WHY PRISON FOR KAREN AND NOT KATE?

Hi All, I see we do have official news reports confirming Tanner and O'Brien were subjected to 10 hour grilling. Obviously not the usual case of the police simply getting their evidence, more a case of them being cross examined upon it.

Whilst I can understand the legal reasons why Karen has been promptly charged with her own child neglect and remanded in custody and Kate has not (because there is a lot more than that still being investigated) , it is clear from reading comments on the web, see the comments below the article also, and my own blog there is growing public resentment at the apparent disparity in treatment of these two women from very different social backgrounds.

There is no doubt Kate and Gerry McCann have had an awful of help in seeking to defend themselves, not available to Karen, but I would just say this, has this actually convinced the public they are innocent and perhaps, more importantly, has it convinced the Police of their innocence? Clearly not, their legal status as arguidos remain and reports emanating from Portugal clearly indicate the only way they will ever get rid of this status is after they have been tried in a court of law.

There is no doubt the McCanns will be charged and this case would not be brought if it was considered that it was likely the McCanns are going to secure an acquittal. Having said that, Portuguese and British authorities have clearly never been under any illusions as to just how much backing the McCanns have and how hard they intend to face the case against them. As Gerry himself said, "we will fight this every step of the way". That is what they are currently doing in Brussels, it is all part of his campaign.

Euro MPs would have to look at the McCanns proposals in an unbiased way, but he figures if they get approved, that will signify approval of him and Kate. Just like he figured extracting the libel settlement from the Daily Express would do. To quote him again, (he does make quite a few Freudian slips or arrogant clues) "we are conducting an aggressive and high risk strategy". It is a very high risk strategy to have taken money from the Daily Express because as he will well know, that is fraud, but he likes to play poker, the potential gains outweigh the risks.

Whether the Daily Express actually settled the claim because they could not prove the truth of their articles i.e. they killed Madeleine etc without access to the police evidence (which of course they could not have), or whether they did it in a contemptuous way, knowing the money they will eventually make, I am not certain. I certainly think the latter.

Maybe also another thing we have learned is the Daily Express also printed what appeared to be scurrilous accusations against Karen, when we did not know anything of the police case against her, but in fact they did turn out to be true.

I have been criticised (albeit by people who even criticise my parrot!) for refusing to suggest Karen was guilty based on these reports. I resent that criticism. It is not open to anyone in my view to simply accuse anyone of a serious criminal offence prior to any official details of them being either "prime police suspects" or having actually been charged.

I always suspected the McCanns but I never once wrote anything at all on the internet to that effect until October 2007 on the Daily Express, AFTER they were made police suspects and details of why, the forensic evidence, were made public.

That is a matter of behaving responsibly and lawfully and not libelling people, you simply cannot just go around pointing the finger at people when the police are not.

How many wicked people accused Mr and Mrs Cortez and were proved to be wrong? This is why I know I am right in saying, every time, until the POLICE let us know they did something, do not accuse people. It is wrong and it is unlawful.

Karen was entitled to the benefit of the doubt, before we knew, just the same as Kate and Gerry were. We may not like their campaign but they are in it to defend themselves. This blog will continue to oppose their campaign, flag up the insidious and disingenuous nature of it, and support justice for little Madeleine McCann. Once the McCanns are charged however, far greater restraint will have to be shown and it will be. I would ask for the same in Karen's case given she is charged and in custody and is entitled to a fair trial. She is already being punished, leave her alone and remember what she did, although extremely serious, pales into almost insignificance by comparison to what Kate and Gerry did who may well have motivated and inspired a family of clearly far lower intellect and means by their wicked behaviour.

Police continue to quiz McCann friends

Portuguese detectives are still attending police interviews with friends of Kate and Gerry McCann.
The so-called Tapas Seven are the group who ate with the McCanns on the night their four-year-old daughter Madeleine went missing.
Police said that witnesses and Portuguese detectives had arrived at Leicestershire Constabulary's force headquarters in Enderby to be re-interviewed about the dissaperience of Madeliene from an apartment in the Portuguese holiday resort of Praia da Luz on May 3 last year.
It is thought 34-year-old Fiona and 41-year-old David Payne from Leicester are the latest witnesses to be questioned.
The interviews are being conducted by British officers as a three-man team of Portuguese detectives, led by Paulo Rebelo, sit in.
On Tuesday, Jane Tanner, 37, and her partner, 36-year-old Russell O'Brien, were quizzed for about ten hours.
But sources said they were allowed a number of breaks and that the interviews had given them the chance to put their point of view across "strongly".
Meanwhile, Mr and Mrs McCann are preparing to travel to Brussels where they plan to lobby MEPs for the introduction of a child alert system that is used in the US in cases where children are victims of a suspected abduction.
The couple will give a presentation on the importance of greater co-ordination between European countries when a child is abducted.
Clarence Mitchell, the McCanns' spokesman, said: "For Kate and Gerry this is an important opportunity to ensure better co-ordination in Europe when a child goes missing to make sure that no other family goes through the anguish that they are continuing to endure."
The McCanns want to launch a dedicated information hotline that will be available across Europe for when police suspect a child has been taken.
Mrs McCann, 40, and 39-year-old Mr McCann, and their team, have already reserved the number - 116 000 - but it has yet to go live.

Were the parents of Maddie responsible enough to leave their children unattended ?I think so and I sincerely hope that Maddie is still alive and well but I personally condenm the parents who were inresponsable and totally disregard the children wellbeing and their safety .You are a good parent if you spend time with your children , why be a parent when you don't want to be one and be responsible for it ?Soon you are a parent you lose some things like , spending time with your friends dinner out ,disco or even bingo , you can't leave your children alone .I don't feel sympathy for them .

I'm a bit more confident now, but I'll tell you how it all came about. As a youngster I flew frequently and had no fears at all. Then at 16 I was on a plane (DC10) that lost an engine while gathering speed for takeoff from Nice to Johannesburg. At 20 I was on a 747 that burst tyres on landing at Reunion on the way to Mauritius. I wanted to swim the last couple of hundred miles! Lastly, I was on a Red Cross mercy flight in 1991 to fetch a premature newborn in distress about an hour out of Cape Town. There was no airfield available and we were to land in the veldt, aided by the headlights of police vehicles. These had lined up in the wrong spot and the pilot had to take evasive action to avoid hitting a small mountain dead ahead. The sound of the stall alarm still haunts me, as does the ashen look that the co-pilot had on his face. Bloody cops radioed to us that the N1 (main highway to Johannesburg) had been closed to allow us to land there, but the Red Cross was not covered by insurance to land on a public road. Halfway back to Cape Town we heard the baby had died.

I have flown on quite a few occasions since, both long and short haul, but always with a marked degree of trepidation.

Why is it some people do not understand the purpose of the reconstruction?

I even read Mandz state it would have to be performed by actors as it would be too traumatic for the "victims" and friends.

The McCanns are backed into a corner with this, as Claudia has explained. They have always said they want to co-operate but when invited to do so, they refuse.

It is not going to be some televised soap opera as Mandz seems to think. That is what Kate and Gerry would like it to be though, no doubt with their own tame television producers.

It is an investigative tool. All the main people are involved and they say exactly where they were along the timeline, where others were and what they were doing. It confronts them with their lies and flags up the clear indiscrepancies, of course they would feel very poorly at the thought of taking part. On the other hand if they were all innocent and telling the truth, they would have no problem at all, would they! After all, they all insist they want to find Madeleine..how can they do that if they refuse to co-operate with the police? Rely on Metodo 3 who claimed they would have her back for Christmas..

Viv, I was actually quite surprised to hear and read about this actor stuff. reconstructions here are done with the implicated people (be it arguidos or witnesses) and it serves the purpose to confront versions and discrepancies. And they are obviously not televised. A crime investigation isn't exactly a show. As CM would say, it's probably a cultural thing.

tee hee is a very childish English saying. I actually use it in a satirical way because it is so loved by Mum21 (who looks about 65), Rosie, Tinkerbelle, Jane Gin and Tonic, SassyP etc.

I have to confess it is not part of my normal language. As for 2345 I do think she gets a little carried away with what she reads on 3 As..and needs to calm down a bit and stick to the facts.

I finally understand why you didn't pursue a career as a test pilot.

Well, you have my complete admiration for even contemplating flying after that lot.

(I go to Nice quite a bit. Think I might drive in future).

I once - very reluctantly - flew to Florida on a DC10. As we were taxi-ing to take off, a 10-year old next to me said to his father "These are the ones that keep crashing, aren't they?".

On the return flight we made a very bumpy landing at Heathrow and came to an abrupt halt on the runway. Then we saw the fire engines surround us and there we stayed, us looking at them, them looking at us, without any information for half an hour. Finally, the Captain told us the hydraulic system had gone on landing, and we were eventually towed to the terminal to the theme from the Muppet Show emanating from the sound system. Everyone burst out laughing.

But I'm afraid I'm just plain cowardly. Very earthy in my astrological chart. That's my excuse.

However, I do worry when the cabin crew look terrified. (One of them once said to me on a flight back from Nice as it happens, that they thought the pilot had been a bit enthusiastic with the French brandy. Hmm.

Well, it's still statistically the safest form of travel...

Re: The Telegraph. They have received a salutary 'smack on the wrist' for that, and soon after ran the 'Madeleine' crying story online as their headline.

Publishing the weasly words of a stupid boy columnist who was in Brussels, and claims child neglect is a minor issue, undermines UK law, and custom. The Telegraph...or the Torygraph as it is called informally...had to be reminded of a few facts, not the fictional, sentimental nonsense spouted by a boy columnist.

They have just become very confused and are thinking of a programme on TV here, Crimewatch where they do use actors to reconstruct a crime to try and jog people's memories and actually FIND witnesses by that process who are given a police number to call (not the main suspects hotline number of course).

This does display their clear lack of intellect in not being able to understand the completely different investigative procedure that is being proposed where the police already have the suspects and witnesses but they do not believe them, or could it be they just do not want to understand, a little of both I suspect!

IMO, this is Clarence's attempt to distract attention from the fact that the McCanns lawyers are in some difficulty. Arguido status leaves no choice for the McCanns if the PJ request their return to Portugal, as you know.

McCanns do not want to be seen using their expensive lawyers to evade return to PJ or extradition proceedings/EAW if it comes to that.

Clarence needs to focus public opinion on the erroneous idea that a reconstruction in Portugal is invalid/out of date. Tripe!

I nearly didn't watch UK TV news tonight because I thought the sight of the McCann spam in Brussels would make me physically sick - and that's a first.

I was very interested to read about the conflict of legal advice that is happening with UK lawyers giving typical paranoid advice, blank it all and it will go away and the Portuguese lawyers giving more sensible advice..as arguidos you are compelled to co-operate and if you are seen to be refusing to do so, what signal does that send out to the rest of the world and indeed ultimately the court, that you are guilty. The Portuguese lawyer is of course correct. Since when did trying to bury your head in the sand (no sick pun intended) actually get you out of trouble. This is what the McCanns have been doing throughout and they could have been getting on with their prison sentence by now rather than prolonging the agony.

I was just reading on one of the other forums that perhaps this Madeline crying on the night before she disappeared is a ploy( spin in this case) to give credence to the belief that she was alive on the 2nd May? It is possible that she disappeared on or before the 3rd of May. Even if the story of the crying is true it could have been any night more than likely before the 2nd May 2007.

I expect that Shannon's mum when interviewed was actually pretty co-operative with the police when interviewed and admitted her behaviour. She is remanded in custody, any sentence she receives that time on remand will be deducted from it. So she is already facing what she did and starting to serve her sentence.

Who is the smart one here, her or Kate and Gerry McCann. I think Shannon's mum is she is facing the music and getting on with her punishment before she even gets sentenced, that way she puts it behind her far quicker. What kind of life is Kate actually enjoying by delaying the agony ?

I agree: the argument between the McCanns UK legal advice and their Portuguese lawyer is their problem.

Bottom line: the law is the law. No amount of UK spin and gerrymandering :-) alters the fact that the McCanns are arguidos, obliged to return to Portugal when requested, unless they want to reveal their true agenda: the reason why they pay extradition lawyers hired last year, and invoke the disdain of popular opinion which they have sought to win over ever since Maddie went 'missing' last May.

IMO: they're busted, and so are those who lied in support of them.

If you read all the accurate reports you will find it was not the night before she was crying it was two nights before. Additionally she was seen by nursery staff at 1.30 on 3 May but was not returned in the afternoon. Suggestions she died prior to this (1.30 on 3 May) are just not feasible.

I have to say thar Dr. Rogério Alves, their most proeminent Portuguese lawyer (not the one who was with K&G when they were considered arguidos) is a very intelligent and balanced man. Everytime we hear him talk on TV he is always very sensible, calm and balanced. And he knows perfectly well how people react when they see that the parents of a missing little girl don't want to cooperate with the authorities.

I did read somewhere on many of the forums that there is no reliable sightings of her on the 3rd and the creche attendance cannot be categorically verified so I think that its the 2/3 May is still open as to the disappearance, I of course could be wrong.

Damn, I forgot about the other news regarding Mr Paulo Pereira Cristóvão.
Apart from having sold the rights of his book "The star of Madeleine" to a Portuguese TV station which will produce a TV series, there is also a negotiation under way with a publisher for the book to be sold in the american market. But that is not all. The rights of his book have also been sold and an international co-production will result in a film.

But may I suggest that a post by lc002f5834 made on here at 14.52 today is worth a closer look.

The subject of that post - a Polish businessman who distributed leaflets defending Madeleine in Brussels before the McCanns staged appearance - was the trigger for the boy columnist's misguided waffle in The Telegraph online today, and what followed.

Personally, I hope people print off that post, and circulate it among anyone they know and their MPs, MEPs, newspapers etc., as a useful synopsis of what is wrong with this gerrymandering in the case of one 'missing' English girl.

Just a thought. 'The pen is mightier than the sword.'

Can anyone shed a little more light on this, is Kate now actually admitting she knew her children were crying when left alone, but went and done it again! I am sure that would be used against her!! Evidence someone tried to get in or evidence she leaves her kids alone to cry!

Just watched BBC 10 pm news re McCanns. Apparently Kate told the police about Madeleine's comment about her and her little brother's crying as evidence that someone had tried to get into the apartment the night before and that 'now this had been turned against them'.

Personally, I think it's not his call, and he knows it. The McCanns will appear in a libel court, imo.

It's only a matter of time. Libel court is a nasty place for nasty people, but it is useful in unmasking manipulators. A rough old game. A game the McCanns chose to play. As Gerry said: they are pursuing an 'aggressive, high risk strategy'.

It's been a while now since one of the british papers has published an article critising the McCanns. Do you think that at last, following the latest interviews, the wheels are finally turning? Most papers are now covering the story of the crying Madeleine the night before she disappeared. Unbelievable that it has taken so long for them to report what most of is alreay knew. Poor little girl :(

Everybody, the Mccann adorers on the House of Filth are climbing walls, as pissed off as it gets. That has to be a good sign. You always know things are going well when that happens. It's better if they read about the other news regarding Mr Paulo Pereira Cristóvão another day. :-)

Considering the way they have undermined an investigation,they have a blatent cheek !!

Well, the House of Filth is saying that now PJ have to pay for the leak, I don’t believe that the leak was provide by Pj but if that is the case , then they should be happy , they always said they wanted to see the files open for all to see.
Now they don’t like it ?

If the McCanns are going to go around painting themselves as saints then it was only a matter of time as to when some of the case file would be leaked. What do they expect if the leak is true a clap on the back? Only weeks ago they were demanding that the file be made public. Are they really prepared for that? Do not throw stones in a glasshouse.

Yes Claudia, but I am not sure the significance of the leak if its true or whether its just to distract. I do not think the PJ would do it, to serve what purpose but give the Mccann team more reason to say the PJ have no integrity?

The tabloids are getting their revenge. The Brussels trip was a bridge too far. Obviously something has happened that teh papers feel ready to let loose on the McCanns

viv you and Claudia have been my heroes for some time, I am bouyed by your words and feel sure you are right. Perhaps now we can all speak more freely about what we think. What is the probability of two really bad events by different perpetrators taking place in the life of little Madeleine on the nights of 2nd and 3rd May last year?

1. Her parents left her alone on numerous occasions while seeking 'into each other pleasure' with their tapas friends and at the same time saddling her with the responsibility of her twin siblings. They must all have, unless drugged, cried themselves to sleep waiting for their neglectful parents to return. Indeed, according to K&G they didn't return in time on the 3rd May!

2. An abductor managed to get into the apartment between allegedly regular checks, enabling him or her to take Madeleine away from her family into an unknown hell without leaving any trace of his or her DNA, or an untidy bed.

This poor mite must have thought the whole world had deserted her and it was probably all her fault, which is something that children who are neglected often think.

I think the probability that more than one party was involved is nil personally.

Just heard on Sky News that Gerry and Kate are adamant that the leak has led to a smear campaign against them. I think it's a bit late for that - there's been one since they high tailed it back to the UK in my opinion!

The parents are demanding a full investigation into the leaks aimed at discrediting them. They are fighting back hard. They are incensed apparently!

This trio and their pals are a disgrace to Britain and their profession.

The McCanns are coming up smelling of roses again according to Sky News - talk about bias!! Unbelievable! Why don't Sky News ask questions like why dont the McCanns just answer the 40 questions outstanding before going on about the PJ's?

Methinks that Rosiepops and her followers will be delighted by this reaction to the Madeleine 'crying all night' story!
