In the toughest talk I have ever seen from the PJ and the Chief, no less, we are promised the investigation will bring results whoever they hurt. This obviously leaves the way open to others being prosecuted besides Kate and Gerry and is wonderful news!
I also post an article from The Lawyer where it is explained London law firm have launched libel action against 11 media outlets including the poor old DE again! It promises this will be the biggest we have ever seen, sounds like it too. Mr Murat is going to be a very rich man:-) Again, fantastic news, for fairness and for justice. The way that Robert and his girlfriend were castigated in the press and by the likes of Rosiepops and Christabel unedited on the comments forum (Now removed) calling him a paedophile and a pervert etc was an absolute disgrace)

Faro police chief Guilhermino Encarnacao, who is in charge of coordinating the investigation into the missing girl, has brushed off criticism of his force.

Madeleine McCann investigators have been locked in a war of words with the four-year-old's parents and their press spokesman Clarence Mitchell following the leaking of the couple's police statements.
Last week Mr Mitchell demanded an inquiry into how the McCanns' witness statements - given shortly after their daughter vanished - had been leaked and claimed it was another attempt to smear the couple.
In a rare public statement, the Policia Judiciaria (PJ) then criticised Mr Mitchell for his "baseless intervention".
Dr Encarnacao, speaking after a meeting between public prosecutors and police who travelled to Britain for fresh interviews with the McCanns' holiday friends, said: "Everything's going well.
"The inquiries carried out in the UK are progressing in the best way possible."
He said the police were not "vulnerable to pressure" from any party involved.
"The investigation will bring its results, whoever they hurt."
The pledge came as a clairvoyant claimed Madeleine McCann died in an accident.
Last week it emerged that Robert Murat, the British expatriate made a formal suspect over the disappearance of Madeleine, has begun one of the largest libel claims in the history of British media.
The 34-year-old, who lived close to the Portugal apartment where the missing girl was last seen, has launched libel proceedings against 11 newspapers and one television network.

Simons Muirhead & Burton is launching one of Britain's largest libel claims on behalf of Robert Murat, the man named by Portugese police as a formal suspect in the disappearance of Madeleine McCann.
The firm, in a statement, confirmed it was representing Murat in respect to libel actions against 11 newspapers and one television channel. The firm declined to comment any further.
Almost a year since Madeleine's disappearance in Praia Da Luz, Portugal, Murat is seeking formal public apologies and damages for his treatment in the British press.
One relative said the media's treatment of Murant resulted in "unfair stains on the name of a man against whom there is not a shred of evidence".
The news comes less than a month after media firm Carter-Ruck ensured Madeleine's parents received apologies from Express Newspapers for suggesting they were responsible for her death.
This included front page retractions in The Daily Express and Daily Star and the newspaper group has paid £550,000 to the Find Madeleine campaign.

(This article is presented as a personal viewpoint on the current furore surrounding the leaking of police statements to Telecinco)
'Why I believe the McCanns' team were behind the leaking of police statements'

When considering where the 'leak' to Spanish programme Telecinco came from we must first look at the advantages and disadvantages of such a leak to the McCanns.
Advantages
Opportunity to smear the PJ by blaming them for the leak – with the bonus that the PJ are unable and unwilling to respond,
Opportunity to make a statement direct to the PJ, about the events of May 3rd - through the media - which had been denied them when they were not called for interview,
Revenge for missed opportunity to milk such interviews for PR effect,
Opportunity to reaffirm their timeline for May 3rd,
Opportunity to reaffirm that Madeleine was still alive on the morning of May 3rd,
An opportunity to account for the cries of Madeleine that were heard by Mrs Pamela Fenn, as well as…
The chance to show that they reacted as responsible parents, when it was said that "Gerry and I spoke for a couple of minutes and agreed to keep a closer watch over the children."
The opportunity to distract and divert attention away from the ongoing interviews of the Tapas Group,
The chance to order an internal review of the PJ and contribute to further distractions and consuming of PJ time and resources,
Substance to any possible claim they would not get a fair trial due to the adverse publicity.
The chance to use the "smear" as a reason to refuse to return to Portugal to participate in a reconstruction.
Disadvantages
Adverse newspaper headlines and public opinion,
Distraction from the McCanns trip to Brussels to champion the Amber Alert System
As you see, the advantages of such a leak to the McCanns massively outweigh the two disadvantages, neither of which have any bearing on the actual case against the McCanns.
There is no doubt that during the early days of the investigation leaks found their way into the public domain from certain ‘sources’. This was stopped completely when Paulo Rebelo took charge of the investigation on 08 October 2007. Since then there have been no leaks.
So, the question must be asked, why, after 6 months of running a water tight ship, against waves of abuse and derision from the McCanns, their supporters and certain elements of the UK press, should the PJ see any possible advantage to leaking such information now? The answer is simple. None. The very idea is, to quote Clarence Mitchell, ludicrous.
The PJ have steadfastly gathered their case against the McCanns and the British government has aided the process, eventually, by agreeing to the rogatory letter and further interviewing of the Tapas Group and other witnesses. The process is continuing with the full blessing of all those who have access to whatever evidence is held and who know the case.
To believe that they would throw that all in the air for the sake of one days newspaper headlines is completely ridiculous. This is not a soap opera. This is the investigation into the disappearance and probable death of a 3-year old girl.
So, what advantage is there in getting the McCanns timeline into the public domain and before the PJ’s watching eyes?
Well, it has to be said, there was very little in this leak that wasn’t already in the public domain courtesy of David James Smith’s article in The Times of 17 December 2007. That article showed such fine detail that it could have only come from the McCanns themselves – in effect, leaking their own timeline.
Consider this section of the article:
Gerry paused over Madeleine, who – a typical doctor’s observation, this – was lying almost in “the recovery position” with Cuddle Cat, the toy her godfather, John Corner, had bought her, and her comfort blanket up near her head, and Gerry thought how gorgeous, how lovely-looking she was and how lucky he was. Putting the door back to five degrees, he went to the loo and left to return to the restaurant. That, of course, was the last time he would see his daughter.
This is a virtual word for word copy of what we are now told is Gerry’s original police statement.
So, if this is 'old news', what can we say is new in the leak to Telecinco?
Four things:
1) That Madeleine complained about being left to cry on the previous night and that she addressed this issue over breakfast with Kate and Gerry,
2) Gerry opened the shutters further and that this was easy to do (explaining the presence of any fingerprints that may have been found),
3) That work was done on the shutters in the main bedroom which were broken, and
4) That Jane Tanner believed the man she saw walking away from the McCanns' apartment was the child’s father
I believe that this 'revelation' about Madeleine crying has been very carefully considered. We know that Mrs Pamela Fenn has made a police statement saying that she heard crying from the apartment on a previous night and that this needs to be addressed and explained by the McCanns.
(Note: The common myth that Mrs Fenn subsequently retracted her statement and said she heard no crying is false. What she actually said was that she heard no crying on the night Madeleine was reported missing – she did not deny hearing crying previously).
So, it is clear, the McCanns need to let the PJ know their explanation for this reported crying. They can’t do it in a police interview because they haven’t been called. Their only option? A leak to the media.
Maybe this was one of the questions they were allegedly unable to answer previously and they have now, after nearly a year, remembered.
If the McCanns have felt the need to leak this information now, would this not also imply that this information is crucial to the investigation? Why do they feel compelled to provide cover for screaming on a previous night?
Madeleine, so far as we are led to believe by the McCanns, did not go missing on a previous night, so this would appear to be purely circumstantial evidence. Unless there is a motive for this information being provided.
Combined with details of the 'grown up' breakfast chat with Madeleine, could this be interpreted as an attempt by the McCanns to convince the PJ that Madeleine was still alive on the morning of May 3rd?
We also hear, in this leak, further information about the state of the bedroom window:
"When I went to see Maddie I realised that she was not there, I looked in all the apartment, I returned to the children's room and at that time I saw the curtains move leaving visible to me that the blind was opened up. I went to the window and opened the curtains to see if she had climbed out there but I did not see any trace of her. I do not know whether or not I closed the window at the time," says Maddie's mother. "In shock I ran to Tapas Bar and shouted to Gerry: 'Maddie is not here, someone has taken her'."
In that instant all started rushing to look for the little girl. "When Kate came running and said, 'Maddie is not here, somebody has taken her', I thought that it could not be. I rushed to the apartment by the same path as always. I looked everywhere, I went back to the kids' room and started to think what could have happened. To my surprise I realised that one could lift the blinds without effort and almost no noise. When I went in I saw that Maddie's bed was almost untouched. The corner of the sheets was a little turned [back], the pillow, the pink cuddly toy and the piece of her blanket were almost in the same place that I last saw it."
So, one can assume from this that the curtains were drawn when Kate entered the bedroom.
Are we to believe an abductor clambered out of the bedroom window with Madeleine in his arms and then leant back through the window to pull the curtains together?
Surely unbelievable but consistent with the McCanns original story that the abductor gained entry by forcing the shutters on the windows and left by the front door, which they originally reported to friends and relatives as being left open. The 'abductor' may well have closed the curtains behind him in that scenario to hide what he was doing.
However, this explanation is found wanting when considered with the lack of evidence of a break-in and Clarence Mitchell’s confirmation on RTE’S Prime Time that "There was no evidence of a break-in".
But what of Gerry’s statement that he "realised that one could lift the blinds without effort and almost no noise." Could this be another later 'add-on' after realising that the blinds/shutters are impossible to open from the outside and that there could be fingerprints on it?
Also Gerry mentions he rushed to the apartment by 'the same path as always'. Yet it has been previously stated that this was the first night they had left the patio doors unlocked. On previous nights it has been claimed they entered by the front door, but fearing that the sound of the key in the lock would wake the sleeping children they decided that night to enter through the patio doors.
But such fine detail and knowledge of the events will be lost on casual newspaper readers who may simply have no desire or time to read further into the case than the information presented before them. So the PR damage on such fine detail is nil.
And what of the statement attributed in this leak to Jane Tanner? Does this reveal that these are not actually the original statements but later enhanced versions?
The Sun reports, in its coverage of the leak, that Jane Tanner told Portuguese police in her original statement she thought a man she spotted carrying a child moments after Madeleine disappeared, was the youngster's father.
Yet, how can this be when the original description issued by the police, and reiterated by Gerry McCann in a press statement, over two weeks later, was that the man was "carrying a child or an object that could have been taken as a child". How could there be ambiguity when Tanner had, we are led to believe through this leak, not only identified the 'object' as a child but also the carrier as the childs father?
Indeed, Martin Brunt has reported that when Jane Tanner first spoke to police she said "I'm not sure if he was carrying anything." So, is this evidence that these 'original' leaked statements, which have conveniently just appeared, are not quite as original as they seem? And who would benefit most from this?
So, what can we say about the disadvantages of such a leak as this to the McCanns?
Well, very little actually. True, for one day, a few newspaper headlines will superficially look bad for the McCanns but Clarence Mitchell has already been hard at work dismissing the reports as a 'blatant smear" by the PJ. Tomorrow will be a different set of headlines and today's papers will be lining the beds of rabbits and hamsters tomorrow.
Did the headlines the Express Group ran over a sustained period affect people’s perceptions of the case? Personally, I doubt it. Because the very next day a contrary headline would be run and people are now so anaesthetised by 'shocking' newspaper headlines in this case that they are going to shrug them off as folly until a charge is made or the case is dropped. Headlines in papers simply reinforce already held beliefs or they wash off people's backs.
That the headlines took away attention from the McCanns championing of the Amber Alert System in Brussels was really neither here nor there. The cause may well be a noble one and if it recovers one child it will have been worth it. But for the McCanns it is an expendable side issue. Something that could be comfortably sacrificed for the opportunity to sacrifice the PJ in the media.
It is also interesting to note that beyond the 'paper selling' headlines, the UK press are still using the leak to belittle and undermine public perception of the work of the PJ. The PJ have worked diligently, conscientiously and patiently in the face of continued abuse.
Clarence Mitchell has grasped this opportunity to slam the PJ for leaking these statements. And a 'friend' has grasped the opportunity to brand anyone who dares to question the McCanns as 'vultures'.
And the PJ?
Alipio Ribeiro, when interviewed by El Pais in October 2007, said this about the continued criticism of the PJ through the McCanns spokespersons:
"Yes, but they talked with the family and the press, not with the police. And it must be understood that the British press also works in this way. They made unfair remarks but we cannot react to this on a daily basis and play ping pong, the PJ against the British press. We are not interested in this game: We have a different tradition to theirs, one of less communication and the judicial secrecy that restricts us."
To suggest that the PJ are behind this leak is an insult to all the hard work and diligence they have displayed over the long months of the inquiry.
Only one group of people benefits from this leak and its fallout: The McCanns. Albeit on a superficial and short term level.
Those of us passionately concerned about securing truth and justice for Madeleine - as opposed to those whose only concern appears to be clearing the McCanns of their arguido status - should actually be heartened by the events of yesterday and today.
For it shows that the McCanns and their team have only the battlegrounds of PR and spin on which to fight.
Justice for Madeleine will not be served by a newspaper headline or a man in a pink shirt.
It will be served in law.
And that process continues...

It was just on TV. The guy was arrested by GNR (our more rural police force) when he was visiting two inmates in Odemira prison, where Leonor is serving her sentence. He had anfetamines (enough for more than 40 individual portions) and ecstasy and he was, apparently, trying to smuggle it into the prison. That's what you can call helping your clients!!!

Is it possible the pj now have evidence that her death was on the night of the 2nd or the early hours of 3rd May and the McCanns need to keep reassuring people that she was alive on the 3rd to uphold their abduction theory? Could one of the T7 have spilled the beans? I am beginning to think this was the reason for the recent leak – desperate measures from desperate people.

The leak call it that, made the impact in the press a) Madeline crying. b) leaving her alone the next night again. c) the Brussels trip all highlighted the leak contents but the crux of the leak was such negative information reinforced the morning of the 3rd of May. If the latter part worked and was believed then the negative statements were worth it.
Apparently, it was the prison staff who called GNR to arrest João Grade, Leonor's lawyer. Prison security staff detected he had drugs on him and called GNR who then arrested him.

It is Kate herself who told the police what her daughter had said.
I doubt that a guilty mother would have dreamed of being so honest in her statement to the police.
The police leak may have been meant to damn the McCanns but Kate McCann’s admission was that of an innocent.

I told someone that I had heard that Madeleine had been crying the night before she was supposed to have been taken and the McCanns knew about it she said that could not be true as they would never have left her again.
At the time I said that as I was reading a lot of things I did not know for definete what was true or not true.
She called me this week while I was away to ask if I had heard that Madeleine had complained about being left to cry and how discusting it was that they went ahead and left her again and if they could do this maybe I was right to doubt them.
I guess it did them a lot of damage as the story of how well they slept and it was like being in your back garden was blown apart if you are to far away to hear a child cry it sudenly does not sound so good.

And we all know for months that the women didn't leave the table that night.
Like Isis said because of JT new (not new to us) statement CM and the MC's tried to influence public opinion putting emphasis on the fact that Madeleine was still alive on the morning of the 3th of may and when they put her to bed. When she was supposed to say that this was her best day of her life or smt like that.
Sadly the leak brought most people back to the 2nth of may.
Because a 3 years old isn't able to make such sentences.

Hope, it's exhausting. Since she became Gonçalo on Mondays, Wednesdays and Fridays and Felícia Cabrita on Tuesdays, Thursdays and Saturdays she decided to rest on Sundays and had to take a little time off from being Alsabella. Clarence is paid to represent the McCann's. However, because he knows the media business when he speaks it can come across as an 'official' type report sometimes. Now his comments rarely get tagged with 'McCann spokesperson' or indeed rarely get balanced alongside somebody who says 'hang on a minute, it may well be these two were invovled in their 3 yr olds disappearance and it is for a court to sort it out. As such we should consider ...'
In other words Clarence is talking on behalf of 2 people (who according to statistics alone are probably involved) and one side is getting heard whilst the counter is not.
However, in the last few months we have seen more and more reports that are hinting at possibilities that do not match Clarence's agenda. Two points to finish on
1) Jeffrey Archer was paid half a million in a court libel case. He was subsequently proved wrong and then he went ot jail !!
2) All people who make comments on such forums like this want is for the rights of Madeleine to be put first ie The parents to be put under the pressure of a courtroom appearance where no spokesperson can answer for them. In short, a situation where the soul of the parents will be exposed.
3)If in a courtroom their souls and persona's hold firm and true and appear sincere in the way they answer then so be it. But also if (without a spokesperson) they are exposed as was many of us believe they may well be then so be it too and a prison spell will follow. It is not being a vulture to think or talk that way if it is proved they were involved in a court of law that is the due course, and actually some may say the right course given a 3 yr old has vanished.
4) Rhys Jones' parents have not had to employ a 'media specialist' at any point to put across their feelings and deflect direct questions. Quite telling hey.

But I can understand that people get paranoid because of the cloning.

By the way the tree was planted last year and a few hopeful words were said as I chucked in the last few handfuls of soil with respect to a certain 3 yr old who was badly let down in this world by people who knew better.
I have tended and watered the plant and it is growing joyfully having survived the worst that winter can throw at it and hopefully it will continue to flourish this year and whilst I live at this address it will be a constant reminder of how we are always treading such a delicate path in our lives.
Sometimes nature puts us in our places doesn't it. Maybe if the McCann's went for a beautiful walk in the country their minds might be jolted and truly awakened.

Atardi not sure what you mean about the majority believing the story. I don't think the PJ would have bothered if the whole country thought there was an abducted it would have made them change their views on the case. They could have walked away from this long ago, but they haven't so I am presuming it is because they have evidence. If they haven't got the evidence I think the Portuguese people will question their reasons. Some have said the blame the McCanns to save the tourist trade but as they looked for Madeleine in the beginning (presuming abduction) they had already brought attention to its possibilty so I do not see the logic of that argument

Judge for yourself, but I found it appalling and strongly suspected that Claudia was cloned that day - so awful and unprovoked attacks were.
We should not fight with each other. That what McCanns want.
We all on the same side and differences could be resolved in respectful manner. 2345 is a wonderful contributor to cause of justice for Madeleine and it is a pity she was ostracized and banned instead of appreciated.

In fact, as Viv knows, I had been ignoring 2345's provocations for quite a while. Doc, although I don't have a legal background, i think it is entirely possible. CM accused the PJ, for the whole world to see, of something the PJ denies doing. Carlos Anjos is the Union guy and he knows his stuff. Don't think for one minute that he called CM a liar without knowing well what he was doing and without the support of people within the PJ. And they all have law degrees, of course. As for Leonor, I do not know if it is possible to sue because the case is going to trial. But I think leonor's sentence can be stretched if it is proven she lied, although I'm not sure about it. But maybe after the verdict, if Leonor loses (which I know will happen) PJ officers may open a civil case and ask for compensation.

That body language has been apparent for many months, almost all the way back to May. Interesting that NL should comment on it though. I'm sure it is very obvious to him too. IMO they have drifted too far apart. I would be very surprised if the marriage survives all the trauma.

Docmac, do you think that if they are guilty, that means they are some kind of psychopaths and in that case the normal criterion is not applicable to them. What I mean is that they might fight during trial if one would have any hope left or stick to each other for ever.
I do not think they would be out sooner then in 20 years, if there will be trial.

I think that is a right assessment of body language for the time of interview.
They should be so dependant on each other, to the brink of not trusting and hating each other in the time of stressful situation. But their strength so far was in their union. If and when the union will break we will see the best of Kate, I think.
Irina, I believe that if they go to trial there will be a major split between them. If what happened is in line with what I think they will have different charges to answer and may well have separate legal representation. It is then possible that one will become a state witness, or whatever the equivalent term is in Portugal, and sell the other down the river.

I have a zoo at home. There are a couple of bearded dragons. They are mating when the season is right. But if there are eggs, I have to take them out in order that the parents would not eat them. It is not common between the primates. That means that all child killing mast be explained by social, not physiological reasons.

As Claudia says you would not believe just how bad the emails are that I have receieved from 2345 where she is so abusive, convinced even when I gave her my telephone number to chat with me that I am not Viv! I continued to try to be pleasant and humour her in the face of some very abusive posts and telling me the police were watching me etc. Additionally she has also been very offensive to Claudia, again insisting she is a Clone. She has written absurd things on 3 A's that Clarence, the government have taken over this blog and we are all clones which some people actually believe and therefore damages this blog. I cannot have her on here when she behaves likes this and do think she must be quite unwell.
Finally I just wanted to say what an excellant observation and I absolutely agree:

Whoever actually did the deed I truly do not feel it would have happened if it were not for Gerry McCann. I do think he is a very wicked man and his personality is simply not normal.
