussed as being despatched around 17 December. PJ's frustration with Government interference and delaying tactics is very understandable.

Sickofconspiracies.

Clarence seems to forget that Leicester Police released FSS information contained in Jane Hill's live BBC news report the day PJ named the McCanns arguidos.

Clarence also seems to ignore the fact that Leicester Police flew to Luz with cadavers on substantiated grounds. The forensics they recovered for analysis confirm there was no abduction. To the contrary, they show Madeleine died in her parents' apartment on or around 3 May.

Clarence ... you're on your own if you believe your clients are innocent !!

I am sure there is some protection in this case, could it be Freemasons / Kights Templar? Due to the one sided news the press are dishing out. Also the UK Goverment, several weeks ago asking for the PJ to go slowly on this case, until after the spring elections. When at the same time GB said ''the public need to be prepared ....'' I can't remember the rest.
Someone else was there on May 3rd (who fled quickly in a waiting private plane) who was High Profile in the Goverment, and this is being covered up.
Could this cause a huge scandal, could Mc's be getting all this protection and (unknown before in any case)involvement of PR, Press, Diplomats,Private Jets, audience with the Pope etc., etc., It is certainly bizarre the way they are protected.
I pray for PJ never to give up, for Justice for Madeleine

PS. Maybe I just have a big imagination...lol

Hiya

Apparently one of the first people rang after Maddie was reported missing was Alistair Campbell, former spin doctor to Tony Blair - the lies we were fed about invading Iraq! Campbell and the McCanns current spindoctor Clarence Mitchell have access to Whitehall Civil Servants and I think this explains the level of interference that has gone on in this case. Many believe it is the civil servants who actually wield the power in government and do all the manipulating and controlling - do you remember that programme Yes Minister - it was based on reality. Access was given to Gordon Brown himself and I think he got used and manipulated whilst still not actually Prime Minister -perhaps being persuaded stating as he did he would do everything he could to get Maddie back would be seen as a populist move - remember Gordon Brown was not perceived to have the charismatic personality of Tony Blair. He got ill used i my view and was unwise.

It is amusing really that Clarence Mitchell and the little drones on the DE give the impression the McCanns just cannot wait for the PJ to come back and do the interviews but in reality do everything to frustrate and stop this happening. With the rogatory letters - they may have caused delay but nothing will actually stop the process.

Clarence Mitchell's suggestion some police officer somewhere has told him this was rare stranger abduction is bizarre. Note he cleverly does not say Leicestershire Police or say when he was told this!! There has been a dedicated team of officers from Leics police working on this case from the very outset - remember the Ambassador notified government of his concerns the McCanns were involved right at the outset also. Remember also it was Leics police who brought the sniffer dogs over and our own forensic science service that provided the damning evidence against the McCanns. Does this really suggest the government itself are trying to stop the McCanns getting prosecuted - I really dont think so. I think it is more likely Clarence Mitchell is getting at some civil servants who are puttting a spoke in the wheel here and there - e.g. delay with the rogatory letters but nothing will stop the process in the end. Police officers will not be party to botching an investigation against a couple of child abusers/killers - they dislike them just as much as everyone else and wil be just as hungry to get these two as the PJs are.

At the end of the day Mitchell's shenanigans with Whitehall civil servants will be just as hopeless as his spin in the press. This couple will be brought to trial. Why on earth would Gordon Brown ruin his own political future for these two - he will not! There is a lot of right wing spin going on to suggest this to cause political damage to Gordon Brown - that is all it is!

There is evidence Gerry knew Murat from political rally etc in Leicester and why did he refuse to comment when asked by the reporter "and do you know Murat". That was a very comforting and reassuring post.I think GB after waiting 10 yrs to be PM is not going to let these 2 criminals spoil it for him now
This statement that CM(The Pink Panther) gave about the police saying it was a 'a rare stranger abduction) this was said to him before he went to PDL last year. And he is making it seem like it was last year.
I only wish the press would get some guts and expose him for what he is.
